This is to inform you that the terms and conditions of_ the
rezoning have been met.
I am rather vague as to when the building was removed, but
the map enclosed is dated January 29, 1976. This indicates
that the building was sold and the old house was torn down.
This project was approved by Mr. Bill Fergen of the Spokane
County Building Codes office. In fact, I believe that I had
coffee with both Mr. Fergen and Mr. Charles Huggins of the
County Planning office at the time of completion.
Your assistance in this matter would be greatly appreciated.

AGRICULTURAL TO COMMERCIAL: ) AND
APPLICANT - JOE STALEY, ) CONDITIONS
THIS MATTER, being the consideration by the Board of Commissioners of
Spokane County, hereinafter referred to as the "Boar~d," at therequest of the Spokane County
Pluining Department and aflter consultation with the applicant, of the S kane County Plannin
Cominission's recommendation to a previous Board of County Comaussioners on ~
November 14,1975 to approve zone reclass'if'ication ZE-56-75 AGRICULT'URAL to
COMMERCIAL for the purpose of developing a gmcery st,ore and general builchng supply
store, hereinafter referred to as the "Proposal"; and the previous policy of the Board of County
Commissioners of not finalizing an approved rezone roclassificanon undl all condidons have
been met; and the curr+ent Board of County Commissioners, being desirous of fomially
recognizing the previous Planning Commission's recommendation as approved by the previous
Board of Counry Commissioners so that the rezone can be finalized; and accordingl , it is
necessary to convert the previous approval subJect to condidons belng met prlor to,nalization
to approval subject to condltions being met, dces hereby make the following:
FINDINGS OF FACT
1. The proposal is generally located north of and adjacent to Appleway, approximately
600 feet west of 1Vhchigan Road and 850 feet east of Barker Road in Section 17-25-45.
Tax parcel number: 17553-0615 and portion of 17553-0611. Legal descnption: The east 144
feet of Lot 9, Block 5, Corbin Addidon to Greenacres, except the north 150 feet thereof.
Also all of Lot 15, Block 5, Corbin Addition to Greenacres, except county road nght-of-way.
2. The proposal consisted of a zone reclassification to Commercial for the purpose of
developing a grocery store and general building supply store.
3. The previous Spokane County Comprehensive Plan Map, which was in effect u1
1975, indicated the area as suitable for residential uses with a commercial area appropnace near
Barker Road and Appleway.
4. The provisions of RCW Chapter 43.21C (State Environmental Policy Act) were
comphed with by the Spokane County Planning Commission in their review and findings of
November 14, 1975.
5. The Spokane County Planning Commission held a public hearing on
November 14,1975 concening the proposal, subsequent to which, by recommendation dated
November 14,1975, they recommended that the Boanl of County Commissioners approve the
proposal, subject to specifc condidons of approval.
b. One of the Planning Commission's condidons (No. 2) stated:
"Prior to resolurion by the Board of county Commissioners, the
unauthorized storage building encroaclung into the Agncultural zoned
portion of the ownersbip shall be either removed from the preauses or
relocatal to a Comtnercial zoned pordon of the ownGrship."
The above condition was in reference to a building on the applicant's ownesship. However,
the, 1,320-square-foot building was not located on the descnbed rezone site. Because of this
condidon, the resoludon adopting the rezrone was never forwarded ta the Board of County
Commissioners for the,ir final acdon.
7. The applicant indicated by letter of July 14,1988 that the building was removed;
prabably before January 29,1976. A site inspecction and research has revealed that, in fact, the
building no longer adsts on the property.
8. Since the building in quesdon has been removed and therefore the condidon satisfied,
the current Board of Counry Commissioners is in a posidon to finahze the rezone subject to
specific condidans of approval.

9. The Board of County commissioners notes that the Planiung Comnaission made the
following findings in their November 14,1975 recommendation:
"a. The request is an expansion of the established commercial
development to the wesL In 1974, the Commission approved a
similar expansion proposal for the Staley operation and imposed
similar conditions.
"b. The site is situated on Appleway, a major arterial. The site is
effeciively separated from neighboring residential properdes to the
south by the Milwaukee Roads tracks. A 150' strip has been retmed
along Main Avenue for a buffer between the commercial uses
established on Appleway and the established residential neighborhood
north of Main Avenue.
"c. The site is situated within an urbanizing area. The zone change
proposed would not have any greater effect upon the topography,
geology, biological and botanical charactenstics, atmosphe~nc and
aquadc condidons, and other natural develop:nent than siaailar uses
established along Appleway. The Commission, therefore, concludes
that aQ environmental unpact statement is not roquired for the project."
10. The Board notes that all condidons of approval recommended by the Planning
Commission must be met at the time a building permit or use is requested for the site
11. Inasmuch as the action of the Boanl of County Commissioners herein is an
adminisuative acdon, no foimal legal advertising was required; however, the apphcant was
advised of the acaon.
From the foregoing findings, a review of File No. ZE•56-75, and a review of the
Planmng Comnaission's recommendation dated November 14,19759 the Board hereby, in
APPROVING the rezone, dces attach the following conditions as reflected in the Planning
Commission's recominendadon:
CONDITIONS
1. Access pernnts for the subject property shall be obtained from the Spokane County
Engineer's office prior to release of building permits.
NOrI'E: In conjunction with such access permits, the Spokane County Engineer's
offce may reqwre physical delineation of the acvess points.
2. Insmlladon of fire hydrants in acxordance with the requirements of the Spokane
Valley Fire Mushal.
4. A six (6)-foot slatted cyclone fence or other fence acceptable to the Director of
Planning shall be constructed along the north boundary of the Commercial zoned
parcel within sixty (60) days of issuance of any building pennit foar the advertised
parcel. Failm to construct such fenve within the dme period specified shall be
considered grounds for suspension or revocadon of any such building permit.
5. All storage areas within the ownership shall comply with Secdon 4.10.110 of the
' Spokane County Zoning Clydimce within sixtY (60) dsYs of occupancy of the new
adchnon.

Planning C ommi s sion Recommendation: ADprove to Commercial Zone, subi ect
to the followinct conditions: (Vote was unanimous.)
A. COIVDITIONS:
1. Access permits for the subject property shall be obtained from the Spokane
County Enqineer's office prlor to release of building permits.
NOTE: In conjunction wlth such access permits, the Spokane County
Engineer's office may require physical delineation of the access
points.
¢ 2~. Prior to re solution by the Board of County Commis sioners, the unauthorizeu
storage building encroachinq into the Agricultural zoned portion of the
ownership shall bQ ei#her removed from the premi ses or relocated to a
Commercial zoned portion of the ownership.
3. Installation of fire hydrants in accordance with the requirements of the
Spokane Valley Fire Marshall.
4. A six (6) foot slatted cyclonQ fence or other fence acceptable to tho
Director of Planning shall be constructed alonq the north boundary of
the Commercial zoned parcel withfn sixty (60) days of issuance of any
building permit for the advertised parcel. Failure to construct such
fence within the time period specified shall be considered grounds for
suspension or revocation of any such butldEng permit.
5. All storage area svvithin the ownership shall comply with Section 4.10 .110
of the Spokane County Zoning Ordinance within 60 days of occupancy of
the now addition.
B. REASONS INCLUDING ENVIROTVMENTAL ASSESS11riENT:
1. The roquest is an expansion of the establish3d commercial development
to the west. In 1974, the Commission apprc)ved a similar expansion
proposal for the Staley operation and imposc d similar conditions.

2. Tho site is sifiuated on Appleway, a maior arterial. The sfte is effect!vely
separated from neighboring residential properties to the south by the
Milwaukoe Roads tracks. A 150' strip has been retai.ned along Main Avenuc
for a buffer between the commercial uses established on AppZeway and the
established residential neighborhood north of 1lliain Avenue.
3. The site is situated wfthin an urbani2ing area. The zone chanqe proposd
would not have any greater effect upon the topoqraphy, geology, bioloqical
and botanical characteristics, atmospheric and aquatic conditions, and
other natural development than sfmilar uses established along Appleway.
The Commission, therefore, concludes that an environmental fmpact
statement is not rEquired for the proj ect.
