A concept of 'proportionate geometry' was employed in estab-

system dimensions of 15' ; 20" and 30" square are propoRional

FINDINGS AND 4RDER REGARDING ZONING MAP PROPOSAL, ZE-43-75 -
RESIDENTIAL OFFICE TO COMMERCIAL: BELKNAP AND MacNEILL
WHEREAS, The Spokane County Planning Commission did, after public
hearfng on August 8, 1975, forward to the Board of County Commissioners a
recommendation that the Zoning Map not be changed from the existing Residential
Office classification to the Commercial classification on property described as
follows•
The W 1/2 of Tract 144 of Opportunity, except the North 461 feet,
except the East 125 feet, and except the R.R. R/W, Section 17,
Township 25 N., Range 44, E.W.M., Spokane County, Washington.
and,
WHEREAS, The applicants before the Planning Commission, Drs. Belknap
and MacNeill represented by F. V. Seipp, did by letter dated August 13, 1975,
request a hearing before the Board of County Commissioners to present evidence
and testimony in favor of their applicakion, and
V%THEREAS, The Board of County Commissfoners did hold a public hearing
on September 15, 1975, to consider the recommendations of the Planning Commis- ,
sion and testfmony and evidence of the applicant and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of County
Commissioners of Spokane County havfng fully considered the testimony given,
the records and minutes of the Planning Commfssion and all other evidence
presented and having personally acquainted themselves with the site and vicinity
in question, does hereby find:
1) That the site in question consists of 27,992 square feet situated
on the northea s t corner of Sprague Avenue and Farr Road.
2) That the applicant proposed to construct a franchise restaurant,
including the serving of alcoholic beverages, on the site.
3) That the approval will conform to sfmilar zoning actions along
Sprague Avenue.
4) That dppropriate provisions have been made to assure compatibility
of the project with ad joining properties through the approval of a
specific development p1an.
5) That the site is situated within an urbanizing area. The zone
change would not have any greater effect upon the topography,
geology, biologfcal and botanical characteristics, atmospheric
, and aquatic conditions and other natural development than similar
uses established along Sprague Avenue.

6) That the proposal is compatible with adjofning land uses,
transportation and utility services.
NOW, THEREFORE, The Board of County Commissfoners of Spokane
County does hereby conclude that the above-described findings are sufficient and
controlling; and that an environmental impact statement is not required for the
described pro]ect, and does, therefore, order that an appropriate resolution to
change the Zoning Map from the Residential Office classification to the Commercfal
classffication be prepared incorporating the following conditions:
1) Improvement to Spokane County standards of Farr Road. Such
improvements shall include curb, sidewalk, drainage control,
and paving to exis tfng oil.
2) Approval of access permits by the Spokane County Engineer's
Office prior to release of buflding permits.
3) The advertised property shall be developed in substantfal
conformance wf th the "approved" development plan; i. e., a
sfngle story building oriented toward the southwest corner of the
property with parking to the north and eas t of the building.
Note: A variance may be requfred to allow the buflding to be
placed within 15 feet of Farr Road.
4) Approval of a specific landscape plan for the project by the Director of Planning. Such plan shall indicate the type of ground
cover contemplated, the species, variety, and distribution of
plantings as well as an automatic sprinkler system.
The areas to be landscaped shall include that portion of the right
of way along Sprague Avenue between the parkfng lot and the side-
walk (encroachment permit required), the setback areas and
adjoining rights of way (encroachment permit required) between the
building and the sfdewalks along Sprague Avenue and Farr Road,
and a 4' wfde landscape strfp extendfng north along Farr Road.
The Director of Planning may requfre a bond or other suitable
assurance for installatfon of landscaping.
5) A 6' high ornamental masonry wall conforming to the masonry surface
of the principal building shall be installed alonq the north side of
the access easement to the north of the ownership. Such wall shall
be constructed and placed in a manner whfch will nat disturb the
established trees and bushes along the north boundary of the access
strip. An opening shall also be provfded along the north wall to
afford access to the rear of the residential lot to the north of the
easement road.

6) The delineated driveways and parking lok shall be maintained in
hard surface paving. The final design, location, and arrangement
of parking stalls and driveways shall be in accordance with
standard traffic engineering practices.
7) Approval of a signing and lighting plan for the property by the
Dfrector of Plannfng. Such plan shall utflize low fntensfty lighting
whfch will not produce glare on ad joining roadways and residential
properties. A free-standing advertising sign not exceedfng 84
square feet in area or 25 feet fn height will be allowed.
8) Approval of sewage disposal facilities by the Spokane County
Health District.

sible. Our property is direetly north of the proposed
restaurant. Since we have a permanent ingress and egress
in the driveway adjoining our properties, we must be

ZE-43-75 - RESIDENTIAL OFFICE TO COMMERCIAL: BELKNAP & MACNEILL
Planning Commission Recommendation: Deny
A. BACKGROUND:
In 1962, the Planning Commission conducted a zoning study of the frontage
properties along the north side of Sprague Avenue between Farr and Balfour
Roads. After reviewinq extensfve testimony from residents in the area, the
Commission recommended Residentlal Office Zoning for the Sprague Avenue
frontage properties within the study area "because of the (character of the )
established residential neighborhood immediately north of Sprague Avenue."
The Commission also noted that the Comprehensive Plan for the north side
of Sprague Avenue between Farr and Balfour Roads proposed "high density
restdential development for the entire section. "
S ince 1969, there have been three notable deviattons to the plan.
1. A commercial-offtce center between Herald and Felts.(The proposal
Incorporated an innovative design approach which would reduce the
impact of the project on adjoininq residential and apartment pmperties.)
2. A furniture store on the northeast corner of Sprague and Farr. (The
proposal featured a low traffic generating facility with a quality
extertor whtch would be compatlble with adi oining residential uses.)
3. A sporttng gdods store on an interior parcel between Farr and Sunder-
land. The facility fronted exclusively on Sprague Avenue and main-
tained an extensive buffer between the building and the residential -
areas to the north. Because all of the activity was confined to
Sprague Avenue (parkfng, loading) the residential properties to the
north were not exposed to Lncreased traffic or notse.
Although different design constderations were cited in each case,
the Commission attempted to make each reclassification compatible
with. the particular neighborhood development to the north.
B. REASONS: _
1. The Planntng Commission reaffirmed the integrity of the 1969 Zoning
Study, whfch advocated the Residential Office Zone, which provides
the most appropriate buffer between Sprague Avenue and the residential
properties to the north.
