WHEREAS, The Spokane County Plannfng Commission did, after public
hearing on july 11, 1975, forward to the Board of County Commissioners a
recommendation that the Zoning Map not be changed from the existing Local
Business classificatfon to the Commercfal classification on property described as
follows :
Lots 6, 7, 14, and 15 of Evans Addition, together with that portion of
Rfverside Avenue lying between safd lots in Section 15, Township 25 N. ,
Range 44, E.W.M., Spokane County, Washington.
and,
WHEREAS, The applicant before the Planning Cornmission, Charles Wick,
Opportunity Enterprises, Inc., dfd subsequently request a hearing before the Board
of County Commissioners to present evidence and testimony in favor of the9x
application, and
WHEREAS, The Board of County Cominissioners did ho2d a public hearing
on August 28, 1975, to consider the recommen+dations of the Planning Commfssion
and testimony and evfdence of the applicant and other interested partfes, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of
County Commissioners of Spokane County having fuliy considered the tesEimony
given, the records and ininutes of the Planning Commission and all other evidence
presented and having personally acquainted themselves with the site and vfcinity
in question, does hereby find:
1) That the site consists of a 69,000 sq. ft, parcel situated on the
north side of Sprague Avenue, approximately 400 feet west of
McDonald Road.
2) That the applicant proposed to convert a former Iodge buflding into
a restaurant and cocktail lounge.
3) That adjoining land uses include offices to the east and west, an
apartment house to the northwest, a carpenter shop to the north-
east, and commercial properties including a small trailer court to
the south.
4) That the proposed use, namely, a restaurant and cocktail. Iounge,
is not out of character with the business uses establYShed along
Sprague Avenue.

5) That the Comprehensive Plan indicates that the north side of
SpFague Avenue extending approximately 1/2 mile east of Pines

Road is appropriate for business and commercial uses.
6) That mftigating measures can be incorporated into the zoninq action
to assure the compatibility of the project with residential properties
to the north. Such measures would include screeninq, dust control
of the parking lot, proper liqhting and the retentfon of the Local
Business Zone within the northerly portion of the property.
7) That the site is wfthin an urbanizfng area and that the utilizatfon of
the building and adjoining parking areas is similar to the previous
u s e of the property.
NOW, THEREFORE, The Board of County Commissioners of Spokane County
does hereby conclude that the above-described findings are sufffcient and controlling,
and that an environmental impact statement is not requfred for the described project,
and does, therefore, order that an appropriate resolution to change the Zoning Map
as follows:

of Riverside Avenue lying between said lots, except the North
164.81 feet thereof in Section 1 S, Township 25 N., Range 44,
E.W.M., Spokane County, Washington.

A. REASONS:
A motion to deny the zone change request fatled for lack of a second. The
member making the motion noted that properties to the east and west were
currently zoned Local Business and a Commerclal change would encourage
strip commercial development. The member explained that the applicant
had the alternative of applying for an expansion of non-conforming use
permit through the Zoning Adjustor for the lounge facility.
A subsequent motion to approve the proj =;3ct in accordance with the Staff

convert the former Elks Lodg~ building ilito a restaurant with cocktail facilitfes.
Because of concerns about the utilization of tho rear portion of the property,
the Staff recommends that only the southerly portion (lying south of the nort

to lighting and signing restrictions. In addition, the Staff recommends that
a specific parking and landscape plan be submitted to the Dfrector of Planning
for the rear portion of the facility to reduce the impact of the operation on
adjoining residentfal proporties to thc north.
The Staff is of the opinion that tha recommended property is appropriatc
for Commercial Zoning because:
1. The Comprehensive Plan indicates that the north side of Sprague Avenuc
extand.i.ng'approximately 1/2 mile east of Pfnes Road is appropriate for
business and commercial uses.
2. The Staff notes that adjolning bus iness uses are predominately local
business in nature. Adjolning land uses include offices to the east
and west, an apartment house to the northwest, a carpenter shop to
the northeast, and commercial properties including a small trailer court
to the south. The Staff is of the opinton that the contemplated restau-
rant iounge opcration on the sfte is an extension of the previous use on
the premises.
3. The Sfiaff is of the opinion that appror.i-iat,~ mitigating mc3sures have
been incorporatod into the conditions to assure compatfbility csf the
proj ect with residential properties to thc north. In particular, screcning,
dust control, and proper lighting of thc roar parking area will reduce
the impact of thc: facility on aojoining residential properties.
4. The site is within an urbanizing area. The proposal utilizes an exlsting
bullding and the proposed use is simf.lar to the previous use of the
property. Conditions of approval wi' 1-ictually enhance the compatibility
of the facility with surrounding uscs. The Staff, therefore, conclude~
that an environmental impact stat-amunt is not requtred for the project. o

Wick seeking Commaccial zoning foc the property on 3prague Avenue formerly
occupied by the Elks Lodqe, is no lonqer being pursued by the applicant.
Mr. Wick applied for a Special Permit from the Zoning Adiustor to
expand the non-conforminq Elks Lodqe facility to a commercial restaursnt and
cocktail lounqe. That hearlnq was held today, and the application was approved
by the Zoning AdiuBtor.
