FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PkOPOSAL AND ZONE RECLASSIFICATION
PE-1171-78 CHESTER FIELD ADDITION ZE-16-78 AGRICULTURAL TO SINGLE FAMILY RESIDEN-
TIAL AND/OR TWO FAMILY RESIDENTIAL.
WHEREAS, the Spokane County Planning Commlssion did, after public hearing
on February 24, 197$ forward a reconbnendation to the Qoard of County Commissioners
that the preliminary plat to be known as Chester Field Addition (File #PE-1171-78)
and zone reclassification to both the Single Family Residential and Two Family
Residential zone classification (File #ZE-16-78) be approved, and
WHEREAS, Robert Qonuccelli did request a special hearinq before the Qoard
of County ComiTiissioners to present evidence and testimony concerning the recommen-
dati on of the Planni ng Cornmi ss i on approvi,i)g the above descri bed prel imi nary pl at
and zone reclassification, and
WHEREAS, the Board of County Commissioners did hold a public hearing on
March 23, 1978 to consider the action of the Planning Commission and the testimony
and requests of the applicant, objectors, and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of k"ounty Commissioners of Spokane County having fully considerEd the
testimony given, the records and minutes of the Planning Commission, the environ-
mental assessiflent, and all othEr evidence presentecf, and having personally acquain-
ted themselves with the site atid vicinity in question does hereby find that duplexes
~ would be appropriate fo►- that area lying approximately 250 feet north of the proposed
40th Avenue in that that area would provide an-appropriate buffer from the future
C0111111eY'Cldl uses proposed to be located to the south of the site; that the plat should
be redesigned so as to provide for adequate circulation in the area and should include
a stub road connection to both Pierce and Skipworth roads; that a connection to the
Dishman-Mica highvray should be r-equired, and that improvements to that connection
should be limited to the property under control by the plat sponsor at this time
if a satisfactory arrangement cannot be worked out between the County Engineer and
the adjacent property owners. Now, therefore, the Qoard of County Commissioners does
conclude that the preliiTiinary plat to be known as Chester Field Addition(File #PE-1171-78`
and zone reclassification (File RE -16-78) should be, and hereby is, approved subject
to the conditions as contained in the P1anning Corrnnission minutes dated February 24,
1978, except that the following conditions shall also be irTiposed:
' That duplexes be restricted to the southerly 250 feet of the proposed pre-
liminary plat.

FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION

TIAL AND/OR TWO FAMILY RESIDENTIAL.
WHEREAS, the Spokane County Plarining Commission did, after public hearing
on February 24, 1978 forward a recorrmendation to the Board of County Com,nissioners
that the prelirninary plat to be known as Chester Field Addition (File #PE-1171-78)
and zone reclassification to both the Single Family Residential and Two Family
Residential zone classification (File #ZE-16-7$) be approved, and
WHEREAS, Robert Bonuccelli did request a special hearing before the Board
of County Commissioners to present evidence and testimony concerning the recommen-
dation of the Planning Commission approving the above described preliminary plat
and zone reclassification, and
WHEREAS, the Board of County Commissioners did hold a public hearing on
March 23, 1978 to consider the action of the Planning Commission and the testimony
and requests of the applicant, objectors, and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County having fully considered the
testimony given, the records and minutes of the Planning Commission, the environ-
+nental assessrnent, and all other evidence presented, and having personally acquain-
ted themse]ves with the site and vicinity in question does hereby find that duplexes
would be appropriate for that area lying approximately 250 feet north of the proposed
40th Avenue in that that area would provide an appropriate buffer from the future
commerciai uses proposed to be located to the south of the site; that the plat should
be redesigned so as to provide for adequate circulation in the area and should include
a stub road connection to both Pierce and Skipworth roads; that a connection to the
Dishman-Mica highway should be required, and that improveinents to that connection
should be limited to the property under control by the plat sponsor at this fiime
if a satisfactory arrangement cannot be worked out between the County Engineer and
the adjacent property owners. Now, therefore, the Board of County Commissioners does
conclude that the preliminary plat to be known as Chester Field Addition(File #PE-1171-78'
ana zone reclassification (File #ZE -16-78) should be, and hereby is, approved subject
to the conditions as contained in the Planning Commission minutes dated February 24,
1978, except that the following conditions shall also be imposed:
That duplexes be restricted to the southerly 250 feet of the proposed pre-

This being the time set by the Board of County Commissioners of Spokane
County, Ulashington, to render its decision concerning the request of
Robert A. Bonucelli, East 9212 PIontgomery Avenue, Spokane, Vlashington,
for the above captioned preliminary subdivision and zone classification
upgrading; and
The Board having received the recommendation of the Spokane County
Planning Commission to approve the preliminary plat, subject to findings
and conditions as contained in the Commission's minutes dated February 24,
1978; and
The Board having conducted its own public hearing on P9arch 23, 1978, at the
request of the plat sponsor, Mr. Bonucelli, and after visiting the site
and revievring the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the recommendation of the Spokane County Planning
Commission to approve the preliminary plat, subject to findings and
conditions as contained in the Planning Commission minutes of February 24,
except that the following changes to those conditions shall be permitted:
1) that duplexes be restricted to approximately the southerly
250 feet of the project,
2) that the plat be redesigned to provide for adequate circulation
in the area and shall include stub road connections to both
Pierce and Skipworth Roads,
3) that a connection to the Dishmar, Mica highway be required and
that improvements to that connection be limited to the property
under control by the plat sponsor at this time if satisfactory
arrangements cannot be worked out between the County Engineer
and adjacent property owners.
The Board also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

Staff findings regarding PE-1171-78, Chester Field Addition.
I. GENERAI, I2dFOMATIOPI:
A. Location
Chesterfield Addition ia situated in the south central area of the Spokane
Valley,we9t of Bowdish Road and south of 37th Avenue.
B. Proposal
The applicant proposes to subdivide about 11 ~ acres into 33 lots alI for
. duplexes. The proposal would create a gross den9ity of about 6 units per
acre with a t;fpical lot size of about 11,500 square feet per lot.
C. Relationship to the Comprehensive Plan .
Chesterfield Addition is situated within an asea that has been designated
as being suitable for residential develooment. Within tha.t Comprehensive
Plan neither lot sizes nor higher density residential uses are as of yet
indicated.
D. Ecisting Land Uses
The site is presently vacant with no significant topographic features.
The properties to the north and east have developed over the years into
several single family residential subdivisions including Aloha S;cor.d
Addition, Joey ivtarie Addition, Joey Marie 1st Addition, Joey 1Jarie 2nd
Addition a_nd Midilome Addition. The properties to the south and southeast
include several scattered commercial uses.
E. Compatibility 'Nith bcisting Land Uses
The staff finds the propos2l presented by the plat* sponsor to be inco m-
patible with recent Planning Commission decisions in the area as vrell as •
being incomgatible with the existing development in the area. Located to
the north and northeast once again are several resiciential suhdivisions
includang Aloha 2nd Addition, Joey ifiarie Additions 1 through 3 and
Midilome Addition all of which are Single Familf Residential subdivisions.
The staff recommends that lots 1,14 and 15 of Block 1 and lots 5, b, 7, e,
9 ancl 10 of Bloek 2 be designated as duplex lots and che balance of the
Chesterfield Addition ba reserved for Singl.e Falnily Uses. The duplexe
lots as indicated by the staff would provide a.ri appropriate buffer from the
commercial uses located to the aouth and the b alance ef the pla.t oeing
designated as Single FarQily would be consistent with recent Planning Com~-~ission
decisions in the area.
II. SPECI AL ITIFORMATIOri :
A. Circulation

The Engineer's Office has reviewed this proposal and their offzce finds
that the plat design is acceptable to their ofE'ice and that adequate
County roacis are available to serve the site. Their office further
recommends that all roads within the plat be paved and curbed to the
sgecifications of the County a-ineer as a condition of plat approval
and that a connection to the Dishma.,n ??ica Hi ;hway located to the west of
the plat be obtained prior to the filing of the final plat, '
~3. Seua ;e Disposal
The Health District has approved the use of individual cn-site•systems
to serve this proposal. The plat is however situated over the Spo~ane
Valley Aquifer where a moderatE impact upon ground viater quality maf be
erpected at some future da'Lle zf centinued urbanization occurs in the area.

service area of that purveyor. The staff recommends that if aFproval
~itre to be granted that prior io the filing of the final olat, anr.exation
to that water purreyor be accomplisned.

The staff finds that because of the relatively flat terr3in of the site
and t_hat of the adjacent properfies t.b~Lt-n.o s~clal drainage control
methods would be required anci standard techniaues for storm water control
could be used.
Fire Protection
The proposed subdivision is situated within the iecorded servlce area of
Fire Protection District #1o That district indicates that as a candition
of plat approval both mains and hydrants of sufficient size for fire
protection need3 should be required.
Parks
, rto County parks zre currently available in the area a-nd the ^ounty Parks
Department has no present plan for either site acquisition or major pa.rk
improvements.
G. ' Schools
The proposed subdivision is situated within the boundaries of the Central
Valley School District. The diatricts facilities in this area are currently
at capacity levelso lhe district indicates however •Nhen there current
building program is completed in about 3 years time that their disirict

expects no particular problem in serving this plat proposal.
III. ZONING ANALYSIS
The staff finds that it would be appropriate to upgrade lots 1, 14 and 15 of
Block 1 and lots 5 through 10 of Block 2 to the Two Family Residential Zone
Classification upon the filing of the final plat and at the same time upgrading
the balance of Chesterfield Additicn to the Single Family Residential Zone
Classification. The staff finds that these zone reclassifications would be
consistent with recent Planning Co;nmission decisions in the area and that -
those lots as indicated by the staff for duplexes would provide an appropriate
buffer from the coIIUnercial located to the south of the site.
I V. FDTVI ROPIiMEI1TAL REV'I Ell'l -
The staff has reviewed the environmental checklist submitted by the applicant
and we find that no significa.nt adverse environmental impacts would likely result
from this proposal and a proposed declaration of nonsignificance should be
issued. Slight adverse environmental impacts were however r.oted under the following
questions: Ea.rth, air, water, flora, fauna, noise, light and glare, natural
resources, population, housing, transportation, public services, energy and
utilities.
V. CONDITIOPIS :
If approval is granted, the Staff recommends the following conditions.
Specific conditions applicable to this plat are referenced below and found in
the attached supplement entitled,"Standard Conditions for Approval oi Preliminary

Since I will be out-of-town and unable to attend your meeting of February 24,
19789 I would like to voice my opinion, via this letter, regarding the re-
zoning applications to be considered that day.
First, I' d like to say that I think Great Caution should be taken in granting
ANY zone changes until the status of the Aquifer is more fully known, and
understood.

Z'he two zone change that particularly bother me are :.PE 1171-78 & ZE 16-785
the Chester Field Addition ancl PE 1168-78 & ZE 13-781 Midilome First Addition.
Both are in the Chester area (or "South of Opportunity") and designated by the
recent 208 Study findings to have the highest readings of man made contaminates
in the entire aquifer system.
Midilome, the development in existance now, is a bad enough example of blight on
the environment of the area in more ways than one. Why let it continue to expand
like a cancerous growth?
The Chester Field Addition hasn't the issues against it that Midilome has, but
there is still the potential perpetuation of the aquifer problems, if it comes
into being.
A possible disservice to the aquifer's future could be "nipped-in-the-bud" by
a conscious effort now through your denying these zone changes. ;2

I. GIIJERAL I21F'ORMATI ON :
A. I,ocation
Chesterfield Addition is situated i.n the aouth aentra,l area of the Spokaae
Va11ey,West of Bowdish Road and south of 37th Avenue,
B. Proposal
. The applicant proposes to subdivide about 11 j acres i.nto 33 lots all for
, duplexea. The propo9al would creaze a gross density of about o units per
acre with a typical lot si2e of about 11,500 aquare feet per lot.
C. Relatioaship to the Comprehensive Plan .
ChesterfiEld Addition is situated withia an area tha: has beea deeignated as being suitable for residential development. Witr;n that Compreheasive
Plaa neither lot aizes aor higher density residential uses are as of yet
indi.cated.
D. Ecisting I,,and IIses
The aite is presently wacant with no aignificant topographic features.
The properties to the north and eaet have developed over the yeare into
several single family residentfal subdivisiona including Aloha S:)ocr.3
Addition, Joey Marie Addition, Joey Marie Ist Addition, Joey Marfe 2nd
Addition and Midilome Addition. TE9e properties to the south and southeast
include several scattered commercial uses.
E. Compatibi2ity With Existing Land Uses
The staff finds the propoeal presented by the pla~ sponsor to be incom-
gatible with recent Planning Commi.issioa decisions i. the area ae well aa •
being incompatible with the existing development in the axea. Zocated to
the north aad northeast once again are several resi-lential subdivisions
including Aloha 2nd Add3.tion, Joey Marie Additions 1 through 3 and
1Vlidilome Addition all of which are Single Family 8esidential suhdiviaions.
The staff recommerade tha.t lota 1,14 and 15 of Block 'f and lots 59 69 71 80
9 and 10 of Block 2 be desi,gaated as duplex lots a.nd •zhe balance of the
Chesterfield Addition be reserved for Single Family Uses. The duplexe
lots as fndicated by the staff would provide an a-nprrpriate buffer fram the
commercial uses loeated to the 3outh and the bal:vice of the ola,t being
designated as Single Family Would be eonsistent with recent Planning Comsnission
decisiona in the area.
II . SPFCI AL ]CNFOR2~.ATION:
A. Circulation

The Engineer'8 Office hae reviewed this proposal and their of#'ice finda
that the plat design is acceptable to their office and that adequate
County roads are available to serve the site. Their office further
recommends that all roads witbin the plat be paved and curbed to the
specifications of the County EalgineAr as a condition of plat approval
and that a connection to the Dishman Itica xighway located to the west of
the plat be obtained prior to the filing of the final plat, if at all
poasible.
B. SeWage Disposal
The Health Di3trict has approved the use of individual on-site•systems
to se=-ve this proposal. The plat is however situated over tr.e SpQkane
Valley rlquifer where a moderate impact upon ground water qua.lity may be
expected at some f'uture date if cantinued urbanization occurs i:n the axea.
If approv3l were granted at the plat density proposed by the sponsor a
sewage managemeat system would 'oe required as a condition of Flat approval.
The 3ealth District f,irther recommends the existing well located on lot
5, Block ? be abandoned a.nd filled in accordance with present apFroved
procedures prior to the filing of the final plat.
C. Water Supply
?'he applicant proposes the use of water from t.lodel Irrigation District.
The proposed subdivision is at this tirne not located srithin the recorded
service area of that purveyor. mhe sta.ff recomcnends that if aFproval
^Tere to be granted that prior to the filing of the final pZatlannexation •
to that water purveyor be accomplished.
D. Drainage
The staff finds that because of the relatively z"lat terrain af the site
a.ad that of the adjacent properties that no special drainage control
methods would be required and standard techniquea for storm water control
could be used.
E. Fire Protection
The proposed subdivisioa is situated within the recorde d service area of
Fire Protection District #1. That district indicates that as a condition
of plat approval both mains aad hydrants of sufficient size for fire
protection need.s should be reouired.
F. Parks
. No County garks we currently avai.lable in the area and the County Pasks
Depa.rtment has no present plan for either site aequisi.tion or majar park
iaiprovements.
G. ' Schobls
The proposed subdivision is situa,ted within the boundaries of the Central
Valley School District. The diatricts faci3ities in this arpa are currently
at~i pacity levelso The district indicates however when there current
ding program ia completed in about 3 years time that their district

expects no particular problem i.n serving this plat propoeal.
III. ?ANING ANALYSI S
The staff finds that it would be appropriate to upgrade lots 1, 14 and 15 of
Block 1 aaad lots 5 through 10 of Block 2 to the Two Family Reeidential Zone
Classification upon the filiag of the final plat and at the same time upgra,ding
the balance of Che9terfield Addition to the Single Family Reeidential Zone
Claeaification. The staff finds that these zone reclassifications would be
consiatent with reaent Planning Commission decisions in the area and that -
thoee lots as indicated by the staff fnr duplexea would provide an appropriate
buffer from the conanercial located to the south of the site.
IV. ENVIROM04TAL REVIEV'l
The staff has reviewed the environmeatal checklYat submitted bf the applicaat
and we find that no sigaiffcaat adverae environmental impacts would likely result
from this proposal aad a propo9ed declaration of aonsignif icance should be
issued. Slight adverse environmental impacta were hoWever noted under the following
questions: Earth, air, water, flora, fauna, noise, light and glare, natural
resources, gopulation, hou9ing, transportation, public services, energy and
utilities.
V. CONDITIMtS :
If approval is granted, the Staff recommends the following conditions.
Specific conditions applicable to this plat are referenced below and found in
the attached supplement entitled,"Standard Conditions for Approt►a,l of Preliminary
