As appurtenant and incidental to the residential use of anv mobile home, a natio, canony and one single or double detached garage or car port, architecturally in harmony and of permanent structure may be erected on said lot, subject to the limitations herein. The owner of any lot, once construction of a natio, canopy or detached garage or car Hort is commenced shall, within ninety (90) days thereafter, have the patio, canopy, garage or car port completed, and in the case of a garage or car port shall have the exterior completely finished and all necessary painting or staining completed. Only two sizes of garages or car norts shall be permitted on any lot, namely 241x26' or 181x26'. The roof hitch on any garage or car port shall not exceed 3/12 pitch. Architectural Control: No building or structure shall be erected, niaced, permit ed or metered on any lot until the construc- tion plans and specifications and a nlan showing the location of the structure on the lot has been annroved by the Control Committee as to nuality of workmanship and materials, harmony of exterior design with the existing structures and as to location with resnect to tonnrrnphv and ri ni shed prade elevation. Nn fence, hedge or boundary wall abutting on a street shall exceed three (3) feet in elevation above the finished grade surface of the ground upon which such fence, hedge or boundary wall is situated unless similarly annroved by the Control Committee. Annroval shall he as provided in paragraph 7 hereof. 7. Control Committee: The Control Committee is composed of R. E. Simmons, Adeline Simmons andChester Chastek. A majority of the committee may designate a representative to act for it. In the event of the death or resignation of any member or any two members of the committee, the remaining member or members shall have full authority to designate a successor or successors. Neither the members of the committee nor its designated representative shall be entitled to anv compensation for services performed pursuant to these covenants. Whenever the record ownership of two-thirds of the lots to which these covenants anply, shall have passed from Villa Estates, Inc., to third narties, then a majority of that number (the third party record owners) shall have the power by virtue of a duly recorded written instrument, signed by a majority of the then record holders of the lots, to change the membership of the committee. Should all three of the Control Committee die or resign prior to the time that any successor or successors are named, then a new committee may he named by the record owners of the majority of the lots, placing of record a written instrument signed by the majority, which indicates the individuals elected to the control committee. 8. Actions of Control Committee: All annlications for approval which must come die f ore fire ContrcT ommittee shall be in writing. T>>e Control Committee's approval or disapproval, as required in these covenants, shall be in writing. The Control Committee shall act on all applications within thirty (30) days after the plans and specifi- cations have been submitted to it. In the event the committee or its designated representative fail to approve or disannrove the plans and snecifications submitted to it, within 30 days after submission, the nlans and snecifications submitted will he deemed to have been approved and the related covenants to have been fully complied with. 9. Nuisances and Rules: No noxious or offensive activities shall be carried on upon any lot nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighbor- hood. All occupants of mobile homes in said addition shall subscribe to weekly garbage service from a commercial garbage collection service in the Spokane Valley Area and shall at no time allow garbage to accumulate or collect in the arca. Because the time frame established in our letter to you on March 5, 1985, and the granting of an extention August 1, 1985 has lapsed and no effort was made on your part to either relocate the garage currently located over your drainfield or remove it from the property, we have no choice but to demand corrective action. MANSON, DIRECTOR Dear Mr. Reynolds: Laws and regulations in our society are, at times, difficult to understand and fully comprehend. This is true of zoning ordinances, which are laws intended to protect and govern the many different uses of land in Spokane County. It is my responsibility, as the Zoning Investigator, when the situation arises, to help resolve conflicts involving the Spokane County Zoning Ordinance. This office has received reports regarding storage of inoperable vehicles on your property, located at E. 19015 Marlin Spokane County, parcel number 08552-0509. This property is zoned Residential Mobile Home. A recent visual inspection by our field inspector indicated, we believe, that these reports are accurate. Section 4.03.020(32A) of the Spokane County Zoning Ordinance defines inoperable vehicles as follows: "Junk or Parts Vehicles" shall mean the remants or remains of a motorized or non -motorized device capable of being moved upon a public highway and in, upon, or by which any person or property is or may be transported or drawn upon a public highway and which is inoperative. Such term shall include, but not be limited to vehicle hulks, trailers, semi -trailers, tractors, motorcycles, trucks, and buses." Section 4.17.170 requires that storage of inoperable vehicles or parts thereof shall be in accordance with the following provisions: 1. No "Junk or parts Vehicles" may be stored within the front, flanking street, or side yard setback area; and 2. All "Junk or Parts Vehicles" must be completely sight- screenedyear-round, from a non -elevated view, by a fence, hedge, shrubs or (maintained landscaped berm) (natural landscaped berm). It is the intent of this letter to advise you of an apparent zoning violation and to request compliance within a suitable time frame. Reynolds March 5, 1985 Second Page Accordingly, we are of the opinion that since you have now been informed of the requirements of the Spokane County Zoning Ordinance, a period of 30 days, beginning with the date of this letter, should be sufficient time in which to bring your property into compliance by either removing those vehicles which are inoperable or by screening them from view as required in Section 4.17.170 noted above. Do not hesitate to act upon this important matter, since a violation of the Spokane County Zoning Ordinance is a misdemeanor and does carry a penalty. Further, our district inspector reported that an accessory building (garage) has been constructed on your property without a valid building permit. In accordance with Section 301 of the Uniform Building Code as adopted by Spokane County, such work requires that you first obtain the appropriate permit. Section 304(d) of the Uniform Building Code requires that a double fee be charged whenever any work for which a permit is required has commenced without first obtaining such permit. However, the double fee will be waived, provided you take the appropriate action to obtain a permit within ten (10) days of the date of this letter. I can assure you a double fee will be assessed should you fail to comply with this request. If the above mentioned time frame is insufficient, please contact this office within 7 days in order that an equitable time frame might be established in which your property will be brought into compliance with the ordinance requirements.
