Dear Mr. Brinck:
This confirms a July 21 telephone conversation between Harold Scott,
a member of my staff, and Mr. Nal Barnes regarding housing projects
in the Spokane Valley-Rathdrum Prairie Aquifer area. The following
projects are considered acceptable and should not contaminate the
ground water to a level which would cause a significant hazard to
public health for those people using the Aquifer as a drinking water
source:

2. Orchard Gardens First Addition, S.P. #356

We are still reviewing the Farwell Estates Subdivision - S.P. #348. ,
The project is located in an area of higher nitrates. Also, EPA •
approval for the Pines West Addition - S.P. #333 is being withheld
on pending additional information on the lawsuit.
The Westgate Village, S.P. #359 (190 lots) and Westgate Rim, S.P.
#358 (135 lots) projects are being held until receipt of additional
information from your-office on the type of central sewer system.
It appears these two projects collectively (325 lots) could require
a Special Environmental Clearance (Threshold of_200 units or a mort-
gage of more than $5 million) according to the HUD NEPA regulations.
I also note with interest, the application for the Westgate Village,
S.P. #359 shows a line through the first listing of 211 lo ihich
was replaced by 190 lots and that 225 acres of adjacent la
der control of the project sponsor. Does HUD plan to pre
cial Clearance for these two projects?

County, Washington, to render its decision concerning the request of

above captioned preliminary subdivision and zone classification upgrading;
and
The Board having received the recommendation of the Spokane County
Planning Commission to deny the preliminary plat, as stated in the minutes
of the Planning Commission, dated February 24, 1978; and
The Board having conducted its own public hearing on April 6, 1978, at the
request of plat sponsor, Mr. Byers, and after visiting the site and '
reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to approve the requested preliminary plat and zone change;
PROVIDED, the density shall_not exceed_three dwelling__units_per acre.
, - - The Board also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

Staff findings regarding PE-1169-78, Berge's Addition to Vera.
I. GEAtERAL INFORMATION:
A. Location
Berge's Addition to Vera is located in the south central area of the
Spokane Va11ey south of 4th Avenue and west of Evergreen Road.
.
B. Proposal
The applicant proposes to subdivide about 2'/2 acres into 6 lots all
for duplexes. The proposal would create a plat with a density of
about 5 units per acre with a typical lot slze in excess of 11,000
square feet per lot.
C. Relationship to the Comprehensive Plan
Berge's Addition to Vera is situated within an area that has been
designated as being for suitable for residential development by the
approved map of the Comprehensive Plan. GJithin that Comprehensive
Plan however no densities have as yet been indicated. D. Existing Land Uses
The site is presently in active cropland vegetation with no significant
topographic features. The properties that generally suround this
proposal have developed over the years into several Singl.e Family
Residential subdivisions.
E. Compatibili 'uy with Exa.sting Land Uses
The staff questions compatibility of duplexes in this area in that the
area appears to have developed over the year s into several subdivisions
all of which are for Single Family Uses. The Planning Commission oolicy
in this area seems to indicate that for those provos2l s located north of
4th P_venue that duplexes may be appropriate in some cases. But for those
proposal s situated south of 4th Avenue the Planning Commission has generally
been holding the policy that those areas are generally suited for higher
density Single Family uses.
II. SPECIAL INFORMATION:
A. Circulation
The Engineer's Office has reviewed this proposal and their office finds
that the plat design is acceptable to their office and that adequate
county roads are presently avai.lable to serve the sl te .

B. Sewage Disposal
The Health District has approved the use of individual on-site systems
to serve this si te . The plat is however si tuated over the Spokane Vall ey
Aquifer where moderateimpact upon g-roundwater quality may be expected at some
future date if continued urbani2ation occurs. If approval wpre granted
for duplexes for thls proposal then a sewage management system would be
required as a condition of plat approval. The Health district further
finds that a public well is situated to the south of this proposal and a
statement should be placed in the plat dedication indicating that a
55 foot building structure setback and frontyard drainfield area be
required for lot 6 due to the 150 foot required minimum distance between
a drai nfield and a public well. ,
C. Water Supply
The proposed subdivision is situated within the recorded service area of
Vera Irrigation District. That district indicates that it does have
the ability to serve the site wi.th both domestic and fire flows.
D. Drainage
The staff finds that because of the relatively flat terrain of the
site and that of the adjacent properties that no special control methods
would be required and standard techniques for storm arater control could
be employed. '
E. Pire Protection
The proposed subdivision is situated within the recorded service area of
Fire Protection District #1. That district indicates that as a conditlon
of approval both mains and hydrants of sufficient size for fire protection
needs should be required.
F. Parks
No County parks are currently available in tne area and the County Parks
Department has no present plan for either site acquisition or major park
improvements.
G. Schools
The proposed subdivlsion is situated within the boundaries of Central
Valley School District. That district indicates that their facilities in
this area are currently at capacity levels. They believe this problem
may be mitigated somewhat when their current building program is completed
in about 2 years time.
IT_I o uOIVING ANALYS IS
ihe staff flnds that it would be appropriate to upgrade this proposal to the
zingle Famlly Residential Zone Classification because of the use and character

of the surounding properties. The staff also finds that an upgrade to the
Single Family Residential Zone Classification would be consistent with recent
Planning Commission decisions in the area.
IV. ENVIRONMIINTAL REVIaJ :
The staff has reviewed the Environmental checklist submitted by the applicant
and we find that no significant adverse environmental impacts caould likely
resul t from this proposal and a proposed declaration of nonsi gnificance should
be issued. Slight adverse environmental impacts were noted however under the
following questions: Earth, air, water, flora, noise, light and g.lare, land
use, natural resources, populatlon, housing, transportation, public facilities,
energy and utilities.
V. CONDITIONS:
If approval is granted, the Staff recommends the following conditlons.
Specific conditions applicable to this plat are referenced below and found in the
attached supplement entitled, "Standard Conditions for Approval of Preliminary Plats
August, 1977. NOTE: Any amendments to said conditlons are stated separately and

Staff findings regarding PE-1169-78, Berge's Addition to Vera.
I. GENERAL INFORMATION:
A. Location
Berge's Addition to Vera is located in the south central area of the
Spokane Va11ey south of 4th Avenue and west of Evergreen Road.
.
B. Proposal
The applicant proposes to subdivide about 2'/2 acres into 6 lots a11
for duplexes. The proposal would create a plat with a dznslty of
about 5 units per acre with a typical lot size in excess of 11,000
square feet per lot.
C. Relationship to the Comprehensive Plan
Berge's Addition to Vera is situated 4rithin an area that has been
designated as being for suitable for residential development by the
approved map of the Comprehensive Plan. Ulithin that Comprehensive
,
Plan however no densities have as yet been indicated.
D. Existing Land Uses
The site is presently in actave cropla.nd vegetation with no significant
topographic features. The properties that generally suround this
proposal have developed over the years into several Single Family
Residential subdivisions.
E. Compatibllity with Existing Land Uses
The staff questions compatibility of duplexes in this area in that the
area appears to have developed over the year s into several subdivisions
a1l of which are for Single Fariily Uses. The Plasuling Commission policy
in this area seems to indicate that for those proposal s located north of
4th P_venue that duplexes may be appropriate in some cases. But for those
proposal s sltuated south of 4th Avenue the Plann3ng Commission has generally
beeli holding the policy that those areas are generally suited for higher
density Single Family uses.
II. SPECIAL INFORMATION:
A. Circulation
The Engineer's Office has reviewed this proposal and their office finds
that the plat design is acceptable to their office and that adequate
county roads are presently available to serve the si te .

B. Sewage Disposal
The Health District has apvroved the use of individual on-site systems
to serve this site. The plat is however situated over the Spokane Va11ey
Aquifer where moderateimpact upon groundwater quality nwj be expected at some
future date if contlnued urbanization occurs. If approval were granted
for duplexes for this proposal then a sewage management system would be
required as a condition of plat approval. The Health district further
finds that a public well is situated to the south of this proposal and a
statement should be placed in the plat dedication indicating that a
55 foot building structure setback and frontyard drainfield area be
required for lot 6 due to the 150 foot required minimum distance between
a drainfield and a public well. .
C. lrlater Supply
The proposed subdivision is situated wlthin the recorded servlce area of
Vera Irrigatlon District. That district indicates that it does have
the ability to serve the site with both do►nestic and fire flows.
D. Drainage
The staff finds that because of the relatively flat terrain of the
site and that of the adjacent properties that no special control methods
woul d be required and standard techniques for storm water control could
be employed. '
E. Pire Protection
The proposed subdivision is situated within the recorded service area of
Fire Protection Distr?ct #'I. That district indicates that as a condition
of approval both mains and hydrants of sufficient size for fire protection
needs should be required.
F. Parks
No County parks are currently available zn the area and the County Parks
Department has no present plan for either site acquisition or major park
improvemen'us.
G. Schools
The proposed subdivision is situated withln the boundaries of Central
Valley School District. That district indicates that their facilities in
this area are currently at capacity levels. They believe this problzm
may be mitigated somewhat when their current building program is completed
in about Z year s time.
IIIo ZONING ANALYSIS
ihe staff finds that it would be appropriate to upgrade this proposal to the
Single Family Residential Zone Classification because of the use and character

of the surounding properties. The staff also finds that an upgrade to the
Single Family Residential Zone Classification would be consistent tvith recent
Planning Commission decisions in the area.
N. ENV IRONMIlVTAL REV IE41:
The staff has reviewed the Environmental checklist submitted by the applicant
and we find that no si gnificant adverse envi-ronmental impacts would likely
result from this proposal and a proposed declaration of nonsignificance should
be issued. Slight adverse environmental impacts were noted however under the
following questions: Earth, air, water, flora, noise, light and glare, land
use, natural resources, population, housing, transportation, public facilities,
energy and utilities.
V. CONDITIONS: ,
If approval is granted, the Staff recommends the following conditions.

attached supplement entizled, "Standard Conditions for Approval of Preliminary Plats

2. Topography, soils and water.
a. Thfs project lies in a relatively flat area between Opportunity and Vera.
Local drainage ways are insignificant. It is located over the Spokane
Valley Aquifer.
b. Surface soils are classed as Garrison gravelly loam with 0 to 5% slopes.
They have a septic tank f ilter ffeld limitation of slight with possible
contamination of groundwater.
c. Geologically the soils are glaciofluvial deposits; stream-laid sand and
gravel; contains some boulders in places; includes some undifferentiated
glacial deposits. The lower terrace renmants have probably been reworked
by streams. These geologic structures yfeld moderate to very large
amounts of water.
d. The data from 4 Vera, 2 Modern Water District and 3 private wells in the
area shows the wells are 99 to 175 feet deep and have static water levels

varqing from 77 to 145 feet below the surface. The highest total
nitrogen 1eve1 was 3.42 ppm. The Vera Water and Power District has
indicated that it caa supply domestic use water for the plat upon
'completion of agreements with the developer.
3. Impact discussion.
a. The plat sponsor has proposed 6 lots on 2.41 acres. Each lot is to
be served by a public water system and its individual on-site sewage
disposal system. This raises the question of significance of the im-
pact on the groundwater in the area and possible alternatives for
• sewage disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd con-
sidered typical soils, natural and sewage disposal recharge to the
groundwater, and the effect of continued urban developffient in the
Spokane River Valley upon the quality of the groundwater. In summary,
he concluded that:
(1) In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
(2) All dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents (phosphate
portion) are mostly removed by the deep soil layer above the
groundwater and "minor dissolved constituents such as phos-
phates, which are known to react with soil particles, or
nitrates, which are taken up by plant roots" will be less than
the total found in septic tank effluents.
,
(3) "The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) sol-
ids concentration expected at present (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater back-
ground of 155 mg/1. The forecast year 2020 maximum incremental
concentration is 101 mg/1 above the natural background."---"The
analytical results of the forecast impact o£ qear 2020 when com-
pared with the present impact, both measured in terms of leachate
volume and dissolved solids concentration, indicate that the
present impact on groundwater quality is already a substantial
proportion of the ultimate level."
c. Currently, results of chemical analysis show the total nitrogen content of
the groundwater in the range of .82 to 3.42 ppm. A projected incremental
increase using Dr. Todd's expected 8.6 percent would result in ranges 0.89
ppm. to 3.71 ppm. Current Federal and State drinking water standards per-
mit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge the groundwater
' have the following general characteristics:

(1) Collector and central treatment systems discharging to sur-
face waters would require at least tertiary Creatment and
perhaps more to obtain a permit for the discharge from the
Department of Ecology. These systems are not currently
economically available for this project.
(2) Sealed systems, whether individual or community, depend on
evaporation for liquid removal. Some, such as lagoons,
have safetq hazards assaciated with them and relatively poor
cotmnunity acceptance.
4. Recommend that:
a. A public water system including fire flows serve each lot prior to sale
of the lot.
b. Each lot be authorized the use of an individual on-site sewage system.
c. An on-site sewage management system be created and approved by this of-
fice prior to the signing of the f inal plat if more than a total af
eight (8) dwelling units are authorized within the plat.
d. A SS foot building structure set back and front yard drainfield area be
designated for Lot 6 due to the 150 foot required minimum distance be-
tween a drainfield and a public well.
