OF SPOKANE COUNTY, WASHINGTON :
IN THE MATTER CONCERNING VACATION OF A) FINDINGS OF FACT
DRAINAGE EASEMENT OVER LOT 5, BLOCK l, ) CONCLUSION AND DECISION
PE-1230B-78, PONDEROSA 6TH ADDITION )
APPLICANT: James & Ann Eastman
THIS MATTER, being considered by the Board of County Commissioners of
Spokane County, hereinafter referred to as the "Board", of a drainage easement
vacation request on Lot 5, B]ock 1 of Ponderosa 6th Addition.
- The Board received an appl,ication on November 6, 1986, by James & Ann
Eastman.
The Board held a.de novo public hearing on December Z, 1986, and,
having fully considered all testimony presented, and having acquainted
themselves with the vicinity and the site in question, did reach a decision on
December 2, 1986, to Approve the requested easement vacation and in doing so
did enter the following:
' FINDINGS OF FaCT
1. That the December 7, 1986 staff presentation was considered by the
Board.
2. That the file of PE-1230B-78 was considered by the Board as well as
comments and recommendations from the Spokane County Engineer's
Department regarding the need for a drainage easement.
3. That the proposa] is located in an area designated URBAN on the adopted
. Spokane County Comprehensive Plan and is within the Priority Sewer
- Service-Area (PSSA) where Spokane Valley sewers will be installed.
4. That no parties appeared to oppose or protest the vacating of the
drainage easernent.
5. That the Spokane County Engineer's office, by memos of November 3 and
November 20, 1986, indicated the drainage easeinent is no longer
required over this lot.
6. That considering all agencies/departments' review and public testimony,
the Board concludes after individual on-site visits that the proposal,
as conditioned wi]1 not be detrimental to the public health, safety and
we 1 fare.
7. That the proper Tegal requirements for advertising of the hearings
before the Board have been met under RCW 58.11.
10. That on -January 6., 1987, the Board, at a regular hearing, did Approve
the request based upon the testimonies submitted at the public hearing
and other evidence available to the Board and thus make the following
decision:
DECISION
From the foregoing Findings, the Board hereby APPROVES the request and
adds the following conditions of approva]: 1. That the applicant file an amended plat drawing of Lot 5, Block 1,
Ponderosa 6th Addition in conformance with the requirements of County
Departments and the Spokane County Auditor's office.

Findings of Fact, Conclusion and Decision
2. That the applicant provide an alternate drainage easement for the subject property which shall be reviewed and approved by the Spok ane County
Engineers Department as a part of the filing of the amended plat.

As I indicated to you in my November 3rd memo, we support the vacation of
the drainage easement on Lot 5, Block 1.
Please note that this vacation should be conditioned to require the final
lot landscaping plan to be reviewed and approved by our office and the neighbor
on Lot 3, Block 2 of Ponderosa 6th Addition. This is to insure nothing is done
- which could cause the owner of Lot 3, Block 2 any future drainage proble m.
