Jt \ 1 .~►11I , .x • I PLANNING DEPARTMENT . , I BROAOWAY CENTRE 9UILOING N 721 JEFFERSON STiiEET ~ PHONE 456 2205 . • SPOKANE, WASHINGTON 99260 SPONqN[ COUNT♦COURTHOUSC ' November 3, 1987 Mr Staniey R Schuitz Winston and Cashatt Seafirst Financial Center Spokane, WA 99201-0695 RE INTERPRETATION OF COMMERCIAL ZONE OF THE ZONING ORDINANCE OF SPOKANE COUNTY - AI-24-87, SELF-STORAGE/MINI- WAREHOUSE AS A PERMITTED USE Dear Mr Schultz: This response to your October 21. 1987, letter is an officiai interpretation of the Zoning Ordinance of Spokane County You have asked the question "Is a self-storage or mini-warehouse a permitted use in the Commercial Zone, Chapter 410, of the Zoning Ordinance of Spokane County'?" it is the Planning Department's posrtion that a self-storage or mini-warehouse is indeed a permitted use within the Commercial Zone In support of this position is an interpretation rendered by the Spokane County Zoning Adjustor on October 20, 1980, and identified as ile No I-9-80 (see attachment) In that case, the Spokane County Zoning Adjustor was asked to review the administratrve decision of the Zoning Administrator that self-storage or mini- warehouses are not a permitted use in the Commercial Zone In overtuming the Zoning Adminisirator's interpretation, the Zoning Adjustor found that - mini-warehouses are companble to transfer storage warehouses which are a permitted use in the Commercial Zone according to Section 410 030(e)(45), - that mini-warehouses are a retail service which is consistent with the purpose and intent of the Commercial Zone, - and that historical files indicated ihat Spokane County had aliowed several mini-warehouses to be located within the Commercial Zone The Spokane County Planning Department stands by this interpretation of the Zoning Adjustor provided that ail standards of the Commercial Zone together r with all conditions of approvai in a Commercial Zone are complied with in the development of the mini-warehouse use Although the above information is correct concerning a mini-warehouse use in the Commerciai Zone, I have found some discrepancies in your letter of October 219 1987 and rezone files related to the property described by you It is imperative that l point these discrepancies out to you since they do in fact affect the situation described in your letter and modifies the interpretation you have asked me to make In your letter, you describe the existing Shurguand Self-Storage facility as being located on the asterly twenty-five (25) feet of Tract 16, all of Tract 17, and a portion of Tract 18 of Assessor's Plat No 6 In reviewing the legai descriptions, I find that the Westerly twenty-five (25) feet of Tract 16 is contiguous to Tract 17 and = the Easteriy portion of Tract 16 Therefore. 1 assume that the correct legal descnption for the Shurguard Self-Storage facility should be the Westerly twenty-five (25) feet of Tract 16, all of Tract 17, and a portion of Tract 18 of Assessor's Plat No 6 in your letter you also describe a bnef zoning history of the area in question In review of the rezone files and associated legal descnptions, I find the following zoning history to be more correct. in 1972 Tracts 15, 169 171 18, and 19 of Assessors Piat No 6 lying northerly of Interstate 90 were rezoned from Agnculturai to Freeway Commeroal by zoning file ZE-60-72 Subsequent to that rezoning, three (3) separate zone changes were proposed and approved to change most of the above-descnbed property from Freeway Commercial to Commercial or Restncted industnal File ZE-3-73 changed the zornng on Tract 15 from Freeway CommerrAal to Restricted Industnal In 1975, the easterly 250 feet of Tract 16 was proposed and approved for rezoning from Freeway Commercral to Commercial by File ZE-23-75 Tract 16 in reality is approximately 275 feet wide Therefore, since ZE-23-75 rezoned only the easterly 250 feet of Tract 16, the westerly 25 feet was not affected by that zone change and remained zoned Freeway Commeraal Finally, in 1976, by File ZE- 43-76, Tracts 17, 18 and 19 lying north of Interstate 90 were approved for Restncted Industnai zornng This application, ZE-43-76, did not include any portion of Tract 16. Therefore, it is the Planning Department's position that the westerly 25 feet of Tract 16 continues to be zoned Freeway Commercial according to File ZE-60-72 Now, w,th the above in mind and knowing that the westeriy 25 feet of Tract 16 is zoned Freeway Commercial, I bebeve that your intended question of interpretation would actually be as follows "Is a self-storage or mini-warehouse a permitted use in the Freeway. Commercial Z=, Chapter 4 08A, of the Zoning Ordinance of Spokane County'?" The Commission notes that the proposed use would be a relatively low traffic generator and would not significantly contribute to traffic congestion at the Pines Interchange. NOTE: The Pines Interchange may be redesigned in the near future to allow better access to the advertiserl property. 4. The site is located on the floor of the Spokane Valley wfthin a corridor designated for industrial expansion on the Comprehensive Plan. The zone change proposal would havE no appreciable effect upon the topography, bioloqical and botanical characteristics and other natural development in the urbanizing area.
