The Staff recomme.nded a significant environmental impact declaration due to the high nitrate concentrations in the area. The recommendation included an Environmental Impact Statement which would address in particular the groundwater impacts and human health of the piat with the proposed density. There was a motion by Byrne to limit the testimony to whether or not the plat needs an E.I.S.; if it should+not, the Commission wouid hear the rest of the plat. Seconded by Quigley. The motion was lost with four "no" votes, and three "yes." It was pointed out by legal counsel that even though the Planning Department based its recommendation on the groundwater quality in the area, all the issues would still have to be addressed. The Commission decided to hear all testimony concerning the plat. The sponsor's representative presented water quality statistics and quoted remarks by Ray Card that this proposal in and of itself would not affect the groundwater quality significantly. The Health District representative questioned the how and when of the samples taken, and pointed out that there are a number of the small plats that "in and of themselves" on an individual basis would not affect the groundwater significantly; but collectively, all those sma]1 plats amount to a rather large area. There was considerable testimony and presentation of slides, statistics, a petition, and other material by opposition, with regard to density, agricultural pursuits in the area, incompatibility, and overcrowded schools. Motion to approve by Thomas (reserving the right to speak to his motion if it is seconded), with the conditions specified by Staff; but determination made that an E.I.S. would not be useful. Seconded by Kennedy. The motion was addressed by the Commission, giving consideration to a decision by the Board of County Commissioners in a Findings and Order of December 16, 1976 (No. 76 1229) wherein the 6oard had made a determination regarding size of tracts in this area; and the Commission felt they should uphold that decision. The density of the plat was held to be incompatible in the area. (Motion to approve was denied unanimously because of incompatibility.) GENERAL INFORMATION A. Location -The proposed plat is situated in the Spokane Valley, north of and adjacent to Valley Way and approximately 300 feet west of the intersection of yalley Way and Evergreen Road. B. Proposal -4.8 acres subdivided into 15 lots for single family use. -Typical lot frontage = 80' -Typical lot siZe = 10,900 sq. ft. -Lots per gross acre = 3.1 lots per gross acre. C. Relationship to Comprehensive Plan -The map of the Comprehensive Plan indicates that the site, as well as adjoin- ing properties, suited for residential usage. The map doesn't make any density designations for residential uses. D. Existing Land Uses -The proposed site currently contains three residences and the back half of the parcels has been used in the past for pasture, -Surrounding the property, we find residential uses. Parcels to the north, west and east (across Evergreen Road) range in size from one to five acres. To the south of the property, across Valley Way, are several subdivisions (such as Loita's Subdivision, Donalee Addition and Birkettts Subdivision) vlith an average lot size of approximately 11,000 sq, ft, On the east side ef the proposal, on the northwest corner of Evergreen Road and Valley Way are five duplexes on 13,000 sq. ft. lots. Across Evergreen Road there are several highly developed residential areas. -Other existing land uses around the proposal include: the Vera Water and Power complex at the northeast corner of the project, a church on the east side of the site, and another church off the northwest corner of the prelimin- ary plat. E. Compatibility with Existing Land Uses -8elcher's Addition is being proposed in a particular section of the rapidly developing Spokane Valley that has experienced very little development. Generally, the area immediately north of Ualley Way and west of Evergreen Road is still of a rural nature with few urban residential density developments. GENERAL INFORMATIOPJ - cont'd. (Compatibility with Existinq Land Uses) -The development as proposed would be compatible with the areas to the south and east. But it is warth noting that the proposal is intruding into an area that has remained virtually untouched by urban development and retains a rural density. II. SPECIAL INFORMATION: A. Circulation (Engineering recommendations not received at time of printing.). B. Sewage Disposal -The applicant's engineer has prepared an analysis of alternative sewage disposal means, including on-site septic tank disposal, community septic tank disposal, and community package treatment plant disposal. For economic reasons, and to provide the most realistic alternative, the applicant's engineer feels on-site septic tanks should be utilized. -The Spokane County Health District has authorized the use of individual on- site sewage systems for each lot within the plat. The District states that an on-site sewage management system should be created and approved by their office prior to the signing of the final plat if more than a total of 17 dwelling units are authorized within the plat. The plat is situated over the Spokane Valley Aquifer; and the Health District, in their examination of the possible impact on groundwater quality from this proposal have the following comments: Impact Discussion a. The plat sponsor has proposed 15 lots on 4.8 acres with a typical lot size of 80 by 136 feet. Each lot is to be served by a public water system and its individual on-site sewage disposal system. This raises the question of sig- nificance of the impact on the groundwater in the area and possible alterna- tives for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. (2) All the dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate portion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phosphates, tivhich are known to react with soil particles, or nitrates, which are taken up by plant roots," will be less than the total found in septic tank effluents. (3) The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) solids concentration expected at present (1975) is up to 93 mg/1 (milligrams per liter) above the natural groundwater background of 155 mg/l. The forecast year 2020 maximum incremental concentration is 101 mg/1 above the natural background.- The analytical results of the forecast impact of year 2020 when compared with the present impact, both measured in terms of leachate volume and dissolved solids concen- tration, indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level. c. Currently, results of chemical analysis show the total nitrogen content of the groundwater as in the range of 1.81 ppm. A projected incremental increase using Dr. Todd's expected 8.6 percent would result in ranges to 1.96 ppm. Current Federal and State drinking water standards permit up to 10 ppm. d. Alternative sewage disposal methods that would not rehcarge the groundwater have the follotiving gene-ral characteristics: (1) Collector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economically available for this project. (2) Sealed systems, whether individual or community, depend on evapora- tion for liquid removal. These systems require more land area than a conventional subsurface drainfield. Some, such as lagoons, have safety hazards associated with them and relatively poor community acceptance. Land, installation and operational cost are generally more expensive than those for septic tanks and drainfields. C. Drainage -The County Utilities Engineer reports that the preliminary storm drainage plans submitted by the applicant indicate that on-site storrn drainage provisions will adequately handle surface water runoff. However, final construction plans should be reviewed and approved prior to the final plat filing by the County Utilities Engineer. D. Fire Protection -This proposal is situated within recorded service area of Fire District #l. -The fire district requests that mains and hydrants of sufficient size for fire protection, as determined by the fire district staff, be required as a condition of final plat approval. F. Schools -The proposal lies within the boundaries of Central Valley School District #356. -The District, in response to staff inquiries concerning current status and future facility needs, indicates that their facilities are currently at capa- city levels. They further state that they "....would like for the Planning Commission and County Commissioners to watch the development activity in relationship to housing students, more closely. The district will have to have a new bond issue for construction very soon. If this doesn't happen, the Central Valley School District will not be able to house all of the students." G. Parks -The report "planning for Parks" (revised 1976) indicates that there are currently no parks located in this neighborhood, known as the Valley Way neighborhood. As the area develops, the report states that a 8.0 acre park is proposed, to be located near the Blake Elementary School on Broadway. H. Unique Environmental Features -The Spokane County inventory indicated none for this area. I. Cu'l tural Resources -No cultural resources have been identified in this area. II. ZONING ANALYSIS -The site is presently zoned Agricultural as is nearly all land adjoining the project. R-l, Single Family Residential zoning is found in Loita's Subdivision and Donalee Addition, to the south; and Agricultural Suburban zoning occurs on property to the east of Evergreen Road. The applicant has proposed R-1 zoning for Belcher's Addition. -If approved, the zoning would be compatible with the R-1 zoning occuring on the south side of Va]ley Way. However, the zone change would be encroaching into an Agricultural-zoned area. This could lead to some land use conflicts until such time as the area develops with additional residential zones. IV. ENVIRONMENTAL REVIEW -An environmental checklist was submitted by the sponsor. This project lies in an area 160' f eet north of Valley Way extending east and west 322 f eet and 683 f eet north and south. Mamer Road lies north and south in the middle of this project ending in a cul-de-sac on the north end. There is a slight roll from north to south but should pnse no problema in reference to surface drainage. It is located over the Spokan-e Valley Aquifer. b. Surf ace soils are classed as Garrison gravelly loam with 0 to 5% slopes. They have a.septic tank f ilter field limitation of slight with possible contamination of groundwater. c. Geologically the soils are glaciof luvial deposits; stream-laid sand and gravel; contains some boulders in places; includes some undiff erentiated glacial deposits.
