FINDINGS AIVTD ORDER REGARDING ZONING MAP PROPOSAL, ZE-18-75 - AGRICULTURAL SUBURBAN TO LOCAL BUSINESS: 'LOWRY WHEREAS, The Spokane County Planning Commission did, after public hearing on May 9, 1975, forward to the Board of eounty Commissioners a recommendation that the Zoning Map not be chariged from the existing Agricultural Suburban classification to the Local Business classification on property described as follows: ' That portion of Government Lot 3 described as follows: Beginning at the W 1/4 corner of said Section 18; thence South 142 feet; thence East 150 feet; thence North 142 feet; thence West 150 feet to the Point of Beginning, except County road rights of way in Section 18, Township 25 N., Range 44, E. W. M., Spokane County, Washington. and, WHEREAS, The applicant before the Planning Commission, John R. Lowry, . through his attorney, Howard A. Anderson, did by letter dated May 16, 1975, request a hearing before the Board of County Commissioners to present evidence and testimony in favor of their application, and Wt3EREAS, The Board of County Commissioners did hold a public hearing on july 3, 1975, to consider the recommendations of the Planning Commission and tes timony and evidence of the applicant and other interes ted parties, and V~rIiEREAS, At said hearing opportunity was afforded those favoring and those opposing the above-described Zoning Map proposal, and the Board of County Commissioners of Spokane County having fully considered the testimony given, the records and minutes of the Planning Commission and all other evidence presented and having personally acquainted themselves with the site and vicinity in question, did concur with the recommendation of the Spokane County Planning Commission, and W"riEREAS, The applicant through his attorneys, Howard A. Anderson and Justin L. Quackenbush, did by letter dated August 29, 1975, request the Board of County Commissioners to reconsider the above-described Zoning Map proposal to allow additional testimony to be presented, and WsiEREAS, The Board of County Commissioners did hold a pubtic hearing on October 2, 1975, to reconsider the zone change action and consider the testimony and evidence of the applicant and other parties, and WHEREAS, At said hearing opportunity was afforded those favoring and those opposing the above-described Zoning Map proposal, and the Board of County Commissioners of Spokane County having fully considered the testimony given, the J • v I recDcus ancl TI11ilULeS ot previous iZearings anu all atiler evidence presentea, anc~ having personally acquainted themselves with the site and vicinity in question, . doQs hereby find: 1) That the site consists of a 13,740 square foot parcel situated on , the southeast corner of Broadway Avenue and Park Road. 2) That the applicant proposed to construct a convenience grocery. s tore on the site. 3) That the property is east of an iridustrial and business area. 4) That the proposed use, namely, a convenience store, is not out of character with the surrounding area. 5) That appropriate provisions have been made to assure compatibility of the project with adjoining properties through preparation of a specific development plan. 6) That an environmental assessment of the project indicates that sufficient mitigating measures have been incorporated into the approved development plan. NOW, THEREFORE, The Board of County Commissioners of Spokane County does hereby conclude that the above-described findings are sufficient and contsolling, and that an environmental impact statement is not required for the described project, . and does, therefore, order that an appropriate resolution to change the Zoning Map from the Agricultural Suburban classification to the Local Business classification be prepared incorporating the following conditions: 1) Installation to Spokane County standards of curb, sidewalk, drainage control, and paving to existing oil along Park Road. Provisions for such installation shall be made prior to release of building permits for the project. 2) Access permits for the advertised property shall be obtained from the Spokane County Engineer's office prior to release of building permits. Access driveways shall conform to the "approved" development plan. 3) The subject property shall be developed in substantial conformance with the "approved" development plan; i, e., a 2,400 sq. ft. store with a self-service gasoline installation and oriented toward Park Road with an 11 car paved parking lot and perimeter land- scaping, 4) The subject property shall be landscaped, planted and maintained in accordance with the "approved" landseape and lighting plan. A 6' high chain link fence with cedar slats shall be constructed along the south and east perimeters of the project to complement the landscape screen. I would, therefore, conclude that the project would not have an appreciable impact on the environment or natural development of the area. (On motion for denial, vote was unanimous. ) BACKGROUrJD: On january 11, 1974, the Commission heard a similar request for the ad- vertised property for a convenfence grocery store. The Commission recommended denial. The matter was subsequently appealed by the appli- cant to the Board of County Commissioners. On Fpbruary 22, 1974, the Board of County Commf s sioners concurred with the recommendation of the ?lanning Commis sfon and denied the zone change request, A. REASONS: 1. The Comprehensive Plan indicates that the propecties east of Park R+oad along Broadway Avenue are appro►pnate for residential uses. The Commission notes that the advertised property is occupied and surnounded on three sides by existing residential development. 2. The Commission is of the opinion that the residential neighborhood lying east of Park Road is adequately buffered from the industriai and mining district to the southwest. The Commfssion concludes that the small business site would be an unwananted intrusion into the residential neiqhborhood. 3. The Commission is of the opinion that there is ample zoning in the vicinity to accommodate Local Business uses. A two and one-half acre (2 1f2) parcel on the southwest corner of Park and Bmadway intersection was zoned Local Business in 1972. The Commission notes that most of the pmpertfes south of Bmadway and west of Park retain zoning classifications which would allow business uses. 4. The Commission has not encouraged the proliferation of Local Busi- ness zoning on either Bmadway Avenue or Park Road.
