In order for this office to undertake an official investigation regarding an
alledged zoning violation in Spokane County, it has been determined by our
statuatory legal counsel that we are -required to act only upon written conn -
plaints, unless an immediate hazard exists. Please fill in the information
requested below and return this form to the Spokane County Department of
Building and Safety. Your complaint will be processed as quickly as possible

around the property.

Dear Mr. Gendron:
The laws and regulations in our society are, at times, difficult to under-
stand and fully comprehend. This is true of zoning ordinances, which are
laws intended to protect and govern the many different uses of land in
Spokane County. It is my responsibility, as the Zoning Investigator, when
the situation arises, to help resolve conflicts involving the Spokane
County Zoning Ordinance.
This office has received reports regarding the storage of unlicensed and
inoperable vehicles on your property, located at East 10714 Maxwell, Spokane
County, parcel number 16542-0423.
A recent visual inspection by our field inspector indicated, we believe, that l
these reports are accurate.
Section 4.04.080 of the Spokane County Zoning Ordinance limits storage in an
Agricultural Zone, in which your property is located, to, "...storage of
those materials normally used in connection with farm and agricultural ac-
tivities. Recreational vehicles, camping vehicles, or boats shall not be
stored in the front yard of any lot used for residential purposes." Inter-
pretations of this section of the ordinance by the Spokane County Planning
Department state that, "...a vehicle must be considered either usable or in
storage. If a vehicle is to be considered usable, it must be licensed and
operable. If both of these characteristics are not present, the vehicle is
not usable and therefore, is classified as storage. Vehicle storage in res-
idential areas shall be screened or enclosed so as to obscure view from
public rights-of-way and/or adjacent property."

We are of the opinion that since you have now been informed of the require-
ments of the Spokane County Zoning Ordinance, a period of 30 days, beginning
with your receipt of this letter, should be sufficient time in which to bring
your property into compliance. Do not hesitate to act upon this important
matter, since a violation of the Spokane County Zoning Ordinance is a misde-
meanor and does carry a penalty. I am sure it is important to you, as it is
to me, that we resolve this situation quickly.

Dear Mr. Gendron:
It has been some time now since we last contacted you regarding the un-
licensed and/or inoperable vehicles stored on your property, located at
E. 10714 Maxwell, Spokane County, parcel number 16542-0423.
A recent visual inspection by our field inspector indicates, we believe,
that you have made substantial progress in bringing your property into
compliance with ordinance requirements since our initial contact by
removing vehicles from the property, however, that you have yet to
complete the process of bringing the property into compliance. Spec-
ifically, unlicensed/inoperable vehicles and miscellaneous materials are
still being stored on your property.
We have tried to contact you numerous times regarding this matter, but
to date,' you have not returned our telephone calls.
As stated in our letter of April 6, 1981, Section 4.04.08 of the Spokane
County Zoning Ordinance limits storage in an Agricultural Zone, in which
your property is located, to, "...storage of those materials normally
use in connection with farm and agricultural activities. Recreational
vehicles, camping vehicles, or boats shall not be stored in the front
yard of any lot used for residential purposes." Interpretations of this
section of the ordinance by the Spokane County Planning Department states

Due to the length of time this matter has been pending, we are of the opinion
that a period of 14 days, beginning with your receipt of this letter, should
be sufficient extension of time for you to complete the process of bringing
your property into compliance with the requirements of the Spokane County
Zoning Ordinance. If these matters are not taken care of within the pre-
viously mentioned 14 days, we will be unable to grant any further extensions
of time and will have no choice but to forward this case to the Spokane
County Prosecuting Attorney's Office for appropriate legal action. A vio-
lation of the Spokane County Zoning Ordinance is a criminal offense and
does carry a penalty of, "...two hundred and fifty dollars ($250.00) or
imprisoned in the County Jail for a term of not exceeding ninety (90) days,
for each offense. Each day that a violation is permitted to exist shall
constitute a separate offense."
Please be advised that this is not a matter that will go away if ignored.
I am sure it is important to you, as it is to me, that we resolve this
situation quickly.
