RE: Final Inspection of Residence - East 7905 Marietta Avenue
Dear Mr. Crosby:
In conjunction with the review of your short plat application
concerning the parcel of property upon which the above -referenced
building permit was issued, it has come to our attention that the
structure's location is not consistent with the setback requirements
of the Spokane County Zoning Ordinance.
The applicable provisions provide that the flanking street setback
shall be a minimum of 45 feet from the centerline of all roadway
right-of-way or 15 feet from the existing property line, whichever
provides the greater setback from the centerline of the roadway
right-of-way. In addition, the front yard set -back is to be a
minimum of 55 feet from the centerline of all roadway right-of-way or
25 feet from the existing property line, whichever provides the
greater setback from the center of the roadway right-of-way.
In reviewing the present location of the above -referenced structure
with the Prosecuting Attorney ' s office and the Planning Director, it
was concluded that the location does not meet these requirements.
At this point in time, with the structure completely built, and
having received no public complaint, it appears inappropriate to
relocate the same or to process a variance application. The
Prosecuting Attorney's Office has determined that another option
available would be the administrative granting of a Waiver of
Violation. This option is authorized under Spokane County Zoning
Ordinance Section 4.25.030(f). Under this option, an Administra-
tive Variance can be granted recognizing the present setbacks of the
structure.
Accordingly, this correspondence should act as official
documentation from Spokane County of the granting of a Waiver of
Violation for the front and flanking yard setbacks with reference to
the location of the structure on the above -referenced property. The
Waiver of Violation concerns the requirements within Spokane
County ' s Zoning Ordinance Section 4.05. 110 (a ). The granting of the
Waiver of Violation would recognize the structure's flanking yard
location to be 15 feet from the existing property line and
approximately 32.5 feet from the centerline of the adjacent roadway

and the front yard to be 30 feet from the existing property line and
approximately 47 feet from the centerline of the adjacent roadway.
In administratively granting this Waiver of Violation, the Spokane
County Department of Building and Safety has checked the structure's
location with the County Engineering Department and has been advised
that the structure's location will create no site distance problems.

hereinafter will act as y our recognition and approval of the granting
of this administrative Waiver of Violation.
