FINDINGS AND ORDER REGARDING ZONING MAP PROPOSALI ZE-19-68
WHEREAS, The Spokane County Planning Commission did, after public
hearing held on June 27, 1968, forward to the Board of County Commis sioners
a recommendation that the Zoninq Map not be changed from the existing
"Multiple Family Suburban" classification to the "Local Business" classifica-
tion on property described as follows;
Lot 1, Block 1 of VVeldon's Subdivision in Section 21,
Town ship 25 N., Range 44, E. W. M., Spokane County,
vlia shington .
and,
vVHEREAS, The applicant before the Planninq Commission, Continental
Plaza, Inc., did request by letter of july 1, 1968, (Signed by john G. Layman
of Turner.. Stoeve, and Layman, Lawyers) a hearing before the Spokane Board
of County Commissioners to present evidence in favor of his application, and,
VvHEREAS, The Board of County Commissioners did hold a public
hearing on August 8, 1968, to consider the recommendation of the Planning
Commission and testimony and evidence of the applicant and other interested
parties, and,
WHEREAS,. At said hearing, opportunity was afforded those favorfng
and those opposing the above-described Zoning Map proposal, and the Board
of County Commissioners of Spokane County having fully considered the
testimony given, the recorde and minutes of the Planning Commission, and all
other evidence presented, and having personally acquainted themselves with
the sfte and vicinity in question does hereby find:
1. That the subject property is presently vacant and undeveloped
and located approximately one hundred ten (110) feet south of an
established commercial buildinq and approximately two hundred
twenty (220) feet south of the Chicago, N~ilwaukee and St. Paul
Railroad right of way. Also, the property is in close proximity
to the Opportunity business district located between Spraque
Avenue and the railroad tracks and would constitute a normal
extension to said business district.

2. That the property in question is bordered on the west by existing
apartment and multiple family residential units which are
customarily located adjacent to business districts, and said
property is proposed to be developed with a Speedee Mart which
will provide food necessities to surrounding residential units.
Development of the property will be controlled in conformance
to Spokane County standards and in a manner which will be
compatible to surrounding residen tial properties and cause
minimal effect to adjacent property.
3. That the proposed reclassification would not constitute a"spot
zone" change since the character of the property to the north is
non-residential.
NO W, T HERE FORE r The Board of County Commi s sione rs of Spokane
County doe s conclude that tha above-stated findings are sufficient and
controlling and does, therefore, order the official Zoning Map of the afore-
mentioned property to be changed from the "Multfple Family Suburban" Zone
to the "Local Business" Zone classification. The resolution establishing the
reclassification shall include the following conditions:
That said property be developed substantially in accordance with the
"Approved" plot plan on file with the applicant's zone change
application in the Spokane County Planning Commission Office. In
parti cul ar:
a) Fencing and Iandscaping indicated on the plot plan shall
be installed prior to the issuance of a"Certificate of
Occupancy" Permit by the Spokane County Building Codes
Office.
b) The off-street parking area shall be paved and installed
in accordance with the approved plot plan.
c) All signs shall be placed flat against the buflding except
for the one sign located in the front yard area as indicated
on the applicant's approved plot plan.

The sign is to be of the size and type substantially as
indicated on the applicant's submitted elevation sketch on
file with his application.

Gentlemen:
t,le are attorneys for Pine Villa, Inc. In behalf of Pine Villa,
Inc., we appeared at the hearing held by the Spokane County
Commissioners on Thursday, August 8, 1968, and presented our
opposition to the application of Continental Plaza, Inc., for
change of zone for the following described real property from
multiple family suburban to local business:
Lot 1, Block 1 of Weldon' s,Subdivision, Section
21, Township 25 North, Range 44, E.W.M., Spokane
County, Washington.
It is our understanding that the County Commissioners have
tentatively decided to reverse the recommendation of the Planning
Commission and grant the application of Continental Plaza for the
zone change. We further understand that this approval is con- ,
diticned upon Continental Plaza filing one or more maps or plans
of tne property showing the location of the proposed buildings
and demonstrating what precautions would be taken to protect the
adjoining owners from interference in the enjoyment of their
properties.

Mr. ~!'usberg of your office informed me by telephone on August 21,
1968, that no formal resolution has been adopted by the Board
of Commissioners authorizing the zone change, and that the approval
nas not been entered in the minutes of the Commission. Mr. Tusberg
furtner stated that the formal resolution would be prepared and
executed after the plans were filed and approved by the Commissioners.

PLAZA Planning Commission Recommendation: Denv for the followinq reasons;
A. Reasons :
1. The Comprehensive Plan indicates high density residential use
(and associated permitted uses) for the area south of the C.M.
St. P. & P. 'Railroad along South Pines Road. In accordance with
that pl,an, this property was included within two plats designed
and zoned for multiple family use. Most other lots vii thin these
plats have irnproved with multiple family structures. The Com-
prehensive Pian designates a major business center and general
commercial area along Sprague Avenue centered at Pines Road and
another busines s center at 1 6th and Pine s Road.
2. This proposal, consisting of a single lot, would constitute spot
zoning contrary and detrimental to the Comprehensive Plan,
surrounding zoning and residential development in the vicinity.
In particular, we concur with objections of the owners of apart-
ments within ll'reldon First Addition that the proposed zoning and
_particular use proposed would be detrimental to the apartment
properties.
3. ti^de do not concur in the contentfon of need for additional busi-
nes s zoning in the vicinity in view of the establi shed zone s at
Sprague and 1 Gth.
