Planning Commission Recommendatfon: ARprove for the followina reasons: A. Reasons: 1. The Planning Commission notes that the property in question was zoned "Local Business" in 1955 at the same time the southeast corner of Pines Highway (S.S.H. No. 3-H) and 16th Avenue was zoned in antiCipation of future businesses serving the n.eighbor- hood. Since 1955, the Opportunity Terrace Plats have developed with substantial sinqle family residences, and the Local Business Zone at Pines and 16th has also been developed. Restricted Residential zoning borders the property on the southwest, Agricultural Suburban zoninq borders on the north, and Agricul- tural zoning to the northeast and southeast. The Comiprehensive Plan for the Valley was prepared in 1960 and indic ate s a neighborhood bu sine s s zone at the Pine s and 16th Avenue intersection only. No nefghborhood business is indicated on the pian for the triangle in question - but rather residential deve2opment is indicated. The subject property was never changed to a residentfal classifi- cation as called for in the Comprehensiva Plan because 1) the property had already been zoned Loca1 Business prior to the making of the Plan, and 2) the property was not deemed good residential property because of its being surrounded by roads on three si de s . 2. The applicant proposes to develop the property with a ten unit (four unft and six unit buildings) two and one-half story apartment building with off-street parkinq sheitered by car ports. Access to the property i s shown from 2 Oth Avenue and South Blake Road. Apparently the applicant can realize a reasonable return from the property with the apartment complex in lieu of hi s opportunity to develop the property commerciallyl if he so wished. The Planning Commfssion is aware of the substantial effort on the part of neighborfng residents to prevent the development of this property for business use. At the February, 1967t hearing a representative of these residents appeared before the Comriission - 14 - (contd. ) . ZE-21-68 - LOCAL BUSINESS TO MUL!EIPLE FAMILY SUBURBAN (contd. ) and requested that the property be rezoned for residentfal use. The Commission at the time advised the representative that the property was already zoned and the initiation o# any zone change would not be effecttve because a building permit could be applied for and i s sued to the property owner prior to any zone change becoming effective. It would appear that the proposed apartment development would be more compatible with surrounding resi.den- tial uses and still allow a reasonable return on the owner's investment which he made relying on tho Local Business zoning.
