WHEREAS, the Spokane County Planning Commission did, after
public hearino held on Nlarch 30, 1907, forward to the Board of County
Commissioners a recommendation that the Zoning Map not be changed
from the existing idiultiple Family Suburban classification to, the
Commercial classification on property described as follows
The north 180 feet of the south 230 feet of the E 1/2
of the E 1/2 of Tract 144 of ppportunity lying in
Section 179 Township 25 Nv, Range 449 E.W.M.

WHEREAS Robert J. '%"cKahna, Attorney for Ervin L. Brown and I

Rmy P. Lackey did address a letter to the Board of County Commissioners ~
dated April 13, 19 67y objecting to the recommendation of the Planning
Commission and requesting a hearing before the Bosrtli of County Com-
missioners on the matter, and, - '
' WtiEREAS, the Board of County Commissioners did hold a oublic ~
hearing on the matter on May 2, 1967 to consider the recommendations
of the Planning Commission9 the objections thereto9 and testimony ~
of any interested persons, and ~

WHEREAS, at said hearing, opportunity was aff orded those favoring
and those opoosing the above described Zoning Map proposal, and the i
, Board of County Commissioners having fully considered the testimony
biven, letters of interested parties, the records and minutes of

personally acquaihted themselves with the site and vicinity in

Dear Sirs
For more than twenty-five years, the owner's of property north of Sprague
Avenue, between Farr Road and University, have opposed commercial and
local business zoning
The Spokane County Planning Commission, organized to assist the Spokane
County Board of County Commissioners, has denied the petition for a spot
zoning for local business at Sunderland and Sprague Avenue in Spokane
Valley and zoned it as Multiple Family Suburban, specifying that it should
not be commercial, industrial, restricted-commercial, nor local business
We who live in this area agree with the findings of the Planning Commissiorb
Their comprehensive planning, surveys, and analyses have promoted a sta-
b1e economy and provided us a pleasant place in which to live We believe
that this proposed spot zoning is not in harmony with the purpose and intent
of the general plan for the physical development of this district, so wish to
retain the Multiple Family Suburban clas sification
The proposed local business zoning would adversely affect the health, safe-
ty and general welfare of residents in this area It would be detrimental to
the use or development of adjacent properties in the general neighborhood
We do not believe in the establishment of running ribbons of business zones
along our major thoroughfareso This practice sets the stage for traffic
strangulation Mr Robert Parker, Assistant County Road Engineer, has
stated that this already has presented a major problem in traffic safety and
direction
On Sprague Avenue at Walnut Road ls a restricted residential zone You
will recall the bitter fight that resulted in that zoning restriction You
could not expect these people on Walnut Road and surrounding areas to look
favorably on a local business zoning just 120 feet away
We are deeply appreciative of the community growth guidance afforded us
through the years by the Spoka.ne County Planning Commission and its able
directors and planners. We..believe our district boundaries should be care-
fully maintained
We are adequately and conveniently serviced by a wide variety of comerc-
ial establishments, such as the University Shopping Center, the Dishman
buszness district, and the variety of businesses on the south side of Sprague
We have many drug stores and a wide variety of drug store items are to be
found on the shelves of all super markets, variety stores and grocery stores
Since most of us cannot be present at the special hearing May 2, 1967,
to be held for the purpos e of hearing the appeal of Brown and Lackey,
pertaining to the proposed zone change, 2E-21-67, from Multiple
Family Suburban to Local Business, we appreciate this opportunity to
present our views by mailo _

You are scheduled at 11:00 o'clock A.M. on Tuesday, May 2,
1967 to hear an appeal by Brown and Lackey seeking to
change the recommendation of the Spokane County Planning
Commission denying a zone change from Multiple Family
Suburban to Local Business on the northeast corner of
Sprague Avenue and Sunderland Road in the Spokane Valley,
Planning Commission file ZE-21-67.
On March 20, 1967 I wrote to the Planning Commission in
regard to this matter and I request that you consider that
letter together with this letter in regard to the appeal.
Zoning recognizes that all economic aspects of our community
must be served. It also recognizes that these activities
can best be served by separating and having like activities
located together. This, of course, means that at some point
you must change from one zone to another zone. Z'he argument
that because the area adjacent is of a less desirable zone
you should therefore reduce the zone in the adjacent property
to the less desirable zone is not valid. You do in fact
merely move the border so another assault can be made on the
next adjacent more desirable zoned property. This erosion
of our zoning destroys value and stability of our homes.
I urge the commissioners to follow the general plan of the
Planning Commission and confine the commercial activity to
the area south of Sprague Avenue and north of the railroad
tracks. Such a ruling will maintain the homes to the north
of Sprague and satisfy the commercial needs of our community.

owners on both sides of vValnut Road, between Sprague and Valle,;
'Way, who have repeatedly opposed busine s s zoning of any type
near their singie family residential street. The Planning Commis -
sion is of the opinion that the er,isting zoning classification,
MultiplP F3mily Suburban, should be maintained, and that the
property could be developed by business uses allowed in the
present class3fication.
2. Surrounding land use i.s as follows: To the west across Sunder-
land Road - a doctors' clinic; to the north - three new dup.lex
units; to the east - single family residences; and to the south
across Sprague Avenue - professional offices. It is reasonable
to expect that the Sprague Avenue frontage at Sunderland Road
could develop, as it has on the northwest corner, with a pharmacY
operated in coniunetion with a medical or dental clinic, but not
as a full range drug storc3 as lpermitted in the Local BusineCs Zone.

Dear Sirs:
I would like you to refer to the proposed zone change re-
quested by Brown and Lackey for the corner of Sprague and
Sunderland Road. The petitioners propose to change the
zone from Multiple Family Suburban to Local Business. The
hearing on this application is set for Thursday, March 30,
1967.
Mrs. Giboney and myself request that this zone change be denied.
Five months ago, at the request of all of the property owners
except one, you upgraded a 22 acre area immediately adjacent
to this proposed zone change from Multiple E'amily Suburban
to Restricted Residential. This was a strong statement by
the property owners in this area that they want no further
erosion of the zoning under which they established their homes
in this area.
It is my understanding that it is the general plan of the
commission that the business activity be confined to the area
between Sprague Avenue and the railroad tracks to the south.
It is our feeling that the proposed drug store should be
located in that area. The present zoning would allow the
establishment of inedical and dental clinics at the proposed
site so the proposed professional offices would not require a
change in the present zoning.
Trhe proposed zone change is not necessary to provide a location
for this business activity. The refusal to change the zone
would not work a hardship on either the petitioners or their
potential customers.

Gentlemen:
This letter is mitten in regard to the proposed change
of zoning on the N.E. corner of SunderlQnd & Sprague in
the Spokane Valley.
First, let it be understood that we are against a zoning
change enywhere betWeen Farr Rd. - and the fire-station.
This has been an understanding Por rnany years on thia side
of the street, an understanding given to us by the County
Planning Board in the County Court House. Ibave personally
been told that thie sontng would never be ahanged.
I am certainly not against a nice looking building on that
corner and would be willing to agree to the following con-
ditions :
1. Simply a variance be granted to build a
drugstore. No zoning change.
2. That a brick vaneer building be built.
3. That the set-back from Sprague would be
at least as Par as our building (N.tiR.
corner of SunderlAnd. )
'.7e have worked and spent a great deal of money tu make our
section of Sprague attractive. We would hope that this
entire area► mentioned previously could be kept as attractive.
Sprague as a zPhole is an unattractive hodge-podge of mixed
zoning and this is one of the few remaining areas where some
planning could be carried out.

The only "cb jection" heard was fror, Dr. 13el'%.r.ap as seen
in, the attached letter, wYierein he states a"variance" is
acceptable to him but a,zone change is not. Our only interest
is to obtain legal qualifications on the property to build
the drug store. The zoning is already adequate for the prc-
poseci professional units and whether a"variance" or zone
cnange is issued is purely academic from our standpoint. The
setback and building requirements as stipulated by Dr. Belknap
are, (while probably not anything we cannot live with), some-
thinE far better determined by the zoning requirements,
architect, costs, and owners, rather than the neighbors.
The proposed project represents a substantial invest-
n:ent by tne parties involved, and would be a prominent 2dc~-1-
tion to the area alre2dv somewhat devel^ced intc a pro-
i'essional atmosphere.
