Spokane County Planning Commission seeking a zoning change of certain
designated real property from Multiply Family Suburban to a restricted
residential zone, said property being described as follows
Lot 1, Block 1, except the north 525', the south 130'
of Lot 2, Block 1 and all of Blocks 6 and 7 in
Opportunity, Plat 3, Spokane County, Washington,
except the south 2 of Lot 5 of Block 6 and except
the west 109' of Lot 5 of B1 ock 7
AND, WHEREAS, the undersigned petitioner is the awner of
certain real property within the above described area and opposes said
zoning change with respect to the praperty owned by him for the reasons
as stated in his affidavit filed herein and attached hereto, said property
being described as
North 2 of Lot 4, Block 7, Opportunity Piat 3,
Spokane County, Washington
NOW, THEREFORE, fihe petitioners, Larry Guthrie and Mary Ann

says• That he is the owner of the North 2 of Lot 4, Block 7, Opportunity
Plat 3, Spokane County, Washington, tfiat there was filed before the
Planning Commission of Spokane County, Washington, a petition on November 19,
1965, wherein petitioners sought the change of zontng map of
Lot 1, Block 1, except the north 525', the south 130'
of Lot 2, Block 1 and all of Blocks 6 and 7 in
Opportunity, Plat 3, Spokane County, Washington,
except the soufih 2 of Lot 5 of Block 6 and except
the West 1091 of Lot 5 of B1 ock 7
from a"Mul t i pl y Fam i 1 y Suburban" zone to a"Restt-i cted Res ident i al Zone",
that included in proposed zoning map change is the property of affiant as
aforesaid, that affiant is opposed to the change of the zoning map as concerns
his real property and destres that the said property, of which he is the
owner, remain as " Multiple Family Suburban Zone", that affiant purchased
the said property in good faith and in reliance upon tfie present zohing
thereof, that on July 9, 1964, affiant was assured by Charles L Huggins,
Director of Planning, Spokane County Planning Commission, Spokane County,
Washington, that sard real property was zoned "Multiple Family Suburban",
and that said zone permitted apartments of the type proposed by affiant,
that affiant has expended approximately $15,000 00 in costs and expenses
necessary to the acquisition of the land, preparing necessary architectural
and engineering plans and speciftcations for the erection of an aparfiment
house on said reat property, that said letter from Charles L Huggins is
attached hereto and made a part hereof as Exhibit 1, that on November 23,
1965, affiant applied for building permit, paying the f ee thereon, to build
a sixteen unit aparfiment house on said real property, that on Decem ber 1,
1965, a building permit was issued, a copy of which is attached hereto and
made a part hereof by reference as Exhibit 2, that failure to exclude affiant's
praperty from any contemplated zoning change would cause extensive damage

, Assessor's records, the properky dimensions are 123.12 ft. by, 301.28 ft for a total square footaqe of approximately 37, 094 square feet. On this size property an apart-
ment structure containin,q up to eighteen units might be constructed provided that not
over 35 percent of the ground area were cavered by such apartment structure and sub-
sidiary structures such as garages, eta.

contain eighteen apartment unita would fall within these qtandaLrds The ordinance, also
