Laws and regulations in our society are, at times, difficult to
understand and fully comprehend. This is true ot zoning
ordinances, which are laws intended to protect and yovern the
many di fferent uses of 1 and i n Spokane County. It is my
responsibility, as the Loniny Investiyator, when the sltuation
arises, to helN resolve contlicts involviny the Spokane County
Zoning Ordinance.
This office has received reports regardiny inadeyuate customer
; parkiny fior Fairplay Motor Company, located at East 11619 Sprague
~ Avenue, Spokane County, parcel number 16544-0514. This property
1s zoned Commercial. N recent visual inspection by our field inspector 7ndicated, we
believe, that these reports are possibly accurate. There
appeared to be no designated customer parkiny.
Currently, Section 4.10.095 of the 1984 Spokane County Zoning
Ordinance requires off-street parkiny to be in accordance with
Chapter 4.17. #Speci fical iy , Section 4. 17 .061 (m ) requi res one (1)
space for each two hundred (200) square feet of yross floor area.
Further, Section 4.17.062 requires, "Each off-street parking
space shall have an area of not less than one hundred and eiyhty
(180) syuare feet excl usi ve of dri ves and ai sl es, and a width of
not iess than nine (9) fieet. Each such space shall be provided
with adeyuate inyress and eyress."
Upon further examination of our records, it would appear that no
"change of use" perrnit has been reyuested or issued through this
department. Such permits are reyuired whenever any chanye is
made in the character or occupancies of any buildiny as per
Section 5U2 ot the Uniform Bui1diny Code.
Section 304 of the Uniform Building Code reyuires that a double
fee be charyed whenever any work for whi cfi a permit is reyuired
has commenced without tirst obtaininy such Nermit.

Dear Mr. Davis:
This will acknowledge receipt of your letter of April 3, 1984,
directed to F'airplay Motor Company, East 11619 Sprague Avenue,
Spokane, Washington, concerning alleged violation of the Spokane
County Zoning Ordinance.
It is requested that you contact my office, at your convenience by
telephone at 624-4355, so that we may make an appointment to meet
at the property of the Fairplay Motor Company, and you may explain
to my client and myself the corrections necessary to meet the
alleged complaints inade by GMP Properties, 521 Shoreline Drive,
Liberty Lake, Washington, 99019. In view of the fact there
appears to be no such violations in the terms and conditions of
the Lease Agreement between Fairplay Motor Company and the current
lessors, GMP Properties are using evey means to constructively
evict my clients from their vested possessory interest in these
premises. I do not think Spokane County should be a party to the
lessor's harassment.
In the eventlyou are unable to meet us at the property in ques-
tion, it is requested you advise this office, specifically in
writing, what are the deficiencies in which my clients are alleg-
edly in violation of the Spokane County Ordinance, as contended by
GMP Properties.

to the approval by the Board of Cbunty Ccemssioners in Nlay of 1978, specl.fic-
ally Condition #4 whexein thre following is stated:
"That porti.on of the advertised groperty lying north of Riverside
Avenue shall be restricted to the Ccmmercial use as proposed. In
the event that the proposed mabil.e hane, nndular hoane sales lot is
mt developed or is di.scontznued, that portion of the advertz.sed
property shall revert tA the existing Agricultural Suburban Zone
classificat.i.on.

T'he file indicates that anti.cipated use of the subject promrtv lyi.nq north
of Main Avenue was for the pwrpose of a modular/manufactured home sales lot.
Thwse plans have mt as yet materialized. The ryronerty oontlnues to remain
vacant and, therefore, m violati.on of the specific con,clition of approval
by the Board of (bunty CarYnissioners is judged to exist on the subject site
lying mrth of Main Avenue.
The property ovmer has provided a cyclone fence with slats for the purpose
of screening his use of the property frcam ad3acent propertX uses. The

alleged storage of junk on the subject site at the tire of my site inspection
consi.sted of mmimsn materia].s to uvclude one pickup truck, one canopy, and
one older vehi.cle. These oouLd be said to be a part of the R-V Sales lot an,d
are found to lie south of Main Avenue.
In closing, I find the subject propert-y tA be i.n substantial oonfonmance wnth
the submitted develognent plan, although mt fully developed to the eXtent
anta.cipated. I further find the use of the property mt to be in violation
of the Zonuq Ordinance. And, I also rea].ize that the awner of the property
could use the property to a more intensive sales displa.y yard whi.ch he has
nat dane at the present tinre.
As always, ths.s detennination by the Zons.ng Adn.inistrator i.s appealable to the
Hearing F~~mliner Camittee withi.n twenty (20) ciays fresn the date of this letter.
There is an appeal fee of $75.00, anrd upon recei.pt of both appeal and fee, a
public hearing wil.l be scheduled to review ttil.s issue. That is rbot to say
that future developnnt of this site will mt be reviewed by the Planning
D t; that in fact,l.s a oontinuing effort with each building peYmit
appl.icati.on.

Dear Irwin:
This morning I had a conference with Mr. Jaries Johnson of
the Spokane County Planning Commission ancl I reviewed with
him the new landscaping plan.
Mr. Johnson will apprc,vre the new plaii, sub]ect to the followinq
changes:
1. A cliainlink fenciny alonc7 the east and west property
lines, plus be of the "sight olascuriny" type . This includes
slats or "yrape stick" bein9 inserteci iii the Fence to make it
s i gllt obscurinrJ.
2. The trees to be installed on the nQ.rth property
line must liave a minimum heiyht of F' when installecl. This
landscapiny must include a permanent water supply for the trees,
either by way of a trickle or aprinkler system.
Mr. Johnso;i was still insistent upon a Surety Perforrlance Bonci
or a Cash Bond to guarantee the improvements beforP he would
agree to the release of building permits. I did yet him to
agree that if the sight obscuring chainlink fence caas installed
at this tiMe alony the east and west property lines to a line
even with the intersection oF Riverside 1lvenuE:, that he would
agree to release building perraits on the south portion of the •
property under a further stipulation that no property, either
real or personal including mobile homes would be placed on
the north portion of the property until the landscaping, as
shown in the new plot plan, was installed. I think this is ta
your best interests and wotilc3 avoid the cnst of the Bond.
I would suc1gest that you i»ne-alately pr-oceed wtth the insta] tat_ion
of the chainlink fence on laoth sides ot the south portion of
the property, at least to Kiverside 11vonue. As soon as that is

Since I k-as involved in the zone change proceedings, W. Schubach has asked ~
me to reply to yaur letter. I, likeWi.se, would svggest that you discuss this
Lnatter with W. Enaci.o, who is coriversant with the facts. i
Your letter of Septenber 14, 1978, alleges that the property is currently zaned
agricultural suburban. Zhis position is evidently based upon the fact that
certain alleged conditions have not been couplied with. While I do not wish
to argue that position, I do rnt agree with the same.
Please be advised that several manths ago, W. Schubach, through a local sign
coupany, mde applicatian for a building permit to erect the sign on the sub-
ject property along Sprague Avenue. It was necessary for W. Schubach to have
the sign installed before he could proceed with the gaving of the property.
That sign pernutt, to date, has not been issued, and as such, W. Schubach has
been delayed in proceeding with the Pavixg inprwezmts. I am svre that it is
W. Schubach's intent and desire to proceed with the ccupletian of the inwrove-
ments as specified by the Board of County Coamri.ssioners, hotiaever, he is being
prevented as above-indicated.
In order that I may further adivse W. Schubach in this matter, I will appreciate

County Commisstoners have placed a condition of approval which

NOW, THEREFORE, the Board of County Commissioners of Spokane County
does hereby conclude that the above-described findings are sufficient and controlling
and does, therefore, order that an appropriate resolutton to change the Zoning
Map on the above-described property from the Multiple Family Suburban and
Agricultural Suburban classifications to the Commercial,classiftcation to be presented
to the Board at such time as the below-ltsted conditions have been met:
r.- 1. Approval of access by the Spokane County Engineer's Office prior
to release of building permlts. NOTE: All access to the site shall
be restricted to Sprague Avenue.
2. Relocation of the west curb cut along Sprague Avenue to Spokane
County Eng ineer' s requ irements ,
3. The descrtbed property shall be devetoped tn substantLal conforma zce
with the apprvved devleopment plan .
4. That portion of the advertlsed property lytng north of Rlverstde Ave.
shall be restricted to thz Commerctal use as proposed. In the event

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Dr. Thomas R. Pelley, East 11619 Sprague Avenue, Spokane, Washington 99206
for the above captioned zone change, and
The Board having received the recommendation of the Spokane County
Planning Commission to deny subject zone change, as set forth in the
minutes of the Planning Commission dated May 20, 1977, and
The Board having conducted its own public hearing on July 21, 1977, at the
request of the applicants Dr. Thomas R. Pelley and Irene Pelley, his wife,
through their Attorneys Howard A. Anderson and Justin L Quackenbush, and '
after visiting the site and reviewing the testimony, and
The 6oard being fully advised in the premises did determine, based upon
, the testimony submitted at the public hearing and other evidence available
to the Board to approve zone change ZE-64-77, Multiple Family Suburban and
Agricultural Suburban to Commercial, subject to the usual conditions to
be developed and recommended by the Planning Staff and subject to the
further condition that in the event the property north of Riverside and
south of ilain Avenue ceases to be used as outlined in the deveiopment
plans submitted by the representatives of Dr. Pelley, the zoning will
revert to its current status.
The Board also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Nonsignificance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter

As you know, the undersigned and attorney Howard A. Anderson
represent Dr. Thomas R. Pelley and Mr Erwin Schubach, the
applicants in t he above entitled matter.
This letter will confirm our discussion that the applicants
are willing to have a condition added to the zone change to
commercial to provide that that portion of the subject pro-
perty lying North of Riverside Avenue will be used only for
modular home demonstration units. As I am sure you are aware,
these modular homes are substantial homes and the utilization
of this Northern portion of the property for the location of
models only would seem to me to be completely compatible with
the uses being made of the adjacent property Certainly,
modular homes would be more compatible with the surrounding
property uses than would be a multiple family use The
applicants are willing to stipulate that in the event anq
use of this Northern portion of the property is proposed far
other than modular home demonstrations that such a use could
take place only upon the approval of the Spokane County
Planning Commission and the Board of County Conimissioners.

IntroductiQn: The State Environmental Policy Act of 1971, Chapter 43.21C, RC'+N,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals, The Act also requires
