THIS MATTER, being the consideration by the Board of Commissioners of
Spokane County, hereinafter referred to as the "Board," at the request of the Spokane County
Planning Department and after consultation with the applicant, of the Spokane County Planning
Commission's recommendation to a previous Board of County Commissioners on
September 16, 1977 to approve zone reclassif'ication ZE-129-77 LOCAL BUSTNESS to
COMMERCIAL for the purpose of developing retail shops and offices, hereinafter referred to
as the "Proposal"; and the previous policy of the Board of County Commissioners of not
finalizing an approved rezone reclassification unril all condidons have been met; and the current
Board of County Commissioners, being desirous of recognizing the previous Planning
Commission's recommendarion as approved by the previous Board of County Commissioners
and finalizing the rezone; and accordingly, it is necessary to convert the previous approval
subject to conditions being met prior tofinalization to approval subject to conditions being
met, does hereby make the following:
FINDINGS OF FACT
1. The proposal is generally located at the northeast corner of Barker Road and LaBerry
Legal description: Lot 3,
Drive in Section 17-25-45. Tax parcel number: 17553-2607.1
Block 7, LaBerry Mobile Park, except the east 32 feet. 4&; -g -85
2. The proposal consisted of a zone reclassification to Commercial on an approximate
one-half-acre site for the purpose of developing retail shops and offices.
3. The previous Spokane County Comprehensive Plan Map, which was in effect in
1977, ind.icated the area as suitable for residenrial development with a commercial area
appropriate somewhere at the intersection of Barker Road and Appleway.
4. The provisions of RCW Chapter 43.21C (State Environmental Policy Act) have been
complied with, and, in fact, the Chainnan of the previous Board of County Commissioners
signed a Final Declaration of Nonsignificance on October 11, 1977.
5. The Spokane County Planning Commission held a public hearing on
September 16, 1977 concerning the proposal, subsequent to which, by Findings dated
September 16, 1977, they recommended approval of the rezone to the Board of County
' Commissioners, subject to specific conditions of approval. The Planning Commission stated
the reasons for their recommendadon as follows:
"The applicant's proposal is compatible with surrounding land uses; is
consistent with recent Planning Coinmission Zone reclassifications; is
consistent with the Spokane County Comprehensive Plan; has or can
provide adequate provisions for circulation, sewage disposal, water and
fire protecdon."
6. The present Board notes that it was customary practice in the past for Boards to take
no action on finalizing rezones until all cond.itions of approval were met; primarily the
dedication of road right-of-way. Subsequent procedure by the Board allowed zone changes to
be finalized and recorded immediately by resolution. Conditions of approval (including right-
of-way dedications) were left to be complied with at the time a building pernut was requested.
These same procedures are currently being used in rezone matters.
, 7. The Board notes that all conditions of approval recommended by the Planning
Commission must be met at the time a building perrnit or use is requested for the site.
8. Inasmuch as the action of the Board of County Commissioners herein is an
administradve action, no formal legal advertising was required; however, the applicant was
advised of the action.

From the foregoing Findings, a review of File No. ZE-129-77 and a review of the
Planning Commission's recommendarions of September 16, 1977, the Board hereby
APPROVES the rezone, subject to those conditions recommended by the Planning
Commission:
CONDITIONS
1. Dedication of a twenty (20)-foot radius at the southwest corner of the site (northeast
corner or Barker and LaBerry Drive).
2. Improvement of Bazker Road along the project perimeter to Spokane County
standards. Improvements sha11 include curbs, paving to exisring pavement and
drainage control.
3. Access pernuts for the advertised property shall be obtained from the Spokane
County Engineer's office prior to release of building permits for the project.
NOTE: Barker Road access drive, located approximately 25 feet south of the site's
north property line, shall be relocated further to the south.
4.. The advertised property shall be developed in substantial conformance with the
development plan on file with this application.
5. Any portion of the project which is to be occupied or traveled by vehicles shall be
maintained in hard-surface paving.
6. An on-site storm drainage system for the project shall be approved by Spokane
' County Engineer's off'ice.
7. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to Spokane County Zoning Administrator shall be submitted for the project
° prior to release of building permits.
8., The applicant shall provide a performance bond to cover the cost of required
landscaping.
9. Installation of fire hydrants in accordance with the requirements of the Spokane
Valley Fire Marshal.
10. Sewage disposal shall be approved by the Spokane County Health District.

THIS MATTER, being the consideration by the Board of Conwaissioners of
Spokane County, hereinafter referred to as the "Board," at the request of the Spokane County
Planning Department and after consultation with the applicant, of the Spokane County Planning
Com,mission's recommendation to a previous Board of County Comrrussioners on
November 14, 1975 to approve zone reclassificadon ZE-56-75 AGRICULTURAL to
COMMERCIAL for the purpose of developing a grocery store and general building supply
store, hereinafter referred to as the "Proposal"; and the previous policy of the Board of County
Commissioners of not finalizing an approved rezone reclassificaaon until all conditions have
been met; and the current Board of County Commissioners, being desirous of formally
recognizing the previous Planning ComrYUSSion's recommendarion as approved by the previous
Board of County Commissioners so that the rezone can be finalized; and accordingly, it is
necessary to convert the previous approval subject to conditions being met prior to finalization
to approval subject to conditions being met, does hereby make the following:
FINDINGS OF FACT
1. The proposal is generally located north of and adjacent to Appleway, approximately
600 feet west of Michigan Road and 850 feet east of Barker Road in Section 17-25-45.
Tax parcel number: 17553-0615 and portion of 17553-0611. Legal description: The east 144
feet of Lot 9, Block 5, Corbin Add.ition to Greenacres, except the north 150 feet thereof.
Also all of L,ot 15, Block 5, Corbin Addition to Greenacres, except county road right-of-way.
2. The proposal consisted of a zone reclassification to Commercial for the purpose of
developing a grocery store and general building supply store.
3. The previous Spokane County Comprehensive Plan Map, which was in effect in
1975, indicated the area as suitable for residenrial uses with a commercial area appropriate near
Barker Road and Appleway.
4. The provisions of RCW Chapter 43.21C (State Environmental Policy Act) were
complied with by the Spokane Counry Planning Commission in their review and find.ings of
November 14, 1975.
5. The Spokane County Planning Commission held a public hearing on
November 14, 1975 concerning the proposal, subsequent to which, by recommendaaon dated
November 14, 1975, they recommended that the Board of County Commissioners approve the
proposal, subject to specific conditions of approval.
6. One of the Planning Commission's condidons (No. 2) stated:
"Prior to resolution by the Board of county Commissioners, the
unauthorized storage building encroaching into the Agricultural zoned
pordon of the ownership shall be either removed from the premises or
rclocatcd to a Commercial zoned portion of thc ownership."
The above cond.ition was in reference to a building on the applicant's ownership. However,
the- 1,320-square-foot building was not located on the descnbed rezone site. Because of this
condition, the resolution adopting the rezone was never forwarded to the Board of County
Commissioners for their final action.
7. The applicant ind.icated by letter of July 14, 1988 that the building was removed;
probably before January 29, 1976. A site inspection and research has revealed that, in fact, the
building no longer exists on the property.
8. Since the building in question has been removed and therefore the cond.ition satisfied,
the current Board of County Commissioners is in a posidon to finalize the rezone subject to
' specific conditions of approval.

9. The Board of Counry commissioners notes that the Planning Commission made the
following find.ings in their November 14, 1975 recommendation:
"a. The request is an expansion of the established commercial
development to the west. , In 1974, the Commission approved a
similar expansion proposal for the Staley operation and imposed
similaz condidons.
"b. The site is situated on Appleway, a major arterial. The site is
effectively separated from neighboring residential properties to the
south by the Milwaukee Roads tracks. A 150' strip has been retained
along Main Avenue for a buffer between the commercial uses
established on Appleway and the established residential neighborhood
north of Main Avenue.
"c. The site is situated within an urbanizing area. The zone change
proposed would not have any greater effect upon the topography,
geology, biological and botanical characteristics, atmospheric and
aquatic condidons, and other natural development than similar uses
established along Appleway. The Commission, therefore, concludes
that an environmental impact statement is not required for the project."
10. The Board notes that all conditions of approval recommended by the Planning
Commission must be met at the time a build.ing pennit or use is requested for the site.
11. Inasmuch as the acdon of the Board of County Commissioners herein is an
administrative acaon, no formal legal advertising was required; however, the applicant was
advised of the action.
From the foregoing find.ings, a review of File No. ZE-56-75, and a review of the
Planning Comrnission's recommendation dated November 14, 1975, the Board hereby, in
APPRO VING the rezone, does attach the following conditions as reflected in the Planning
Commission's recommendation:
CONDITIONS
1. Access pernzits for the subject property shall be obtained from the Spokane County
Engineer's office prior to release of building permits.
NOTE: In conjuncdon with such access permits, the Spokane County Engineer's
office may require physical delineation of the access points.
2. Installation of fire hydrants in accordance with the requirements of the Spokane
Valley Fire Marshal.
4. A six (6)-foot slatted cyclone fence or other fence acceptable to the Director of
Planning shall be constructed along the north boundary of the Commercial zoned
parcel within sixty (60) days of issuance of any building permit for the advertised
parcel. Failure to construct such fence within the dme period specified shall be
considered grounds for suspension or revocadon of any such building permit.
'S. All storage areas within the ownership shall comply with Section 4.10.110 of the
Spokane County Zoning Qrdinance within sixty (60) days of occupancy of the new
addidon. ~

• FINDINGS OF FACT
1. The proposal is generally located east of and adjacent to Pines Road,
approximately 150 feet north of Vailey Way In Section 15-25-44. Tax parcel
numbers: 15543-1704, 1705 and a portion of 1726. Legal description: The N 90' of
the W 130.72' of the S 1/2 of Block 117, Opportunity; the W 130.72' of the S 1/2,
except the N 90' and except the S 133' of Block 117; and also the E 115.72' of the
W 246.44', except the S 133' of the S 1/2 of Block 117.
2. The proposal consists of a zone reclassification to Local Business on an
approximate .99-acre site for the purpose of developing offices.
3. The previous Spokane County Comprehensive Plan Map, which was in effect
In 1978, designated this area as appropriate for residential development.
4. The provislons of RCW Chapter 43.21 C(State Environmental Policy Act)
have been complied with and, in fact, a previous chairman of the Board of County
Commissioners signed a Final Declaration of Nonsignificance on July 18, 1978.
5. The Spokane County Planning Commission held a public hearing on June 16,
,1978, concerning the proposal, subsequent to which, by Fjndings dated June 16, 1978,
they recommended that the 6oard of County Commissioners approve the rezone to Local
6usiness subject to speclfic conditions of approval.
6. The Board of County Commissioners formally accepted the Planning
Commfssions recommendation on July 6, 1978, and concurred In the recommendation to
approve the Local 6uslness rezone. However, as was ihen customary, the Board took no
action on finalizing the rezone until all conditions of approval were met, primarily the
, dedlcatlon of road rlght-of-way. 5ubsequent procedure by the Boerd allowed zone
changes to be finalized and recorded immediately by Resolution. Conditions of approval
(including right-of-way dedication) were left to be complied with at the time a building
permit was requested. These same procedures are currently being used In rezone
matters.
7. It appears that the condition of approval delaying the finalization of the zone
was an engineer's condition requiring the dedication of additional right-of-way along the
nonh boundary of the site. In recent contacts with the County Englneer, it was felt that
the dedication of additional right-of-way could be obtained at the time a building permit
was requested. The zone should be finalized with c4nditions of approval suggested by the
Planning Commission in 1978.
8. The current Board finds that the failure to finalize this zone was ihrough no
fault of the applicant but simply a change in County procedure (streamlining the method

by which zoning is finalized) that resulted in oversight of this matter. The current
Board Is now desirous of finalizing this rezone through appropriate resolution consistent
with the Planning Commissioner's recommendation and the previous Board concurrence.
9. Inasmuch as the action of the Board of County Commissioners herein is an
administrative action, no formal legal advertising was required; however, the applicant
was advised of the action.
From the foregoing Findings, review of the Planning Commission's recommendatlon dated
June 16, 1978, review of the Board's Resolution #78-890 dated July 6. 1978, and a
review of File No. ZE-68-78, the Board hereby APPROVES the rezone subject to the
following conditions of approval.
CONDITIONS
1. Improvements shall be in substantial conformance with the plot plan on file with
this application.
2. The applicant shall comply with rules and regulations of the Health District in
providing for adequate sewage disposal. AIl necessary permits shall be obtained
. from the Health District prior to building permit issuance.
3. Mains and hydrants to be installed, if needed, in accordance with the Spokane
County Fire Marshal.
4. All required lmprovements shall be built to meet or exceed minlmum County
construction standards.
5. Applicant shall dedicate the North 14' of the advertised property for right of way.
6. Applicant shall construct curbs and pave right of way to meet existing pavement.
7. Applicant shall obtain approval for on and off-site drainage plan and access
permits before issuance of building permits.
8. Applicant shall obtaln all necessary access and constructlon permits from the
Department of Transportation for any improvements on Pines prior to issuance of
building per its.

Thls project ts located in gn area wtth soils classlfied by t;ie Soil
Conservatton Service as suitable for installat[on of indlvidu 3i
, on--s[te sewage disposal syskems. The area ls, however, located
over the Spokan e Aquifer. A study ls currently under way to determtne
the degree to which subsurface disposal of sewage treatment
effluent may pollute the Aquifer. There ts very little probabllity
that this project in Itself will have more than a sliqht tmpact on the
Aquifer. However, taken in conjunction with the overall urbanization
of the area, some other sewage dlsposal method wtll most ltkely
be required in the future.
From an environmental health viewpotnt the project appears feasible.
An orl-stte sewage management ptmn pursuant to WAC 248-56-070
may be required dependant upon final design dwelling unit density
or total sewage flow per day.
