and in so approv.ing, adopts the Staff's findings as the Planning Commission's
'Findings of Fact as well as the conditions stated in the Staff's findings, and
that a Final Declaration of Non-Significance be issued, and to delete the
requirement of the County Engineer's Office that the applicant shall dedicate
10 feet on both sides of Adams Road for right of way as the dedication has

This being the time set by the Board of County Commissioners of Spoicane
County, Washington, to render its decision concerning the request of
lJilliam V. Hillstead, East 13701 Sprague Avenue, Spokane, GJA 99206
for the above captioned zone reclassification; and
The Board having received the recommendation of the Spokane County
Planning Commission to deny subject zone reclassification as the motion
for approval lacked a quorum vote of the Planning Commission; and
The Board having conducted its own public hearing on August 24, 1978, at the
request of the Applicant, Mr. Hillstead, and after visiting the site and
reviewing the testimony; and .
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the recommendation of the Spokane County Planning
Commission to deny said application.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the 8oard's action in this matter.

Meeting and would comment on the following items.
ZE-141-77 & ZE-71-78
This office would not oppose the rezoning of these parcels but would advise the
applicants that future controls on Sign Route 27 (Pines Road) could restrict access
to right turn only movements along Sign Route 27. This office would also advise
applicants to consider all access onto Pines via existing county road system
inasmuch as the multitude of present accesses have caused traffic operation
problems. If unable to comply with this restriction, all access onto Pines must
be applied for through the Department of Transportation. .

MINUTES OF THE SPOKANE COUNTY PLANIVING COMMISSION HEARING OF
MARCH 17, 1978 e . .
WHEREAS, the Spokane County Planning Commission did hold a public _
meeting on March 17, 1978 to consider the testimony and requests of several
applicants, objectors and other fnterested parties concerning the below referenced
zone reclassifications and ather items of business, and
WHEREAS, at said hearing opportunity was afforded those favoring and
those opposing all items of business, and
. WHEREAS, Mc. McCoury, Mrs. Byrne, Mrs. Rawlings, and Messrs.
Kennedy, Quigley and Thomas were fn attendance and constituted a quorum, and
WHEREAS, the Spokane County Planning Commission fully considered the
testimony given, the environmental review, and all other evfdence presented,
recommends to the Board of County Commissioners the following:
1. ReQuest by Boundary Review Board for Policv on Annexation,
Mr. McCoury reported that the Boundary Revfew Board wished a statement
from the Spokane County Planning Commission as to their poiicy on-annex-
ati:on •of -County land- to the City. The reason for this request is the proposal
by Bantz, et al to annex 135 acres of land at Five Mile to the Cfty which
is presently being considered by the Boardo
After discussion by the Commissfon members, it was the consensus of
opfnion that the expansion or non-expansion of City Limits is not the
concern of the Commission - It is up to the citizens to decide on whether
or not they wish to be annexed. It was agreed that a poiicy was not needed
by the Commission since annexatfons are governed by State law.
2. Joint Meetinq with the Board of County Commissioners.
Mr. Dayharsh announced that a j olnt breakfa st meeting with the Plannfng
Commission and Board of County Commissioners is sctieduled for March
27, 1978, at 7:00 A.M. A notice wtll be sent to the Commtssion members
wfthin several days to inform them of the place of the meeting o The purpose
of the meeting is to discuss progress to date In terms of new regulations,
and more specifically to discuss the Hearings Examiner Committee and
ordinances which have been developed.
3. Report on Commissioners' Actiono'
john Sweitzer of the Staff reported on two proposed zone changes which had
been considered by the Board of County Commissioners,
ZE-1I0-77, Agricultural to Multiple Family Suburban zoning proposed by
Guthrie on the north side of Mi.ssion Avenue and East of University Road
was referred to the Board of County Commissioners wtthout a recommenda-
tfon because of a two-to-two vote by the Commissfono An appeal hearing

was held, and the Commissioners denied the applicationo
ZN-201-77, initiated by the Plannfng Commission for the rezoning of Elcliff
Subdiviston from Agricultural to Stngle Family Residentlal Zone. The appeal
hearing has been wfthdrawn by the applicanto 4. Tom Davis of the,Staff read a letter received from the Spokane Valley Chamber
of Commerce addressed to the Spokane County Planning Commission and Fred
Dayharsh, Planning Directoro They requested the Commission to adopt a
pollcy with regard to buildf ng setbacks on Pines Road, There is concern by
the State Hfghway Department regarding the increasing traffic and number of .
accidents occurring on Pfnes, The area involved for an increased setback
would be between 16th Avenue and Mf ssfon Avenue of Plnes, requestfng that
an additional 15 foot setback be required for building. This would allow right-
of-way to be acquired by the State Highway Department for wtdening of the
arterial, if It Is desired in the future o Mro McCoury requested that a copy of the Chamber of Commerce letter be
made available for each Commission member, and that the item be placed
on the first Aprll hearing agenda for considerationo He asked that the
copies be gtven tothe Commission on March 30tha
Mr. Quigley suggested that a study be made to determine the depth of the
Residentfal Office zoning in this area to aid in the decision of the frontage
setback o -
5, Five Mfle Proqress Report,
Gary Fergen of the Staff reported on the meettng held with the Board of.*
County Commissfoners on March 16th. The Goals and Policies for Five
Mfle were taken under advisement by the Board as a result of the meeting.
There were some word changes being considered by the Board in the
followfng statements: #4, concerning the definition of "public water
system"; #6, relative to fire station should be converted to a'manned"
station a s the Board of County Commis s ioners does not have any authority
regarding flre stations; and #7, stating that the arterial streets should be
improved to handle the traffic antfcipated, with consideration to the transit
bus loop - the City of Spokane has control of the bus system and the County
has no jurisdiction over this operation. In summary, the Board wishes to
change some of the mandatory statements contained In the presentatfon
because it covers goals and policies and not goals and objectives o
Kurt Orton, representfng Five Mile, requested that the Planning Commission
reque st that this proces s be periodically referred to the C ity-County Task
Force Commfttee on the Prairie for thelr Input. He stated that the same
request will be asked of the City Plan Commissiono

Mr. Orton said that the Boundary Review Board is presently reviewing annex-
ation of 135 acres to the City of Spokane on the southwest portion of the
Prairie. He inquired whether or not it was approprfafie to ask the Boundary
Review Board to delay actron until a Comprehensive Plan is avaflable to use
as a guideline. He cfted the considerations of population, den'stty, land area and uses, and the effect of annexation on the economfc and social
interests as well as local government in the community before a decfsion
is reached.
Mrs. Rawlings moved that the staff read the City information and give a
brief summary of the status of the County's action on the Comprehensive
Plan process on Five Mile and forward the summary on to the Bouadary
Review Board. Mrs. Byrne seconded themotion. Mrso Rawlings and Mrs.
Byrne voted "Aye"; and Messrs o Thomas, Quigley, and Kennedy voted "no".
Motion was lost 4- 2.
. Mrs. Byrne moved that the staff prepare a one page summary stating where
the County is on the five Mile process, to be sent to the Boundary Review
Board. Mrs. Rawlings seconded the motion. Mrs. Byrne and Mrs, Rawlings
voted "Aye"; and Messrs. Thomas,. Quigley, and Kennedy voted "No". Motion
was lost 4 - 2.
6. Report from Policv Committee p
Mrs. Rawlings reported that it was the recommendation of fihe Policy Committee
that the Policy Notebook be reviewed annually to be sure the contents are
current. Mr. Kennedy seconded the motion. Motion carrfed unanimously,
The SEPA checklf st is also to be included in the Notebook a Mr. Davis of
the staff said that a motion short form was being prepared as well as the
newly adopted fee schedule for the Commission. It was pointed out that
the entire Commissfon should receive the Comprehensive Plan update as
well as the Policy Committee, 7. Citizens Partfcipation.
Mr. Fergen reported that he had a citizens participation update progress report.

and in so approving, adopts the Staff's Findings as the Planning Commission's
Findings of Fact, and also that a proposed declaratfon of non-significance

11. ZE-5-78,, TRANSIENT LIVING TO COMMERCIAL: PEARSON, BOYD AND LITTLER.
That the zone reclassification request (Number ZE-5-78) be contlnued for
one month to allow the access easement issue relative to the Vista Service
Statfon to be resolved. OnJ.y testimony regarding the easement will be taken

Findings of Fact for the following reasons: The commission concluded that
buffering and landscaping should be attached to the zone reclassification
approval, thus rimaking the proposed development compatible with surrounding
residentfal I3nd uses; thus avofding a possible illegal spot zoneo

The advertised property shall be developed in substantial conformance with

possfble sight distance restriction at the proposed access potnt.
B, Sewage Dlsposal (Spokane County Heaith District)
This project 1s located in an area with soils classifled by the Soil
Conseivation Service as suitabie for instailation in individual on-site
sewage disposal systems. The area 1s, however, located over the
Spokane Aquffer. A study fs currently under way to determine the degree
to whlch subsurface disposai of sewage treatment effluent may pollute
~ the Aquifer. There is very little probability that this proj ect ln itself
wi11 have more than a slight Impact on the Aquifer. Fiowever, taken
fn conjunctfon with the overall urbanization of the area, some other
sewage disposal'method will most likely be required in the future.
From an environmental health viewpoint the project appears feasfble.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RC'JV,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private propasals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions significanCly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. The

proposal is such a major action.

opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the deqree of impact, asking you for more informa-

believe an explanation would be helpful to government decision-makers, include your
explanation in the space provided, or use additional pages, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answars you provide. Complete answers to these questions now will

review without unnecessary delay.

you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
