Resolution f,inalizing Freeway Commercial Zone of 188-77 was adopted on March 9, 1978. , The beginning of file 142-77 was in January 1976 as file ZE-61-75 and at that time included that property eventually zoned Freeway Corrmercial by file 188-77 at-the subsequent 1978 date. When Valley Mall was resubmitted as file 142-77 its legal description also included that property already zoned Freeway Commercial. The advertisement for 142-77 stated 'reclassification from Agricultural to Commercial ' for that property described as....' The advertisement didn't include any property, such as file 188-77,that was zoned Freeway Commercial. Additionally, the extension of time for 142-77 did not contain the ownership of 188-77 (Red Lion). Condition of 142-77 stated that if an extension of time was not granted in 1985, then the zoning would revert back to what it was prior to the Commercial Zone. For the above reasons, it appears that file 188-77 and the Freeway Commercial Zone still exists and was not legally changed to Commercial by file 142-77. Zoninq Reclassification, ZE-49-68, was finalized on April 17, 1969, per Board of County Commissioners' Resolution #69-135, changing the Zoning Map from Agricultural to Freeway Commercial zoning classification. This zoning was for property on the east side of Sullivan Road, south of the Freeway, and became the site for the Red Lion Plotor Inn. Zoninq Reclassification, ZE-188-77, was finalized on March 9, 1978, per Board of County Commissioners' Resolution #78-308, changing the Zoning Map from Agricultural to Freeway Commercial zoning classification. Some of the statements and notations made on the Environmental Checklist submitted for subject proposal may be inaccurate or require further explanation. Specifi- cally, item 9, page 2 and item 3, page 3, indicate that a septic tank permit would be needed from the countq. We aren't sure of the septic tank designation as to whether the sponsor is confusing such with the existing treatment plant or he in fact, intends to use a septic tank for the disposal of wastewater discharges for the 82 guest rooms. Secondly, items 3(g and H), page 3-"Water" should have been given at least a "maybe" designation since the reason that any of the groundwater aquifer studies have been occurring is due to the probability that surface waters eventually re- charge the aquifer, thus the question as to whether such is significantly affecting the quality and quantity of said aquifer or groundwater zone. Thirdly, sponsor indicated on page 6, item 16, under "Utilities" that the 82 unit project would not result in a need for "new systems" or alterations to water, sewer, storm, water and solid waste. There is considerably more involvement other than simply "hooking up" the utilities as mentioned by the sponsor. Lastly, within the sir quality category of the checklist, the sponsor may not be aware that the additional vehicular activity will at least add to the air emissions. Until recently, the Spokane County Air Pollution Authority has had several com- plaints and subsequently, followed-up with compliance requirements on the odor problems associated with the existing wastewater treatment facility. If the sponsor intends to use the same wastewater treatment facility without modifica- tion the acl.or problem may again reoccur.
