Mr. Quigley had made the Ynotion at the March 30th meetinq, seconded by Mrv Kennedy. Mr. McCoury said that only five Corrimission members had parti- cipated In the plan. The original motion stated, "That the Planning Staff be directed to prepare a final plan for Five Mile based upon the maps and the goals and pollcies pretty much as developed as per the Cttizens Comrnittee from Ftve Mile and as per the final vote." Mr. Quigley wished to add the following to his motion, seconded by Mtso Rawlfnqs: That all of the other materfals in the alternate plans shouZd be submftted along with the plan recommended by the Citizens Coramittee. (Only Plan "D" for Five Mtle should be considered to go through the entire process. Planninq Business: a} Report on Commissioners' Actfons john Sweitzer of the Staff presented a Planning Staff review of all items which had been appealed to the Board of Caunty Commissioners - -I- ti ZE-2-78, Tupper request for a zone change from Agricultural to Local Business o This property is located at the northwest corner of Sullivan and Boardway. The Planning Commission recommended denial; however, the Board of County Commissioners reversed the decision and gave their approval to the zoning request on May 23rd, ZN-150-77, proposed by Harlan Douglass, at the northwest corner of Francis and Washingtona This proposal was recommended for approval by the Planning Commission, and the appeal hearing upheld this decision and gave their approval to the zonlng request on May 23rd. ZE-192-77, proposal on North Pines from Local Business to Commercial by Mc C Properties. Thfs zone change proposal was recommended for denial by the Planning Cbmmissfon, and a decision has not as yet been gfven by the Board of County Commissfoners after their appeal hearing. b) Staff Reports. Mr. Sweitzer reported that the Staff requested a one month continuance on showing Resfdential Office Zones which had been approve3 on North Pfnes for information and evaluation by the Commfssion. c) Report from Policy Committee. There had not been a recent meeting of the Policy Committee . Mrs. Byrne suggested a dfscussion be held on the Pollcy Commfttee being ad hoc or a teinporary committee and the determination made whether it is necessary to have as a permanent committee an3 also 3efine the responsfbilities of the commlttee. Mro Kennedy asked that the Policy Commi.ttee be continued. He stated that it should be checked whether or not the member of the Commission has the capability of voting on an lssue and who 3etermines whether a person has a conflict of interest. He said this should be decLded by Commissioa members. Meo Thomas moved, Mr. Kennedy seconde3 that it be proposed that the Policy Committee be a permanent committee but not meet on a regular basis but only at the direction of the Commission. Mro Emacio, legal counsel, advise3 that it would be necessary to amend the By-Laws, advertise the amendment proposed, and take action at the next regular hearing of the CoYnmission. Mro McCoury suggested that thls matter be postponed until the ftrst meeting in May for further consideratfon ot the motion. No vote was takeno The Commisslon concurred with the postponement. - 2 - ~ . ' d) Other Business a ZW-26-78, Citizen Request ot Change Zonfng Map, Mra Terry M. Thompson requested that the Commfssion place his proposed zone change from Agricuitural to Restricted Industrfal on tlze aqenda in May for property located in the area of Russell Road intersectinq with Highway No a 2. The Site contains approximately 50 acres and it is planned to have an office - tndustrial park, Mra Thpmpson stated that 30 % of the requfred property owners' sfgnatures had been obtafned on the petition whtch had been circulation. Mr. Sweltzer informaed the Comnstsston that the West Suburban Compre- hensive Plan designates the area on t#ie edge of the subiect property as Restricted Industrial zoning o Mr. Quiqley moved, Mra Main seconded, that Mr. Thompson's request be placed on the Commission's next aqenda. Messrs. McCovey, Kennedy Quigley, Thomas and Main voted "Aye" v Mrs a Rawlings voted "No". Mrs o BYrne abstained from voting. Motfion carrfed. Mrs. Byrne moved, Mra Kennedy seconded, that a study or referral be made by the appropriate committee or some action be taken reqardinq some of the requirements to see If they should not be changed - to be studied and re-evaluated to see if they are still fillirig the purpose that was that was fntended for processing applications o Motion carried un3ni- mous ly. ZN-161A-72 Mr. Sweitzer reported that the legal description was Incorrect on the advertised agenda; the Planning Commission approved one piece of property and the Board approved another. Mation carried unanimouslyo e) Ordinance Amendrnents: Vttai Records Center as a Conditional Use in the Aariculturai Zone. In order that the language be consistent, 4.04.170 (ii) and 4.24.550, should be "Vital Records Center" instead of "Vftal Statistics Center" in the proposed amendments. -3- . N. Mr. Quigley mov ed to approve the proposed amendment allowinq a Vftal Records Center as a Conditional Use in the Agricultural Zone. Mr. Thomas moved, Mrs. Byrne moved to amend the motion to amend Paragraph 3-B to read a fifty foot (50) front yard setback instead of the 25 feet listed in the standards. Motion carri.ed unanimously. Motion carrfed unanimously. Proposed Deletion of Section 4.06.040 from the ZoninQ Ordinance Regardinq Uses Prohibited - Beautv Pariors in the Two-Familv Zone. Mr. Sweltzer stated that the Staff has received three letters requesting deletion of this use as a home occupation. It is necessary to 3etermfne whether the beauty parlor is a primary use or a home occupation o Mr. Qufgley moved that the proposed amendment be denied. MC QUEEN A PROPOSED ACTION Condition No. 6 for ZE-102-77 reads. The advertised propoerty shall be developed in substantial conformance with the development plan on file _ with this application. The applicant has requested an amendment of Condition No. 6 to allow for 13,850 square feet of additional property (ZE-4-78), for a larger develop- ment which will require a revised development plan. ZE-102-77 was approved allowing for a 14 unit mu]tiple family development. The Corrmission concluded that the applicant's development proposal was rather vague, and that a detailed development plan and an elevation rendering be reviewed by the Planning Staff and Corrmission before action is taken on the ione reclassification. Circulation Frontage Type ADT Mission Avenue Secondary Arterial 3,740 Engineer's Review• The Spokane County Engineers have requested that all access from the site be restricted to Bowdish Road and/or Bates Road._ B Sewage Disposal This project is located in an area with so11s classified by the Soil Conservation Service as suitable for installation of individual on-site sewage disposal systems. The area is, however, located over the Spokane Aquifer. A study is currently under way to determine the degree to which subsurface disposal of sewage treatment effluent may pollute the Aquifer There is very little probability that this project in itself will have more than a slight impact on the Aquifer. However, taken in conjunction with the overall urbanization of the area, some other sewage disposal method will most likely be required in the future. His report explained vhat the Coordiiiating Committee did at this meeting and the consensus feeling of its members vR as to: 1. Deemphasize the use of the report at this time . 2. To qet the staff working on a model for Agricultural Suitab lity Maps by using an existinq use map, a so-ii quality map, and a comiialabili'tly of adjacent land uses map. 3 Not mail the aforementioned report out aat thi s time. 4. And to have the staff gather new fnformation for the report. It was also explained that the *ninutes of the Coordinating Committsel would be sent to the Planning Commission as soon as the staff received and re liewed them. The Planning Commission responded affirma'Lively when they were asLE d if they wanted a further report on the progress of the Stia*_abzlity phase of t1he G=prehensive Plan Update The points covered reqarding Suitability progress were: 1. Our time frame has been pushed back about three to six months . 2. Suitability major section reports have been written with the Prelimina cy Draft pgriculture Report published and the other four reports soon to b 1 published It was requssted by the Planning Commission members that the following lten s be given to them as a result of the dfscussion that followed the proqress report 1. Preliminary Draft Agricultural Suitabflity 2. Copy of tbe minutes of an early Coordinating Committee that was attended by Coznmissioner Christensen and dealt with the function and role of the Coordinatunq Committee. 3. A written report done by a staff inember, approved by the staff and Planning Commission regardir.g structure and responsibility of the Coordinating Committee. 4. IVlinutes of a meetinq in june 1976, when Advisory Council Chairmen were elected and that they were asked to do some collating of goals and obje~tives. -1- ~ Two people from the audience gave testimony regarding the Coordinating Commfttee and the progress of the Comprehensive Plan Update Some points or questions asked by these two indfv±du4ls were 1. Does the Coordinating Committee have a veto poweO 2. How does a citizen get informed of these meetings and are they open ? 3. That the staff do work regarding Suitability and bring it back to the Coordinating Committee. 4. Good planning is a logical thing and the citizens should be partici- patinq in it because they know the most about past planninq mistakes. The Planning Commission after review of the proposed short plat ordinance and after two public hearings (September 23, 1977 and November 9, 1977) instructed the Planning Department staff to investigate some possible modi#ications to the proposal, includinq• 1r A 10 acre acreage exemption Combining preliminary and final short plat procedure 3) Modification of Short Plat Revfew Committee procedure 4) Ntodification of appeal proceciure and notice of action 5) Further study of the fee scheduie. The Planning Commission instructed the staff Lo make the appropriate changes to the ordinance and set a date for further review by the Commission. Commzssfoners' Concern - Five Njile Praine Comprehensive Plan Study Commissioners members received a letter from City Plan regarding their request for an extension of time to becember 1, 1977 to comment on the Draft En- vironmental Imgact Statement Ivlr. Ferqen reported that the staff would send a letter to City Plan regarding the staff's concems over the Draft Environmental Impact Statement. He briefly explained the two concerns of the staff which were. 1) Concerning present policy regarding existing Comprehensive Plans, and 2) the possibflity of Five Mile Prairie containing historiq~archeaological sites. Mr. Clegg, Director of the Spokane Citv Plan Commission then said that they would be qlad to extend the time period if it would facilitate comments Mr Clegq gave a brief explanation of where the Draft E.I.S. came from and answered questions of the Planning Commission regardfng it. Commissioners Kennedy and Main initiated discussion on the prnbability of limiting the items appearing on the Commission`s Agenda. The area is, however, located over the Spokane Aquifer, a study is currently under way to determine the degree to which subsurface disposal of sewage treatment effluent may pollute the Aquifer. There is very little probability that this project in itself wi]1 have more than a slight impact on the Aquifer.
