Subject: AIE-2-95, Zorung Code Interpretation of specific conchtions of approval and
mod.ification/review of a previously approved site plan
Issue: Denny Chnstenson of Denny Chnstenson & Associates, has requested a wntten
interpretation of the Spokane Counry Zonuig Code as it applies to the conditions
of approval attached to Zone Reclassification ZW-190-77, and for modificanon
of a previously approved site plan (See enclosed proposed site plan)
Background: Mr Chnstenson's request has been subnutted pursuant to Chapter 14 504 040
of the Spokane County Zomng Code and perta,uis to the specific conchtions of
approval attached to Zone Reclassif'icaaon, ZE-190-77 The zone
reclassification from Agncultural Suburban (AS) to Residential Office (RO) was
approved by the Spokane County Board of County Com.missioners on March
3, 1980, and the conchtions of approval for ZE-190-77 require that the property
be developed in substantial conforinance with the onguial site development
plan Mr Chnstenson's request expla.ins that the exisnng property owner has
outgrown the exisang office space and wishes to expand by adding on to the
existing office bwlding and malang minor modificanons to the onginal site
plan Specifically, the revised site plan illustrates modfficanons to parking
areas, landscaping, building location, and an increase -in the total square footage
from the onginal site developanent plan The onginal szte development rlari
fllustrated an existing house, garage, office, shop, storage bufldhng, and
pro-pg office building consistYng of 24,760 total square feet The onglnal
site development plan also fflustrated the proposed office building as a separate
structure located at the northern pornon of the site The revised slte plan
subnutted by Mr Chnstenson illustrates three (3) total structures inclucimg an
exisang office buildhng, storage building, and the proposed office builchng
consistulg of 27,000 total square feeL The revised site plan illustrates the
parlang areas on the southern pomon of the site whereas the onginal site
development plan illustrated parking throughout the entire site The revised site
plan also illustrates landscaping stnps around the site penmeter and a new
section of a six (6) feet high wood fence along the east property lme, whereas
the ongrnal site development plan illustrated less landscaping and fencing
Response: After review and analysis of the onginal site plan, conchtions of approval for
ZE-190-77, and the revised site plan, the Planrung Department has determined

that the requested revisions are permitted, as authonzed by Section 14 504 040,
of the Spokane County Zoning Code The proposed site plan revisions are
minor in nature, consisting of a relocation of proposed office building,
landscaping, parlang, and an increase of approximately 9% more total square
footage than the onginal site plan The proposed revisions do not increase the
intensity of the use, and are consistent wnth the existing underlyuig zone
classification Therefore, the request for mod.ificanon to a previously approved
site plan is hereby approved
Justification: Secuon 14 504 040 (Interpretation of Zoning Change Condlnon) states "the
followuig alterations or add.itions to approved site development plans for zone
reclassifications are deemed to be minor m nature and may be approvecl
admuustraavely by the Department if the changes are not contrary to the adopted
findings atid conditions "
1 Additions to bLUldmgs, provlded that the mcrease in floor area is less than
ten percent (10%) of the total floor area of all bwldings on the approved site
development plan and the addition(s) does not exceed allowable densines of the
underlymg zone or requuements govermng bufldhng coverage, and/or
2 Muior adjustments to build.ulg or structure locanons, provided that the
density or uitensity of use is not mcreased and dces not signdficandy affect
adjacent uses, and/or
3 Changes in parlang areas, provided that adopted regulanons and condinons
are met, andlor
4 Modif'ications ui landscape plans, provided that requued percentages of
landscaping or open space are not reduced below those prescnbed in this Code
or as approved by the Hearuig Body
Changes to approved site development plans other than those listed above will
requue a public heanng before the Heanng Body Any person aggneved by an
interpretation regarchng the circumstances above may appeal said Lnterpretation
to the Heanng Body under Section 14 412 041 of the Spokane County Zoning
Code
From the above cntena, it is clear that the revised site plan does not increase the
ultensity of the pernutted land use and does not significantly affect adjacent
propemes The relocation of the proposed office builduig dces not exceed the
maxunum builduig coverage allowed by the underlyuig zone, and does not
increase the total floor area by more than 10% In add.ition, changes in parlang
areas are specif'ically permitted by Section 14 504 040 (3), provided adopted
regulations are met and the revised site plan provides the requu-ed number of
parking spaces for the uses on site The landscaping and fencing inodifications,
as proposed, provide more landscaping, buffenng and aesthencs than the
onguial site plan The revised site plan is consistent with, and mauitains the
development concept of the ongznal site plan

Summary: The Planmng Department has detemuned that the proposed alterations to the
onguial site plan are minor in nature, are consistent with the cntena provided by
Section 14 504, of the Spokane County Zoning Code, and are not contrary to
the adopted finduigs and condztions of ZE-190-77 The above cited sections of
the Spokane County Zoning Code, zone reclassification file ZE-190-77, and the
onguial/revised site plans are available for review and copyuig at the Spokane
County Planning Department.
Appeal Rights: This is an ad.mimstraave deternunation of the Spokane County Zoning Code
pursuant to Section 14 504 000 As such, it is requu-ed to be sent to the
apphcant as well as adjacent property owners/taxpayers and is appealable under
the provYSions of Section 14 412 041 of the Zoning Code As stated therein,
such appeal request shall contain reference to the specific decision or
interpretation contested and shall be dehvered to the Heanng Body at the
Planiung Department office no later than twenty (20) calendar days from the
date of the wntten decision of the Planrung Department The fee for such an
appeal is $215 00

MINUTES OF THE SPOKANE COUNTY PLANIVING COMMISSIOIV HEARING OF
MARCH 17, 1978 0
WHEREAS, the Spokane County Planning Commission did hold a public
meeting on March 17, 1978 to consider the testfmony and requests of several
applicants, objectors and other Interested parties concerning the below referenced
zone reclasslfications and other items of business, and
WHEREAS, at said hearing opportunity was afforded those £avoring and
those opposing all items of business, and
WHEREAS, Mc. McCoury, Mrs. Byrne, Mrs. Rawlings, and Messrs.
Kennedy, Quigley and Thomas were in attendance and constituted a quorum, and
WHEREAS, the Spokane County Planning Commission fully considered the
testfmony given, the environmental revf ew, and all other evtdence presented,
recommends to the Board of County Commissioners the following:
1 o Request by Boundary RevLew Board for PolLCy on Annexaticn,
Mr. McCoury reported that the Boundary Review Board wished a statement
from the Spokane County Planning Commission as to thelr polircy on annex-
ation of County land to the City. The reason for this request is the proposal
by Bantz, et al to annex 135 acres of land at Flve Mile to the Clty which
is presently being considered by the Board o
After discussion by the Commission members, it was the consensus of
opinion that the expansion or non-expansion of City Limits is not the
concern of the Commission - it is up to the citizens to decide on whether
or not they wish to be annexed. It was agreed that a poltcy was not needed
by the Commission since annexations are governed by State law.
2. Toint MeetinQ wfth the Board of Countv CommfssLOners.
Mr. Dayharsh announced that a joint breakfast meeting with the PlannLng
Commission and Board of County Commissioners is scheduled for March
27, 1978, at 7:00 A.M. A notice will be sent to the Commission members `
within several days to inform them of the place of the meeting o The purpose
of the meeting is to discuss progress to date in terms of new regulations,
and more specifically to dxscuss the Hearings Examfner Committee and
ordinances which have been developed.
3. Report on Comrra.ssioners' Actfon,john Sweitzer of the Staff reported on two proposed zone changes whfch had
been considered by the Boand of County Commissionersa
ZE-110- 77, Agricultural to Multiple Family Suburban zoning proposed by
Guthrie on the north side of Mfssion Avenue and East of University Road
was referred to the Board of County Commissioners without a recommenda-
tion because of a two-to-two vote by the Commissiono An appeal hearing

was held, and the Commissioners denied the application.
ZN-201-77, initfated by the Planning Commission for the rezoning of Elcliff
Subdivision from Agricultural to Single Family Residential Zone. The appeal
hearing has been withdrawn by the applicant,
4. Tom Davls of the Staff read a letter received from the Spokane Valley Chamber
of Commerce addressed to the Spokane County PlannLng Commission and Fred
Dayharsh, Planning Director. They requested the Commission to adopt a
policy with regard to building setbacks on Pines Road, There is concern by
the State Highway Department regarding the lncreasing traffic and number of
accidents occurring on Ptnes. The area Involved for an increased setback
would be between 16th Avenue and Mlssfon Avenue of Pines, requesting that
an additfonal IS foot setback be required for building. Thfs would allow rfght-
of-way to be acquired by the State Hlghway Department for widening of the
arterial, If it is desfred fn the future o
Mro McCoury requested that a copy of the Chamber of Commerce letter be
made available for each CommissLon member, and that the item be placed
on the first April hearing agenda for considerationo He asked that the
copies be given to 1he Commission on March 30th o
Mr. Quigley suggested that a study be made to detennine the depth of the
Residential Office zoning in this area to aid fn the decision of the frontage
setback o
5. Flve Mtle Proqress Report,
Gary Fergen of the Staff reported on the meeting held wtth the Board of
County Commissioners on March 16th. The Goals and Policfes for Flve
MLle were taken under advtsement by the Board as a result of the meetfng.
There were some word changes being consLdered by the Board in the
followfng statements: #4, concerning the definition of "publtc water
system"; #6, relative to ffre station should be converted to a'Ynanned"
station as the Board of County Commissloners does not have any authority
regarding fire stations; and #7, stating that the arterfal streets should be
improved to handle the traffic anticipated, with consideratlon to the transit
bus loop - the Clty of Spokane has control of the bus system and the County
has no jurfsdiction over this operation. In summary, the Board wishes to
change some of the mandatory statements contafned in the presentatton
because it covers goals and policies and not goals and objecttves o
Kurt Orton, representing Ffve Mile, requested that the Planning Commission
request that this process be perfodically referred to the City-County Task
Force Committee on the Prafrfe for their input. He stated that the same
request will be asked of the City Plan Commissfono

Mr. Orton said that the Boundary Review Board is presently revlewing annex-
ation of 135 acres to the City of Spokane on the southwest portion of the
Prairie. He inquired whether or not it was appropriate to ask the Boundary
Revfew Board to delay action until a Comprehensive Plan is avallable to use
as a guideline. He cfted the conslderations of population, denslty, land
area and uses, and the effect of annexation on the economic and social
interests as well as local government in the community before a declsion
f s reached.
Mrs. Rawlf ng s moved that the staff read the C ity informatfon and give a
brief summary of the status of the County's action on fihe Comprehensive
Plan proces s on Five Mile and forward the summary on to the Sot. zdary
Review Board. Mrs. Byrne seconded themotion. Mrso Rawlings and Mrs.
Byrne voted "Aye"; and Messrs o Thomas, Quigley, and Kennedy voted "no".
Motion was lost 4- 2.
Mrs. Byrne moved that the staff prepare a one page summary statLng where
the County is on the five Mile process, to be sent to the Boundary Revfew
Board. Mrs. Rawlings seconded the motion. Mrs. Byrne and Mrs o Rawling s
voted "Aye"; and Messrs. Thomas, Qufgley, and Kennedy voted "No" o Motion
waslost4-2.
6. Report from Policv Committee a
Mrs. Rawlings reported that it was the recommendation of the Policy Committee
that the Policy iVotebook be reviewed annually to be sure the contents are
current. Mr. Kennedy seconded the motion. Motion carried unanimously,
The SEPA checklist is also to be included in the Notebook, Mr. Davis of
the staff said that a motion short form was being prepared as well as the
newly adopted fee schedule for the Commfssion. It was pointed out that
the entire CommLssion should recefve the Comprehenslve Plan update as
well as the Policy Committee o
7. Citizens PartLCfpation.
Mr. Fergen reported that he had a cLtizens participation update progress report.
8. ZE-I54-77, AGRICUL'I'URAL SUBURBAN TO RESIDEN'I7AL OFFICE OR MULTIPLE
FAIVIILY SUBURBAN: HIL?.STEAD.
That the zone reclassification request (File Number ZE-154-77) be denied
ior the following reason: that the request f sinconsistent with the area and
inconststent with previous zoning reclass ifications for the area.

That the zone reclassificatfon request (FLle Number ZE-189-77) be denied for
the following reasons: the Commercial request is fnconsistent with the
Comprehensive Plan and with the absence of a plot plan, there is not the
planning consfderatfnn before the actual happening. (Motfon by Mrs.
Rawlfngs, seconded by Mra Thomas. Vote was unanfmous.)
10. ZE-190-77, AGRICULTURAL SUBURBAN TO RESIDENZ'!AL OFFICE: WOLFF,
That the zone reclas siflcation request (File Number ZE-190- 77) be approved,
and in so approving, adopts the Staff's Findings as the Planntng Commission's
Findings of Fact, and also that a proposed declaration of non-slgniftcance
be issued. ( Mr. Thomas moved, and Mrs. Rawlings seconded. Vote was
unanLmous . )
11. ZE-5-78, TRANSIENT LIVING TO COMMERCIAL: PEARSON, BOYD AND LITTLER.
That the zone reclassification request (Number ZE-5-78) be continued for
one month to allow the access easement issue relative to the Vista Servi.ce
Statian to be resolved. Only testimony regardxng the easement will be taken
at that time.( Motion by Mrs. Byrne, Mr Qulgley seconded o Vote was
unanimous. )
12. ZW-23-78, AGRICULTURAL TO RESTRICTED INDUSTRIAL: OVERTON.
That the zone reclassification request (File Number ZW-23-78) be approved
and in so approvxng, adopts the Staff's Findings as the Planning Commission's
Flndings of Fact for the following reasons: The commf ssion concluded that
buffering and landscaping should be attached to the zone reclassification
approval, thus makrng the proposed development compatible wlth surrounding
residential Isnd uses; thus avolding a possible illegal spot zoneo
Additional conditions afitach.ed to the zone reclassificatfon are as follows:
The advertised property shall be developed in substantial conformance with
the plan on file with thls application.
A specific ltghting, sfgning, and landscape plan (landscape plan to include
planting schedule and provisions for maintenance) acceptable to the Spokane
County Zoning Administrator shall be submitted for the project prior to
the release of building permits. NOTE: Lightfng and sfgning shall be
installed in a manner which will not advsrsely affect the operations of Fairchild

ENVIRONMEN'TAL CHECKLIST
Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RC W,
requires all srate and local governmental agencies to consicler environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. The
purpose of this cheGklist is to help the agencies involved deterrtiine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Please answer questions as "yes" or "m:iybe" if, in your
opinion, even only sllght impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the deqree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are required, or where you
believe an explanation would be helpful to government decision-makers, include your
explanation in the space provided, or use additional pages, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answars you provide. Complete answers to these questions now will
help all agencies involved with your proposal tp undertake the required environmental
review without unnecessary delay.
The following questions apply to your total proposal, not just to the license for which
you are currently applying or the proposal for whfch approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime in the future This will allow all
of the agencies which will be involved to complete their environmental review now,
without duplicating paperwork in the tuture ,
No application shall be processed until the checklist has been completed and returneri
to the appropriate County department. State law requires explanations for every "yes"
and "maybe" answer on the checklist. The person completing the form may be required
to provide explanations for "no" answers, and in some cases, more detailed information
to aid in a threshold determination.
NOTE. This is a standard form being used by all state and local agencies in the State
of Washington for various types of proposals. Many of the questions may not

proposal, ZE-84-71 Agricultural Suburban to Resfdential Offfce. The
Planning Commissfon on September 24, 1971 approved Lots 2, 3, and 4 of
Paradfse Acres Additfon for Resfdential Offxce Zontng, but denied the zonfng
reclassfficatfon for Lot 5; (Note, the Alvin j. Wolff Office is located on
Lots 2, 3 and 4). The Commisston at that tfine concluded that Lot 5 should
remaln substantially in residential use, wfth the rear yard possibly used
for parkfng in conjuncti.on with the office use o It was the opini.on of
the Commission that Lot 5 extended too far into a residential neighborhood o

Washington State Highway Department have reviewed this prop4 sal
and have concluded that both Pfnes Road and 8th Avenue are adequate to
serve this proQosal.
B. Sewage Disposal
ThLs project is located in an area with soils classified by the Soil
Conservation Servlce as suifiable to insta],Zation of indfvidual on-site
sewage disposal systems. The area is, however, Iocated over the~
Spokane Aquifer. A study is currently under way to determine the
degra-e to which subsurface disposal of sewag e treatment effluent may
pollute the Aquifer. There is very iittle probabilfty that this project
in itself will have more than a sltght impact on the Aquifer, However,
taken in conjunctfon with the- overall urbanizatfon of the area, some
other sewage disposal method will most 1ikely be requfred in the
future.
From an envfronmental health viewpoint the project appears feasible.
(Note: The Spokane Aquifer has been designated as a sole source.)

E. Staff Envfronmental Review
Concluded that a declaration of Non-Significance be issued. However,
evidence and findings presented at the public hearing concerning this
matter should also be considered. The slight adverse impacts noted by
the Staff included: Earth, air, water, flora, noise, light and glare,
land-use, transportatfon, publlc se ivices and utilities.
IV. CONDITIONS:
1. Improvement of E ighth Avenue along the proj ect perimeter to Spokane
County Standards. Improvements shall znclude curbs, sidewalk,
paving to existing and drainage control.
2. Approval of access by the Washington State Highway Department for
P ine s Road and b y the Spokane C ounty Eng f neer' s Department for ELghth
Avenue, prior to release of bullding permtts.
3. The advertf sed property shall be developed In substantial conformance
with the development plan of file with this application,
4. Any portfon of the project which is to be occupted or traveled by automo-
b iles shall be ma inta ined f n hard surface paving o
5. An on-site, storm-drainage system shall be approved by the Spokane
County EngLneer's Office prior to release of building permits for the
project.
6. A specffic landscape plan, plantfng schedule, and provisions for matn-
tenance, for the project shall be approved by the Spokane County Zoning
Administrator prior to release of buildlng permits.
7. The applicant shall provide a performance bond to cover the cost of
the required landscaping prror to release of buflding permits.
8. Sewage disposal shall be apprnved by the Spokane County Health District
prior to issuance of building permLts.
