MINUTES OF THE SPOKANE COUNTY PLANNING COMMISSION HEAKING OF
MARCH 17, 1978.
WHEREAS, the Spokane County Planning Commission did hoid a public
meeting on March 17, 1978 to consider the testimony and requests of several
applicants, objectors and other interested parties concerning the below refetenced
zone reclassiffcations and ather items of business, and
WHEREAS, at satd hearing opportunity was afforded those favoring and
those opposing all ltems of buslness, and
WHEREAS, Mc. McCoury, Mrs. Byrne, Mrs. Rawlfngs, and Messrs.
Kennedy, Quigley and Thomas were in attendance and constituted a quorum, and
WHEREAS, the Spokane County Planning Commtssion fully considered the
testimony given, the envl.ronmental review, and all other evidence presented,
recommends to the Board of County Commissioners the followfng:
1 o ReQuest bv Boundary Review Board for Poltcv on Annexatfone
Mr. McCoury reported that the Boundary Review Board wished a statement
from the Spokane County Planntng Commission as to their pvltcy on annex-
ation of County land to the Cityo The reason for this request ls the proposal
by Bantz, et al to annex 135 acres of land at Five Mile to the Ctty which
is presently being cansidered by the Boardo
After discussion by the Commisslon members, it was the consensus of
opinion that the expansion or non-expansion of City Limtts is not the
concern of the Commission - it Is up to the citizens to decide on whether
or not they wish to be annexed. It was agreed that a poticy was not needed
by the Commission since annexatlons are qoverned by State law.
2. Toint Meetinq with the Board of Countv Commissioners.
Mr. Dayharsh announced that a ioint breakfast meeting with the Planning
Commission and Board of County Commissioners is scheduled for March
27, 1978, at 7:00 A,M. A notice will be sent to the Commission members
within several days to inform them of the place of the meeting o The purpose
of the meeting is to discuss progress to date In terms of new regulatfons,
and more speciflcally to discuss the Hearings Examiner Commtttee and
ordinances which have been developed.
3. Report on Commissioners' Action,
john Sweitzer of the Staff reported on two proposed zone changes which had
been considered by the Board of County Commissioners o
ZE-110- 77, Agricultural to Multiple Famtly Suburban zoning proposed by
Guthrie on the north side of Mlssion Avenue and East of University Road
was referred to the Board of County Commisstoners wlthout a recommenda-
tion because of a two-to-two v+ote by the Commissiono An appeal hearing

was held, and the Commissioners denied the appllcationo
ZN-201-77, inltiated by the Planning Commission for the rezoning of Elcliff
Subdfvision from Agricultural to Single Family Residential Zone. The appeal
hearing has been wlthdrawn by the applicanto
4. Tom Davis af the-Staff read a letter received from the Spokane Valley Chamber
of Commerce addressed to the Spokane County Planning Commission and Fred
Dayharsh, Planning Dfrectoro They requested the Commisslon to adopt a
policy with regard to bullding setbacks on Pines Roado There is concern by
the State Hiqhway Department reqarding the lncreasing traffic and number of
accidents occurrinq on Pines o The area lnvolved for an increased setback
would be between 16th Avenue and Mtssion Avenue of Pines, requesting that
an additional 15 foot setback be requfred for building. This would allow right-
of-way to be acquired by the State Htghway Department for widening of the
arterial, if lt is desired In the futureo
Mro McCoury requested that a copy of the Chamber of Commerce letter be
made available for each Commisston member, and that the item be placed
on the first April hearing agenda for consideratione He asked that the
copies be given to tie Commission on March 30th,
Mr. Quiqley suggested that a study be made to determtne the depth of the
Residential Office zoning in this area to atd in the decislon of the frontage
setback o
5. Flve Mtle Proqress Reporte
Gary Fergen of the Staff reported on the meeting held wtth the Board of
County Commisstoners on March I6th. The Goals and Policies for Five
Mlle were taken under advtseinent by the Board as a result of the meeting.
There were some word changes be-Ing considered by the Board In the
following statements: #4, concerning the definition of "publtc water
system"; #6, relative to fire station should be converted to a'hnanned"
station as the Board of County Commissioners does not have any authority
regarding fire stations; and #7, stating that the arterial streets should be
improved to handle the traffic anticlpated, wtth conslderatton to the transit
bus loop - the City of Spokane has control of the bus system and the County
has no jurisdiction over this operation. In summary, the Board wishes to
change some of the mandatory statecnents contained in the presentation
because it covers goals and pollcies and not qoals and objectives o
Kurt Orton, representing Five Mile, requested that the Planning Commission
request that thls process be periodically referred to the Clty-County Task
Force Committee on the Prairie for their lnput o He stated that the same
request will be asked of the City Plan Commfssiono

Mr. Orton sald that the Boundary Revfew Board is presently reviewing annex-
ation of 135 acres to the Cfty of Spokane on the southwest portion of the
Prairie. He inquired whether or not it was appropriate to ask the Baundary
Review Board to delay action unttl a Comprehensfve Plan is avallable to use
as a guldeline. He cited the considerations of population, density, land
area and uses, and the effect of annexation on the economic and social
interests as well as local government ln the community before a decision
is reached.
Mrs. Rawlings moved that the staff read the Clty information and give a
brief summary of the status of the County's action on the Comprehensive
Plan process on Flve Mile and forward the summary on to the Boundary
Review Board. Mrs. Byrne seconded themotion. Mrs o Rawlings and Nlrs.
Byrne voted "Aye and Messrs o Thomas, Quigley, and Kennedy voted "no" .
Motion was lost 4- 2.
Mrs. Byrne moved t~•at the staff prepare a one page summary stating where
the County is on the five Mile process, to be sent to the Boundary Revlew
Board. Mrs. Rawlings seconded the motion. Mrs. Byrne and Mrs, Rawlings
voted "Aye"; and Messrs. Thomas, Qutqley, and Kennedy voted "No" e Motion
was lost 4 - 2.

Mrs. Rawlings reported that lt was the recommendation of the Policy Committee
that the Policy Notebook be reviewed annually to be sure the contents are
current. Mr. Kennedy seconded the motion. Motion carried unaninlously,

the staff sald that a motion short form was being prepared as well as the
newly adopted fee schedule for the Commission. It was pointed out that
the entireCommission should receive the Comprehensive Pian update as

Mr. Ferqen reported that he had a citizens participafiion update progress report.
8. ZE-154-77f AGRICULTURAL SUBURBAN TO RESIDENTIAL OFFICE OR MULZZPLE
FAMILY SUBURBAN: HILLSTEAD.
That the zone reclassiffcation request (File Number ZE-154-77) be denied
for the foilowing reason: that the request is inconsistent with the area and
inconsistent with previous zoning reciassifications for the area.

the followtng reasons: the Commercial request is fnconslstent wfth the
Comprehensive Plan and with the absence of a plot plan, there is not the
planning considera►tion before the actual happening. (Motion by Mrs.
Rawlings, seconded by Mr, Thomas. Vote was unanimous.)
10. ZE-190- 77 r AGRICULTURAL SUBURBAN TO RESIDENTTAL OFFICE : WOLFF,.
That the zone reclas sification request (Flle Number ZE-190- 77) be approved,
and in so approving, adopts the Staff's Findings as the Planning Commission's
Flndtngs of Fact, and also that a proposed declaration of non-significance
be Issued. ( Mr. Thomas moved, and Mrs. Rawlings seconded. Vote was
unanimous. )
11. ZE-5-78, TRANSIENT LIVING TO COMMERCLAL: PEARSON, BOYD AND LITTLER.
That the zone reclassification request (Number ZE-5-78) be continued for
one month to allow the access easement issue relative to the Vlsta Service
Station to be resoived. Oniy testimony reqarding the easement will be taken
at that time. ( Motion by Mrs. Byrne, Mr Qulgley secondedo Vote was
unanimous. )
12. ZW-23-78. AGRICULTURAL TO RESTRICTED INDUSTRIAL: OVERTON.
That the zone reclassiffcation request (File Number ZW-23-78) be approved
and fn so approving, adopts the Staff's Findings as the Planning Commission's
Flndings of Fact for the following reasons: The commission conciuded that
bufferi.ng and landscaping should be attached to the zone reclassffication
approval, thus making the proposed development compatible with surrounding
residential land uses; thus avotding a possible illegal spot zone o
Additional conditfons attached to the zone reclassification are as follows:
The advertised property shall be developed In substantial conformance with
the plan on ftle wfth this appllcationo
A specific lightfng, signing, and landscape plan (landscape plan to lnclude
planting schedule and provislons for maintenance) aceeptable to the Spokane
County Zoning Adminlstrator shall be submftted for the project prior to
the release of building permits. NOTE: Llghting and signfng shall be
installed in a manner which will not adversely affect the operations of Fairchtld
Air Force Base or Spokane International Alrport. A representative designated

furnish fire protection .for this zone change. ;
The Washington Water Power has a main along Dishman-Mica. The ~
Washington Water Power-representative Mr. Bob Taylor has stated ;
that Washington Water Power cannot install a fire hydrant in
this area because this area is not in Washington Water Power
service area (letter to follow). R
The Provisions set in Item #8 of the September 16, 1 rlcd► ihy
cannot be complied with due to the lack of main size by the Cheste r
