PROPERTIES )
THIS MATTER, Being the consideration by the Board of County
Commissioners of Spokane County, hereinafter referred to as the "Board"
of an appeal of the Spokane County Planning Commission's Decision of
"No Recommendation" concerning the zone reclassification (ZE-192-77)2
Local Business to Commercial, for the purpose of allowing a larger variety
of commercial and retail uses within an existing neighborhood shopping
center, hereinafter referred to as the "Proposal", and after consideration
of an action by a previous Board of County Cornmissioners of Spokane County
who held a public hearing on April 13, 1978, and which Board fully con-
sidered all testimony presented thereat, and further individually visited
the site and vicinity in question, did render a decision on the 27th day
of April, 1978, APPROVING said proposal. The present Board desires to
enter Findings of Fact, after a briefing by staff, so that the record in
the matter can be finalized.
FINDINGS OF FACT
1. That the proposal is generally located at the southeast
corner of Pines Road and Desmet Avenue in Section 15, Township 25 N.,
Range 44, E.W.M.
2. That the proposal consists of a rone reclassification to
Commercial to allow a larger variety of commercial and retail u~es within
an existing neighborhood shopping center than are permitted under the
Local Business Zone.
3. The previous Spokane County Comprehensive Plan Map, which
was in effect in 1978, indicated the site as appropriate for a Business
Center; primarily retail shopping.
4. That the provisions of RCW Chapter 43.21C, (State Environ-
mental Policy Act) have been complied with, and the Board concurs with the
Planning Department's issuance of a proposed Determination of Non-
Significance and adopfis a Determination of Non-Significance for this proposal.
5. That the Spokane County Planning Commission held a public
hearing cn FEbruary 17, 1978, concerning the proposal, and forwarded the
file to the Board of County Commissioners with a decision of "No Recommen-
dati on" .
6. That Larry D. McCormick, representative for M& C
Properties, did appeal the Planning Commission's decision of "No Recorrmen-
dation" to theBoard of County Commissioners.

7. That on April 13, 1978, the Board of County Commissioners,
consisting of Commissioners Christensen and Kopet, held a public hearing
on the proposal to consider public testimony and other available evidence.
8. That after review of the file, consideration of public
testimony and evidence, and an inspection of the site, the above-described
Board did approve the proposal on April 27, 1978, through a written
Commissioners' Decision and subject to specific conditions. The Board
ordered preparation of specific Findings and Order for execution at a
subsequent meeting.
9. That the existing land uses in the area of proposal
i noi ude comnerci al , offi ce, resi dential , and publ i c uti li ty faci 1 i ty.
10. That the proposal is compatible with existing uses in the
aicea.
11. That the proposal Zs not detrimental or otherwise harmful
to the public health, safety and welfare.
T 12. That the applicant did demonstrate changed conditions
since the original zone change warranting a zone change from Local Business
to Commercial.
13. That the proposai is consistent with the surrounding land
use c]assifications and does not grant a special privilege or rights to the
applicant different than those enjoyed by adjacent property owners.
14. That the proposal is located within the recorded water
servi.ce area of Modern Electric Water Companyp

15. That the proposal is situated within the recorded fire
service area of Fire District #l. •
16. That the proper legal requirements for advertising of the
April 13, 1978, hearing before the Board of County Commissioners of Spokane
County were met.
17. That on the 27th day of April, 1978, the Board of County
Commissioners of Spokane County at a regular meeting did APPROVE the
proposal subject to certain conditions.
From the foregoing Findings, a review of the Planning Department
Report dated February 17, 1978, a review of File No. ZE-192-77, and a review
of the Commissioners' Decision dated April 27, 1978, the Board hereby in
APPROVING the proposal does make the following conditions as reflected in
the previous Board's action on April 27, 1978:

CONDITIONS (continued)
1. Pursuant to the provisions of Chapter 43.21C RCW, the
SEPA Guidelines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed Determination of Non-Significance had been issued at
least fifteen (15) days prior to the February 17, 1978, public hearing.
The official file, written comments and/or public testimony contain infor-
mation regarding assessment of the proposal's likely significant adverse
impacts to the physical environment; a finding is hereby made that no
probable significant adverse impacts upon the physical environment are
anticipated as a result of the project; and a final Determination of Non-
Siqnificance is hereby to be issued.
2. That the provisions of SEPA'S NOTICE OF ACTION pursuant to
43.21C.080 RCW and the Board of County Commissioners' Resolution No. 77-1392
be accomplished by the project applicant within thirty (30) days of formal
ac,tion by the Board of County Commissioners; as instructed by the Planning
Department Staff.
3. Dedication of the north five (5) feet of the advertised
property along Desmet Avenue for right of way.
4. Dedication of a twenty (_20) foot radius at the northwest
corner of the site, (southeast corner of Pines and Desmet Avenue).
5. Improvement of Desmet Avenue along the project perimeter.
Improvement shall include curbs, sidewalk, paving to existing pavement and
drainage control.
6. Improvement of Pines Road along the project perimeter.
Improvements shall include dement concrete sidewalk, five (5) fee,t in width.
7. Approval of access by the SFokane County Engineer's Office.

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
fIcC Properties, 1014 North Pines Road, Spokane, Washington, for the
above captioned zone classi-fication upgrading; and
The Board having received no recommendation from the Spokane County
Planning Commission as set forth in the Commission's ininutes dated
February 17, 1978; and
The Board having conducted its own public hearing on April 13, 1978
at the request of Larry D. McCormick, McC Properties, and after visiting
the site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the 6oard to approve subject zone change to commercial, subject to
the conditions which have been developed by the Planning Staff and approved
by the sponsor,
The Board also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

FEBRUARY 17, 1978.
WHEREAS, the Spokane County Planning Commission did hoid a public
meeting on February 17, 1978 to constder the testimony and requests of several
appllcants, objectors and other Interested partles concerntng the below referenced
2one reclassifications and other items of buslness, and
WHEREAS, at said heartng opportunity was afforded those favoring and
those opposing all items of business, and
WHEREAS, Mr. NcCoury, Nrs. Byrne, Mrs. Rawlings and Messrs.
Maln and Thomas were in attendance and constituted a quorum, and
VITHEREAS, the Spokane County Planning Commisston fully constdered the
testimony given, the envtronmental review, and all other evldence presented,
recommends to the Board of County Commf ssloners the folYowing:
1. Proposed Amendment to the Spokane County Zoning Ordtnance Regardintz lot
Frontage in the Agricultura 1 Zone. The Board of County Commis sion e..-°~ -'.'s :-ected
a request to the Planning Department to prepare a proposed amendmen} to
the Spokane County Zoning Ordinance; Titte IVy •:to increase the lot f.«nt3ge
for residentlal bullding sites to 100 feet in the Agrlcultural Zone. The Staff
prepared an amendment in compltance wlth the request, adding the prc%'-fsion
that duplexes which are a Condltional Use in the Agricultural Zc%r,e at the
present time, have a frontage requirement increased also.

a) ChanQe in By-Laws The Policy Committee recommended that an amend-
ment be made to the Spokane County Planning Commlssion's By-Laws by
adding a sectlon, "Procedures for Revievving Platting and Zoning". This
addition would be added after the Section on "Commfttees", The
procedures would consider long-range planning, 2oning, and platting
separately.
Mr. Thomas moved, Pfrs. Byrne seconded, that the Commisston accept
the proposal of the Poltcy Committee to change the By-Laws. Motlon
carrled unanimously.
b) Ftndlnqs and Facts for Aqendas for Plannina Commtssion Hearincts In
cooperation wfth the Staff, the Policy Commiftee recommended that the Findings and F3cts prepared for agenda items for consideratfon by the
Planning Commission be made avatlable to the members -seven (7) days
prior to the public hearing.
Mr. Thomas moved, Mr. Matn seconded, that the procedure be fc!!owed

c) SEPA Procedures a The Policy Commfttee recommended that the Planrxing

making sfgniflcant and non-slgnif:cant decislons, etc. The Planning
Director and Deputy Prosecuttng .Attorney vvere directed to coordinate
efforts for this presentation.
3. Citizen Partctpation and Update ef the Comprehensive Plan.
Gary Fergen of the Staff gave a brief summary of efforts betng made to Inform
varlous citizen groups by presenting curre:Ls ~ r.formatton rega"rdrng the upda'te of the Com.prehen:si've Plan and citizen par:;.uipation. • The "Operatton Insight" flyer ts planned for gublfcatlon monthly, givfng up to
date informatton for the calendar of forthco:ning meetings and a synopsis of
current points of interest. The Staff has been requested to make presentations
as result of the distribution of the flyer to the complied mailing llst.
A lifestyle quettfonnaire has been sent out as well as a. suitabillty llfes$yld -
questionnalre. Results of these maitings are still being received by the Staff.
The Staff is working In cooperatton with a workshop session betng held at SFGC
ln conjunction wlth comprehen sive planning and wi= L make a presentatlon durinc
one of the evening sesslons. This ls aslide present-ation.
4. Preparation of SuitabilitV Maps. john Nunnery of the Staff explatned about the
status of destgning suitabliity maps, wtth land use maps to be printed at a

ting Committee and the Advisory Councils. It was esttmated that Staff alterna-

This office would not oppose the rezoning of these parcels but would advise
the applicants that future controls on Sign Route 27 (Pines Road) could
restrict access to right turn only movements along Sign Route 27. This office
would also advise applicants to consider all access onto Pines via existing
county road system inasmuch as the multitude of present accesses have caused
traffic operation problems. If unable to comply with this restriction, all
access onto Pines must be applied for through the Department of Transportation.

Intraduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. The
purpose of this checklist is to hElp the agencies involved determine whether or not a
proposal is such a major action.

opinion, even only slight impacts will result. The reviewers of the chec}:list will be
