received an application for a conditional use from the representative or
owners of East-West Metals. It has been approximately 1 1/2 weeks since
P1r. Braman was i n our offi ce ivorki ng on the appl icati on . At that ti me
all he needed to complete the application were Assessor's maps and a micro-
fiche run and pay his fees, and the application 4vould have been complete.
Since this is a matter of concern to property owners in the area, vrould
you please advise what you are going to do or what action we need to take.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on February 7, 1980,
and the members of the Committee present being John Culler, Chairman, Paul
Sceva, J r. and Ted McCou ry .
B. PROPOSAL
The sponsor, American West Realty, is requesting approval of a change of
conditions, ZE-199-77 to omit a contition requiring a finalization of zone change
within one year of Spokane County Planning Commission's approval and to
approval a new revised Development Plan.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, commercial, church
and undeveloped.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Multiple Family Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been compl ied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses withih
the proposed Zone Classification.
7. That the owners of adjacent lands expressed both approval and disapproval
of the proposed use.
8. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY ENGINEER
1. Applicant shall dedicate 24.5 feet on Knox Avenue and a 20 foot radius
on the southwest corner of Knox Avenue extended and Argonne for
right-of-way.

2. All access to Argonne Road from Knox Avenue extended shail be
restricted until Knox Avenue extended is constructed to Spokane
County standards. (40 feet paving, cement concrete curbs and
sidewal k) . The developer shal I be responsible for one half of the
roadway improvements, one half the cost of updating the existing
traffic signal, and cost of modifying the existing traffic island to
provide for south bound left turn. Said improvements shall be
constructed and the traffic signal updated when development occurs on
the north side of Knox Avenue extended.
3. Appropriate on and off-site drainage and access plans shall be
approved by the Spokane County Engineer's Office prior to the
issuance of building permits for the project.
4. The design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Any portion of
the project which is to be occupied or traveled by automobiles shall be
maintained in hard surface paving.
b) COUNTY HEALTH DISTRICT
1. A detailed combined on-site sewage system and surface water disposal
plan for the entire project shall be approved by the County Engineer
and the Spokane County Health District prior to the issuance of any
building permit.
2. The use of individual on-site sewage systems is authorized subject to
obtaining appropriate permits.
c) SEPA
1. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080
RCW be initiated by the applicant within thirty (30) days of final
action of the Responsible Administrative Body and be completed before
any site improvements are made.
d) ZONING
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of any
building permits.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Administrator
shall be submitted with a performance bond for the project prior to
release of building permits.

3. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Minor variations when approved by the Zoning Administrator will be
permitted, including, but not limited to the following changes:
Building location, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.
4. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
5. All remaining conditions of the original approval shall apply to this
approval.
e) That the Hearing Examiner Committee after hearing all testimony and a
review of the staff analysis adopts the proposed declaration of non-signifi-
cance and directs the chairman of the committee to sign the final declaration
of non-significance.
E. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of American West Realty for a change of conditions as described in
the application should be approved.

Dear Mr. Tnompson:
Tnis letter will serve as our formal application for a change
of conditions on zone change ZE-199-77 granted f rom Multi-
farnily-Suburban to Commercial on June 16, 1978.
4e wish to rnake the following changes of conditions :
Condition "c`°: The plot plan is slightly revised and improved
to include aBurger King restaurant resulting in more land-
scaping and parking.
Conaition "e": This conaition states that if the application
is not adopted one year from date of approval, the application
would be void. Due to unforeseen delays in acquiring title to
tnis property and cooperation from the adjoining property owner
for dedication of one-half of Y:nox Street extended, we are
requesting that Condition "e" be eliminated or an additional
twelvE°-nlonth extension be granted.

WNEREAS, The Spokane County Planning Commis sion did hold a public
meeting on June 16, 1978, to consider the testimony and requests of several
applicants, objectors, and other interested parties concerning the below-
referenced zone classifications and other items of busfness, and
WHEREAS, At said hearing opportunity was afforded those favoring
and those opposing all items of busines s, and
WHEREAS, Mr, McCoury, Mrs. Byrne, and the Messrs. Kennedy,
Culler, Main, and Quigley, were in attendance and constituted a quorum, and
WHEREAS, The Spokane County Planning Commission fully considered
the testimony given, the environmental review, and all other evidence presented, .
recommends to the Board of County Commissioners the `following:

Chairman Ted McCouiy introduced the new Commission member,
John R. Culler of Culler, Gale, Marteil and Ericson, who has
recently been appointed to fill the vacancy caused by Mrs. Grace
Rawlings' resignation. Mr. McCoury paid a public tribute to
Mrs, Rawlings as a thank you for all the tfine and effort she had
devoted to the Planning Commission during her years of service.
b) Regort on Commissioners' AGtions Tom Davis of the staff reported on items whfch had been given
consideration by the Board of County Commissioners recently.
Zone Change application, ZW--26-78, Agricultural to Restricted
Industrial: Rothrock, has been appealed and the Board of County
Commis s ioners will hold their hearing on July 13 , 1978, a t
3:00 p, m.
The Board reversed the Planning Commission's recommendation
to retain Section 4.06.040 which prohibited beauty parlors in
the Two-Family Residential Zone. Beauty Parlors will now be
allowed as a home *occupation in the Two-Family Residential
Zone.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals, The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the envlronment. The
purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a ma jor action.
Please answer the following questions as completely as you can with the information
presently available to you. Please answer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the deqree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are required, or where you
believe an explanation would be helpful to government decision-makers, include your
explanation in the space provided, or use additional paqes, ff necessarX. You should
include references to any reports or studies of which you are aware and which are
