compounds the sxtuation(s). Specifically, at this time, we are asking
your prompt attentian to Flara Road frvm 5prague Avenue south to
Fifth Avenue before a rezaning hearing scheduled for March 17.
From tkae Milwaukee railroad tracks south, a~0' right vf way was
d~eded by the property owners to the county sevaral years ago; however,
due to existing buildings, vnl~ a 40' right of way (30t0--Vre5~i and 30'
east of the liaxe) was secured between Sprague Avenue and the Milwaukee
tracks» Th3,s is not adequate now with motel parking and the increased
traffic, let alvne considering a business east af Flo~a from Sprague
Avenue tv the Milwaukee tracks.

FINDIIVGS A\TD ORDER REGARDING ZONING MAP PROPOSAL, ZE-5-78 , TRANSIENT
LIVING TO COIVIMERCIAL: PEIIRSON, BOYD AND LITTLER
WHEREAS, The Spokane County Planning Commission dicl, after public
hearing on April 21, 1978, forward to the Board of County Commissioners a
recommendation that the Zoning Map be changed from rhe existing Transient Living
Zone classification to the Commercial classification on property described as
follows :
That portion of the N 1/4 of Government Lot 1, lying N of the r/w
conveyed to the Idaho and Western RR Company, exc.ept roads along
the N and West lines thereof in Section 19, Township 25 N. ,
Range 45, E.W,M., Spokane County, V1Tashington.
and
WHEREAS, The applicants before the Planning Commission, Pearson,
Boyd, and Littler, requested that a hearing be set before the Board of County
Commissioners to present evidence and testimony in opposition to certain
conditions of the Planning Commission's recommendations, and
WHEREAS, The Board of County Commissioners did hold a public hearing
on June 1, 1978, to consider the recommendations of the Planning Commission and
testimony and evidence of the applicant and other interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of
County CommissionErs of Spokane County having fully considered the testimony
given, the records and minutes of the Planning Commission and all other evidence
presented and having personally acquainted themselves with the site and vicinity
in question, does hereby find:
1) That the advertised property is located adjacent to a major arterial where
adequate access is of concern to the Board,
2) The Board does have the responsibility to insure that all reasonable
conditions be required to protect public safety and welfare.
3) The Board has consistently been requiring that whenever a proposal
abuts a substandard street, dedication of additional right of way for
public use is essential.
4) The proposed use will not rESUIt in any significant adverse impacts
within the vicinity.
NOW, THEREFORE, The Board of County Commissioners of Spokane County
does hereby conclude that the above-described findings are sufficient and
controlling, and does, therefore, order rhat an appropriate rESOlution to change

the Zoning Map from Transient Living Zone to Commercial be prepared, incorporating
the following conditions :
\1 Dedication of the west twenty-five (25) feet of the advertised property
- along Flora Road for right of way, and dedication of a twenty (20) foot
radius at the northwest corner of the site (southeast corner of Sprague
and Flora Road) . Dedication will occur at time of need as determined by
the County Engineer.
No access shall be allowed to Flora Road until Flora Road is curbed and
paved as directed by the County Engineer, All access to Sprague Avenue
shall be delineated and paved,
3) Approval of access by the Spokane County Engineer's Office prior to
, release of any building or occupancy permits.
4). The applicant's proposal shall be developed in substantial conformance
with the revised development plan dated March 7, 1978.
~~-S) Any portion of the project which is to be occupied or traveled by
automobiles shall be maintained in hard surface paving.
6) An on-site storm-drainage system shall be approved by the Spokane
County Engineer's Office prior to release of building permits.
47) A specific landscape plan, planting schedule, and provisions for
maintenance for the project shall be approved by the Spokane CounCy
Zoning Administrator prior to release of building permits.
; 8) The applicant shall provide a performance bond to cover the cost of the
required landscaping prior to release of building permits.

` 9) Sewage disposal shall be approved by the Spokane County Health
District prior to issuance of building permirs.
10) That the provisions of SEPA's NOTICE OF ACTION pursuant to
43. Z1c.080 RCW and the Board of County Commissioners Resolution
No. 77-1392 be accomplished by the project applicant within thirty
(30) days of formal, action by the Boa rd of County Commis sioners , a s
instructed by the Planning Department st .

IN THE MATTER CONCERNING ZONE RECLASSIFICATION )
ZE-5-78, TRANSIEfJT LIVING ZONE TO COMh1ERCIAL ) COPIMISSIONERS' DECISION
Applicant: Pearson, Boyd and Littler )
This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Pearson, Boyd and Littler, East 15304 Sprague, Spokane, WA for the above
captioned zone reclassification; and
The Board having received the recommendation of the Spokane County
Planning Commission to approve the zone reclassification, subject to
findings and conditions as contained in the Commission's minutes dated
April 21, 1978; and
The Board having conducted its own public hearing on June l, 1978, at the
request of Michael L. Senske, P.E., Principal, Senske & Masgai, East
9723 Sprague Avenue, Spokane, Wahsington 99206 and after visiting the
site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to announce its approval of this zone change subject to
certain conditions to be developed by the County Engineer and Planning
Staff which include but are not limited to conditions concerning:
l. Dedication of right of way on Flora Road
2. Access, ingress and egress
3. Landscaping, plantings etc., including a bond to cover
said landscaping.
The Qoard instructed the Planning Staff to prepare Findings and Order,
for execution by the Qoard at a subsequent meeting, setting forth more
definitively the Board's action in this matter.
The Board concurred in the Planning Staff's recommendation that no
signifiicant adverse impacts will result and a Declaration of Non-Significance
be issues.
