A. INTROCUCTION
This matter having come beforE the Spckane County Hearing Examiner
Committee on September 22, 1983 and the members of the Committee present
being Lynn Tennican, Chairperson, Kathy Carstens and Ken Kennedy.
B. PROPOSAL
The sponsor, John Achord, is requesting approval of Preliminary Plat,
PE-1436-83, ACHORD ADDITION, for subdivision of 1.6± acres into 6 lots for
an existing Yeterinary Clinic, 4-plexes R.0 d h

C. FINDINGS OF FACT
1. That a Conditional Use Permit, CUE-99-75, was approved with
conditions to allow veterinary clinic on this property and later
CUE-99A-75 granted the treating of large animals.
2. That the property was zoned for Residential Office (RO) through
application ZE-196-78 in 1978.
3. That a condition of complying with a"site-plan" was added to
ZE-196-78 approval.
4. That neither the "site-plan" nor the zone change can provide for
separate ownerships of the land, since subdivisian laws address thp
division of land for transfer of separate ownership. -
5. That the sponsor is attempting to create properly recorded lots that
comply with local and state subdivision laws.
6. That the ZE-196-78 zone change to RO and the CUE-99A-75 Conditional
Use Permit for the large animal veterinary clinic, both have
established the land-uses allowed on this property.
7. That since Preliminary Plat Lot 2 was being proposed as less than
current requirements of the R.O. Zone a joint hearing with the
Spokane County Zoning Adjustor was held to expedite a subdivision
decision; whereby, the Zoning Adjustor could grant the Hearing
Examiner Committee a"variance" for the preliminary plat from the
Zoni ng Ordi nance i f necessary.

8. That the September 22, 1983 hearing was contined by the Hearing
Examiner Committee and Zoning Adjustor to allow the parties of record
time to negotiate the location of Lot 2's lot lines.
9. That the Zoning Adjustor under his own set of Findinrs and Grder and
Decision, VE-173-83 and CUE-99-75, did not grant a variance from the
125 ft. road frontage requirements of veterinary clinics in the R.O.
zone for Lot 2.
10. That the Zoning Adjustor did require the additional land to be added
on the north side of Lot 2, to among other reasons, providE for buffering and additional land to assure vehicular traffic with
trailers to travel along the north and rear of the clinic.
11. That the Hearing Examiner Committee concurred with the Zoning
Adjustor's suggestion that the lot lines of the Preliminary Plat for
Lots 3, 4 b 5 be adjusted northward for 101.1 ft. x 118.8 ft. each
and Lot 6 comprising the remaining area (88± ft.).
12. That the Zoning Adjustor did grant a 150 sq. ft. "variance" from the
15,000 sq. ft. requirements of the R.O. zone for veterinary clinics
on Lot 2.
13. That the Hearing Examiner Committee adds as findings the inforriaticn
contained in the September 22, 1983 Staff Report and the
September Zb, 1983 addendum to this Staff Report.
14. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
15. That we have visited the site or reviewed aerial photographs.
16. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with.
17. That the proposal was properly advertised for public hearing.
18. The Nearing Examiner Committee finds the proposed use is not
detrimental to the general purpose or othe rwise harmful to the public
health, safety, and welfare.
D. SPECIAL CONDITIONS OR CONTINGENCIES APPLICABLE TO THIS DEOISION:
Those conditions as listed in the September 22, 1983 STAFF REPORT.

PRELIMINARY SUBDIVISION PROPOSAL )
(PE-1436-83).
THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane
County APPROVING the application. Having fully considered all testimony
presented at the Subdivision Hearing Examiner Nearing on September 22, 1983
and the continued hearing on September 26, 1983, and further having visited
the site and vicinity in question, and having rendered a decision on the 29th
day of September, 1983, APPROVING said proposal as noted in the Planning Staff
addendum dated September 26, 1983, does hereby make the folloaving:
FINDINGS OF FACT
1. That the property was zoned Residential Office through application
ZE-196-78 and that such rezoning requires that animal clinics contain a
minimum of 15,000 square feet lot area and a minimum of 125 feet of public
lot f rontage.
2. That in the above referenced subdivision (PE-1436-83) lot #2 was initially
proposed to be approximately 101 feet wide and 118 feet deep thereby not
conforming to either standard within the Spokane County Zoning Code.
Additionally, large animals have prediously been approved for care at the
veterinary clinic.
3. That the veterinary clinic aras as established use prior to the submission
of the subdivision noted above.
4. That the applicant's request as modified shows lot #2 on which the
veterinary clinic is located to contain 125 feet of frontage, but to be
approximately 150 square feet less than the required 15,000 square feet of
1 ot area.
5. That the Zoning Adjustor finds that the above-mentioned deficiency in lot
area is insignificant and does not represent a detriment to adjoining
property owners in that no-one appeared to oppose the action nor were any
written comments received in opposition to it.
6. That the Zoning Adjustor recommended to the Spokane County Hear-Ing
Examiner that lot #2, as modified in the September 26 continued hearing on
the above mentioned items, be approved with 125 feet of f rontage and that
the lots #3, #4, and #6 be adjusted northerly approximately 25 feet to
accomodate the veterinary clinic lot.
7. That the Zoning Adjustor recognizes previous conditional use permits
allowing for the care of large animals and sites such continued care to be
authorized under the variances and conditional uses granted.
8. That the proposal was properly advertised for public hearing.
9. That the proposal is generally compatible and not otherwise harmful to the
public health, safety, and welfare as modified at the September 26 hearing.
10. That the Zoning Adjustor's action is concurrent with the hearing Examiner
Committee action and specific conditions of approval incorporated with that
insofar as finalizing subdivisions are incorporated herevrith.

DECISION
From the foregoing findings, a review of the Planning Department File No.
VE-173-83, CUE-99-75, testimony at the public hearing, and a site visit, the
Zoning Adjustor hereby in APPROVING the proposal makes the following
recommended conditions of approval to the Subdivision Flearing Examiner
Committee:
1. The Preliminary Plat Lot 2 of PE-1436-83 is to be increased in size
by adding additional land to the north side so that the frontage is
125 feet. Lots 3, 4, 5& 6 can be shifted north leaving lots 3, 4&
5 101.1 x 118.8 with lot 6 with the remainder.
2. A"Minor Variance" is granted for Lot 2 being 125 ft. x 118.8 ft. _
14,850 sq. ft. or 150 sq. ft. short of the requi red 15,000.
3. The CUE-99A-75 condition for 50 ft. setback f rom all property lines
is hereby removed; that all other conditions of this Conditional Use
permit is hereby retained and to be enforced, with particular
emphasis on CUE-99A-75 Condition No. 4"No animals will be allowed
outside the building while they are in the custody of the clinic."
and No. 6"The Zoning Adjustor reiterates Condition #5 that no
animals shall be kept outside the structure."
, 4. The treating of large animals shall be allowed to continue as
conditioned pursuant to CUE-99A-75, whereby all animals are to be
retained inside the clinic at all times while under the care and/or
treatment of the Clinic Veterinarians ---no animals are to be penned,
kenneled, stores or kept outside the building (clinic).

and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and Glenn Quigley and there being the following persons present who
wish to request approval of a Zone Change; Silas Bates for a Zone Change,
Agricultural to Multiple Family Suburban and Residential Office for the purpose
of apartments and office.
B. FINDINGS OF FACT
1. That the existing land use in the area is Residential, veterinarian office,
and corrals/pasture.
2. That the Comprehensive Plan designates this area as appropriate for
Residential development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been compl ied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion or intent of adopted policies.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.

Comprehensive Plan: URBAN and within the Priority Sewer Service Area
- (PSSA) boundary.
Proposal: The sponsor is requesting approval to subdivide 1.6± acres
into 6 lots for R.O. land uses; specifically an existing veterinary
clinic, future 4-plex dwellings and future offices. The request
also includes a change-of-condition f rom the approved "site plan"
of ZE-196-78, in which the property zone classification was changed
to R.O. The request also involves considerations for "early-start"
Building Permits involving two existing 4-plex structures to be
relocated onto this preliminary plat site. The sponsor has requested
the ability to finalize the preliminary plat in phases for Lots 3,
4, 5& 6 separate from Lots 1 and 2. This preliminary plat decision
will be coordinated with the Spokane County Zoning Adjustor's
decision, as this will be a public hearing held jointly by the
Hearing Examiner Committee and the Zoning Adjustor. (see below
VE-173-83 & CUE-99-75). Page 4 shows the Preliminary Plat of Record
map and the property involved with the variance.

Proposal: John Achord (applicant of the preliminary plat and the previous
property owner of the Veterinary (Vet.) Clinic) and Doctors Patricia
Hoffman and Dale George (current owners of the Vet. Clinic and property
owners of Lot 2 of the Preliminary Plat) are requesting the Zoning
- Adjustor to resolve issues* regarding appropriate size and frontage for
a Veterinary Clinic in the RO zone. The existing property frontage is
101.1 feet along Sullivan Road while 125 feet is required and the exist-
ing property size is 12,010.68 square feet while 15,000 square feet is
required for this existing land use. This decision will affect the
preliminary plat decision by the Hearing Examiner Committee since the
preliminary plat lot lines may need to be relocated. Also, the original
conditions placed on the Conditional Use Permit #CUE-99-75 and its
amendment #CUE-99A-75 are to be considered by the Zoning Adjustor regard-
ing setbacks of the clinic from property lines and from residential
dwellings and the treating of large animals within the clinic.
* Two requests regarding the variance are being made:
John Achord is requesting the variance to be granted persuant the
lot size he sold to Dr's Hoffman and George, that being approx-
imately 101.1 f eet along Sullivan by 118.8 feet deep or
12,010.68 square feet.
Dr.Hoffman & Dr.George are requesting that full road frontage
of 125 feet be required and full lot size of 15,000 square feet
also be required; therefore, granting of no variance from the
standards set forth in Section 4.24.350 of the County Zoning Ord.,
that granting of such a variance as requested by John Achord would
impair the use and value of the property as; loss of necessary
- parking with Sullivan Road being improved, loss of access to the
rear of the clinic on the north side, septic tank drainfield extend-
_ ing beyond their property, and with such problems the marketability
of the clinic and property could be impacted. They are also request-
ing that treatment of large animals be allowed to continue as orig-
inally conditioned.

In 1975: John Achord owned 3.7 acres known as Tax Parcel #23541-1401*
(E 2/5 of Tract 134 of VERA), which had a single-f amily dwelling, garage
andsheds on the northeast portion of the parcel at 4th Ave. and Sullivan
Road, see page 4. = See page 9)
May 14, 1976: John Achord was granted a Conditional Use Permit
#CUE-99-75 for a Small Animal Veterinary (Vet.) Clinic with the following
conditions: (Note Condition #2.)
l. Approval by the Spokane County Zoning Adjustor of a specific
plot plan, off-street parking plan and landscape plan is
required prior to the release of any building permits.
NOTE: The applicant is required to locate the animal clinic
f acility in such a way as to provide for the extension
of Fifth Avenue, and required setbacks.
2. The animal clinic must be located a minimum of fifty (50) feet
from any property line and two hundred (200) feet from any
existinq dwelling unit, other than the dwelling of the owner.
3. The applicant is required to sound-insulate the proposed
f acility and shall submit to the Zoning Adjustor plans for
the sound-insulation prior to release of building permits.
4. The animal clinic shall be operated to care only for small
animals, domestic pets rather than farm stock such as horses
or cattle.
5. No animals will be allowed outside the building while they are
in the custody of the clinic.
6. The applicant shall dedicate the east ten (10) feet of the
property for future widening of Sullivan Road.
December l, 1976: John Achord submitted to Spokane County Building
Codes Building Permit Plans for the Vet. Clinic to be located 170 feet
north of the south property line and 50 feet west of Sullivan Rd. right-
of-way (page 7). The plans included a landscape plan as required by
CUE-99-75 and the necessary sound-insulation for the building. The
Building Permit was issued 12/14/76. Note: the 175 feet setback placed
the clinic 200 feet north of the existing dwelling to the south of John
Achord's property. Also the permit was issued pursuant to an approved
landscape plan (see page 7) which did not provide for a driveway on
the north side of the Building nor did it provide for parking in front
of the Building or parking to the north of the Building. .

December 10, 1976: As part of the financial arrangements for the
clinic, John Achord filed a Mortgage with Spokane County Auditor for
160 ft. x 272 ft. on which the clinic would be built. This "file-of-
record" caused Tax Parcel #23541-1401 to be segregated into
#s23541-1406 (the Vet. clinic site) and 23541-1407. See page 9.
May 24, 1978: A change-of-condition to the Vet. Clinic Conditional
Use Permit was granted to John Achord as CUE-99"A"-75 to allow treating
of large animals inside the clinic only, while retaining all other
conditions except #4 of CUE-99-75. Note: no animals of any size are
allowed outside the Uet. Clinic building and the building was sound-
insulated.
November 30, 1978: Silas J. Bates (Sy Bates), agent for John Achord,
made ZE-196-78 application for a zone reclassification from Agricultural
to Residential Office (R.O.) for the east 112 and Multiple-Family
Suburban (MFS) for the west 1/2 of said 3.7 acres, which included both
Tax Parcels #23541-1406 & 1407. The Hearing Examiner Committee approved
the zone change pursuant a"site-plan" on January 19, 1979. Due to an _
appeal, the Board of County Commissioners upheld the Hearing Examiner
Committee"s decision on March 19, 1979. The Zoning Administrator
approved a"Revised Site-Plan" as being in substantial conformance to _
the ZE-196-78 approval. Note: the east 112 of the property with the
R.O. zone is the same property involved in the preliminary plat application
PE-1436-83 and which includes the Vet. Clinic and involves the variance
VE-173-83. See page 9.
October 26, 1979; As a result of Sy Bates purchasing the west 1/2
of John Achord's property with the MFS zoning the Tax Parcels 23541-1406
and 1407were further segregated into 23541-1408 (being the west 1/2 owned
by Sy Bates) and 23541-1409 (being the north 112 of John Achord's east 1/2)
and 23541-1410 (being the south 1/2 of John Achord's east 1/2 with the
Vet. Clinic). Note: this transfer of ownership constituted a violation
of local and state subdivision laws. See page 9.
May 7, 1980: As a result of John Achord's selling a middle portion
of his south property (approximately 100 ft. x 118.8 ft.) with the
Vet. Clinic to Dr. Patricia Hoffman and Dr. Dale George, the Tax
Parcel 23541-1410 was further segretated into Tax Parcels 23541-1412
(being the Vet. Clinic site) and 23541-1411 (John Achord's property
south of the Clinic property) and 23541-1413 (again John Achord's north
property). Note: this transfer of ownership constituted the second
violation of local and state subdivision laws. See page 9.

History: (cont'd)
July 28, 1983: Karen L. (Spratt) Bates, being no relation to
Sy Bates, made application for a Building Permit to relocate two
existing 4-plex structures onto property being sold to her by John
Achord under a"purchase agreement", being Tax Parcel 23541-1413 and
a portion of 23541-1409. Upon review of the permit application by
the County Planning Department, it was determined that subdivision
laws were about to be violated for the third time and John Achord was
verbally notified through his realtor, Rob Higgins, that a subdivision
was required. Note: A third violation was not committed since the
property sale was not yet completed.
Comment: John Achord was, for the first time, made aware-of require-
ments regarding segregating and sale of his property persuantto subdivision
laws, after having already made successful transfer of his property to
Sy Bates in 1978 and to Doctors Hoffman and George in 1980. These previous
"successful" transactions with the recording of 1% tax documents with
Spokane County's Treasurer and segregation applications for the property
with Spokane County's Assessor through the professional services of
realtors and closing attorneys of sales contracts point out a basic _
problem that persists in Spokane County the Spokane County
Administrative Departments, County Treasurer's Office, and County
Assessor's Office do NOT coordinate to assure that County and State laws _
are being complied with leaving a property owner such as John Achord
with a surprising realization that he has not been complying with the
various laws after having gone through two Spokane County offices,
realtors, and closing attorneys.
August 12, 1983: John Achord, realizing the need for a subdivision
and being readily willing to comply, made application for a preliminary
plat and on August 15, 1983 and made application for a Variance
regarding the Vet. Clinic. Mr. Achord has paid all necessary fees
and is attempting to resolve this legal matter through the "due process".
September 2, 1983: Since property owners are required to participate
in Variance proceeding involving their own property, the current owners
of the Vet. Clinic have joined the variance application with a supplement
and signatures.
Issues of Requested Decisions: As noted in the History section above,
the Land Use issue/decision has already been made; as, the issuance of
a building permit for the Large/Small Animal Vet. Clinic pursuant the
Conditional use permit CUE-99A-75 and the zone change to R.O. zoning
of ZE-196-78 have both already approved the type "land-uses" to be
allowed on this property. Therefore, the type "land-uses" is NOT an
issue of these applications. -

The public hearing is intended to address two issues:
lst, the "land-use compatibility" of the existing Vet. Clinic
regarding setbacks, road frontage and lot size, and
2nd, the "division-of-land" to allow separate ownerships.
The Zoninq Adjustor will address the lot line location
of the Preliminary Plat Lot 2 for a Veterinary Clinic in the Residential
Office (R.O.) zone regarding compatability of the land uses.
The Hearinq Examiner Committee will address the overall divisions of the
preliminary plat property to accommodate separate owners for land uses
allowed in the existing R.O. zone on this property.
- II. SITE PLAN INFORMATION
A. Site Size: 1.6± acres
B. Site Characteristics: The site is vacant except preliminary plat
Lot 2 has an existing Vet. Clinic and Lot 6 has an existing
single-family dwelling.
C. Neiqhborhood Characteristics: The proposal is part of a predominately
single-f amily neighborhood on the west side of Sullivan Road, with
a transition from R-1 to Multiple Family to the proposal with
approved Residential Office being adjacent the major arterial,
Sullivan Road. East of Sullivan Road the neighborhood consists
of acreage ownerships with few single-family homes, Central
Valley School, and approved multiple f amily.
D. Agricultural Summary: The Comprehensive Plan designation URBAN does
not support agricultural uses.
E. Zon i ng:
Proposal - The sponsor is proposing a change-of-condition of the
approved "site-plan" of the existing R.O. zone approval
ZE-196-78. Additionally, a change-of-condition is
being requested of the Zoning Adjustor for the Conditional
Use permit CUE-99A-75.
Site - The existing zoning is R.O., 1978.
North - The existing zoning is Agricultural, 1942.

Northeast - The existing zoning across Sullivan is MFS, 1978.
East - The existing zoning across Sullivan is Agricultural, 1942.
South - The existing zoning is Agricultural, 1942 with R-2, 1975,
approximately 100 ft, further south.
West - The existing zoning is MFS, 1978 and R-1, 1972,
130 west of the proposal site and Agricultural, 1942,
beyond the R-l.
F. Land Use:
Proposal - The land use is already established through the R.O.
zone ZE-196-78 for Residential Offices and Multiple-
Family dwellings and through the Vet. Clinic conditional
use permit.
Site - Existing Vet. Clinic at south end of the site and a
single-family dwelling at the north end.
North - Small segregated single-f amily ownerships and single-
f amily subdivision north and northwest of these
_ segregations.
East - Large acreage ownerships with few single-f amily homes.
Southeast - Central Valley High School
South - Single-f amily home on one-acre+ ownership with subdivided
lots south of this having duplexes.
West - Vacant land with approved zoning site-plan for
multiple family dwelling and 130 feet futher west is
a subdivision with single-f amily dwellings.
G. Comprehensive Plan Desiqnation: The Comprehensive Plan designates
this area west of Sullivan as URBAN and east of Sullivan as
SUBURBAN. The proposal is within the Priority Sewer Service
Area (PSSA). The proposal to locate 4-plex dwellings and offices
along Sullivan, a major arterial, which meets the purpose of the
Comprehensive Plan guideline policies. The conditions of the
Conditional Use Permit CUE-99A-75 (all animals to be treated
and retained within the clinic and the building being sound-insul-
ated with no windows on the north, south, or west) all meets the
Plan's policies for adjacent land-use compatibility regarding noise.
H. Special Information:
Circulation - The proposed lots and the Vet. Clinic all f ront
onto Sullivan Road. Sullivan Road between Sprague
Ave. and 16th Ave. is to be improved through a
County Road Project (CRP) for a 4-lane arterial
with sidewalks along the east side of Sullivan with
construction due in early 1984.

Vet.Clinic
Parking/Driveways - The building permit for the Clinic as issued
on Dec. 14,1976 did NOT provide (via the parking
and landscape approved plan) for a driveway on
the north side of the clinic nor did it provide
for driveway and parking stalls in front of the
clinic ----see page 7 landscape plan; however,
the clinic site was developed and built as shown
on the sketch of page 15. As is shown, a gravel
driveway for access to the rear clinic door and
operating room was built approximately 10 feet
north of the clinic, a paved driveway was placed
in front of the clinic, parking stalls were also
placed directly adjacent and in front of the clinic,
a landscaped island was placed in front of the
clinic adjacent Sullivan leaving approximately 12
feet between ZO foot long parking stalls in front
of the clinic and the landscaped island, and the
overall parking lot paved is shown with shading _
on the sketch of page 15.
Detailed and surveyed Construction Plans for the
1984 Sullivan Road Improvements show the existing
locations.and distances used to make the sketch on
page 15. These Construction Plans indicate that:
l, the Sullivan Road Curb and Paving will come
within 5 feet of the clinic property-line,
2. the landscaped island will be removed and
replaced with a 5 foot drainage swale between
the curb and property-line and replaced with
a paved driveway between the property-line and
the parking stalls in front of the clinic.
These Sullivan Road improvements will NOT eliminate
the Vet.Clinic's parking in front of the clinic,
it will in fact improve the access and use of these
existing parking stalls by expanding the existing
12 foot driveway to a 20 foot paved driveway (being
an additional 8 feet). See page 15.
The Planning Department staff is recommending adding
10 feet to the north side of the preliminary plat
Lot 2, which will provide for additional spacing
between the clinic and the proposed two-story
4-plex and will assure continued "one-way" traffic
over the existing gravel driveway along the north
side of the clinic providing the necessary access -
for the current and past use of the clinic's rear
door for delivery of large animals and supplies.
Additionally, this area being non-paved may need
to be used to relocate one leg/run of the drainfieldo

Sewage Disposal - On-site septic tanks are being recommended by
County Utilities with provisions to connect to
the Valley area-wide sewer system with ULID
agreements and double-plumbing for all but the
Vet.Clinic.
The Preliminary Plat map and building permit maps
for the Vet. Clinic show the septic tank drainfield
as extending beyond the current ownership/lot-lines
of Lot 2 for the Vet. Clinic. Although the actual
location of these drainfield lines may not be
located as shown on the map (see pages 4 and 7), it
must be assumed they were installed as approved on
the building permit map; therefore, the Clinic
drainfield lines are on Sy Bates property to the
west and on John Achord's property to the south and
encroaching into the required 10 foot setback of
all property-lines.
The County Health District is recommending that
prior to finalizing this protion of the preliminary
plat that the drainfield lines be located and -
moved inside Lot 2 property lot lines by 10 feet,
and cannot be placed under paved surfaces or within
10 feet of the clinic as health regulation specify.
The Planning Department staff is recommending that,
in addition to the 10 feet being recommended to be
added to the north side of the Preliminary Plat
Lot 2, an additional 10 feet be added to the south
side of Lot 2 to assure the necessary unpaved pro-
perty to relocate this drainfield within a 10 foot
property line setback. This additional south 10 feet
will assure the "loop" for "one-way" traffic around
the rear of the Clinic on the gravel driveway.
Lot Sizes and - The Planning Department Staff is recommending that
Road Frontages Lot 2 be increased in size for reasons as stated,
this wi 11 create lot frontage for Lot 2 of 121.1
feet along Sullivan (being 3.9 feet short of the
RO zone requiremant of 125 feet); and, this
increase will cause Lot 2's area to change from
12,010.68 square feet to 14,386.68 square feet
(being only 613.32 square feet short of the RO
zone requirement of 15,000 square feet).
In making this recommendation, staff also considered
the affect that changes to Lot 2 would have on the
remaining lots. By adding only 10 feet on the north
all Lots 3, 42 5, and 6 being purchased by Karen L.
(Spratt) Bates for 4-plex dwelling sites will leave

Lot Sizes and - (cont'd)
Road Frontages 101.1 feet of f rontage on Sullivan which is needed
to have the required 12,000 square feet per lot for
multiple-f amily dwellings (each 1ot being 101.1 x
118.8 = 12,010.68 square feet). By adding only
10 feet to the south part of Lot 2 will leave 91.1
feet of frontage on Sullivan for Lot 1 south of the
Clinic (90 feet being the minimum frontage required
in the RO zone for office buildings).
The overall considerations for the size of Lot 2
resulted in a recommendation that solves the Vet
Clinic site problems and retains usable lot sizes
in the rest of the Preliminary Plat.
Change-of- - The"Change"from the approved "site-plan" of the
Conditions RO zone reclassification ZE-196-78 to platted lots
without a site-plan is controlled by the lot sizes
and the existing regulations of the RO zone.
" The"Change"of the condition for the Conditional Use
Permit CUE-99A-75 regarding the 50 foot setback from
_ all property lines is again being resolved by the
approval of a preliminary plat where lot sizes and
RO zone regulations for setbacks will assure land
use compatability. '
Phasing of the - Since there will be three individual involved
Preliminary Plat with civil type mattersregarding Cot -2 (the
cost and manner of relocating the drainfield
and transf er of additional land to the clinic
property title) and since there are two other
individuals (John Achord being common in both)
involved with Lots 3,4,5, & 6 regarding the
relocation of two existinq (temporarily setting
on house moving equipment in the Counties right-
of-way with exposure to the elements) needing to
be moved onto the Preliminary Plat site as soon
as possible, staff is recommending that the plat
be allowed to be finalized in two phase, if
necessary, one phase being Lots 3,4,5 & 6
and the other phase being Lot 1& 2.
Early-Start - With Spokane county f acing some liability risks

the Final Plat is recorded; therefore, staff is
recommending that prior to issuing any building
permit for Lot 5 or Lot 6 that the garage be
relocated or removed.
Water - Vera Water District will provide water to this
preliminary plat and will be required to approve
. a water plan prior to finalizing the plat.
Fire - The proposal is located within Fire District #1
which will be required to approve fire protection
prior to finalizing the preliminary plat via the
water plan mentioned above.
Schools - The proposal is located within the Central Valley
School District #356 with Central Valley High Sch. _
adjacent and across Sullivan Road to the southeast.
Parks - The property is already zoned for RO uses, which .
precluded any public parks on this property.

Zoning
Ordinance - July 6, 1982 with Resolution #82-0668 the Board
of County Commissioners added regulationsand
provisions for large animal Veterinary Clinics
where 1-acre would be required with 125 feet
of frontage. Since, the Conditional Use Permit
CUE-99A-75 authorized large animal treatment
with conditions of indoor retention and sound-
insulation of the clinic and the continued
treatment of large animals does constitute a
"non-conforming use" in todays R.O. zone,
staff recommends that treatment of large animals
be allowed as originally conditioned.
_ III. BACKGROUND/ANALYSIS
A. Land Use: Staff finds that the proposed and existing land-
- uses to have already been established through decisions of ZE-196-78
f or R. 0. and of CUE-99A-75 f or a Uet. C 1 i n i c; however, staff does
note the proposed land uses for 4-plexes and the existing and
future R.O. type offices to be a compatible land use adjacent a
major arterial and future multiple-f amily dwelling to the west.
That a transition of land use and structure "scale" will be made
from the existing single-family dwelling adjacent and south of the
proposal to a small office on Lot 1(as dictated by the lot size,
required parking, and area necessary for a drainfield) and the
existing Vet. Clinic and then a two-story 4-plex (being spaced 30
to 40 feet from the Vet. Clinic) and followed by three other 4-plex
structures.
Staff is recommending that the preliminary plat of Record Lot 2 be
extended 10 f t. to the north and 10 f t. to the south, 1 eav i ng Lot 1
91.1 f t. x 118.8 ft, and Lots 3, 4, 5& 6 all 101.1 x 118.8 (note
Lots 5~ 6 wou 1 d change f rom 106.1 ft.).
These adjustments to the lot lines of the Preliminary Plat of
Record map will accomplish the following:
l. The size and road f rontage dimensions for a Vet. Clinic
will be very close to the R.O. requirements.

2. The Vet. Clinic will be able to continue to function
as it was purchased with existing driveways and
parking.
3. There will be room to relocate the septic tank drain-
field within the setbacks required by County Health
all on Lot 2.
4. The remaining preliminary plat lots will be of minimum
size or frontage for R.O. uses.
B. Zoning_: Staff finds that the existing zoning of R.O. allows
residential offices and multiple-f amily dwellings and that the
R.O. zone establishes standards f or size and frontage; there-
f ore, staff recommends approval of the amended lot lines of the
preliminary plat as recommended by staff, thereby allowing
efficient fill-in development and assured continued function
of the existing Vet. Clinic.
Staff recommends the "site-plan" condition of ZE-196-78 be with-
drawn, since the preliminary plat amended lot sizes and the R.O. .
zoning standards will provide for a11 necessary setbacks and
proper uses.
C. Zoning Adjustor: Staff finds that the recommended 10 ft. on the
north and south side of Preliminary Plat Lot 2 will meet the
purpose and intent of the R.O. zone to assure proper spacing
of structures, proper setbacks, and compatible mix of land uses,
as the amended Lot 2 will be within 3.9 ft. of the necessary
frontage and within 613.32 sq. ft. of the lot area required of
R.O. veterinary clinics.
Staff finds that the CUE-99A-75 conditions have provided assurances
for compatible land uses related to animals and adjacent residential
dwellings, with sound-insulating of the clinic and retension of
all animals inside the clinic. And staff finds the elimination
of CUE-99A-75 condition for 50 ft. setbacks from all property
lines to be appropriate since the above conditions and the existing
standards of the R.O. zone will properly address necessary set-
backs along with the change in Lot 2 size as recommended.
D. Comprehensive Plan: Staff finds that the existing Vete Clinic and
preliminary plat proposal as amended (lot lines) will meet the
purpose and intent for "fill-in" development and also assures -
proper adjacent land use compatibility.

IV. ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by thesponsor and has been
reviewed by the Planning Department staff. No Significant adverse
environmental impacts were judged to exist.
Possible slight adverse environmental impacts were identified on the
checklist in the following categories: earth, air, water, flora, noise,
light and glare, land use, patural resources, population, housing,
transportation/circulation, public services, energy, and utilities.
The County Subdivision Administrator issued a"proposed Declaration of
Non-Significance", and it was circulated to other agencies of juris-
diction and staff recommends a"Final Declaration of Non-Siqnificance"
be signed.
V. LEAD AGENCY RECOMMENDATION
The Spokane County Planning Department in considering the above information
and conclusions, and furtherconsidering the forthcoming public testimony
would not identify unanticipated and unresolvable problems, does
_ RECOMMEND APPROVAL for:
l. The preliminary plat PE-1436-83, as amended by the Zoning Adjustor.
2. The Change-of-Condition of ZE-196-78, to eliminate the "site-plan"
condition.
.
3. The ability to issue "Early-start" Building permits for the two
4-plex structures now in Spokane County right-of-way.
4. The variance on Lot 2 of the preliminary plat with the addition of
10 ft, on the north and 10 ft. on the south (making all Lots 3, 4,
5& 6 101.1 ft. wide along Sullivan).
5. The change-of-condition of CUE-99A-75, to eliminate the condition
for a 50-ft. setback from al1 property 1 ines.
6. The continued treatment of large animals as was approved by
CUE-99A-75.
This recommendation is, in p art, based on the following recommended
"conditions of approval"; and therefore, staff additionally recommends
that the below conditions be attached to the Hearing Examiner Committee
approval and the Zoning Adjustor approval, if approval is granted.

- VI. CONDITIONS OF APPROVAL
If approval is granted, the following conditions are recommended to the
Hearing Examiner Committee.

COUNTY PLANNING CONDITIONS
5. That the plat be designed as indicated on the preliminary plat of
record, as may be amended by the Spokane County Zoning Adjustor, and/
or attached sheets as noted.
6. That the preliminary plat of record approval is for the property
described in the Legal Description, signed and stamped by the
sponsor's licensed land surveyor, attached to the application of
this proposal.
7. That the preliminary plat be given conditional approval for three
(3) years to October 1, 1986. The applicant may request a one (1)
year Extensi on of Time by submi tti ng a wri tten request forty-fi ve
(45) days prior to the above expiration date. Such applications
should demonstrate the progress made toward finalizing this
preliminary plat. If a Time Extension is not requested in a timely
. manner or a Time Extension is not granted, then the preliminary
plat approval is NULL & VOID.
8. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter
43.21c.080 RCW be initiated by the project applicant within thirty
(30) days of final disposition of this application, and prior to
any on-site improvements unless the applicant(s)/sponsor(s) chooses
to file a notarized Waiver of Notice of Action with the Spokane
County Planning Department.
9. Pursuant to the provisions of Chapter 43.21C. RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's adverse impacts
to the physical environment; a finding is hereby made that no
potentially significant adverse impacts upon the physical
environment are anticipated as a result of this project; and a
final declaration of non-significance is hereby to be issued.
10. That a name be indicated before the final plat is filed; such name
to be approved by the County Assessor and the Planning staff.
11. That appropriate street names be indicated, and approved by the
County Subdivision Administrator.

12. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distribution to the Planning
Department and the utility companies. blritten approval of the
easements by the utility company must be received prior to the

13. That the plan for water facilities adequate for fire protection be
approved by the water supplier and fire protection district. Said
water plan must also have been approved by the appropriate health
authorities. The health authorities, water supplier (purveyor),
fire protection district, and County Building and Safety Department
will certify, prior to the filing of each phase of the final plat,
on the face of said water plan that the plan is in conformance with
their requirements and will adequately satisfy their respective
needs. Said water plan and certification will be drafted on a
transparency suitable for reproduction. -
The pu rveyor will also certify prior to the filing of the final
plat on a copy of said water plan that appropriate contractual -
arrangements have been made with the plat sponsor for construction
of the water system in that phase, in accordance with the approved
plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system and
inspection by the appropriate health authorities prior to
application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and
the purveyor harml ess from cl aims by any 1 ot purchaser refused a
building permit due to the failure of the plat sponsor to
satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that:
"the publ i c water system, as approved by County and State Neal th
authorities and the local fire district and County Building &
Safety Department, and purveyor, will be installed within this
plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot prior to sale of
each lot."
14. That a current certificate of title be furnished the Planning
Department prior to the filing of the final plat.

NOTE this condition does not stipulate how this transfer of
ownership to the property title is to be accomplished nor does this
condition address cost or value of this property, as this
transaction is a"civil" matter between John Achord and Doctors
Hoffman & George.
19. That prior to issuing aRy building permit on Lots 5 or 6 the garage
on Lot 6 is to be removed or relocated with proper setbacks from
property lines.

Road Improvement Project is sanctioned by Spokane County. The
improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the owner, their heirs, grantees and
assigns. The dedicatory language of the plat shall exclude Parcel(Lot)
#2 from being bound by this provision.
39• The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches,
drainage, and fees in new construction.
40. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing
County Road System warrants the dedication of additional
right-of-way and the roadway improvements herein specified.
COUNTY UTILITIES DEPARTMENT
41. Pursuant to the Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance with
al l rul es and regul ati ons of the Spokane County Heal th Di strict and

42. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of a
ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Onwer(s) property. PROVIDED, this condition shall not prohibit the
Owner(s) or Successor(s) from objection to any assessment(s) on the
property as a resul t of improvements cal 1 ed for i n conj uncti on wi th
the formation of a ULID by either petition or resolution method
under RCW Chapter 36.94.
43. Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane County, as
amended.
44. Each new unit shall be double plumbed for connection to future
area-wide collection systems.
COUNTY HEALTH DISTRICT
45. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Health
District prior to the issuance of any building permit for this
project.
46. The dedicatory language of the plat will state that: "Subject to
specific appl ication approval and issuance of permits by the Heal th
Officer, the use of individual on-site sewage systems may he
authori zed .
47• Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social & Health Services.
48• Prior to filing the final plat, the sponsor shall present evidence
that the plat lies within the recorded service area of the water
system proposed to serve the plat. The dedicatory language on the
plat shall state: "Use of private wells and water systems is
prohibited."

50. Prior to filing the final plat, the sponsor shall demonstrate to

suitability of the soils on each lot for on-site sewage disposal.
51. Prior to filing the final plat, the existing on-site sewage system
serving the Central Valley Yeterinary Clinic shall be relocated
wholly within the boundaries of Lot 2.
NOTE: This condition does not address who will assume the cost
and/or responsibilities of refocating the drainfield, as this is a
"civil" matter between John Achord and Ooctors Hoffman b George.

This is in reference to the proposad property- on the corner of
fourth and Sullivan road. c.✓
When PJIr. Si Bates 'came to our house and Presented his plans to build
agartments, we were impr*sed, and thou ht it c~ould be a finE idea. But as soon as 1~1r. Bates
.left, c~e caere starti.ng io have second ~houghts about the whole thing. Tie nov are not in favor
of these plans for the following reasons:-
1. Everyone in our neighborhood that we have talked to cJas told something different about
the whole thing.
2. Vtie feel that with these apartments it will cause more of a traffic problem than there
already. And with the apartments that vai11 be built on t~g
b'et cor er of fourth and sullivan
and the traffi.c from Central Valley riigh school, this is jus~ too mnc~:
3. In this area there are alot of sma1.l children walking to and from school. We feel that it
would be hasordes for them.
4. We feel that the aFartments will hurt the value of our property if any of us wanted to sell.
5. ~"Je feel trat these apartments wi11 cut our privecie dovin to nothing. Vie have two dogs,
whicii vie Do Not lot run that are fenced a$ a11 time.We are afraid that they 'Would 'oe a cused
of barking which triey do not do. They are srow dogs and very well trained.
6. Vr'ith al1 of the building going on in the valley vae feel this vill add polution to the
aquifer, which they already are having trouable with.
In closing, we feel the proposed plans should be changed to sin;le.family housing, iy
somethin Y?as to go in there.
Personal~~I myself vould rather not rave anything at alI built there. Seems like every-
time there is a plst of 1and some one has to come along and put housin4 on it no matter
how large or small it is. Sooner or later people are going to get fed up vith all of this
buildino and put a stop to it. Seems like tlrsere a-re enough empty rouses 2sound and more
than enougb vacant apartments that could be filled.

Subject Revised Plot Plan for ZE-196-78 ,
After reviewing the revised plot plan for ZE-196-78, I find it to substantially
conform to the plot plan as submitted and recommended for revision during the
Appeal hearing before the Board of County Commissioners.
At that hearing, an error was found in the side yard setback for the Multiple
Family Suburban zoned property. Subsequently, Mr, Bates had the plans revised
to meet the setback requirements. No additional units or additions to ground area
coverage were added. The general configuration of buildings remains the same,
with only the multiple family units' parking lot changing. This change allows for
a far greater setback of tho proposed buildings from the single family residential
development to the West.
Therefore, this plan does not violate the original intent of the zone application
a s propo sed originally.

request on January 19, 1979, did approve unanimously said application; and

WA 99037, and after visiting the site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon

As required in 'V`iAC 197-10-320, the staff of the County Planning Commissfon
reviewed the environmental checkllst submitted my Nir. D-on Swanson for
Donald Swanson and Donald Bard2n for a zone change from Agricultural
Suburban to Multiple Famlly Suburban. The proposal is located approximately
in the SE 1/4 of the NE 1/4 of Section 21, Township 25 N., Range 44 EVy'M
about 160 feet west of Ptnes Road between Fourth and Sixth Pvenues. The
proponent is requestfng that approximately Cwo acres of vacant land currently
zoned agricultural suburban be changed to 1Vlultiple Famf ly Suburban to allow
the development of a 40 unit apartment complex. The site is located on
,relattvely flat terrafn currently covered by unmanaged grassland vegetatlon.
The staff review has fdentified three potential areas of environmental impacts.
First'., and common to ait residentfal deve.lopments is the increase in motor
vehfc'Le traffic, and all the effects associated therewith. These would
include such impacts as increased atr po.l.lution, specifica.lly suspended
particulates and carbon monoxide, increased public safety hazards from
traffic.
A second potentfal environmental impact area considered was the increased
demand on public services and utilfties. This would include such factors
as increased requirements for po.lice and fire protectton, provision of
additional school, park, and recreational facilitfes, and additional mainten-
ance requirements on county facilitfes and roads. This would also include
such impacts as associated with extenston of utility lines (power, natural
gas, telephone) and the provision of suitable long term sewerage, domestic
water, storm water runoff, and soltd waste disposal systems.

The third type of environmental impact considered fnvolved the effect of
subsurfare injectton of waste water into the Spokane Valley Aquifer. Storm
water drafned from the fmpervious surfaces (building, carports, driveways,
sidewalks, ) along with effluent from the sewage disposal wlll be injected
beneath the surface and allowed to percolate toward the qquifer rather than
evaporate back to the atmosphere as happens in a natural sltuatfon. The
amount of contaminent carried by these waste waters by the time they reach
the aquifer is unknown but undoubtedly a great deal of filtering will have
taken place. Therefore, this is not considered a significant tmpact with this
proposal.
The conclusion of this environmental checklist review is that no significant
, envfronmental impacts wlll likely resu.lt from the proposal. Therefore, lt is
recommended that a Declaration of Non-Significance be issued and an environ-
\ mental impact statement not be required. a

3. Applicant shall construct cement concrete curb sidewalk and pave to
existing pavement on 4th and Sullivan.
4. Applicant shall obtain approval for on and off-site drainage and
access plans before issuance of building permits.
5. Applicant must be a willing participant in any future LID or RID.
b. Spokane County Health District:
The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary Health
- District permits shall be obtained prior to building permit issuance.
c. County Fire Marshal's Office: Fire District #1
Mains and hydrants to be installed, in accordinace with the Spokane
County Fire Marshal's requirements.
Access and circulation plans for emergency vehicles to be approved prior
to building permit issuance.
d. Water Purveyor: Vera Water and Power
We are able to supply this proposal with adequate water.
III. CONDITIONS
If the Planning Commissioa approves this request, the following conditions
should be considered:
a. Compliance with all requests stated under Reviewing Agency Comments
above.
b. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee. Minor
variations when approved by the Zoning Administrator will be permitted,
including, but not limited to the following changes: Building location,
building materials, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.
c. A landscape plaa showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.
