ZONING ADJUSTOR DECISION: After public testimony and on-site investigation
with subsequent review, the decision of the Zoning Adjustor is to approve the
applicant's request to allow an off-street parking facility with a Variance for setback
of parking stalls.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.24.010 (b) and
4.24.310 (a) (b) of the Spokane County Zoning Ordinance, the Zoning Adjustor
has the responsibility of determining that the granting of a Special Conditional
Use Permit will not be detrimental to the surrounding properties. In assuring
compatibility, the Zoning Adjustor based his decision on the testimony presented
at the February 21, 1979 Zoning Adjustor Hearing as well as criteria set forth
in the Spokane County Zoning Ordinance for issuance of a Special Permit and
Variance. The Zoning Adjustor hereby finds the following:
. 1. The granting of a Variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in the vicinity.
2. The granting of a Variance will allow the applicant to use his property
efficiently and without infringing upon the public safety, health, and general
welfare. The Zoning Adjustor, through this Order, is of the opinion that
appropriate conditions will insure compatibility with the surrounding properties.
3. The Zoning Adjustor found that the granting of a Special Conditional Use will
not be detrimental to the surrounding properties or- injL,rious to the public
safety, health, and general welfare.
4. Through attachment of conditions with this Order, the Zoning Adjustor is of the
opinion that the compatibility of the parking facility will be assured.
5. The parking facility will relieve, some potential congestion of on-street parking
on Boone Avenue near the proposed office building. Since Boone Avenue is
primarily residential, off-street parking will negate possible accidents,
particularly from children running between parked cars.
6. The proposed parking facility with existing and proposed area for landscaping
wi I I have a positive effect upon the present neighborhood.
7. The parking facility does meet the necessary criteria as required in Section
4.24.310 of the Zoning Ordinance.
8. The Zoning Adjustor is of the opinion that those issues raised at the Hearing
can be effectively mitigated through attachment and enforcement of conditions.
B. ORDER:
1. Minimum lot size: 7,5000 sq. f't.
2. The land area must abut at least sixty-five (65) feet directly, or directly
across, a street, alley, railroad, or other right-of-way or easement from the
property served by the off-street parking facility.
3. No commercial enterprise ofi any kind shall be established on the property.
4. No signs other than directional signs not to exceed four (4) square feet stating
conditions of use.
5. The parking area shall be paved with a dust controlling surface.
6. The paved area shall observe the normal setbacks relating to dwellings for
whichever zone classification the facility is located.

A I NTRODUCTI ON
This matter having come before the Examiner Committee on December 15, 1978,
and the mernbers of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and John Culier and there being the following persons present who wish
to request approvai of a Zone Change; Joe (ngalls for a zone change,
Agricultural Suburban to Residential Office for the purpose of offices.
B FINDINGS OF FACT
1 That the existing land use in the area is generally residential and two
churches
2 That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing toning of the property described in the application is
Agricultural Suburban.
4 That the provisions of RCW 43 21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legai requirements for advertisement of the Agenda Item
have been fulfilled
6 That this proposai is not in confiict with the provisions of adopted regula-
tion or intent of adopted policies
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification
8 That the proposed use is compatible with existing uses in the area

District permits shall be obtained prior to building pei-mit issuance. •

Installatioa of fire hydrants to be in accordance with the requirements
of the Spokane Countq Fire Marshall.
Access and circulation plans for emergency vehicles to be approved prior

We are able to supply this proposal with adequate water.
