FINDINGS AND ORDER
A. I NTRODUCTION
This matter having come before the Examiner Committee on June 21, 1979, and the members of the Committee present being Ken Kennedy, Chairperson, Abby
Byrne and John Culler and there being the foilowing persons present who wish
to request approval of a Zone Change; ZE-146-78 for a Zone Reclassification,
Reconsideration of Condition on previously approved application for the purpose
of changing the originally approved use to approve an automotive service station
development plan.
B. FINDINGS OF FACT
1. That the existing land use in the area is residential and office buildings.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Local Business.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
8. That the proposed use is compatible with existing uses in the area.

9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Ali R. Mirghanbari for a reconsideration of conditions on a
previously approved application as described in the application should be
app roved .
Special conditions or contingencies applied to motion:
a. County Engineer's Office:
The County Engineer's Office has requested the following be considered if
the rezone is approved :
NOTE: All required improvements shall be built to meet or exceed
minimum County construction standards.
1. Applicant shall dedicate 5 feet on Valley Way Road and a 20 foot radius
on Pines for right-of-way.
2. Applicant shall construct cement concrete curb sidewalk and pave to
existing pavement on Valley Way or be a wifiing participant in any
future LID,. RID or CRP as directed by the County Engineer.
3. Applicant shall construct 5 foot cement concrete sidewalk on Pines
Road.

III. CONDITIONS
If the Zoning Hearing Examiner approves this request, the following conditions

b. The applicant shall develop subject property generally in accordance
within the concept presented to the Heariag Examiner Committee. Minor
variations when approved by the Zoning Administrator will be permitted,
including, but not limited to the following changes: Buildiag location,
building materials, laadscape plans, and general allowable uses of the
permitted zone. All variations must coaform to regulations set forth in
the Spokaae County Zoning Ordinance. The original intent of the
development plans shall be maintained.
c. A landscape plan showing specific detail and accompanied by a performance
boad shall be approved by the County Zoning Administrator prior to
building permit issuance.

In regards to the above refierenced zone change, we would like to go o,
record as oppos i ng the proposed use. We have been adv i sed by cert i f i e~_;
mail that the use is to be for a service station. Rumor in the neigh-
borhood is that it is also to be a recreational vehicle repair and
maintenance center. Neither ef the two uses appear to be compatible with
t he a rea .
We would like to point out that five service stations have been close,_'
on Pines Road within the (ast four years. (f a service station is
really needed in the area, one of these might easily have been reacti-
vated.
We have no objection to Residential Office or Light Local Business
zon i ng, prov i ded the use does not I ean towards thE
tenance side and respects the existing properties.
Currently, there is, to the north, a real estate firm, an architect'
office and a mortgage company. To the east, is an attorney's offic,
and residential homes. To the south, are insurance and real estate
offices. To the west, across Pines, are dental off'ices and residen-tia'
homes.
We feel that there is ample flexibility for development of the property
without being detrimental to the area.

1. Applicant shall dedicate 5 feet on Valley Way Road and a twenty (20)
foot radius on Pines and Valley Way for right-of-way.
2. Applicaat shall construct cement concrete curb, 5 feet wide sidewalk
and pave to egisting paveatent on Valley Wap. -
3. Applicant shall construct five foot concrete sidewalk on Pines.
4. Applicant shall obtaia approval for on and off-site drainage plan
before issuance of building permits.
5. Access permits for the advertised property shall be obtained from
the Spokane County Engineer's Office prior to release of building
permits.
b. §pokane County Health District:
The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuance.
Approval of sewage disposal facilities by the Spokane County Health
District.
c. County Fire Marshal's Office: Fire District #1
Installatioa of fire hydrants to be in accordance with the requirements
of the Spokane County Fire Marshall.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on December 15, 1978,
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and John Culler and there being the foliowing persons present who wish
to request approval of a Zone Change; Ali Mirghanbari for a zone change,
Residential Office to Commercial or Local Business for the purpose of retail
engineering supplies.
B. FINDINGS OF FACT
1. That the existing land use in the area is office buildings, dental clinic, and
single family residences.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Residential Office.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion or i ntent of adopted pol icies .
7. That the land in this area is suitable for the proposeo use, or 'uses within
the proposed Zone Classification.

9. That the owners of adjacent lands expressed neither approval nor

C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Ali R. Mirghanbari for a zone change, Residential Office to Local
Business as described in the application should be approved.
Special conditions or contingencies applied to motion:

We would request the minutes of your hearing be made public so that the
sponsor and his potential clients can be alerted to the possible future
restriction of access to right turn only movements from the parcel in question
and that any acceas to SR 27 (Pines Road) muet be approved by this department.

The previous comment set forth in ZE-145-78 are likewise applicable to this
zoning matter and the developer should be encouraged to seek access via the
existing established county road, Valleyway, rather than SR 27 and that such
access will be granted only if other acceas is not feasible.

This office must oppose the zoning until development and traffic plans are
developed and presented for our determination as to the adequacy of the
SR 90/SR 904 (Medical Lake Interchange) can accommodate the anticipated
development. This office was led to believe these above plans are a pre-
requisite to freeway commercial zoning.

project is allowed, a more complete submittal will be required.

architect or engineer licensed by the State of Washingtoo, O.B.C. Section
9 301 (c). The footing details alone are not enough to satisfy this
