B. FINDINGS OF FACT 1. That the existing land use in the area is generally residential and a church. 2. That the Comprehensive Plan designates this area as appropriate for residential development. 3. That the existing Zoning of the property described in the application is Agricultura! Suburban. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been compl ied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. ~ ; 6. That this proposal is in conflict with the provisions of adopted regulation 01 intent of adopted policies. 7. That the land in this area is unsuitable for the proposed use, or uses within the proposed Zone Classification. 1 File No. ZE-149-78 8. The Hearing Examiner Committee does not find the proposed use to be in harmony with the general purpose and will be otherwise detrimental to the public health, safety, and welfare. C. ORDER The Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of R.D. Jordan for a Zone Change, Agricultural Suburban to Residential Office as described in the application should be denied. Special conditions or contingencies applied to motion: a. Compliance with all requests stated under Reviewing Agency Comments above. b. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Minor variations when approved by the Zoning Administrator witl be permitted, including, but not Ilmited to the following changes: Building tocation, building materials, landscape plans, and general allowable uses of the permitted ione. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. c. A landscape plan showing specific detail and accompanied by a performance bond shall be approved by the County Zoning Administrator prior to building permit issuance. 2 File No. ZE-149-78 d. This matter came before the Planning Com-nission either the later part of August or the f irst part of September 1977. Your commission was advised by Mr. Emacio from the Prosecuting Attorneys affice that this zone change would constitute "SPOT ZONING" and would be illegal. Consequently the hearing on this matter was never concluded. We felt that we should have been informed at the time of the applicatioq 5eing acceptsd, of this possibility. There was a great deal of work obtaining signatures and expense that could have been avoided had we been so informed. It has beeh brought to our attention that Mr. Carroll IGeeling& who subsequently bought the property now bas a petition before you to be heard Dec. 15, 1978. The proposed zone change from Agrtcultural Suburban to Residential Office and the resulting change in the use of the property that has applied for a zone change may have an adverse fmpact on an historic property. The structure, now owned and resided in by Dr, and Mrs. Richard D. jordan, is a house built in 1939 by Ted Crosby, the brother of Bing Crosby. The structure, commonly known as the Crosby House Is preceived by the community as being a local historical Iandmark. Based on the communfty preception of the Crosby House representing a local landmark, it would be appropri.ate to conditisn this proposed zone change in such a manner as to preserve the distinctive architectural character of the structure. It is suggested that the zone change be condittoned so that whenever exterior modlfication is planned for the structure that the owner of the house apply for plan approval before the County Planning Commission. Consequently the hearing op this matter was never concluded. We felt that we should have been informed at tlae time of the application being acceptedo of this poasibility. There was a great c1ea1 of work obtaining sigriatures and expense that could have beeh avoided had we been so informed. It has been brouqht to our attention that Mr. Carroll IGeeling, who subsequently bought the property now has a petition before you to be heard Dec. 150 1978. He is proposing a zone change to residential office. Also property owned by Dr. RicbarcT jordan, at N. -718 U`filversity, is being proposed for rezone to residential office. Dr. jurdan's property is acros3 the street to the immediate south of Mr. Keelitag's property. Circumstancea in this area have not chanqeci to any degree that would juatify theae rezone petitions to be granted. If theae petitions are qranted we feel that we have been damaged and will retaip an attorney to bring action against the Planning Com!nission and Mr. Etnacio fro:n the Prosecuting Attorneys office.
