FINDINGS AND ORDER REGARDING ZONING MAP PROPOSAL, ZE-149-78;
AGRICULTURAL SUBURBAN TO RESIDENTIAL OFFICE: JORDAN
WHEREAS, The Spokane County Zoning Hearing Examiner Committee
did, after public hearing on December 15, 1978, forward to the Board of County
Commissioners a recommendation that the Zoning Map not be changed from the
existing Agricultural Suburban classification to the Residential Office classification
on property described as follows:
The North 182 feet of the N 1/2, EXCEPT the East 3 acres of
Block 192, Opportunity, in Section 16, Township 25 N.,
Range 44, E. W. M., Spokane County, Washington.
and,
WHEREAS, The applicant before the Zoning Hearing Examiner Committee,
. Dr. Richard Jordan (represented by Gordon Richardson), South 717 Pines Road,
Spokane, Washington 99206, did subsequently request a hearing before the Board
of County Commissioners to present evidence and testimony in favor of this
appli'cation, and
WHEREAS, The Board did hold a public hearing on January 25, 1979, to
consider the recommendation of the Zoning Hearing Examiner Committee and
testimony and evidence of the applicant and other interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described zone reclassification, and the Board of County
Commissioners fully considered the testimony given, the records, and the minutes
of the Zoning Hearing Examiner Committee and all other evidence presented and
having personally acquainted themselves with the site and vicinity in question,
does hereby find:
1) The Board concurred with the Zoning Hearing Examiner Committee' s
action that the proposed use of offices would be incompatible with
existing uses in the area which are generally residential and a
church.
2) That the Board of County Commissioners upholds the action of
the Spokane County Zoning Hearing Examiner Committee denying
such application for a zone change.

This being the time set by the Board of County Commissioners of Spokane
County, Washington to render its decision concerning the request of R. D. Jordan
(by Gordon Richardson) South 717 Pines, Spokane, WA 99206 for the above captioned
zone reclassification; and
The Spokane County Hearing Examiner Committee having heard the above request
on December 15, 19789 did deny said application; and
The Board having conducted its own public hearing on January 25, 1979, at the
request of Gordon Richardson (representing Dr. Richard Jordan), South 717 Pines
Spokane, WA 99206, and after visiting the site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon the
testimony submitted at the public hearing and other evidence available to
the Board tv uphold the action of the Hearing Examiner Committee (denial) as
set forth in the Spokane County Hearing Examiner Committee Findings and Order
of December 15, 1978. -
The 6oard instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

A. IlVTRODUCTION
This matter having come before the Examiner Committee on December 15, 1978,
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and John Culler and there being the following persons present who wish
to request approval of a Zone Change; Gordon Richardson and Dr. Jordan, for a
Zone Change, Agricultural Suburban to Residential Office for the purpose of
' offices.
B. FINDINGS OF FACT
1. That the existing land use in the area is generally residential and a
church.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing Zoning of the property described in the application is
Agricultura! Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been compl ied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled. ~

6. That this proposal is in conflict with the provisions of adopted regulation 01
intent of adopted policies.
7. That the land in this area is unsuitable for the proposed use, or uses
within the proposed Zone Classification.

8. That the proposed use is incompatible with existing uses in the area.
9. That the owners of adjacent fands expressed disapproval of the proposed
use.
10. The Hearing Examiner Committee does not find the proposed use to be in
harmony with the general purpose and will be otherwise detrimental to the
public health, safety, and welfare.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of R.D. Jordan for a Zone Change, Agricultural Suburban to
Residential Office as described in the application should be denied.
Special conditions or contingencies applied to motion:
a. Compliance with all requests stated under Reviewing Agency Comments
above.
b. The applicant shall develop subject property generally in accordance within
the concept presented to the Hearing Examiner Committee. Minor variations
when approved by the Zoning Administrator witl be permitted, including,
but not Ilmited to the following changes: Building tocation, building
materials, landscape plans, and general allowable uses of the permitted
ione. All variations must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the development plans
shall be maintained.
c. A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.

d. That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 RCW
and the Board of County Commissioner's Resolution #77-1392 be accomplished
by the applicant within thirty (30) days of formal action by the Hearing
Examiner Committee as instructed by the Planning Department staff.
e. Interior driveways and parking areas shall be paved.
f. Direct light from any exterior area lighting fixture shall not extend over
the property boundary.
g. That, if after one year from the date of the Hearing Examiner Committee's
action, the applicant has not received final adoption of the zone change,
the application is void.

June 28, 19770 Mr. & Mrs. Wade Teeter, made an offer to
purchase N. 804 University contingent upon rezoning approval
for residential office. This matter came before the Planning
Com-nission either the later part of August or the f irst part
of September 1977.
Your commission was advised by Mr. Emacio from the
Prosecuting Attorneys affice that this zone change would constitute
"SPOT ZONING" and would be illegal. Consequently the hearing
on this matter was never concluded.
We felt that we should have been informed at the time of the
applicatioq 5eing acceptsd, of this possibility. There was a great
deal of work obtaining signatures and expense that could have been
avoided had we been so informed.
It has beeh brought to our attention that Mr. Carroll IGeeling&
who subsequently bought the property now bas a petition before you
to be heard Dec. 15, 1978. He fa proposing a zone change to residential
office. Alao property owned by Dr. Richard JDrdan, at N. 718 University,
is being proposed for rezone to residential office. Dr. ibrdan's
pro,perty is acros3 the street to the imcrtediate south of Mr. Keeling's
property.'
Circumstancea 3,n this area have not changed to any degree that
would juetify the9e reaone petitiona to be granted.
If these petftions are qranteci we feel that we have been damaged and
will retain an attorney to bring action agaihst the Planning Comrnissioh
and Mr. Emacio from the Prosecuting Attorneys office.

is a house built in 1939 by Ted Crosby, the brother of Bing Crosby. The
structure, commonly known as the Crosby House Is preceived by the
community as being a local historical Iandmark.
Based on the communfty preception of the Crosby House representing a local
landmark, it would be appropri.ate to conditisn this proposed zone change
in such a manner as to preserve the distinctive architectural character
of the structure. It is suggested that the zone change be condittoned so
that whenever exterior modlfication is planned for the structure that the
owner of the house apply for plan approval before the County Planning
Commission.

"SPOT ZONING" and would 'be illegal. Consequently the hearing
op this matter was never concluded.
We felt that we should have been informed at tlae time of the
application being acceptedo of this poasibility. There was a great
c1ea1 of work obtaining sigriatures and expense that could have beeh
avoided had we been so informed.
It has been brouqht to our attention that Mr. Carroll IGeeling,
who subsequently bought the property now has a petition before you
to be heard Dec. 150 1978. He is proposing a zone change to residential
office. Also property owned by Dr. RicbarcT jordan, at N. -718 U`filversity,
is being proposed for rezone to residential office. Dr. jurdan's
property is acros3 the street to the immediate south of Mr. Keelitag's
property.
Circumstancea in this area have not chanqeci to any degree that
would juatify theae rezone petitions to be granted.
If theae petitions are qranted we feel that we have been damaged and
will retaip an attorney to bring action against the Planning Com!nission
and Mr. Etnacio fro:n the Prosecuting Attorneys office.

The applicant shall comply with rules and regulations of the Health
District in providiag for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuaace.
Approval of sewage disposal facilities by the Spokane Couaty Health-
District.
c. County Fire Marshal's Office: Fire District #1
Installation of fire hydrants to be in accordance with the requirements
of the Spolcaae County Fire Marshall.
