FINDINGS AND ORDER
A. IIVTRODUCTION
This matter having come before the Examiner Committee on March 22, 1979, and
the members of the Committee present being Glenn Quigley, Chairman, Jane
Myers, and John Culler and there being the following persons present wha wish
to request approval of a Zone Change; John Sweitzer for a Zone Change,
Agricu{tural Suburban to Commercial for the purpose of a restaurant, wholesale
office - warehouse.
B. FtNQINGS OF FACT
1. That the existing land use in the area is residential, motel, gas station and
restaurant.
2. That the Comprehensive Plan designates this area as appropriate for
commercial development or use under study.
3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been cbmpl ied with.
5. That the proper legal requirements for advertisement of the Agenda Ifiem
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion or intent of adopted policies.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.

9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Mearing Examiner Committee finds the proposed use to be in harmony

health, safety, and welfare.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Dick Taylor (Baker, Taylor, Schmautz) for a Zone Change,
Agricultural Suburban to Commercial as described in the application should be
approved,
Special conditions or contingencies applied to motion:
a. County Engineer's Office:
The County Engineer's Office has requested the following be considered if
the rezone is approved:
NOTE: All required improvements shall be built to meet or exceed

minimum County construction standards.
1. No requirements at this time.
b. Spokane County Health District:
The applicant shal{ comply with rules and regulations of the Health District
in providing for adequate sewage disposal. All necessary Health District
permits shall be obtained prior to building permit issuance.
Approval of sewage disposal facilities by the Spokane County Health District.

shall be maintained.

The long range plans for the site (office-
warehouse) will require excavation, compaction
of soil to construct parking and drivecaay areas,
utilities, building foundations and landscaping.

features?
The long range plans for the site (office-
warehouse) will require the construction of
buildings, parking and driveway areas, and
landscaping will result in minimal changes
in surface relief features. The overall topo-
graphic character of the site will not be
significantly altered.
(e) Any increase in wind or water erosion of soils,
either on or of f the si te?
The long range plans for the site (office-
warehouse) will disturb, remove, expose soil
and increase the possibi.].ity of wind and water
erosion. Phasing of project will be used to
mitigate wind and water erosion. The finished
project will be heavily landscaped and will,
therefore, be less susceptible to caind or
water erosion. .
2, AIR
(a) Air emissions or deterioration of ambient air
quality?
The long range plans for the site (office -
warehouse) caill introduce people, automobiles,
heating units resulting in a modification of
air quality.
(b) The creation of objectionable odors?
The long range plans for the site (office -
warehouse) will increase automobile emissions
on-si.te which may be considered obnoxious.

(b) Changes in 3b5orption rates, drainage patterns,
or the rate and amount of surface water runoff?
The long range plans for the site (office-
warehouse) caill require construction of parking
and driveways thus altering some of the local
drainage patterns; however, major drainage patterns
and basins will not be significantly altered.
Impervious surfaces in the form of paved parking
and driveway, sidewalks and roofs will cover a
majority of the site. Construction of a drycaell
system will handle the drainage.

of ground waters?
The long range plans for the site (office-
caarehouse) will require minimal changes in
the surface relief features, which in turn
may alter the direction or rate of flow of
ground water with the construction of parking
and driveway areas, sidewalks and buildings.
Construction ot a drywell system will handle
the drainage. _
(g) Change in the quantity of ground waters,
either through direct additions or withdrawals,
or through interception of an aquifer or with-
drawals by cuts or excavations?
The long range plans for the site (office-
warehouse) caill require minimal amounts of
water for cooking facilities within a proposed
restaurant, for required restrooms, for land-
scape irrig,ation, and for required fire flow.
The proposal's water needs caill be serviced by
the aquifer and provided by a water purveyor.
The project will require minimal amounts of
water and poses no threat to existing supplies.
(h) Deterioration in ground water quality, either
through direct injection, or through the seepage
of leachate, phosphates, detergents, waterborne
virus or bacteria, or other substances into the
ground waters?
The long range plans for the site (office-
warehouse) taill result in the construction of
impervious surfaces over the soil which will
disrupt and alter existing surface water runoff
and absorption characteristics. Surface water
runoff from the site will be disposed of in a
system of drywells and catch basins with no pro-
vi.sions made for the treatment of this water.
Storm water runoff can be expected to contain
minor amounts of ground-caater contaminants
including suspended solids, petroleum-based
hydrocarbons, dissolved inorganic salts, among
others. The majority of the contaminants are
subject to substantial removal as the water
percolates through the soil column above the
ground water.
The site is located over the aquifer where the
transmissivity and flow of the aquifer is the
greatest. While it is not anticipated that the
proposed project will have any effect on the
geology or the hydrology of the aquifer, the
existing conditions will have a bearing on the
potential for water quality degradation from
project related effluents.

The long range plans for the site will result
in the disposal of waste water effluent to a
subsurface drainfield located above the aquifer.
The project will generate waste caater, a portion
of which would be available for percolation to
the ground water. Because of the potential
threat to ground water quality through the use
of an on-site sewage disposal system, the project
sponsors will be working closely caith the Spokane
County Health District to provide for installation
of a system which will meet those requirements of
the project without posing a problem to ground
water resources.
The County Health District officials have indicated
that a septic tank system caill most likely be
appropriate. The quality of the potential effluent
reaching the aquifer from a subsurface drainfield
will be improved over the quality of the effluent
discharged to the drainfield because of biochemical
treatment mechanisms that occur as the effluent
passes through the soil column above the ground
water. Soil systems do not generally retain anions
including nitrates, chlorides, sulfates and bicarbon-
ates. These dissolved inorganic materials move with
the drainage waters and may pose a potential threat
to ground water quality. It is not expected that
the existing or future project will result in the
violation of any drinking water standard regardless
of what system is used.
4. FLORA
(a) Change in the diversity of species, or numbers of
any species of flora (including trees, shrubs,
grass, crops, microflora and aquatic plants)?
The long range plans for the site (of_fice -
warehouse) will result in the removal of much
of the grass and vegetation but will be replaced
with vegetation commonly associated with land-
scaping in commercial centers.
(c) Introduction of new species of flora into an area,
or in a barrier to the normal replenishment of
existing species?
Landscaping commonly associated with a restaurant
and office warehouse facility proposed for the
future will be added and may include various and
new species of grass, shrubs, trees and flowers.
6. NOISE
Will the proposal increase existing noise levels?
The long range plans for the site (office -
warehouse) will result in an increased noise
level from people and automobiles. It is
anticipated that the highest noise levels caill
be during the construction phase of the project.

Will the proposal produce new light or
glare?
Light will be produced by interior and exterior
lighting of the future commercial area. Glare
will be produced by automobile headlights, but
screening will be employed to reduce such effects.
8. LAND USE
Will the proposal result in the alteration of
the present or planned land use of an area?
The zone reclassification will bring the existing
non-conforming use (motel) up to required zoning
standards, will require no improvements, and will
not generate environmental impacts as a result of
the major action.
The long range plans for the site (office-
warehouse) will require that the existing
motel complex, house and accessory buildings
be removed. A restaurant is proposed for the
adjacent parcel to the south tahich already has
the commercial zone classification.
The zone change proposal is consistent with the
Regional Comptehensive Plan, is consistent with
previous zone reclassification requests for the
area, and is compatible Eaith surrounding land
uses.
9. NATURAL RESOURCES
(a) Increase in the rate of use of any natural
resources?
During the construction phase of the proposed
restaurant and office-warehouse facility,
natural resources will be consumed, including
the energy resources directly and indirectly
used by construction activities and the natural
resources utilized as building materials. Some
natural resources will continue to be consumed
after construction is completed, including most
notably the consumption of energy in the form of
fossil fuels and electricity.
11. POPULATION
tidill the proposal al.ter the location, distribution,
density, or growth rate of the human population of
an area?
The long range plans for the site (office-warehouse)
will have a minimal increase to the area's employ-
ment base, which will in turn have an indirect
impact on the area's population base.

12. HOUSING
Will the proposal ai'fect existing housing or create
a demand for additional housing?
The long range plans for the site (office-warehouse)
may create jobs in both the construction and opera-
tional phases.of the project, many of the employees
will probably be recruited in the local area from
those people not currently working, or who may be
seel<ing a job change. Thus, the addition of new
housing units and their location directly constructed
as a result of this project is inestimable.
Secondary impacts are perhaps more predictable, but
again, the specifics are difficult to define. It is
expected that the proposed project will help to provide
a stimulus for housing development both in the form of
new subdivisions and the fill-in of individual vacant
lots.
13. TRANSPORTATION/CIRCULATION
(a) Generation of additional vehicular movement?
The project site is served by Sprague Avenue.
Traffic generated by the project is not
expected to be significant.
The traffic demand during the operational phase
should have more of an impact on the peak hours
and total traffic volumes in the site vicinity.
Variations in total traffic volume will occur
both on a daily and seasonal basis and will be
influenced by holiday shopping, weather, etc.
Weekly traffic is generally a function of the
day of the week, with Saturday being the busiest
day and the early day being the slowest.
In summary, the increased traffic generated by the
proposed long ranp-e plans for the site is not
expected to be of major significance.
(b) Effects on existing parking facilities, or demand
for new parking?
A total of 30 automobile parking spaces has been
planned for the future uses and will satisfy the
minimum zoning ordinance requirements.
(c) Impact upon existing transportation systems.
As mentioned the project is served by Sprague Avenue.
When fully developed the traff.ic generated by the
project is not expected to have a significant impact
on the existing road systems in the vicinity of the
site according to Spokane County Engineers.
(d) Alterations to present patterns of circulation or
movements of people and/or goods?
Once the future project is fully operational, it
should become a traffic generator within the Sprague
Avenue shopping district. The proposed future project
will hopefully attract more business and traffic to
the area.

An increase in traffic will correspondingly
increase the hazard to vehicular, bicycle
and pedestrian travel. The degree of hazard
may be reduced by upgrading Sprague Avenue
and Bowdish Road and by tratfic control devices.
14. PUBLIC SERVICES
tJill the proposal have an effect upon, or result
in a need for new or altered governmental services
in any of the following areas?
(a) Fire protection?
The long range plans for the site (office-
warehouse) will require additional fire hydrants
and will place more demands on the Spokane Valley
Fire Department located one block away.
(b) Police protection?
The long range plans for the site (office-
caarehouse) may require additional police pro-
tection from the Spokane County Sheriff's
D epartment.
(c) Schools?
Any increases to the County population figure
resulting from this future proposal will corres-
pondingly increase the demands on Central Valley
School District. Minimal impact is expected as
a result of the proposal however.
(e) Maintenance of public facilities, including roads?
The long range plans for the site (office-
caarehouse) caill generate additional vehicular
movement to and from the site, and together
with the existing vehicular traffic require
maintenance of county and state roadways.
~ The future proposal caill require water from
Modern Electric tiaater Campany and maintenance
of the new lines.
(f) Other governmental services?
The long range plans for the site (office-
warehouse) will require the extension of
postal services as well as other services
associated with a commercial center. These
public services are mandated by law and would
appear to be capable of being provided without
over-extending the various agencies beyond normal
work routines.
