WHEREAS, The Spokane County Zoning Hearing Examiner Committ,_,.
did, after public hearing on December 15, 1978, forward to the Board of County
Commissioners a recommendation that the Zoning Map not be changed from the
existing Agricultural Suburban classification to the Residential Office classification
on property described as follows:
The S 3/5 of the W 1/2 of Tract 69 of Opportunity, except the N 255
feet and the E 180 feet thereof; and except that portion of land
conveyed to Spokane County by right of way deed filed May 14 , 1974,
in Section 16, Township 25 N., Range 44, E. W, M,, Spokane County,
Washington.

WHEREAS, The applicant before the Zoning Hearing Examiner Committee,

The Spokane County Hearing Examiner Committee having heard request on December 15, 1978, did deny said applicatior.:
The Board having conducted its own public hearing on January 25, 1979, at
the request of Carroll L. Keeling, North 804 University, Spokane, tqA 99206
and after visiting the site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon the
testimony submitted at the public hearing and other evidence available to
the Board to uphold the action of the Hearing Examiner Committee (denial)

My reasons for appeal are in answer to the Hearing Examiner's Committee letter of denial
Please read the following in conjunction with their letter. (Copy attached)
B. Fact Finding
r 1. True, generally residential. Except a corner property such as Broadway & University
i s on a double arterial hi ghway wi th street 1 i ghts and upward of 12,000 autos and
trucks a day passing by. This is not a good corner for a family home as such.
2. True. Except for the traffic and busy intersections, no one will live here, just
as a home. Too noisey.
3. 3, 4 & #5 O.K.
6. Again, there are usually areas within larger areas that can and should be used
differently with no determent to surrounding properties.
~ 7. Not according to the reviewing agencies.
8. The present use as a residence is not compa tible with present zoning because of
the busy street and intersection.
9. I don't believe the adjacent property owners realize what R.O. Zoning means.
Their tes timony indica ted they were afraid of large neon signs. Tha t the next
thing would be indus trial zoning and that no one should make a profit from zone
change, etc. None of these people live on a corner such as this and don't have
the same conditions. They seem to be afraid of a change of any kind.

with the hope of making it nice again and making a showplace out of it. We wish to
matce an offi ce out of the attached garage, which wi 11 not al ter the outsi de of the
home's appearance. N(j► wi fe and I are real tors and woul d 1 i ke to have 1 or 2 people
work with us. 1 realize we can have a home occupation with present zoning, but no one
outside of our family can work with us. It would be very disappointing if we cannot
co nt i nue wi th thes e pl a ns .
I believe our place can and will be an asset to the neighborhood.

A. INTRODUCTION
This matter having come before the Examiner Committee on December 15, 1978"
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and John Culler and there being the foilowing persons present who wish
to request approval of a Zone Change; Carroll Keeling for a Zone Change,
Agricultural Suburban to Residential Office for the purpose of residential and
office.
B. FINDINGS QF FACT
1. That the existing land use in the area is generally residential.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the appiication is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper tegal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is in conflict with the provisions of adopted regulation or
intent of adopted policies.
7. That the tand in this area is unsuitable for the proposed use, or uses
within the proposed Zone Classification.
8. That the proposed use is incampatible with existing uses in the area.

9. That the owners of adjacent lands expressed disapproval of the proposed
use.
10. The Hearing Examiner Committee does not find the proposed use to be in
harmony with the general purpose and will be otherwise detrimental to the
public health, safety, and welfare.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Carroll Keeling for a Zone Change, Agricultural Suburban to
Residential Office, as described in the application should be denied.
Special conditions or contingencies applied to motion:
a. Compliance with all requests stated under Reviewing Ayency Comments
above.
b. The applicant shall develop subject property generally in accordance within
the concept presented to the Hearing Examiner Committee. Minor variations
when approved by the Zoning Administrator will be permitted, including,
but not limited to the following changes: Building location, building
materials, landscape plans, and general allowable uses of the permitted
zone. All variations must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the development ptans
shall be maintained.
c. A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.

d. That the pravisions of SEPA's Notice of Action pursuant to 43.21c.080 RCW
and the Board of County Commissioner's Resolution #77-1392 be accomplished
by the appiicant within thirty (30) days of formal action by the Hearing

e. Interior driveways and parking areas shall be paved.
f. Direct tight from any exterior area lighting fixture shall not extend over
the property boundary.
g. That, if after one year from the date of the Hearing Examiner Committee's
action, the applicant has not received final adoption of the ione change,
the application is void.

We are able to supply this proposal with adequate water.

June 23, 1977, Mr. & Mrs. Wade Teeter, made an offer to
purchase N. 804 University contingent upon rezoning approval
for residential office. This matter came before the Planning
Comnission either the later p3rt of August or the first part
of September 1977.
Your commission was advised by Mr. Emacio from the
Prosecuting Attorneys office that this zone change would constitute
"SPOT ZONING" and would be illegal. Consequently the hearing
on this matter was never concluded.
We felt that we should have bPen informed at the time of the
application ~eing accepted, of this possibility. Tnere was a great
c7eal of work obtaining signatures and expense that could have been
avoided had we been so informed.
It has been brought to our attetation that Nir. Carroll Keeling,
who subsequently bought the progerty now has a petition before you
to be heard Dec. 15, 1978. He is proposing a zone change to residPntial
of f ice. Also oroperty owned by Dr. Richarc7 J:)rdan, at N. 718 University,
is being proposed for rezone to residential office. Dr. Jbrc7an's
property is across the street to the immediate south of Mr. Keeling's
property.
Circumstances in this area have hot changed to any degree that '
would justify these rezone petitions to be granted.
If these petitions are granted we feel that we have been damaged and
will retain an attorney to bring action against the Planning Commission
anl Mr. Emacio f ro:n the Prosecut ing Attorneys of f ice .
