A. INTRODUCTION ' t

This matter having come before the Examiner Committee on March 6, 1980, and
the members of the Committee present being Jane Myers, Acting Chairman, Ted
McCoury and Paul Sceva, Jr. and having personaliy visited the site.
B. PROPOSAL
The sponsor, Edward Unicume is requesting approval of a zone recfassification,
ZE-170A-78, Agricultural fio Residentiai Office and Local Business, for the
purpose of develop;ng a retail business/office complex.

C. FINDINGS OF FACT
1. That the existing land use in the area is residentiai, office, and undevelop-
ed.
2. That the Comprehensive Plan designates this area as appropriate for residen-
tial development.

3. That the existing zoning of the property described in fihe application is
Agricultural.
4. That the provisions of RCW 43.21C (The Stafie Envtronmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda ltem
have been fulfilled.
6. That the land in this area is suitable for the propvsed use, or uses within
the proposed Zon'e Classification.
7. That the proposed use is compatible with existing uses in the area.
8. That the owners of adjacent lands expressed bofih approval and disapproval
of the proposed use.
9. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
10. The Follativing are addiLianal findings ot fact considered by the Hearing
Examiner Committee.
a) That approval is granted for both buildings in the Residential Office
and Local Business zones to consist of two stories.

D. COND{TIONS OR CONTINGENCIES APPLIED TO TH1S APPROVAL
1. That uses contained in the Local Business zone are not to exceed the 172
parking spaces as presented by the applicant.

2. That the landscaping on the north portion of the site along the west 300
feet for a width of five feet shall be planted with shrubbery to create a
sight-obscuring fence.
a) COUNTY FIRE MARSHAL
1. The site is located in Fire District #1.
.
2. Adecfuate water for fire protection and distribution of such water shall
be required For this project. A water plan is required to be submitted
for apprnval prior to any land development.

b) COUNTY ENGINEER
1. Appiicant shall dedicate a 20 foot radius on Pines Road and Maxwelf
Avenue.
2. Applicant shall dedicate half (25 feet) of the proposed Sinto Avenue
extension as shown on the approved pfat pian and a 20 foot radius on
Pines and proposed Srnto Avenue extension.
3. Applicant shall construct cement concrete curb, sidewalk and pave to
ex i sti ng pavement on Maxwel l Avenue.
4. Applicant shall construct cement concrete sidewalk on Pines Road.
5. Access permits and improvements to Pines Road must be approved by
the Washington State Department of Transportation.
6. Applicant shall construct cement concrete curb, sidewaf k and pave haif
(20 feet) of the proposed Sinto Avenue extension. At the trme of
construction, if the property owners to the south are not prepared to
construct their half of the roadway then the applicant shall pave an
additional 10 feet on the proposed Sinto Avenue exfiension.
7. An appropriate off-site drainage disposal system and access pians shall
be approved by the Spokane County Engineer's Office prior to the
issuance of building permits for the project.
8. A detailed combined on-site sewage system and surface water disposal
plan for the enti re project shall be approved by the Spokane County
Engineer and the Spokane County Health District prior to the issuance
of any building permit.
9. The design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. (Any portion
of the project which is to be) occupied or traveled by vehicles shall be
maintained in hard surface paving.

c) WATER PURVEYOR
1. Purveyor is Modern Electric Water Company and they are able to
supply the site with adequate water for domestic fire and irrigation

uses.
d) COUNTY HEALTH DiSTRICT
1. A combined sewage and surface water disposal plan shall be approved
by the Spokane County Engineer and Spokane County Hea{th District
prior to issuance of any building permits.
2. Water service shall be from Modern Electric Company.
3. Sanitaryi% plumbing shall be installed to facilitate conne.ction to an
area-widb sewerage system.
4. The owner, his heirs and assigns shail agree to participate in and not
protest assessmenfis for any local improvement district for sewering to
serve this property.
5. Connection to area-wide sewer collection system shall be made when the
system becomes availab{e.
e) SEPA
1. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080
RCW be initiated by the applicant within thirty (30) days of final
action of the Responsible Administrative Body and be completed before
any site improvements are made.
2. The request has proven to be environmentally non-significant. There-
fore, a final deciaration of non-significance shall be signed by the
Chairman of,the Hearing Examiner Committee.

1. Approval by the Zoning Administrator of a specific lighting and signing
plan for the described property prior to the release of any building
permits.
2. A specific landscape p1an, planting schedule and provisions for main-
tenance acceptable to the Spokane County Zoning Administrator shall
be submitted wi th a performance bond i'or the project prior to release
of building permits.
3. The applicant shall develop subyect property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Minor va ri zftiarrs- -afhen approved by the Zoning Administrator will be
permittezi;-incFuding, but nofi limited to the following changes: Build-
ing location, landscape plans, and general allowable uses of the per-
mitted zone. All variations must conforrn to regulations set forth in
the Spokane County Zaning Ordinance The original intent of the
development plans shall be maintained

w +4. Direct light from any exterior area lighting fixture shall not extend
over the property boundary .
g) That the Hearing Examiner Committee after hearing all testimony and a
rev=iew of the staff analysis adopts the proposed declaration of non-signifi-
cance and directs the chairman of the committee to sign the final declaration
of non-significance.
E. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Edward Unicume for a zone reclassification as described in the
application should be approved.

Gentlemen:
At the direction of Mr. Edward Unicume, I hereby request that Zotle Change
Item ZE-170-78 - Agricultural Suburban to Local Business and Residential
Office or Multiple Family Suburban be withdrawn from consideration.
The Spokane County Engineer's requirement for the extension of Sinto
Avenue along the south boundary of the project in conjunction with the
reluctance of property owners to the south to work toward a timely
agreement for the alignment of the roadway have caused unacceptable delays
to the developer.
Mr. Unicume also requests the staff to keep him appraised of future
actions on the property to the south so that a reasonable alignment of
the road will not be precluded.

Dear Sir:
This office wishes to comment on the following items before your
May 17, 1979, Zoning Hearing Committee.
~ ZE-170-78
We have reviewed the referenced application for zone change. A1-
though the zone change proposals would have little direct impact
on SR 27 (Pines Road) at this time, the proponent should be advised
of the fact that our department is presently studying the feasibility
of expanding the capacity of this route. In so doing it may be nec-
essary to construct added lanes and possibly acquire access control
along the right of way limits.
In addition, we would point out that any new access points we might
consider at this place of business should be oriented to Maxwell or
Sinto Avenue and not Pines Road.

This off ice would advise the developer to limit the access points
onto Sign Route 2 and be advised that legal access to the south sid,e
of Sign Route 2 is providerlto right turn only movements except at the I
dedicated public intersection of Garf ield Road in as much as the
median is a legal barrier separating east and west bound traffic
lanes.

pavement on Maxwell.
2. Applicant shall dedicate a twenty (20) foot radius on Pines and
Sinto.
3. Applicant shall construct five foot wide cement concrete sidewalk on
Sinto.
4. Applicant shall construct five foot wide cement concrete sidewalk on
Maxwell.
5. Applicant shall obtain approval for oa and off-site drainage and
access plans before issuance of building permits.
6. Access permits and improvements to Pines must be approved by the
State Department of Transportation.
7. Future left hand turns onto Pines Road may be prohibited by
Washington State Department of Transportation.
8. Applicant shall dedicate north one half of Sinto Road for
right-of-way (to fulfill 50 foot right-of-way requirement).
9. Applicant shall pave 20 feet on Sinto Road.

The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuance.

a. Compliance with all requests stated under Reviewing Agenc,y Comments

b. The applicant shall develop subject propertq generally in accordance
withia the coacept presented to the Hearing Egaminer Committee. Minor
variations whea approved by the Zoniag Administrator will be permitted,
iacluding, but not limited to the following changes: Buildiag location,
building materials, landscape plans, and geaeral allowable uses of the
permitted zone. All variations must conform to regulatioas set forth in
the Spokaae County Zoning Ordinaace. The original iatent of the
development plans shall be maiatained.
c. A landscape plan showiag specific detail and accompanied by a performance
boad shall be approved by the County Zoning Admiaistrator prior to
building permit issuance.
d. That the provisions of SEPA's Notice of Actioa pursuaat to 43.21c.080 RCW
and the Board of County Commissioaers' Resolution #77-1392 be
accomplished by the applicant within thirtq (30) days of formal action bp
the Board, as instructed by the Planaing Departmeat staff.
e. Interior driveways and parking areas shall be paved.
f. Direct light from any exterior area lighting fiuture shall aot extend

1. Applicant shall construct cement concrete curb, 5 foot sidewalk and
pave to existing pavement on Mauwell.
2. Applicant shall dedicate a twenty (20) foot radius on Pines and
Maxwell.
3. Applicant shall construct five foot cement concrete sidewalk oa
Pines.
4. Applicant shall obtain approval for on and off-site drainage and
access plans before issuance of building permits.
5. Access permits and improvements to Pines must be approved by the
State Department of Transportation.
6. Future left hand turns onto Pines Road may be prohibited by
Washington State Departmeat of Transportation.
b. §pokane Cowaty Health District:
The applicant shall comply with rules and regulations of the Health
District ia providing for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuance.
Approval of sewage disposal facilities by the Spokane County Health
District.
c. County Fire Marshal`s Office: Fire District #1
Installation of fire hydraats to be in accordaace with the requirements
of the Spokane Countp Fire Marshal .
Access and circulation plans for emergency vehicles to be approved prior

permitted zone. All variations must conform to reguletions set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maiatained.
c. A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.
d. That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 RCW
and the Board of Couaty Commissioner's Resolution #77-1392 be
accomplished by the applicaat withia thirty (30) days of formal actioa by
the Board, as instructed bp the Plaaning Department staff.
e. Interior driveways and parking areas shall be paved.
f. Direct light from any exterior area lighting fiuture shall not eztend
