Although the Conditionai Use Permit does not restrict the hours of operation for this facility, late night use of the car wash and vacuum equipment was also mentioned in the complaint. The purpose of this letter is to suggest that the triggering mechanism for the automatic door cioser be tested and repaired if necessary. I believe this designed-in feature of the equipment would reduce the noise impacts if operating properly. It would also please your neighbors (possible customers?) as well. There will be no enforcement action by the Division of Planning on this matter, however, being a good neighbor is never bad for business. Your cooperation will be appreciated. (CUE-19-85); BUDGET OIL ) AND DECISION SUMMARY OF APPLICATION: The applicant requests a conditional use permit for a single-bay automated car wash in the Local Business zone located immediately west of and in conjunction with the Zip Trip facility. LOCATION: The location of the entire activity, the Zip Trip and the proposed one-bay car wash is on the southwest corner of Maxwell Avenue and Pines Road in the Spokane Valley. The Assessor's Parcel # is 16541-0161. DECISION OF THE ZONING ADJUSTOR: Qased upon the evidence presented and circumstances associated with the project proposal, the Zoning Adjustor APPROVES the single-bay car wash consistent with the various conditions of approval and after the submission of certain clarifying information regarding the site plan and improvernents at the site, such information regarding improvements is to be clarified prior to the issuance of any building or permits associated with the project. PUBLIC HEARING: After examining all available information on file with the application and vi si ti ng the subject property and surroundi ng area, the Zoni ng Adjustor conducted a public hearing on November 19, 1985, rendered~ verbal decision on November 19, 1985, and a written decision on December 1985. FINDINGS OF FACT l. The proposal is generally located some 100 to 150 feet west of Pines Road and on the south side of Maxwell Avenue in the Spokane Valley and is furttier described as Assessors Parcel #16541-0161, being more specifically described in Zoning Adjustor File CUE-19-85. 2. The proposal consists of the establishment of a single-bay, automated car wash west of the existing Zip Trip convenience store. The store and the car wash would operate 24 hours a day, seven days a week. There would be no place or provisions for tile cleaning of engines at the site. The present septic tank and drainfield of the convenience store would be abandoned, the parking lot paved over in an integrated paving and landscape scheme and the convenience store and the car wash would be hooked by a sewer, presently existing on the south side of the property, to the Pines Road trunk line now in the process of being installed. A landscaping area would be provided to accommodate the 208 stormwater runoff treatement and generally to enhance the site. A new fence is proposed at a height of 48 inches, chain-link with metal slat fabric designed to tie in with the existing similar fence on the south side of the property and to tie into a fence running north and south on the alignment with the most westerly wall of the car wash unit. The applicant has indicated that directional arrows will be installed, as well as curbing, some parking lot striping and sidewalks on Maxwell consistent with the County Engineer's requirements. The applicant also indicates that illumination for the site will be of a"down lighting" nature and be designed and placed so as to provide only nomimal off-site illumination. Finally, the applicant will submit written documentation, either on a revised site plan or a supplemental information sheet which will address the fence, the directional arrows, illumination and irrigated landscaping for approval by the Zoning Adjustor, with assistance from the County Engineer's Office. FINDINGS, CONCLUSIONS AND DECISION FILE CUE-19-85 PAGE Z 3. The adopted Spokane County Future Land Use Plan designates the area of the proposal as COMMERCIAL and the proposal is consistent with the County's entire Comprehensive Plan, including the Future Land Use Plan. 4. The site is zoned Local Business which would allow the proposed use upon approval of this application. 5. The existing land uses in the area of the proposal include commercial business, residential and office, all of whicli are compatible with the proposal. 6. Testimony was received from a property owner whose residence is generally northwesterly of this location, on the north side of Maxwell, which identified the existing adverse environmental impacts as a result of the convenience store existence and i.ts hours of operation.. Adverse impacts addressed i ncl uded the 24~hour a -~day; seven day,:oper.ati:or~ and the vari ous activities associated therewith, litter, noise and visual appearance. This property owner felt the automated car wash would contribute to the existing adverse impacts. 7. Pursuant to the State Enviro rnnental Policy Act the environmental checklist and otiler data has been reviewed and the project has been found to not have any probable significant adverse impacts to the physical environ- ment. A Determination of Nonsignificance (DNS) was issued on October 24, 1985 and sent to 7 agencies of jurisdiction. The agencies reviewing the checklist neither indicated that a more detailed envirornnental review should be provided nor commented that the DNS should be re-considered. Comments regarding environmental matters were not made at the public hearing. There was not sufficient evidence presented pursuant to WAC 197-11-340 (3) (a) to withdraw the DNS. 8. The applicant has been made aware of the recommendations of various County/State agencies reviewing this project and has indicated he can comply with those recommendations. 9. The proposed site plan indicates that setbacks, parking, height of the structure(s) will conform to the Spokane County Zoning Ordinance. 10. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 11. Any conclusion hereinafter stated which may be deemed a finding herein is hereby adopted as such. From the Findings, the Zoning Adjustor comes to these: CONCLUSIONS l. The proposal is not detrimental to and is compatible with the public health, safety and welfare as hereinafter conditioned. The operation of the automated car wash, as described by the applicant, will increase tlle adverse impacts to existing nearby residences, but not substantially, above that whicll already exists due to the presence of the convenience store and the Local Business zoning. 2. The proposal is listed in the Spokane County Zoning Ordinance as a conditional use allowed in the Local Business zone and the proposal does meet the established and applicable criteria described for that conditional use. 3. Various performance standards and criteria are additionally needed to make the use compatible with other permitted activities in the same vicinity and zone and to insure against imposing excessive demands upon public utilities and these shall be addressed as conditions of approval. 4. A landscape buffer on the westerly edge of the proposal, as a substitute for the fence, would provide a visual and audio screen to residences to the northwest and west. FINDINGS, CONCLUSIONS AND DECISION FILE CUE-19-85 PAGE 3 5. The proposal will not be detrimental to the Comprehensive Plan or the surrounding properties as hereinafter conditioned. The single bay car wash, properly landscaped, may actually serve,as a_buffer between the nearby residential uses and the more i'ntensive-around-tie-clock,operations~of the convenience store and gasoline'sales. 6. Any finding hereinbefore stated which may be deemed a conclusion herein is adopted as such. DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal. The following CONDITIONS OF APPROVAL ARE STIPULATED. CONDITIONS OF APPROVAL 1. GENERAL l. The following conditions shall apply to the applicant, owner and successors in interest. 2. Prior to the full implementation of this proposal and issuance of permits, certain revisions and adjustments (by drawings and by notations) need to be made to the site plan to clarify parking lot directional arrow indications, parking space striping as appropriate, the specific lighting type with a spec sheet, and location, specifics with regard to the fence (including height and appearance), directional signs which indicate where to enter the car wash apparatus and clearly marking the exit from the car wash apparatus, and a landscaping/irrigation plan and schedule, all as approved by the Zoning Adjustor, with assistance of and delegation of authority to the County Engineer's Office. The revised site plan/ notations shall be submitted for review and approved by the Zoning Adjustor. 3. The Department of Building and Safety shall route the building permit application to all of the agencies and offices of county government below which are indicated as needing to give their authoriaation prior to the release of a building permit. The Planning Department shall be the last authorization sought prior to the issuance of the permit(s) by the Department of Building and Safety. II. PLANNING DEPARTMENT C 1. A revised and updated site plan shall be submitted to the Planning Department for approval by the Zoning Adjustor. That p lan sha l l in dicate the various improvements required by the various other agencies listed hereinafter as well as details concerning the following: . a. A striping plan for the paved areas, including parking stalls as necessary and directional arrows for the movement of cars; ~ b. An extension of the existing fence on the south side at a height of 48 inches and identical to the existing fence in appearance; ~ c. The location and content of si9ns which Provide entering and exit O ~ information regarding the car wash unit; ~ d. A lighting proposal, sclledule and specifications which will provide for "down lighting," concentrating illumination on the existing property and not creating high lumen fixtures as viewed from off-site nor cast illumination off the site in a manner which would be ~ distracting or disturbing to the travelling public or nearby residences; and I FINDINGS, CONCLUSIONS AND DECISION FILE CUE-19-85 PAGE 4 A e. A landscaping/irrigation schedule designed to accomplish the following objectives: i) A five (5) foot width irrigated landscape area shall be specified and installed west of the westerly curb and in lieu of ~p the applicant's proposed fence. The planting should be ~ initially a minimum of 5' in height, spaced to form a full ~ visual screen hedge within 3 years; giant or western red cedar ~ arborvitae, leyland cypress or similar is suggested. v ii) The '208' area should be designed to be irrigated and without shrubs or trees, except at its north end, where two semi-dwarf flowering trees and a mixture of flowering, deciduous shrubs and lower growing coniferous shrubs (if possible to compliment the above hedges) should be planted. The '208' design and shrub/ tree plantings should not conflict; that is the planting area should be graded above the grass area or separated from the grass by a physical barrier. . III. DEPARTMENT OF BUILDING & SAFETY 1. All buildings, structures and fences in excess of 6' in height require building permits as per Section 301 of the Uniform Building Code. 2. Compl i ance wi tli al l otlier appl i cabl e codes admi ni stered by thi s Depart- ment shall be demonstrated prior to the release of building permits. 3. Prior to the issuance of a Certificate of Occupancy, the North Pines Road sewer trunk line must be operational, The Zoning Adjustor shall assist with inspection if requested by the Building and Safety Department in regards to any other aspects of the site plan, landscaping, etc. IV. UTILITIES DEPARTMENT l. Approval for construction of this project shall not be given until public sewer lines now under construction are completed. This condition may be waived or interpreted at the discretion of the Utilities Department, con- sistent with actual constructions activity. 2. Certificate of Occupancy shall not be granted until hook-up to the North Pines trunk line is accomplished. Y. HEALTH DISTRICT 1. Prior to paving over the existing drainfield, the sanitary waste facilities of the existing convenience store shall be hooked to ttle Nortll Pines sewer trunk line and be operational. 2. The waste drainage from the car wash unit shall be designed to collect the wash water and deliver it to the North Pines sewer line. Use of any individual on-site sewage systern, including a holding tank is not ~ authorized. 3. Water service shall be by an existing public water supply when approved • by the Regional Engineer (Spokane), State Department of Social and Health Services. , 4. Use of private wells and water systems is prohibited. FINDINGS, CONCLUSIONS AND DECISION FILE CUE-19-85 PAGE 5 VI. ENGINEER'S OFFICE 1. The owner(s) or successor(s) in interest must obtain an approach perrnit from the County Engineer prior to the construction of any new access to the county road. (Car wash exit to Maxwell Ave.). 2. Prior to the release of a building permit for the automated car wash facility the applicant shall indicate on the approved site plan and otller- wise install prior to the issuance of a Certificate of Occupancy, the various applicable conditions of approval set forth in the findings and order of the Spokane County Hearing Examiner Committee for zone reclassification ZE-170A-78, as listed hereinafter, a. The applicant shall construct portland cement concrete curb, sidewalk and pave to the existing pavement on Maxwell Avenue. b. An appropriate off-site drainage disposal system and access plan shall be approved by tiie Spokane County Engineers Office prior to the issuance of building pe nnits for the project. c. A surface water disposal plan for the area essentially west of the gas pump area shall be approved by the County Engineer prior to the issuance of any building permit. d. The design, location and arrangement of parking stalls shall be in accordance with standard Engineering practices. Any portion of tile project which is to be occupied or travelled by vehicles shall be maintained in hard surface paving. BACKGROUND/ANALYSlS In early 1979, the Hearing Examiner Committee continued a previous request for this site. (Local Business and Multiple Family Suburban) from the March, April, May and June hearings. On June 21, 1979 this item was continued indefinitely by the Hearing Examiner Committee. On June 29, 1979 the applicant requested that the proposal be withdrawn from consideration. Since that time the applicant has changed his request to Local Business and Residential Office zoning. The Local Business zone encompasses the east 350 feet of the proposal for a total area of 2.35 acres. The Residen- tial Office Zone incorporates the remaining west 300 feet for a total area of 1.15 acres. Consideration should be given to the following: (1) The Residential Office zone adequately meets the parking requirements, the Local Business zone is 8 spaces short; Spokane County Health District indicates that this project lies over the Spokane Aquifer; is within Critical Water Supply Service Area #3 and service area of Modern Electric Company. Soils are suitable for use of on-site sewage disposal systems. It lies within the 208 Study recommended Primary Sanitary Sewer Area. Disposal of sewage effluent beneath paved surfaces may be prohibited. IV. AGENCIES RECOMMENDED CONDITIONS a) COUNTY FI RE MARSHAL 1. The site is located in Fire District #1. 2. Adequate water for fire protection and distribution of such water shall be required for this project. AGENCIES CONSULTED/COMMENTS RECEIVED (continued) b) COUNTY ENGINEER 1. Applicant shall dedicate a 20 foot radius on Pines Road and Maxwell Avenue. 2. Applicant shall dedicate half (25 feet) of the proposed Sinto Avenue extension as shown on the approved plat plan and a 20 foot radius on Pines and proposed Sinto Avenue extension. 3. Applicant shall construct cement concrete curb, sidewalk and pave to existing pavement on Maxwell Avenue. 4. Applicant shall construct cement concrete sidewalk on Pines Road. 5. Access permits and improvements to Pines Road must be approved by the Washington State Department of Transportation. 6. Applicant shall construct cement concrete curb, sidewalk and pave half (20 feet) of the proposed Sinto Avenue extension. At the time of construction, if the property owners to the south are not prepared to construct thei r half of the roadway then the applicant shall pavE an additional 10 feet on the proposed Sinto Avenue extension. 7. An appropriate off-site drainage disposal system and access plans shall be approved by the Spakane County Engineer's Office prior to the issuance of building permits for the project. 8. A detailed combined on-site sewage system and surface water disposal plan for the entire project shall be approved by the Spokane County Engineer and the Spokane County Health District prior to the issuance of any building permit. 9. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. (Any portion of the project which is to be) occupied or traveled by vehicles shall be maintained in hard surface paving. c) WATER PURVEYOR 1. Purveyor is Modern Electric Water Company and they are able to supply the site with adequate water for domestic fire and i rrigation uses. d) COUNTY HEALTH DISTRICT 1. A combined sewage and surface water disposal plan shall be approved by the Spokane County Engineer and Spokane County Health District prior to issuance of any building permits. 2. Sanitary ptumbing shali be installed to facilitate connection to an area-wide sewerage system. 4. The owner, his heirs and assigns shall agree to participate in and not protest assessments for any focal improvement district for sewering to serve this property. 5. Connection to area-wide sewer collection system shall be made when the system becomes available. e) SEPA 1. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080 RCW be initiated by the applicant within thirty (30) days of final action of the Responsible Administrative Body and be completed before any site improvements are made. 2. The request has proven to be environmentally non-significant. Therefore, a final declaration of non-significance shall be signed by the Chairman of the Hearing Examiner Committee. f) ZONING 1. Approval by the Zoning Administrator of a specific fighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, ptanting schedule and provisions for rnaintenance acceptable to the Spokane County Zoning Adminis- trator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property generally in accord- ance within the concept presented to the Hearing Examiner Committee. Minor variations when approved by the Zoning ` Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowabte uses of the permitted zone. All variations must 4 conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be ~ maintained. 4. INTRODUCTION This matter having come before the Examiner Committee on March 6, 1980, and the members of the Committee present being Jane Myers, Acting Chairman, Ted McCoury and Paul Sceva, Jr. and having personally visited the site. B. PROPOSAL The sponsor, Edward Unicume is requesting approval of a zone reclassification, ZE-170A-78, Agricultural to Residential Office and Local Business, for the purpose of developing a retail business/office complex. C. FINDINGS OF FACT 1. That the existing land use in the area is residential, office, and undevelop- ed. 2. That the Comprehensive Plan designates this area as appropriate for residen- tial development. 3. That the existing zoning of the property described in the application is Agricultural. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the proposed use is compatible with existing uses in the area. 8. That the owners o# adjacent lands expressed both approval and disapproval of the proposed use. 9. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 10. Water service shall be from Modern Electric Company. 3. Sanitary plumbing shall be installed to facilitate connection to an area-wide sewerage system. 4. The owner, his heirs and assigns shall agree to participate in and not protest assessments for any local improvement district for sewering to serve this property. 5. Connection to area-wide sewer collection system shall be made when the system becomes avai lable. e) SEPA 1. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080 RCW be initiated by the applicant within thirty (30) days of final action of the Responsible Administrative Body and be completed before any site improvements are made. 2. The request has proven to be environmentally non-significant. There- fore, a final declaration of non-significance shall be signed by the Chairman of the Hearing Examiner Committee. f) ZONING 1. Approval by the Zoning Administrator of a specific lighting and signing plan for the described property prior to the release of any building permits. 2. A specific landscape plan, planting scheduie and provisions for main- tenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Minor variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Build- ing location, landscape plans, and general allowable uses of the per- mitted zone.
