15-004.01 David Evans & Associates: 2015 Traffic Engineering Svcs 5-0©4.01 CONTRACT AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF SPOKANE VALLEY AND DAVID EVANS AND ASSOCIATES, INC. Contract # 15-004 For good and valuable consideration,the legal sufficiency of which is hereby acknowledged,City and the David Evans and Associates,Inc.mutually agree as follows: 1. Purpose: This Amendment is for the Contract to provide Traffic Engineering Services by and between the Parties, executed by the Parties on January 9, 2015, and which terminates on December 31, 2015. Said contract shall be referred to as the "Original Contract" and its terms are hereby incorporated by reference. Total compensation under the Original Contract is not to exceed$40,000. The purpose of this Amendment #1 is to increase the scope and compensation of the Original Contract to conduct a traffic impact analysis for the City Hall project,as set forth more fully in Appendix"B". 2. Original Contract Provisions: The Parties agree to continue to abide by those terms and conditions of the Original Contract and any amendments thereto which are not specifically modified by this Amendment. 3. Amendment Provisions: This Amendment is subject to the following amended provisions, which are either as follows, or attached hereto as Appendix "A". All such amended provisions are hereby incorporated by reference herein and shall control over any conflicting provisions of the Original Contract,including any previous amendments thereto. • 4. Compensation Amendment History: This is Amendment #1 of the Original Contract. Paragraph 3 of the Original Contract is hereby amended to change the total compensation paid from a time and materials basis, not to exceed $40,000, to a time and materials basis, not to exceed $55,000. Paragraph 3 of the Original Contract is amended to read as follows: The City agrees to pay Consultant on a time and materials basis, not to exceed $55,000 as full compensation for everything furnished and done under this contract, in accordance with the provisions outlined in the scope of work, as previously and/or presently amended. Time and Materials rates may be revised if approved in writing by the City. Consultant shall not perform any extra, further or additional services for which it will request additional compensation from City without prior written agreement for such services and payment therefore. 2. (DEA) will develop a Traffic Impact Analysis in accordance with the tasks documented within this scope of work for the City of Spokane Valley New City Hall. The proposed development site is located in the City of Spokane Valley on Sprague Ave. east of Dartmouth Rd. This scope assumed that a Trip Generation and Distribution Letter has been completed separately. General Assumptions 1. The City will provide the most recent site plan and conceptual buildout information including development areas (e.g. building and site size, etc.)upon notice to proceed. This information is the basis for the trip generation calculations. If the site plan, access points, size,type and or mix of development changes after the traffic work has begun an addendum to the scope and fee may be required. 2. This scope of work assumes that no public traffic meetings will be required. 3. This scope of work does not include the collection of traffic counts. An additional scope will be required if the City requires additional traffic counts. 4. The assumed build-out year for the project is 2017. 5. Attendance at Hearing Examiner or City Council hearings is not included in the scope of work. Task 2. Traffic Impact Analysis: The Scope of this Traffic Impact Analysis (TIA) shall be consistent with published traffic impact analysis procedures and policies of the City of Spokane Valley(CITY), as agreed upon at the onset of this Project. This includes coordination with the project team and client. Two to three conference calls are anticipated along with periodic communication with the project team regarding project status and schedule. It should be noted that pm peak hour counts were already conducted and will be utilized for this project. Traffic counts were completed at the six study area intersections discussed with CITY staff, as noted below: Sprague/University Sprague/Dartmouth Sprague/Farr Appleway/University Appleway/Dartmouth Appleway/Farr The TIA shall contain the following elements: A. A site visit to review existing roadways, intersections, traffic control, sight distances, speed limits, roadway geometry and lane configurations at all study intersections and roadway segments. B. Collection of site plan data,traffic volumes, and accident data from agencies and traffic counting vendor, confirmation of current traffic and land use conditions, PM peak hour data at six study area intersections. C. Background traffic growth will be calculated for future conditions based on a traffic growth rate of 1.1% per year per the CITY's standard. Traffic generated by the proposed development at build-out and build-out plus 5 years will be completed for inclusion in the TIA. Trip distribution and assignment of traffic generated by the proposed development to the surrounding streets at build-out will be assigned to the various roadways within the study area and intersection approaches. Existing turning movements, along with background traffic and project trip assignment at study intersections will be analyzed for each scenario. E. Projection of design year traffic volumes at six study area intersections and three project driveways is assumed as Year 2017. F. Analysis of PM peak hour levels of service and queuing at six study area intersections will be analyzed assuming four scenarios: a. Existing Conditions b. Opening Year, 2017 (without the project) c. Opening Year, 2017 (with project) d. Opening Year plus 5,2022 (without the project) e. Opening Year plus 5, 2022 (with project) Analysis for the three proposed driveways will be conducted for opening year with project and Year 2022 with project. G. Intersection control recommendations at the six study area locations and project driveways will be made based upon the five scenarios identified above, physical characteristics of the intersections, the queuing analysis performed, and whether one or more warrants (per MUTCD) are met. H. Determination of potential off-site improvements to mitigate Project impacts such as paving of access roadways, road widening for additional lanes, or improvements at the study intersections will be included in this traffic study. I. Preparation of a TIA report including narrative, graphics, and supporting calculations for the CITY's review and comment. J. Revision of the TIA report to address one iteration of applicable comments received from the CITY. This Scope and Fee includes no more than sixteen (16) hours of DEA personnel time for revisions. Any major revisions and/or additional submittals that exceed this budget will be done on a"Time and Materials"basis. K. DEA transportation engineering/planning staff will attend up to two project related meetings. FEE Proposal The contract type based on time and materials and will be included under the existing on-call contract. The client will be billed monthly based on work completed the previous month.
