There are several reasons why I feeZ this deveZopment wouZd be desirabZe. The restaurant wouZd eertainZy eZean up that eorner and Zook good. Anythzng wouZd Zook better than that vaeant Zot whieh does nothing but eoZZeet posters and debris. The restaurant wouZd be eompatibZe with the neighborhood as Zong as no beer was soZd, and its signs were not too fZashy. As to the schooZ board's opposition to the deveZopment beeause of kids smoking in the Zot, it has been the experienee on my property aeross,the street from the schooZ that the kzds smoke everywhere. I even had to take down a shed on my property because they were 8moking there. AZso, I have never noticed any facuZty member of the sehooZ taking eare of any of these kind of probZems. Stocker, Assistant Superintendent for Administration has asked me to correspond with your office regarding the proposed zoning change for the property on the corner of Pines and Broadway. The property is currently Agriculture- Suburban zone classification and the owners have requested a change to Local Business zone thus permitting a proposed pizza parlor. The administration and staff of North Pines Jr. High strongly support the Policy and position of the Central Valley School Board on zoning areas adjacent to schools. I believe Mr. Stocker forwarded that policy to you. Our assistant principal, Mr. Harv Hagen, was in attendance at the school board meeting on 0 ctober 12, 1976 and recommended that the C. V. School District Board of Directors reaffirm this policy. After considerable thought we thought it necessary to make this recommendation on behalf of our students. Our school has a closed campus policy and with a commercial eating establishment next door the temptations would be far too great for junior high aged students. The supervision of our students as well as the supervision of the neighboring property would be monumental. We regret taking this action against the owners who are requesting this change but definitely feel that it is in the best interests of our students and the Central Valley School District. There are two reasons for this: 1). access routes going East, West, North or South are con- troled by the light at Pines and Broadway. Persons utilitizing service at North Pines Professional Bldg. N. 905 Pines and N. 1005 Pines laclc., t'his advantage, due to the lack of a traffic light on Cataldo and Pines. 2). Size of the property in question (33,000 sq. ft.). None of the other corners at Pines and Broadway can offer this advantage. With regard to the question of whether a local Business Zone be allowed, let me offer these points: 1). Land use planning cannot be arbitrary. Each piece of property must be judged on its best use to the community. Points, though, that are more i.mportant involve con- sistency involving density. Our proposal would affect traffic less than does the offices and apts. located at Pines and Cataldo. This we feel is a consistent use with those that have already been implemented. 2). With regard to the school: The C.V. school district, like every school district in the county, has school property adjacent to or near areas which are already or are likely areas for the development of local business zones. An immediate example of this is University Elementry School at 16th and University. In 1952, according to the planning commission staff, this property was zoned local Business. In 1955, C.V. School district accepted the completed Elembntary school, just across the street, and began using it. In the 60's a gas station was built on the corner and in 1975 a 7-11 store was built adjacent totIme gas station. Today, according to the owner operator of the 7-11 store, "Our relationship with the school is good." In the city, Shadle Park Shopping Center is directly adjacent to a Junior High. Development of those areas has continued and been successful, Logical areas for development even though near school property has consistently been utilized to its highest and best use. 3). Development of a strictly family dining restrurant of this type in this area is needed to acc- ommidate the high density residential area surrounding this area under consideration.
