Schultz Winston and Cashatt Seafirst Financial Center Spokane, WA 99201-069 -5 RE: INTERPRETATION OF COMMERCIAL ZONE OF THE ZONING ORDINANCE OF SPOKANE COUNTY - AI-24-87; SELF-STORAGE/MINI- WAREHOUSE AS A PERMITTED USE Dear Mr. Schultz: This response to your October 21, 1987, letter is an official interpretation of the Zoning Ordinance of Spokane County. You have asked the question: "Is a self-storage or mini-warehouse a permitted use in the Commercial Zone, Chapter 4.10, of the Zoning Ordinance of Spokane County?" It is the Planning Department's position that a self-storage or mini-warehouse is indeed a permitted use within the Commercial Zone. In support of this position is an interpretation rendered by the Spokane County Zoning Adjustor on October 20, 1980, and identified as File No. I-9-80 (see attachment). In that case, the Spokane County Zoning Adjustor was asked to review the administrative decision of the Zoning Administrator that self-storage or mini- warehouses are not a permitted use in the Commercial Zone. In overturning the Zoning Administrator's interpretation, the Zoning Adjustor found that: - mini-warehouses are comparible to transfer storage warehouses which are a permitted use in the Commercial Zone according to Section 4.10.030(e)(45); - that mini-warehouses are a retail service which is consistent with the purpose and intent of the Commercial Zone; - and that historical files indicated that Spokane County had allowed several mini-warehouses to be located within the Commercial Zone. The Spokane County Planning Department stands by this interpretation of the Zoning Adjustor provided that all standards of the Commercial Zone together with all conditions of approval in a Commercial Zone are complied with in the development of the mini-warehouse use. Although the above information is correct concerniiny a riini-vvarehause use il; the Commercial Zone, I have found some discrepancies in your letter of October 21, 1987 and rezone files related to the property described by you. It is imperative that I point these discrepancies out to you since they do in fact affect the situation described in your letter and modifies the interpretation you have asked me to make. In your letter, you describe the existing Shurguard Self-Storage facility as being located on the Ea~ twenty-five (25) feet of Tract 16, all of Tract 17, and a portion of Tract 18 of Assessor's Plat No. 6. In reviewing the legal descriptions, I find that the Wes~ twenty-five (25) feet of Tract 16 is contiguous to Tract 17 and = the Easterly portion of Tract 16. Therefore, I assume that the correct legal description for the Shurguard Self-Storage facility should be the Westerly twenty-five (25) feet of Tract 16, all of Tract 17, and a portion of Tract 18 of Assessor's Plat No. 6. In your letter you also describe a brief zoning history of the area in question. In review of the rezone files and associated legal descriptions, I find the following zoning history to be more correct. In 1972 Tracts 15, 16, 17, 18, and 19 of Assessor's Plat No. 6 lying northeriy of Interstate 90 were rezoned from Agricultural to Freeway Commercial by zoning file ZE-60-72. Subsequent to that rezoning, three (3) separate ione changes were proposed and approved to change most of the above-described property from Freeway Commercial to Commercial or Restricted Industrial. File ZE-3-73 changed the zoning on Tract 15 from Freeway Commercial to Restricted Industrial. In 1975, the easterly 250 feet of Tract 16 was proposed and approved for rezoning from Freeway Commercial to Commercial by File ZE-23-75. Tract 16 in reality is approximately 275 feet wide. Therefore, since ZE-23-75 rezoned only the easterly 250 feet of Tract 16, the westerly 25 feet was not affected by that zone change and remained zoned Freeway Commercial. Finally, in 1976, by File ZE- 43-76, Tracts 17, 18 and 19 lying north of Interstate 90 were approved for Restricted Industrial zoning. This application, ZE-43-76, did not include any portion of Tract 16. Therefore, it is the Planning Department's position that the westerly 25 feet of Tract 16 continues to be ioned Freeway Commercial according to File ZE-60-72. Now, with the above in mind and knowing that the westerly 25 feet of Tract 16 is zoned Freeway Commercial, I believe that your intended question of interpretation would actually be as follows: "Is a self-storage or mini-warehouse a permitted use in the r w Q&rnmercial Zone, Chapter 4.08A, of the Zoning Ordinance of Spokane County?" In response to this question I find that self-storage or mini-warehouse uses ~r = a permitted use in the Freeway Commercial Zone. In support of this position is the fact that Section 4.08A.010 - Intent of the Zoning Ordinance of Spokane County states that the Freeway Commercial Zone is intended to serve the special needs of persons and vehicles traveling on limited access highways. in other words, the Freeway Commercial Zone is intended to serve those specific needs of the traveling public only. Section 4.08A.020 - Uses Permitted lists the commercial uses that would be allowed in the Freeway Commercial Zone and includes service stations, automobile and truck repair, restaurants, hotels, motels, and recreational vehicle parks. In order for developments to be allowed in the Freeway Commercial Zone, site plans for a specific proposal must be submitted, reviewed, and approved by the Hearing Examiner Committee. File ZE-60•72 does not indicate that a mini-warehouse facility was ever approved in a public hearing for this site. In order to correct this situation on the westerly 25 feet of Tract 16 there are several alternatives which you may wish to pursue. 1. Request a special permit from the Spokane County Zoning Adjustor pursuant to Section 4.25.030(h) of the Zoning Ordinance of Spokane County to allow extension of a use into an adjacent zone. 2. Apply for a rezone to Regional Business (B-3) Zone or Light Industrial (I-2) Zone which would allow the mini-warehouse facility on this property. 3. Apply to the Spokane County Zoning Adjustor for an interpretation of the location of a ioning boundary line pursuant to Section 4.25.030(d) of the Zoning Ordinance of Spokane County. 4. Appeal this entire interpretation to the Spokane County Board of Adjustment pursuant to Section 4.25.030(c) of the Zoning Ordinance of Spokane County. I would be happy to discuss the above alternatives or any other thoughts that you may have on this situation at your convenience. Answers to Questions on the Environmental Checklist Form. 1. 6 B-D Mini-Storage of Spokane is a 60,000 + or - square foot mini- storage project on approximately 3.37 acres of land in the Spokane Central Valley. We will build seven buildings plus a manager's unit. The storage buildings will be constructed with tilt-up concrete walls to a height of 12 to 14 feet. The project will be completely fenced with a chain link fence and the frontage along Indiana Avenue will be extensively landscaped. 1. 7 The project is located between the Northeast offramp of I-90 and Indiana Avenue, just east of Pines Road. The land is flat and covered with grass. Approximately 75$ of the land will be covered by impervious surface, either building or driveway. Extensive drywells will be constructed to capture all runoff and contain it on site. II. lb There will be disruptions to the soil to the extent that the site will be contoured for drainage control and building locations. The site will be covered by buildings and driveways. II. lc See above statement. II. 2a This project will result in a slight increase in automobile traffic in the area, however, the deterioration of the ambient air quality will be negligible. II. 4a The site will be cleared and the grasses will be removed. These grasses will be replaced by shrub and tree plantings in the land- scaped areas. II. 5a Any land animals or birds who use this grass field as a habitat will be displaced. They will migrate to new areas in close proximity to the site to the extent that the new areas are not already over crowded.
