and Marletta Avenue. The appllcant proposed to construct a 4480 square
foot offtce complex on the North 180 feet of the described property, and
a 1, 920 square foot convenience grocery store on the South 140 feet of the
property.

1. The Spokane County "Zoning Plan for Pinos Road Between the Freeway
and Trent Avenue", inidcates that the properties with Pines Road
Frontage between the Northern Paciflc Ratlroad rlght of way and

The Planning Commissfon notes that thQ rIorth Pines Study delineates
2onirg along Plnes Road as follows:
a. Between the Northern Paciffc Railroad right of way and

around the Trent Grade School: (Single and Two Family Residen-
tial).

NOTE: The Board of Counry Commf ss i oners concurred with the
Planntng Commission's recommendation to accept and approve the
Plannfnq Staff's study of iVorth Pines Road between Trent Road and
the Spokane Vailey Freeway. The Board further concurred that the
ComprehensLve Plan for the Valley be chanqed to reflect future iand
use as outlined by the Planning Commisst on's Study and Zoning Plan.
2. The zoning plan for Plnes Road between the Northern Pacific
Railroad right of way and Marietta calls for residential uses of those
properties. The Text Portton of the ComprBhensive Plan for Spokane
County defines residential as a land use slement destgned to serva
existing and future dwellfng units. Areas designed for residenttal
purposes are to remai n free from commercial and industrtal uses.
. 3. The Ptannlnq Commission has not encouraged the proliferatton of
Local Business Zoning along North Pines and the staff c oncludes
that the smalt business site would be an unwarranted intrusion Into
the resldentfal neighborhood.
NOTE: The advertised property is surrounded on three sides by
residential development.
4. It was noted that the Planning Commissi on has been recently approv-
inq Resldential Office requests on North Pines Road between I-90,
south to Sprague Avenue, Also, the "7oning Ptan for Pines Road
Between the Freeway an3 Trent Avenue" recommends R2sidential
Office uses for property along Pines, south of Mansfleld to Shannon

B. STAFF ENVIRONMENTAL REVIEW:
A s required ln WAC 197-10- 320, the staff of the County Pl anning Commis-
ston revlewed the envrionmen~al checkltst submitted by Mr. F. V. Seipp
tn behalf of V4 olfl3nd, Inc. for a zono ch3nge to allow construction of a
convenLence Grocery and office complex. The proposal is located
approximately fn the E 1/2 of the IVE 1/4 of Section 9, Township 25N.,
Range 44 EViM frontlnq Pfnes Roa.d, south of Buckcye Avenue. The pro-
ponent is requesting a zone change from Two Family Residential to
Residential Office and Local Business to allow the consruction of a
convenience qrocery store and an offfce bullding on a site of just over one
(1) acre in size. Thz sfte is located on relatlvely flat terrain with an
unmanaqed grass land vegetation cover.
The -staff evaluatfon identlfied only cna potentially major lmpact area, that
of increased motor vehlcie trafftc an4 *he secondary Lmpacts therewith.

its decision concerning the request of Wolfland, Inc , South 717 Pines Road,
Spokane, Washington, for above entitled zone change, and
The Board having received the recommendation for denial from the Spokane County
Planning Commission as contained in the Commission's minutes of June 11, 1976,
and
The Board having conducted 1ts own public hearing at the request of the
Applicant, Wolfland, Inc., and after visiting the site and revlewing the
testimony, and
The Board being fully advised in the premises did determine, based upon the
testimony submitted at the public hearing and other evidence availabie to the
Board, to uphold the recommendation for denial of said zone change.

We have studied the minutes of the presentation by the planning staff
to the County Commissioners in this appeal hearing. Erroneous information
as to what the zoning presently is between Marietta and Mansfield was
offered. We find there is considerable zoning for residential office
North of Mansfield on the East side of Pines Road.
We had petitioned for a combination of local business and residential
office zoning, but would accept a change to residential office on the
entire parcel.
On the basis of the contents of this letter, we appeal for a rehearinq 6(/ -

Dear Sirs:
We wish to appeal the decision rendered by the Spokane
County Planning Commission on June 11, 1976, pertaining to
the above referenced zone change.
We feel this decision was based on an outdated study
for this area, from 1968. Apparently no thought or consideration
was given to the changes and needs of the people. This area,
having a higher than normal density of population due to multi-
family construction, needs a convenience store at this t1me.

approximately fn the E 1/2 of the 1VE 1/4 of Section 9, Township 25AT.,
Range 44 EWM fronting Pines Road, south of Buckeye Avenue. The pro-
ponent is requesting a zone change from Two Famtly Residenttal to
Residential Office and Local Business to allow the consruction of a
convenience qrocery store, and an offlce butlding on a site of just over one
(1) acra tn size o The site i s located on r elatively flat terrain with an
