MICHAEL HUFFMAN being first duly sworn on oath deposes and says that he is the EDITOR of the Spokane Valley News
Herald, a weekly newspaper. That said newspaper is a legal newspaper and it is now and has been for more than six months prior
to the date of publication hereinafter referred to, published in the English language continually as a weekly newspaper in Spokane
County, Washington, and it is now and during all of said time was printed in an office maintained at the aforesaid place of
publication of said newspaper, which said newspaper had been approved as a legal newspaper by order of the Superior Court of
the State of Washington in and for Spokane County. That the following is a true copy of a Legal Notice as it was published in
regular issues commencing on the 11th day of December, 2015, and ending on the llth day of December, 2015, all dates

a new section of 10 -inch diameter pipeline
beneath the Spokane River using a horizon-
tal directional drill.

partment of Ecology
Written comments: Agencies, tribes,
and the public are encouraged to review
and provide written comments on the
proposal/project and its probable environ-
mental impacts. All comments received by
January 8, 2016, which is within thirty (30)
calendar days of the date of this notice will
be considered prior to making a decision
on this project. Any person has the right to
comment on this project and receive notice
of and/or participate in any public hearing
process it scheduled. Further, any person
may request a copy of the decision for the
proposal once made. Pursuant to Chapter
17.90 (Appeals) of the City of Spokane
Valley Municipal Code (SVMC), a written
appeal of the decision shall be filed with
the City of Spokane Valley Community De-
velopment Department within fourteen (14)
calendar days after the date the notice of
the decision is mailed. Standing to appeal a
decision shall be determined in accordance
with the provisions of Chapter 17.90.030
(Standing) of the SVMC.

Studies Required: None at this time; ad-
ditional studies to be determined.
Environmental Review: The Planning
Division has reviewed the proposal/project
and has determined that the project Is not
categorically exempt pursuant to WAC 197-
11-800 from environmental review under
the provisions of the State Environmental
Policy Act. The Planning Division acting
as lead agency will conduct an environ-
mental review of the proposed preliminary
plat and will issue a separate threshold
determination.
Applicable DevelopmentRegulatlons:
Tkle21(Environmental Controls) the SVMC,
Chapter 21.50 Shoreline Regulations and
the 2015 Shoreline Master Program (SMP,),
and Title 24, Chapter24.50 Excavation, Fill.
and Grading, are the primary development
regulations applicable to the site.
Public Hearing: Pursuant to the 2015
SMP Section 21.50. 130 and SVMC Sec-
tion 17.80.060, the Planning Division shall
be the decision -maker on the Shoreline
Substantial Devebpment Permit and Wash-
ington State Department of Ecology shall be
the decision maker on the Shoreline Condi-
tonal Use Permit. Therefore, the proposal
is not subject to a public hearing.
