FINDINGS AND ORDER RECARDING ZONING MAP PROPOSAL,;'.
RICHARDSONT WHEREAS, The Spokane County Planning Commission did, after public
hearing on October 8, 1976, forward to the Board of County Commissioners` a
recommendation that the Zoning Map be changed from the existing Agricultural
Suburban classification to the Multiple Family Suburban classification on the
property described as follows:
Beginning 30 feet North of the SE corner of Tract 215 of Opportunity;
thence North 172 feet to the true point of beginning; thence West 113
feet; thence South 47 feet; thence West 115 feet; thence North 15 feet;
thence East 115 feet; thence South 47 feet; thence East 113 feet; thence
South 259 feet to the true point of beginning; alI in Section' X.Town- '
ship 25 N., Range 44, E.W. M., Spokane County, Washington,
and,
WHEREAS, Concerned persons before the Planning Commission, did by
letter dated October 13, 1976, request a hearing before the Board of County
Commissioners to present evidence and testimony opposing this application, and
WHEREAS, The Board of County Commissioners did hold a public hearing
on November 18, 1976, to consider the recommendation of the Planning Commission
and testimony and evidence of the applicant and other interested parties, and
WHEREAS, At said hearing, opportunity was afforded those favo'ring and
those opposing the above-described Zoning Map proposal, and the Board of County
Commissioners of Spokane County having fully considered the testimony given, the
records and minutes of the Planning Commission, and all other evidence presented,
and having personally acquainted themselves with the site and vicinity in question,
does hereby find:
1) `l'izat the proposect apartrnent project contorrils to the C;otiiprehensivu
Plan, which indicates the area as being appropriate for residential
uses.
2) The proposed multiple family site lies on the edge of a residential
neighborhood, has access to shopping, community services, public
facilities, and an arterial system.

project in conjunction with the conditions of approval will assure
compatibility of the development with existing and future land uses
in the area.
NOV1T, THEREFORE, The Board of County Commissioners of Spokane County
does hereby conclude that the above-described findings are sufficient and controlling,
and does, therefore, order that an appropriate resolution to change the Zoning Map
on the above-described property from the Agricultural Suburban classification to the
Multiple Family Suburban classificatfon be prepared, subject to the following
conditions :
1) Dedication of the East fiue (S) feet of Tract 215 of Opportunity and
dedication of the North ten (10) feet and the South five (S) feet of
the East 228 feet of Tract 215 for right of way.
2) Dedication of a twenty (20) foot radius on the northwest corner of -
Fourteenth Avenue and Houk Ro`~;l «7~~.I ~1;~~ ~ coor

3) Improvements to Spokane County standards of Houk Road, Twelftlz
Avenue and Fourteenth Avenue, along the project perimeter; i, e.,

228 feet of Tract 215 of Opportunity of Twelfth Avenue and Fourteenth
Avenue. Such improven ents will include curbs, sidewalk, drainage
control and paving to existing paving on Twelfth Avenue; of a 30
foot strip on Houk and Fourteenth Avenue along the project perimec,_.c,
4) Access permits for the advertised property shall be obtained from
the Spokane County Engineer's Office prior to release of building
permits.
5) The advertised property shall be developed fn substantial conforniai ce
with the development plan on file with this application; i, e., two-
story structures, the total number of apartment units not to exceed
forty (40), with a ratio of 2,394 square feet of land per dwelling

6) The off-street parking facility and connecting d'riveways shall be developed in substantial conformance with the development plan.
Any portion of the pro ject which is to be occupied or traveled by

The above-entitled matter coming on regularly for hearing before the Board of munty
Commissioners of Spokane County, Washington, on this day, and it appearing
to the Board that the Spokane County Planning Commission has given due notice of
the hearing on the matter in the manner and for =the time provided by laws; that
said Planning Commission has held a public hearing as required, and that the
said Planning Commission concurs in the plan to zone the following described
property as:
MULTIPLE FAMILY SUBURBAN:
Beginning 30 feet North of Southeast corner of Tract 215 of Opportunity;

NOW, THEREFORE, BE IT RESOLVED, that the above described property be, and
the same is zoned under the classification of MULTIPLE FAMILY SUBURBAN as
defined in the Zoning Ordinance of Spokane County, adopted August 25, 1953,
as amended.
AND FURTHER BE IT RESOLVED that any development on the above-described pro-
perty shall be subject to the following conditions:
1) Dedication of the East five (S) feet of Tract 215 of Opportunity and
dedication of the North ten (10) feet and the South five (S) feet of
East 228 feet of Tract 215 for right of way.
2) Dedication of a twenty (20) foot radius on the northwest corner of
Fourteenth Avenue and Houk Road and on the southwest corner of
Twelfth Avenue and Houk Road.
3) Improvements to Spokane County standards of Houk R,oad, Twelfth
Avenue and Fourteenth Avenue , along the pro ject perimeter; i. e.,
along the east side of Tract 215 of Opportunity, and along the East
228 feet of Tract 215 of Opportunity of Zwelfth Avenue and Fourteenth
Avenue. Such improvements will include curbs , sidewalk, drainage
• control and paving to existing paving on Twlefth Avenue; of a 30 foot
strip on Houk and Fourteenth Avenue along the project perimeter.
4) Access permits for the advertised property shall be obtained from the
Spokane County Engineer's office prior to release of building permits.
5) The advertised property shall be developed in substantial conformance
with the development plan on file with this application; i. e., two-
story structures, the total number of apartment units not to exceed
forty (40) with a ratio of 2394 square feet of land per dwelling unit.
6) The off-street parking facility and connecting driveways shall be developed
in substantial conformance with the development plan. Any portion of the
project which is to be occupied or traveled by automobiles shall be
maintained in hard surface paving. Open parking areas shall be unlighted
except that driveways and walkways may be illuminated by low intensity
lighting.

7) An appropriate on-site storm ,drainage disposal system shall be approved
by the Spokane .County 'Engineer's Office prior to the release o# building .
permits for the pro ject. .
8) All areas not occupied by buildings, parking and paved roadways, shall
be landscaped, planted, and maintained in appropriate turf and shrubbery.
The Zoning Administrator shall approve a landscape plan and installation
schedule for the project incorporating a sprinkler system and screening
(fencing), prior to is suance of building permi ts .
9) Approval of sewage facilities by the Spokane County Health District.
10) Provisions shall be made for fire hydrants in accordance with the
requirements of the Spokane Valley Fire Marshal.

hearing on October 8, 1976, forward to the Board of County Commissionerg a
recommendation that the Zoning Map be changed from the existing Agricultural .
Suburban classification to the Multiple Family Suburban classification on the
property described as follows: Beginning 30 feet North of the SE corner of Tract 215 of Oppor tunity;

and, WHEREAS, Concerned persons before the Planning Commission, did by
letter dated October 13, 1976, request a hearing before the Board of County
Commissioners to present evidence and testimony opposinq this application, and
WHEREAS, The Board of County Commissioners did hold a public hearing
on November 18, 1976, to consider the recommendation of the Planning Commission
and testimony and evidence of the applicant and other interested parties,
WH£REAS, At said hearing, opportunity was afforded those favoi-ing ancl
those opposing the above-described Zoning Map proposal, and the Board of County
Commissioners of Spokane County having fully consfdered the testimony given, the
records and minutes of the Planning Commission, and all other evidence presented,
and having personally acquainted themselves with the site and vicinity fn question,
does hereby find:
1) That the proposed apartment project conforms to the Comprehensive .

Plan, which indicates the area as being approprlate for residential
uses.
2) The proposed multiple family site lies on the edge of a residential
neighborhood, has access to shopping, commllnity services, public
facilities, and an arterial system.
3) There have been several applications for Residential Office and
Multiple Family Suburban zoning along Pines Road between the
Milwaukee Railroad tracks and Sixteenth Avenue. Aithough the
advertised property is one lot depth removed from Pines Road, it

FINDINGS AND ORDER REGARDING ZONING M11P PROPOSAL, ZE-114-76 -

WHEREAS, The Spokane County Planning Commission did, after public
hearing on October 8, 1976, forward to the Board of County Commis sioners~ a
recommendation that the Zoning Map be changed from the existing Agricultural
Suburban classification to the Multiple Family Suburban classification on the
property described as follows:
Beginning 30 feet North of the SE corner of Tract 215 of Opportunity;
thence North 172 feet to the true point of beginning; thence West 113
feet; thence South 47 feet; thence West 115 feet; thence North 15 feet;
thence East 115 feet; thence South 47 feet; thence East 113 feet; thence
South 259 feet to the true point of beginning; all in Section 22, Town- '
ship 25 N., Range 44 , E. W, M., Spokane County, Wa shing ton ,
and, i
WHEREAS, Concerned persons before the Planning Commission, did by
letter dated October 13, 1976, request a hearing before the Board of County
Commissioners to present evidence and testimony opposing this application, and
WHEREAS, The Board of County Commissioners did hold a public hearing .
on November 18, 1976, to consider the recommendation of the Planning Commission
and testimony and evidence ot the applicant and other interested parties, and
WHEREAS, At said hearing, opportunity was afforded those favo'ring and
those opposing the above-described Zoning Map proposal, and the Board of County
Commissioners of Spokane County having fully considered the testimony given, the
records and minutes of the Planning Commission, and all other evidence presented,
and having personally acquainted themselves with the site and vicinity in question,
does hereby find:
1) That the proposed apartment project conforms to the Comprehensive -
Plan, which indicates the area as being appropriate for residential
uses.
2) The proposed multiple family site lies on the edge of a residential
neighborhood, has access to shopping, community services, public
facilities, and an arterial system.
3) There have been several applications for Residential Office and
Multiple Family Suburban zoning along Pines Road between the
Milwaukee Railroad tracks and Si.xteenth Avenue, Although the
advertised property is one lot depth removed from Pines Road, it
. does not extend any further into the residential neighborhood than I
a number of other multiple family projects along Pines Road,

compatibility of the development with existing and future land uses
in th e area,
NOW, THEREFORE, The Board of County Commissioners of Spokane County
does hereby conclude that the above-described findings are sufficient and controlling,
and does, therefore, order that an appropriate resolution to change the Zoning Map
on the above-described property from the Agricultural Suburban classification to the
Multiple Family Suburban classification be prepared, subject to the following
conditions :
1) D-ndication of the East ffve (5) feet of Tract 215 of Opportunity and
dedication of the North ten (10) feet and the South five (S) feet of
the East 228 feet of Tract 215 for right of way,
2) Dedication of a twenty (20) foot radius on the northwest corner of - ~
Fourteenth Avenue and Houk Road and on the southwest corner of
Twelfth Avenue and Houk Road,
3) Improvements to Spokane County standards of Houk Road, Twelfth
Avenue and Fourteenth Avenue, along the project perimeter; i.e. ,
along the east side of Tract 215 of Opportunity, and along the East
228 feet of Tract 215 of Opportunity of Twelfth Avenue and Fourteenth
Avenue. Such improvem ents will include curbs, sidewalk, drainage
control and paving to exis ting paving on Twelf th Avenue; of a 30
foot strip on Houk and Fourteenth Avenue along the project perimeter.
4) Access permits for the advertised property shall be obtained from
the Spokane County Engineer's Office prior to release of building
permits.
S) The advertised property shall be developed in substantial conforman ce
with the development plan on file with this application; i. e. , two-
story structures, the total number of apartment units not to exceed .

6) The off-street parking facility and connecting driveways shall be
developed in substantial conformance with the development plan.
Any portion of the project which is to be occupied or traveled by
automobiles shall be maintained in hard surface paving. Open parking
areas shall be unlighted except that driveway, and walkways may
be illuminated by low intensity lighting.
7) An appropriate on-site stbrm drainage disposal system shall be
, approved by the Spokane County Engineer's Office prior to the
release of building permits for the project.

shall be landscaped, planted, and maintained in appropriate turf

"lalks) along with th-a effluent from the sewage disposal will be injected

<~vaporate back to the atmosphere as happens in a natural situation. The
amount of contaminant carrieeby these waste waters by the time they reach
the aquifer is unknown but undoubtEd-ly a great deal of filtering will have taken

The conclusion ~-f this environmental checklist review is that no eignifiaerit
