HEARING EXAMINER COMMITTEE
FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Zoning Hearing Examiner Committee on
October 4, 1984, and the members of the Committee present being
Kenneth Kennedy, Chairman, F. Lynn Tennican and Richard L. Skalstad.
B. PROPOSAL
The sponsor, D. J. Hume, is requesting approval of a change of conditions,
Fi 1 e No. ZE-65A-79, Cormnerci al Zone, for the purpose of revi ewi ng a new ,
site development plan for a 184-Unit Motel and Restaurant; and Conditional
Use Permit Request, CUE-18-84, for an Off-Street Parking Facility in the
Agricultural Zone, to serve the motel and restaurant facility.
C. FINDINGS OF FACT
1. That the existing land use in the area is motel, church, restaurant,
residential, I-90, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
P1ajor Commerci al devel opment.
3. That the existing zoning of the property described in the application
is Commercial.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Corronittee concurs with the
Declaration of Non-Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the Zone Classification.
7. That the applicant has demonstrated that conditions have
substantially changed since the original zoning of this area and
accordingly, the proposed change of conditions is justified.

C. FINDINGS OF FACT (continued)
8. That the proposed use is compatible with existing uses in the
area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Heari ng Exami ner Corroni ttee:
DISCUSSION:
a) Mr. Skalstad -
- The applicant is requesting County approvals for a parking
lot that is already developed.
- That the proposed change of conditions contains more motel
units than indicated in the 1979 approval; therefore, the
development of the restaurant shall be conditioned upon the
removal of the gas station and pumps.
b) Mrs. Tennican -
- That the use of the parking lot by semi-trucks and the
resulting potential for storage of chemicals within the
trucks is addressed by the '208' conditions regarding
aquifer protection.
c) Mr. Kennedy -
- That the issue of the parking lot is not before the Hearing
Examiner Committee for consideration, and any public
testimony or concerns of the Corrmi ttee are a part of that
which is pertinent to the decision of the Zoning Adjustor.
- That the proposal as understood by this Committee member
entails the decision by the Planning Department to trade
more motel units for the restaurant, and the consideration
of the Hearing Examiner Committee to, in effect, trade the
existing gas station for the restaurant. In light of this,
the gas station and pumps should be removed prior to
issuance of a building permit for the restaurant.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
l. That no building permit be issued for the restaurant until such time
as the gas station and associated pumpsyare removed from the subject
s i te .
2. That the '208' Water Quality office be made aware of the existing
parking lot being used by trucks, and the potential for storage of
materials within the trucks, because the site is located over the
Aquifer.
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
5. All current standards of the Commercial Zone, as amended, shall
be complied with in the development of this site (for the
commerci al property ) .

a) COUNTY PLANNING DEPARTMENT (continued)
6. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
7. That the present proposal is not detailed enough to determine
whether or not the use of or materials stored on the site are in
compliance with Chapter 4.16A (Aquifer Sensitive Area Overlay
Zone) of the Spokane County Zoning Ordinance. Accordingly, as a
condition of approval, the sponsor/applicant shall be required
to file with the Spokane County Auditor, within thirty (30) days
of the signing of Findings and Order of the final decision in
this matter, a"Notice to the Public" which shall provide in
material as follows:
PRIOR TO THE ISSUANCE OF ANY BUILDING PERMIT OR
CERTIFICATE OF OCCUPANCY FOR ANY BUILDING OR ANY USE
ON THE PROPERTY DESCRIBED HEREINAFTER, THE APPLICANT
SHALL BE RESPONSIBLE FOR COMPLYING WITH THE PROVISIONS
OF SPOKANE COUNTY ZONING ORDINANCE CHAPTER 4.16A
(AQUIFER SENSITIVE AREA OVERLAY ZONE). THE PROPERTY
WNICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY
DESCRIBED AS FOLLOWS:....".
8. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
9. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
10. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.

a) COUNTY PLANNING DEPARTMENT (continued)
11. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
off i c i al f i 1 e, wri tten comments and/or publ i c testimony conta i n
information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environ ment are anticipated as a
result of the project; and a final declaration of
non-significance is hereby to be issued.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
3. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building pemit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
4. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
5. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592 as amended.

c) COUNTY UTILITIES DEPARTMENT
l. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. The unit shall be double-plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.

d) COUNTY HEALTH DISTRICT (continued)
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District # l.
2. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
3. The requi red fi re fl ow for thi s project based on present
presented plan is 3,000 G.P.M. Each hydrant shall be capable of
flowing 1,500 G.P.M. at 20 P.S.I. residual when any two hydrants
are flowing simultaneously.
4. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road f ronting the property. Said
numbers shall contrast with their background.
5. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
6. A land use permit will be required for each structure.

f) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.

2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracki ng or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.
3. Al1 travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Al1 air pollution regulations must be met.
h) STATE DEPARTMENT OF TRANSPORTATION
1. No Corrunent.

The Hearing Examiner Committee, pursuant to the aforementioned, finds that
the application of D. J. Nume. for a change of conditions as described in

CONDITIONAL USE PERMIT TO ALLOW AN OFF-STREET PARKING FACILITY IN THE
AGRICULTURAL ZONE, PER SECTION 4.24.310 OF THE SPOKANE COUNTY ZONING
ORDINANCE.
a) FINDINGS
1. The applicant already complies with Conditional Standards
Nos. l, 2, and 3 of Section 4.24.310 of the Spokane County
Zoning Ordinance pertaining to lot size, location of the
off-street parking facility, and the prohibition of any
commercial activity on the site.
2. The proposal is generally compatible with the area.
b) CONDITIONS
1. Conditional Standards for the Off-Street Parking Facility
Nos. 4, 5, and 6, of Section 4.24.310 of the Spokane County
Zoning Ordinance, shall be complied with by the applicant,
relative to signs, paving of the area, and observance of
setbacks.
2. No fencing shall be required along the southerly property line,

5) NEIGHBORHOOD CONSIDERATIONS: This area around I-90 Interchange is

Commercial. Existing residence to east may need buffering.
III. SITE ANALYSIS
1) SITE CHARACTERISTICS AND CONSIDERATIONS: The proposed restaurant
will be located between I-90 and the motel structures; general
landscaping will be provided. The off-street parking facility is
planned at the eastern edge of the property and adjacent to single
family residential and associated yards. Access is shown via the
commercial site. Spaces to be used by large trucks and semi's. This
site should be sight-obscuring fenced and landscaped to assure
controlled access and mitigate effects to adjacent residence and
future uses.

BUFFERING TECHNIQUES: The restaurant area shows general landscaped
areas. No landscaping or fencing is shown around the off-street
parki ng facil i ty wi thi n the Agricul tural Zone. Thi s i s an i ssue to
be considered by the Zoning Adjustor in reviewing the Conditional Use
Permit. This issue has been addressed by staff under Site
Characteristics and Considerations.
OTHER SITE PLAN CONSIDERATIONS: Access to the parking facility
should be controlled to be via commercial site. Staff feels that if
an alternate access is provided to the site, a public hearing before
the Zoning Adjustor should be held to determine traffic effects to
adjacent properties.
IV. CONCLUSION: Both the Change of Conditions and the off-street parking
facility are consistent with guidelines of the Comprehensive Plan Text.
If properly conditioned for controlled access and landscape buffering,
this project can be compatible with adjacent existing and future uses.

V. RECOMMENDED AGENCY CONDITIONS, IF APPROYED:
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumination
to the area with full consideration to adjacent properties).
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
. Administrator shall be submitted with a performance bond for the
project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Nearing Examiner
Conmittee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permi ts.
5. Al1 cu rrent standards of the Commercial Zone, as amended, shall
be complied with in the development of this site (for the
comrnercial property).
6. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.

this matter, a"Notice to the Public" which shall provide in

WHICH IS THE SUBJECT OF THIS NOTICE IS MORE PARTICULARLY

8. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
9. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
10. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982.
11. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197-10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non-significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and/or public testimony contain
information regarding assessment of the proposal's likely
significant adverse impacts to the physical environment; a
finding is hereby made that no probable significant adverse
impacts upon the physical environ ment are anticipated as a
result of the project; and a final declaration of
non-significance is hereby to be issued.

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Access permits for approaches to the County Road System shall be
obtained f rom the Spokane County Engineer.
2. The applicant shall submit for agealth proval by the Spokane County
Engineer and the Spokane County District a detailed
combined on-site sewage system plan and surface water disposal
pl an for the enti re project prior to the i ssuance of any
building permit on the property.
3. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
4. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
5. A11 requi red improvements shal l conform to the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other applicable County standards and/or
adopted resolutions pertaining to Road Standards and Stormwater
Management in effect at the date of construction, unless
otherwi se approved by the County Engi neer.
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County
Commissioners'Resolution No. 80-1592 as amended.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to Board of County Commissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
Di strict.

petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) f rom
objection to any assessment(s) on the property as a result of
improvements called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for thi s project shal l be provided i n
accordance with the Coordinated Water System Plan for Spokane
County, as amended.
4. The unit shall be double-plumbed for connection to future
areawide collection systems.
d) COUNTY NEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Health District prior
to the issuance of any building permit for this project. ,
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of permits
by the Health Officer, the use of an individual on-site sewage
system may be authorized.
4. Water service shall be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.

placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the 1 owest outl et of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
mi nute for each f i re hydrant) and meeti ng the requi rements i n
Chapter 10.04 of the Uni form Fi re Code i s requi red prior to
construction of the water service. All required fire protection
• facilities shall be installed and made serviceable prior to and
during the time of construction.
3. The required fire flow for this project based on present
presented plan is 3,000 G.P.M. Each hydrant shall be capable of
flowing 1,500 G.P.M. at 20 P.S.I. residual when any two hydrants
are flowing simultaneously.
4. Approved numbers or addresses sha11 be placed on all new and
existing buildings in such a position as to be plainly visible

in a dry place. During periods of poor ventiTation or elevated air pollution
levels we request that use of wood stoves and fireplaces be discontinued.
~ Some objectionable odors will likely result during the construction phase
of the project and from motor vehicles using the site following campletion
of the project and from occupants of the proposed project.

Findings:
a. This project lies over the Spokane Aquifer.
b. Yt is within Critical Water Supply Service Area No. 3 and within the ser-
vice area of Modern Electric Water Company. Water supply will be a public
system. Groundwater resources appear adequate to support development at
the proposed density.
c. The project is inside the Spokane County Comprehensive Wastewater Man-
agement Area; inside the General Sewer Service Area, and inside the
Priority Sewer Service Area recommended in the '201' Study. The method
of sewage disposal is subject to approval of the Director of Utilities,
Spokane County, pursuant to County Resolution 80.0418 adopted March 24,
1980. The topography and soils in the area are generally suitable for
use of individual on-site sewage disposal systems. The lot is of the
proper dimensions to permit use of both an individual well and sewage
system.
d. The project lies in a relatively flat area east of Argonne Road and north
of Interstate-90. Local drainageways are insignficant.

e. Surface soils are classed as Garrison gravelly loam with 0% to 5% slopes.
They have a septic tank filter field limitation of slight with possible
contamination of groundwater. The soil, based on textural classification
is Type I.
f. Geologically, the soils are glaciofluvial deposits. These geological
structures generally yield moderate to very large amounts of water.
Data from wells in the area shows they are from 50' to 235' deep and
have static water levels varying from 40' to 107' below the surface.
The Modern Electric Water Company has indicated that it can supply
domestic use water for the project upon completion of agreements with
the proponent.
Recommendations:
a. A combined surface water and sewage disposal detailed plan shall be ap-
proved by the Spokane County Engineer and the Spokane County Health
District prior to the issuance of any building permit for this project.
b. Sewage disposal method shall be as authorized by the Director of Utilities,
Spokane County.
c. Subject to specific application approval and issuance of permits by the
Health Officer, the use of an on-site sewage disposal system may be
authorized.
d. Water service shall be coordinated through the Director of Utilities,
Spokane County.
e. Water service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social & Health
Services.
f. Use of private wells and water systems is prohibited.
g. Disposal of sewage effluent beneath paved surfaces is currently prohibited.

11 A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer prior to the issuance of a building permit on the property. 1'he
design, location, and arrangement of parking stalls shall be in accordance with standard
traffic engineering practices. Paving or surfacing as approved by the County Engineer,
will be required for any portion of the project which is to be occupied or travelled by
vehicles.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires all state and local
governmental agencies to consider environmentaY values both for their own actions and when licensing private
proposals. The Act also requires that an Environmental Impact Statement be prepared for all major actions
significantly (and "adversely", as per WAC 197-10) affecting the quality of the physical environment. The
purpose of this checklist is to help the agencies involved determine whether qr not a proposal is such a
major action.
Please answer the following questions as completely as you can with the information presently available to
you. Please answer questions as "yes" or "maybe" if, in your opinion, even only slight impacts will result.
The reviewers of the checklist will be aware of and concern themselves with the de~ree of impact, asking you
for more information, if necessary. Where explanations of your answers are required, or where you believe
an explanation would be helpful to government decfsion-makers, include your explanation in the space provided,
or use additional paqes, if necessary. You should include references to any reports or studies of which you
are aware and which are relevant to the answers you provide. Canplete answers to these questions now will
help all agencies involved with your proposal to undertake the required environmental review without unnec-
essary delay.
The following questions apply to your total proposal, not just to the license for which you are currently

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires all state and local
governmental agencies to consider environmentaT values both for their own actions and when licensing private
proposals. The Act also requires that an Environmental Impact Statement be prepared for all major actions
significantly (and "adversely", as per WAC 197-10) affecting the quality of the physical environment. The
purpose of this checklist is to help the agencies involved determine whether pr not a proposal is such a
major action.
Please answer the following questions as completely as you can with the information presently available to
you. Please answer questions as "yes" or "maybe" if, in your opinion, even only slight impacts will result.
. The reviewers of the checklist will be aware of and concern themselves with the deqree of impact, asking you
for more information, if necessary. Where explanations of your answers are required, or where you believe
an explanation would be helpful to government decision-makers, include your explanation in the space provided,
or use additional pages, if necessary,. You should include references to any reports or studies of which you
are aware and which are relevant to the answers you provide. Complete answers to these questions now will
help all agencies involved with your proposal to undertake the required environmental review without unnec-
essary delay. '
The following questions apply to your total proposal, not just to the license for which you are currently
applying or the proposal for which approval is sought. Your answers should include the impacts which will be
caused by your proposal when it is completed, even though completion may not occur until sometime in the
future. This will allow all of the agencies which will be involved to complete their environmental review
now, without duplicating paperwork in the future.
No application shall be processed until the checklist has been completed and returned to the appropriate
County department. State law requires explanations for every "yes" and "maybe" answer on the checklist.
The person completing the form may be required to provide explanation for "no" answers, and in some cases,
more detailed informati.on to aid in a threshold determination.
NOTE: This is a standard form being used by all state and local agencies in the State of Washington for
