As a result of Mrs. Tubbs' visit to the Planning Department office on October 9, 1989, the
following is descriptive of the situation involving the property at East 19202 Mission Avenue
(Assessor's Parcel No. 17552-0143).
1. The conditional use permit for a dependent relative for the purpose of housing
Raymond E. and Florence Hedrick has expired and is null and void (CUE -41-80).
2. The short subdivision which was filed on the same property has become null and void,
due to a lack of finalizing the subdivision and due to a lack of anyone's applying for an
extension of time, in response to the extension of time request dated July 28, 1989
from the Spokane County Planning Department (SP -86-424). The present owner of
the property, Jean Burke, was contacted by myself by telephone on October 9, 1989
and informed of the solution described herein and advised that the short subdivision,
SP -86-424, was being declared null and void due to a lack of filing and granting of an
extension of time.
3. Mrs. Tubbs, as agent for Jean Burke, applied on October 9, 1989 for a change of use
from residence to nonresidence for a mobile home on the subject property. Her intent
is to allow her parents, Mr. and Mrs. Hedrick, to live in the manufactured home for a
matter of a few more weeks before assisting them in a permanent relocation to Arizona.
At that time she intends to have the kitchen stove removed from the building and the
plumbing disconnected, in order to render the manufactured home useless as a dwelling
unit. At that point she intends to request that the Building & Safety Department inspect
this structure under the permit for which she has applied (Project No -89003925) The
Planning Department signed off on this permit on October 9, 1989 With the comment
that: (a) inspection and verification of nonresident status be accomplished by December
1, 1989, with verification of the nonresident status to be placed in Planning Department
Files CUE -41-80 and SP -86-424. The Planning Department will verify with the

Building & Safety Department that this has been accomplished on or about December 1,
1989.
4. Although it is not required, Mrs. Tubbs states that she intends to remove the
manufactured home (which belongs to her daughter) from the site no later than June 30,
1990.
5. Regardless of the removal of the manufactured home, all parties are advised that only
one dwelling unit may exist on Parcel No. 17552-0143 after December 1, 1989. An
inspection will be made on or about June 30, 1990 to verify that the manufactured
home structure is removed, unless Mrs. Tubbs or Ms. Burke advises us earlier that the
manufactured home has been removed. There is not an absolute requirement to remove
the manufactured home, inasmuch as it may remain as a nonresident structure, but the
intent has been expressed to remove the manufactured home.
The Planning Department will do what it can to monitor the situation until it has come to a

FINDINGS OF- FACT,
CONCLUSION AND DECISION
THIS MATTER, an application from Patsy Tubbs has been received and
decided upon, pursuant to Spokane County Subdivision regulations, on the llth
day of April, 1986.
The individual signing'below has further been properly delegated the
responsibility for rendering the decision by the Spokane County Director of
Planning.
FINDINGS OF FACT AND CONCLUSION
I.
That the Spokane County Comprehensive Plan indicates this site to be
Urban and within the Priority Sewer Service Area category.
II.
That the uses and density proposed by the plat sponsor appear to be
consistent and compatible with adjacent land uses.
That improvement already exists on the property as approved by Spokane
County File #CUE -41-80 for dependent relative. That the request for Short
Plat was to provide for separate permanent ownership of improvement approved
in above referenced file.
IV.
That the existing zoning for this site is Agricultural.
V.
That proper legal notification was given for this proposal.
VI.
That the owners of adjacent lands expressed no written concern of this
proposed use.
VII. •
That appropriate provisions have been made for sewage disposal, water
supply, storm water control, circulation, fire protection and other necessary
public facilities and utilities.
VIII.
That the proposed short plat as conditioned is not detrimental to the
general purpose or otherwiseharmful to the public health, safety and welfare.

That no significant adverse environmental impact will likely result from
approval of this proposal.

CONDITIONS OF APPROVAL FOR SP -86-424
PLANNING DEPARTMENT
1. Inst the preliminary plat be given conditional approval to May 1, 1989.
The Short Plat Administrator may administratively approve a request for
a one year,;extension of time if the sponsor submits a written request
forty-five (45) days prior to the above expiration date. A request for
an Extension of Time may subject the proposal to new conditions required
by reviewing agencies.
2. That the plat be designed as indicated on the preliminary plat of record
and/or attached sheets as noted.
3. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites withoutfiling a replat.
4. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distribution to the Planning Department
and the utility companies. Written approval of the easements by the
utility company must be received prior to the submittal of the final
plat.
5. That a certificate of title be furnished the Planning Department prior
to the filing of the final plat.
6. That a survey be required prior to the filing of a final plat.
COUNTY ENGINEER CONDITIONS
1. That conditional approval of the plat by the County Engineer is given.
2. A statement must appear in the dedicatory language of the final plat:
"that individual driveway access permits be required prior to issuance
of a building permit for driveway approaches to the County road system."
3. Dedication of 12 ft.additional Right of Way along Mission Avenue.
4. That Public Road Standard TYPICAL Roadway Section be: (1) Section Number
2 for Mission Avenue*Minimum Paving width Secondary Arterial Standard.
5. The word "applicant" shall include the owner or owners of the property,
his heirs, assigns and successors.
6. To construct the road improvements statedtherein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. •At such time as an RID is created or
any Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns.
7. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road project (CRP) to the extent of the
required road improvement. At such time as an RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned owner,
their heirs, grantees and assigns.
8. That the following statement be placed in the plat dedication: The
owners, their heirs, grantees and assigns, agree to join in the
formation of a County Road Improvement District pursuant to RCW 36.88 at
such time as a Road Improvement District is created or any Road
Improvement Project is sanctioned bg Spokane County. The improvements
required (curb, sidewalk, drainage control and paving) will be at the
sole expense of the owner, their heirs, grantees and assigns.

9. The proposed private road(s) as shown on the preliminary plat serving 1
lot with no extension possible is approved by the County Engineer.
10. That private road(s) be improved to Spokane County standard for a
private road Urban -Suburban standard serving 1 lot. Subject to approval
under Sectin 10.207 of the Spokane County Fire Code.
11. That the following statement be placed in the plat dedication:
WARNING:Spokane County has no responsibility to build, improve,
maintain, or otherwise service the private roads contained within or
providing service to the property described in this plat. By accepting
this plat or subsequently by allowing a building permit to be issued on
property on a private: road, Spokane County assumes no obligation for
said private road and .the owners hereby acknowledge that the County has
no obligation of any kind or nature whatsoever to establish, examine,
survey, construct, alter,repair, improve, maintain, provide drainage or
snow removal on a private road. This requirement is and shall run with
the land and shall be binding upon the owner, their heirs, successors or
assigns including the obligation to participate in the maintenance of
the private road as provided herein.
12. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80-1592, as
amended, which establishes regulations for roads, approaches, drainage,
and fees in new construction.
13. The County Engineer ha's examined this development proposal and has
determined that the impact of this proposal upon the existing County
Road System warrants the dedication of additional right-of-way and the
roadway improvements herein specified.
14. That the owner of Lot 27, Block 1 of Corbin Addition shall sign and
record Spokane County "Notice to the Public #3." The Spokane County
Auditor's recordation number shall be referenced in the dedicatory
language of the plat. The applicant shall also provide to the County
Engineer a plat certificate which established the existence of the
easement which serves Parcel "B" of the proposed short plat. This
requirement is necessary in order to assure a perpetual non-exclusive
easement in favor of Parcel "B".
COUNTY HEALTH DISTRICT '
1. Prior to filing the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private wells and water systems is prohibited."
2. The plat dedication will contain a statement to the effect that: "The
public water system as approved by County and State health authorities
and the local fire district and purveyor will be installed within this
plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot/tract prior to sale of
each lot/tract."
3. The dedicatory language of the plat will state: "Subject to specific
application approval and issuance of permits by the Health Officer, the
use of an on-site sewage disposal systems may be authorized."
COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners Resolution No.80-0418, the
use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific applicaton approval and issuance of
permits by the Health District.

2. The dedication shall state: "The owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition for
the formation of OLID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the
owner(s) or successor(s) from objection to any assessment(s) on the the
property as a result of improvements called for in conjunction with the
formation of a ULID by either petition or resolution method under RCW
Chapter 36.94.
COUNTY BUILDING CODES
1. The sponsor to provide written verification from Fire District to the
Department of Building & Safety that provisions have been made for
adequate fire protection prior to finalization of this plat.
