CUE -9-79, TRAILER AS A RESIDENCE
ZONING ADJUSTOR DECISION: After public testimony and review, the decision
of the Zoning Adjustor is to approve the applicant's request to allow a mobile home
as a residence within the Agricultural Zone.
A. FINDINGS FOR APPROVAL: Pursuant to Section 4.24.010 (b) of the
Spokane County Zoning Ordinance, the Zoning Adjustor has the responsibility
of determining that a use will not be detrimental to the surrounding properties.
In assuring compatibility, the Zoning Adjustor based his decision on the
testimony presented at the April 4, 1979 Zoning Adjustor Hearing as well as
criteria set forth in the Spokane County Zoning Ordinance for issuance of a
Conditional Use. The Zoning Adjustor hereby finds the following:
1. The proposed mobile home is compatible with the area as evidenced by either
other mobile homes and/or mixed land uses in the immediate vicinity.
2. The described property meets the requirements as set forth in the Spokane
County Zoning Ordinance, for a Conditional Use Permit.
3. The applicant demonstrated to the satisfaction of the Zoning Adjustor that
sufficient screening can be provided so as not to conflict with adjacent land
uses.
4. The granting of this Variance, in the opinion of the Zoning Adjustor, is not a
granting of special privileges as evidenced by other properties having the same
rights and privileges in the vicinity and under identical zone classification.
B. ORDER:
1. Before a building permit can be issued, the applicant shall submit to the
Planning Department, evidence that the proposed property is in compliance with
the Spokane County Short Plat Ordinance.
2. The location of the trailer must be in such a fashion as to use ground cover for
sufficient screening.
3. The trailer shall be located on the subject property in compliance with yard
(setback) requirements for a single-family dwelling as prescribed in Section
4.05.110 (a) of the Zoning Ordinance of Spokane County.
4. This approval is granted for 5 years, at which time the permit will be reviewed
administratively to determine if the trailer is still a compatible use.
5. The trailer shall be skirted with a fire resistant material.
6. The trailer shall not be mounted on a permanent foundation in such a manner as
to constitute a permanent residence.
7. The trailer shall not be attached to other residential or accessory structures.
Metal canopies, tip outs and—awnings may be attached to the trailer, however; —
all wooden structures and accessory buildings, except open porches, must be
detached and placed at least three (3) feet from the trailer. (If the mobile'
home is to be located in Fire Zone II, this distance must be increased to forty
(40) feet, or a one-hour fire wall must be provided.)
8. The trailer shall have an ownership title and be listed as personal property
with the County Assessor.
9. Spokane County shall not assume any obligation for said private road or ease-
ment and the owner or owners hereby acknowledge that the county has no
obligation whatsoever to establish, examine, survey, consturct, alter, repair,
improve, maintain, provide drainage or snow removal on said roadways.
