October 2, 1997 Mr Phil Hares Spokane County Commissioner West 1116 Broadway Spokane, WA 99260 RE Zone change # ZE-189-79 Dear Phil This letter is in reference to the above captioned zone change, in which I was a hearing examiner committee member, as evidenced by my signature on the approval of the zone change, which I have attached to this letter for your reference It has come to my attention that the developers of the property are being required to submit a Site Plan for the development of the property under the public hearing process similar to that of the zone change It was not the intent by the hearing examiner committee members to ever require a public hearing to review the site plans once development plans had been sohchfied. INTRODUCTION This matter having come before the Examiner Committee on November 20, 1979, (being a continuance of the November 15, 1979 hearing) and the members of the Committee present being Eldon Thomas, Chairman, Jane Myers, and Ted McCoury and there being the following persons present who wish to request approval of a Zone Change; Michael Kirk, representing sponsor and Tom Marxson of Medicus for a Zone Reclassification, Agricultural to Residential Office for the purpose of (no proposal at this time). B. FINDINGS OF FACT 1. That the existing land use in the area is Agricultural. 2. That the Comprehensive Plan designates this area as appropriate for residential development. 3. That the existing zoning of the property described in the application is Agricultural. 4. That the provisions of Chapter 43.21C RCW (The State Environmental Policy Act) have been complied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That this proposal is not in conflict with the provisions of adopted regula- tion. 7. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 8. Access plans for firefighting equipment around the byilding shall be approved prior to building permit issuance. 3. Adequate water for fire protection and distribution of water is required for the following zone changes. A water plan is required to be sub- mitted prior to any development or use of subject lands. b) COUNTY ENGINEER 1. Applicant shall construct cement concrete curb, sidewalk and pave to existing pavement on Nora Avenue and/or applicant must be a willing participant in any future Local Improvement District (LID), Road Improvement District (RID), or County Road Project (CRP). 2. I explained that the Hearing Examiner had reviewed that specific type of condition of approval and felt that the site plan needed to return to him for a hearing, if the HE Committee condition of approval states that it needed to come back to the committee for public hearing. I have received a copy of a letter from a past member of the HE Committee that states that V was not the intent by the HE Committee members to ever require a public hearing to review the site plans once development plans had been solidified. The intent was only to insure the integrity of the project by allowing the staff to administratively review the specific development plan of the property. It was not our intent to add to the cost, development time or to duplicate the procedure for the development of the property.
