WHEREAS, The Spokane County Zoning Hearing Examiner Committee did,
after public hearing on November 6, 1979, forward to the Board of County
Commissioners a recommendation that the Zoning Map not be changed from the
existing Agricultural Suburban classification to the Multiple Family Suburban
classification on property described as follows
That portion of the SW 1/4 of the SW 1/4 of the SE 1/4 of

Hearing Examiner Committee and testimony and evidence of the applicant and
other interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of County
Commissioners of Spokane County having fully considered the testimony given, the
records and minutes of the Zoning Hearing Examiner Committee and all other
evidence presented and having personally acquainted themselves with the site and
vicinity in question, does hereby find that this application is approved, subject
to the following conditions
1) Applicant will be required to submit a specific site plan to the
Planning Department staff for review The staff shall forward
recommendations to the Board of County Commissioners
2) Board of County Commissioners' approval of the specific site plan is
required prior to commencing work on the site

200 feet south of the north property line The applicant shall
dedicate a 50-foot right of way for said access road
4) Applicant shall dedicate 10 feet on Carnahan Road for right of way

5) Applicant shall construct cement concrete curb, sidewalk and pave
to existing pavement on Carnahan
6) An appropriate off-site drainage disposal system and access plans
shall be approved by the Spokane County Engineer's Office prior to the
issuance of building permits for the project
7) A detailed combined on-site sewage system and surface water disposal
plan for the entire project shall be approved by the County Engineer
and the Spokane County Health District prior to the issuance of any
building permit for the project
8) The design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices Any portion
of the project which is to be occupied or traveled by automobiles
shall be maintained in hard-surface paving
9) Improvements including 40-feet of paving, curbs, and sidewalks as
directed by the County Engineer, will be required for the site access
road
10) Purveyor is Washington Water Power and will supply the site with
adequate water for domestic fire and irrigation uses
11) The number of dwelling units possible on the property may be restricted
by available area suitable for sewage treatment and disposal
12) That the provisions of SEPA's Notice of Action pursuant to 43 21C 080
RCW be initiated by the applicant within thirty (30) days of final
action of the Responsible Administrative Body and be completed before
any site improvements are made
13) The request has proven to be environmentally non-significant There-
fore, a Final Declaration of Non-Significance shall be signed by the
Chairman of the Board of County Commissioners
14) The specific development plan for this zone reclassification shall be
subject to all of the provisions of SEPA, Chapter 43 21C RCW when

This being the time set by the Board of County Commissioners of Spokane
County, Washington to render its decision concerning the request of
Kahuna Land Company, South 813 Pines Road, Spokane, WA 99206 for the
above captioned zone reclassification} and
The Spokane County Hearing Examiner Committee having heard the above
request on November 6, 1979s did deny said application, and
The Board having conducted its own public hearing on February 25, 1980,
at the request of the applicant, Kahuna Land Co , and after visiting the
site and reviewing the testimony, and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to approve said application SUBJECT TO
1) The submittal of a specific site plan by the applicant to
the Planning Staff for their approval and recommendation
to the Board of County Commissioners
2) No work shall begin on subject project until said specific
site plan has been approved by the Board of County Commissioners
3) There shall be only one ingress/egress road off Carnahan and
it shall be located 200 feet south of the north property line
to the center line of said ingress/egree road The applicant
shall dedicate a 50 ft right of way for said access road
4) County Engineer Condition #5 be changed to provide that the
developer shall construct said above described access road
with improvements to include 40 ft wide paving, cement
concrete curbs and sidewalks as directed by the County Engineer
It is understood that County Engineer's conditions #s 1,2 and 3
are as stated in Findings and Order of Hearing and Examiner
Committee
5) All other conditions as set forth in the Findings and Order
of the Hearing Examiner Committee

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C. RCd, requires all state and local governmental
agent es to consider environmental values both for their own actions and when licensing private proposals. The Act also
requires that an Environmental Impact Statement be prepared for all major actions significantly (and "adversely", as per
RAC 197-10) affecting the quality of the physical environment. The purpose of this checklist is to hlep the agencies in-
volved determine wnether or not a proposal is such a major action.
Please answer the following questions as completely as you can with the information presently available to you. Please answer
questions as "yes" or "maybe" if, in your opinion, even only slight impacts will result. The reviewers of the checklist will
be aware of and concern themselves with the of impact, asking you for more information, if necessary. Where explanations

This matter having come before the Examiner Committee on November 6, 1979,
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and Ted McCoury and there being the following persons present who
wish to request approval of a Zone Change, Robert J Bethards, Agent for a
Zone Reclassifcation, Agricultural Suburban to Multiple Family Suburban for the
purpose of multiple family dwellings without a specific site plan
B FINDINGS OF FACT
1 That the existing land use In the area is residential, gravel pit, and
undeveloped
2 That the Comprehensive Plan designates this area as appropriate for
residential development
3 That the existing zoning of the property described in the application is
Agricultural Suburban
4 That the provisions of RCW 43 21C (The State Environmental Policy Act)
have been complied with
5 That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled
6 That the application not being for a specific site plan is unsuitable for the
proposed use, or uses within the proposed Zone Classification
7 That the proposed application not being for a specific site plan is incompat-
ible with existing uses in the area

PLANNING DEPARTMENT
As we discussed yesterday, the lack of a specific site plan for the
above captioned zone reclassification poses many interesting SEPA
questions if additional written material were not to be provided
to assist your office in a threshold determination. As I also discussed
with you, I have taken the time to discuss this project with various
state and local agencies in a very definite effort to ccrnply with
all rules and regulations that might possibly have sane effect on
the project.
Specifically, the following has been accariplished:
1. Sewage Disposal- Depending upon the number of units
constructed both State and County Health agencies
could have jurisdiction. I have met with Dennis
Kroll of County Health, Andy Tan of DOE and George
Schlender of DSHS at various times during the past
few months to determine what their respective
agencies require for approval to be granted. To date,
approval has been granted by County Health for the
use of two (2) drainfield sites to serve the project
(see attached). Both DOE and DSHS have given me
favorable responses for the same drainfield sites
but reserve final approval pending completion of highly
detailed and expensive soil testing of each of the
sites. I have retained Budinger and Associates of this
city to perform those tests and the results will be
forthcaning in the next few days.
2. Traffic/Circulation/Ingress and Egress- As I indicated
in my earlier letter to the Zoning Administrator,
building construction would be limited to a very specific
area of the project site. Access would, of course, be
from Carnahan Road. Mr. Finney of the Engineers Office
asked for site distance calculations for the proposed
area of ingress and egress several months ago and those

were supplied several weeks ago, with a favorable
response being obtained. Further, this office is in
a position to assure you that our plan is to provide
one (1) point of ingress and egress to carnahan Road
and a possible connection to our proposed plat to the
southeast of this proposal is impossible and will
not be provided due to excessive grades.
3. Storm Water Control- I have not developed a firm method
for dealing with storm water control. I do anticipate,
however, that due to the shallow depth to bedrock in
the area planned for multiple family construction, that
standard storm water techniques would not be permissablE_
and alternative solutions will have to be provided.
Specifically, this office is investigating provisions
of sump area (s) either on site or off site to provide
for proper storm water retention and disposal. The
above alternative would, of course, have to be approved
by the appropriate regulatory agency.
4. Number of units to be constructed; I am not in a position
to indicate the specific number of units to be constructed,
nor am I in a position to indicate the number of
bearocros in each. I wish to point out to you, though,
that several site limitations do exist that could possibly
severely limit the number of units, including but not
limited to:
1) Steepness of topography
2) Adequate area (s) for subsurface sewage disposal
3) Provision of acceptable method of storm water
control due to soil shallowness that might require
significant amounts of surface area
4) Protection of views that will be enjoyed by the
homes above this project that could be destroyed
if multiple story buildings were to be constructed.
It is our intent to limit construction to 2-2 1/2
stories to protect those views.
As I also discussed with you, it is our intent to create a first class
project on this property. Mr. Ward and myself have been involved in
several projects in the immediate area of this proposal, all of which

are of the highest quality. To lessen the quality we normally
require and expect for this project would, we feel, be a mistake
that would damage the entire area.

Enclosed, please find our application for the above captioned rezone.
As we previously discussed, you indicated that you would waive the
requirement for a detailed site plan, provided certain information
detailing general location of structures, points of ingress and egress, etc.,
were indicated. In that regard, I submit the following:
1. The multiple family structures will generally be located above
contour interval 2000'.
2. The type and number of these structures is unknown at this
time, but will be governed by the following :
a. The Spokane County Zoning Ordinance
b. Regulations of the Spokane County Health District
c. Topographic restraints
d. A strong desire on the part of this office to create an
extremely high quality development with the types of
construction evidenced in Kahuna Hills and Riegel Heights P.U.D.
3. Sewage disposal facilities are planned to be located below the
2000' contour elevation. This office has received written approval
from the Health District for this area.
4. Ingress and egress will be acccoplished to whatever standard the
County Engineer desires.
