have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.

The Hearing Examiner Cornrnittee, pursuant to the aforementioned, finds that the
applicalion of J. Harold Raines for a Zone Reclassification
as described in the applica[ion should be approved/alappie*.
Approval contingent fio all Agency requfrements and standard conditions as outlined in the
Planning Staff Report.
Special conditions or coriliiigencies applied to motion:
1. That the rezoning apply only to the portion of the advertised property immediately
west of the existing residence which presently houses an accessory building,
provided that the applicant must apply for a replat of the advertised property into
two lots, meeting the minimum requirements of the Zoning Ordinance.
2. The lot fronting on McDonald Road occupied by the residential structure to, meet
the minimum requirements of the Agr• Suburb. Zone; and the second lot housing the
accessory structure meeting the minimum requirements of the Local Business Zone.
3, Provided further that the zone change to Local Business shall not become final
until subsequent to the approval of the replat as provided for hereinabove; and,
additionally, the applicant-owner of the lot created through the replat process
housing the accessory building include on the tace?of the replat and deed
creating such lot, a provisfon providfng that the Local Business Zone authorizes
only the sale and repair of C-B Radios and that upon sale of the lot housing the
building containing such use, the zoning shall automatically revert back to
Agricultural Suburban withouC the necessity of any action by the Spokane County
Planning Commission or Hearing Examiner Committee or subsequent body entitled
to hear rezones.

1, Applicant shall construct cement concrete curb and sidewalk and pave to
existing pavement on McDonald Road.
2. The applicant shall construct cement concrete curb and 30 feet of paving on
River°side Avenue.
3. That the applicant will have to present a revised parking plan before occupying
the site.
a, That the Hearing Examiner Committee after hearing all testimony and a review of
the staff analysis adopts the proposed Declaration of Non-Significance and
directs the Chairman of the Committee to sign the Final Declaration of Non-
Sfgnificance.
