STREET SETBACK } DECISION AND REQUIREMENT - T & D PROPERTIES } CONDITIONS THIS MATTER, Being the consideration by the Zoning Adjustor of Spokane County, approving i n part the application (VE-80-83), for the purpose of establishing a flanking street setback of 5' from the property line for a commercial structure, hereinafter referred to as the "Proposal", and the Zoning Adjustor of Spokane County having held a public hearing on August 313 1983 and having fully considered all testimony presented thereat, and further having visited the site and vicinity in question, and havlnq rendered a decision on the 9th day of September, 1983, approving in part said proposal, does hereby make the following FINDINGS OF FACT 1 That the proposal is qenerally located at the northeast corner of Argonne Road and Knox Avenue in Section 8-25-44 Parcel #08543-0207, 0208, 0209, and 0210 2 That the proposal consists of reducing the flanking street setback from the required 50' from the centerline of Knox Avenue to 29 5 feet The Knox Avenue right-of-way is currently 49' wide The total requested variance is 20 5 feet 3 That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates commercial usage of the area encompassed by the proposal 4 That the site is zoned Commercial. 5 That the existing land uses in the area of proposal include a fast food restaurant to the south on Knox Avenue, multi-family and vacant land to the east, commercial uses generally to the north and west 6 That the Burger King directly across Knox Avenue from the site appears to met the flanking street setback requirement, however, the setback is able to be utilized as a drive thru window area in the operation of the business 7 That the existing duplex setback along the north side of Knox Avenue is approximately 37 feet from the centerline of Knox Avenue 8 That an agent for the applicant indicated that other uses in the area generally would not be detrimeVal ly affected through granting the proposal in the Knox Avenue is not a through street and has very little traffic 9 That the agent indicated that recently enacted stormwater drainage requirements make it more difficult to meet all setback requirements and still provide adequate visibility for commercial clients 10 Nearby owners of property on Knox Avenue appeared and went on record as neutral parties regarding the project The chief concern was that future commercial development of other land on Knox not be adversely affected by the Zoning Adjustor action on this application 11 That the original development plan for this site is contained in Planning Department File ZE-215- 79 This plan shows development with a 50' setback and access to the site being available from Knox at the easterly end of the development If such access is provided, it is necessary to provide adequate setbacks to allow traffic to safely enter and exit the site 12 That Knox Avenue in this area is currently paved and has sidewalks and curbs 13 That maintaining resonable setbacks promotes the safe movement of traffic, permits aesthetic development of commercial centers and is harmonious with other nearby commercial/residential properties FINDINGS OF FACT, DECISION AND CONDITIONS VE-80-83 PAGE 2 14 That the proposal otherwise meets all current standards of the Spokane County Zoning Ordinance for this use 15 That the proper legal requirements for advertising of the hearing be- fore the Zoning Adjustor of Spokane County have been met CONCLUSION 1 That the proposal merits some reduction in flanking street setback requirements in keeping with the character of present development, potential future improvements, and original site plan with zone change file ZE-215-79 2 That the proposal is not detrimental or otherwise harmful to the public health, safety and welfare DECISION From the foregoing Findings, a review of the Planning Department File No VE-80-83, testimony at the public hearing, and a site visit, the Zoning Adjustor hereby in approving in part the proposal to allow applicants structure to locate 34 5 from the centerline of Knox Avenue which is 10' from the property line as shown on Exhibit "A" of this file This First off, we can see littILz reason for an additional "fast food" outlet in this area. At present there exists within a two block radius the Long Horn Bar-bRque, the Hungry Farmer in Argonne Village, Cub's Sandwich shop in Village Square, the A- & W, and a not yet completed Burger King just south of the newly proposed outlet. At the present time we have to contend with more than adequate garbage and noise and odor pollution from the existing outlets. The area does have many single family dwellings and to preserve some of the neighborhood it seems more food outlets or commer- cial facilities that are to increase traffic flow and definite- ly overlap the present facilities seem unnecessary. At a time when we are so concerned with our environment it seems consid- eration should be stronger in favor of limiting facilities rather than to overlap as proposed. The Burger-King is not even opened or completed yet, and here we are planning for more of the same type outlet right next door. At the time the Planning Commission approved the Long-Horn I was present to voice objection. After approving the change, the Long-Horn has never completed the guidelines set forth, name- ly, putting the fence along the south boundary. At present, we have to contend with an unsightly array of trucks, woods, garbage, etc. Before approving this zone change we would ask that you con- sider fully the need of another facility of this type plus the impact it will have on the environment of the area.
