FINDINGS OF FACT 1. The application requests a change of conditions to a prior zone reclassification, in the Light Industrial (I-2) zone, to delete the requirement for public hearing review of a specific site plan for the westerly 245 feet of the site, modify the requirement for a 10-foot high landscaping berm, and allow the development of warehouse uses on the site. 2. The site is generally located at the southeast corner of the intersection of Woodruff Road and Knox Avenue, in the SE 1/4 of Section 8, Township 25 North, Range 44 EWM, Spokane County, Washington. 3. The site is currently designated as County Assessor's tax parcel no. 45084.0227. The site is legally described as that portion of the north half of Tract 266 of Opportunity, according to the plat recorded in Volume "K" of Plats, page 20, records of Spokane County Auditor, lying south of Knox Avenue and east of Woodruff Road, excluding the South 54 feet of the north half of said Tract 266. 4. The applicant for the proposal is Ron Mackie, 9802 East Mission Avenue, Spokane, WA 99206. The owner of the site is Rude Enterprises, 717 West Sprague Avenue, #1600, Spokane, WA 99201. 5. The Hearing Examiner heard the application pursuant to the County Hearing Examiner Ordinance (County Resolution No. 96-0171) and the County Hearing Examiner Rules of Procedure (County Resolution No. 96-0294). 6. The Hearing Examiner conducted a site visit on March 5, 2002. A public hearing was held on the proposed change of conditions on March 6, 2002. The requirements for notice of public hearing were met. 7. The County Division of Planning issued a Determination of Nonsignificance for the proposal on March 1, 2002. 9. The Hearing Examiner takes notice of the County Generalized Comprehensive Plan, GMA Comprehensive Plan and Capital Facilities Plan, GMA Comprehensive Plan map, Phase I development regulations, County Resolution Nos. 1-1033 and 2-0037, County Arterial Road Plan maps, County official zoning maps, County Zoning Code, County Code, other applicable development regulations, and prior land use decisions in the vicinity. 10. The record includes the documents in File Nos. ZE-222-79, ZE-222A-79 and ZE-222B-79 at the time of the public hearing; the testimony and documents submitted at the public hearing; and the items taken notice of by the Examiner. 11. The site is approximately 3.93 acres in size and is not improved with any buildings. An existing paved driveway with adjacent retaining wall extends through the east portion of the site from Knox Avenue to adjoining property to the east, a driveway and existing landscaping extend along the west border of the site, existing landscaping is found along the north border of the site, and a block retaining wall and existing landscaping are found along the south border of the site. The westerly driveway serves adjacent property to the south, and accesses Knox Avenue at the northwest comer of the subject property. The site is generally flat, except for an eight (8)-foot rise in elevation between the driveway and Woodruff Road. 12. On April 14, 1980, 7.5 acres of land, consisting of the site and the adjacent parcel to the south, were rezoned from the Agricultural (A) zone of the now expired County Zoning Ordinance to the Restricted Industrial (RI) zone. The rezone decision adopted the conditions of approval recommended by the Planning Department, in its staff report dated 4-10-80, except for two of the County Engineering conditions. The decision also added some new conditions to protect the residential neighborhood to the west. See County Hearing Examiner decision adopted on April 14, 1980 in File No. ZE-222-79, (erroneously attested to on "3-14-80'). 13. The site plan for the 1980 rezone illustrated development of the easterly 390 feet of the original 7.5 acres for sales, service, engineering and repair of diesel engines (Cummins Northwest Diesel). This included a 1-story building of 43,681 square feet, with a maximum height of 40 feet, and with areas for trailer parking illustrated along the east property line and also west of the building. The site plan showed the westerly 245 feet of such parcel as undeveloped. 14. The conditions of approval for the 1980 rezone provided that future development on the westerly 245 feet of the property between Knox Avenue and I-90 by any future building will be for an office business park". Such conditions also required the developer to submit a specific site development plan for the review and approval of the hearing body, prior to issuance of a building permit for development of the westerly 245 feet of the subject parcel. The conditions further prohibited access to Woodruff Road, required a 6-foot high fence at the southwest edge of the building, and required a 10-foot berm and 6-foot high plantings to be installed 130 feet west of such building. HE Findings, Conclusions and Decision ZE-222B-79 Page 2 15. Effective January 1, 1991, the zoning of the 7.5 acres rezoned in 1980 was reclassified to the Light Industrial (1-2) zone, pursuant to the Program to Implement the Spokane County Zoning Code. The Program to Implement specifically preserved, as a condition of the new I-2 zoning, the conditions of approval of the 1980 rezone that were more specific or strict than the development standards of the new zone. See County Resolution No. 85-09010, Program to Implement 16. On February 16, 2000, the Hearing Examiner approved a change of conditions to the 1980 rezone for the adjacent parcel to the south. The decision authorized the development of ,iii office/warehouse use on such parcel, changed the configuration of the building and other improvements shown on the site plan for the 1980 rezone, and authorized the installation of 1 feet of Type I landscaping along the west boundary of the parcel in lieu of the required berm an plantings. The decision required primary access to such parcel from Knox Avenue, with an allowance for restricted access along Woodruff Road. See Hearing Examiner decision in File No. ZE-222A-79. 17. On December 21, 2001, the applicant submitted a complete application for a change of conditions to the 1980 rezone for the current site. The application is appropriate under the change of conditions process set forth in Section 14.504.040 of the County Zoning Code. 18. The site plan of record for the change of conditions submitted dated May 25, 2001 illustrates phased development of the site and adjoining property to the south and east, with the site developed last. The site plan shows a 24,112 square foot, single-story building for office/warehouse use on the site, associated parking, landscaped banks, existing monument sign; and also shows the existing landscaping, driveways and retaining walls. The driveway entrance in the northeast portion of the site is indicated as the main entry point to the joint development, and the driveway in the northwest corner of the site is indicated as a secondary entry. The site plan illustrates existing office/warehouse uses and parking on the adjoining parcels to the south and east, and a future parking area on land located further to the east along Knox Avenue. 19. The change of conditions would retain the existing landscaping on the site and extend an existing, 6-foot high, sight-obscuring, chain link fence along the west boundary of the site from the adjacent property to the south. The proposed building would have a maximum height of 20 feet. 20. Effective January 15, 2002, the County adopted County Resolution No. 2-0037. Such resolution implemented a new Comprehensive Plan ("GMA Comprehensive Plan"), a Capital Facilities Plan, County Urban Growth Area (UGA) boundaries, and Phase I Development Regulations; all pursuant to the State Growth Management Act. Such resolution also repealed the interim development regulations previously adopted by the County under the State Growth Management Act. 21. The Phase I Development Regulations designate the land lying north of Interstate 90 in the area, east of Woodruff Road, including the site, in the Light Industrial category of the Comprehensive Plan; and retained the I-2 zoning of the site and such land. Such regulations designated the land lying west and southwest of the site, which is developed for single-family homes, in the Low Density Residential category of the GMA Comprehensive Plan, and HE Findings, Conclusions and Decision ZE-222B-79 Page 3 reclassified the zoning of such land from the Urban Residential-3.5 (UR-3.5) zone to the Urban Residential-7 (UR-7) zone. An office/industrial park is located north of the site. 22. Section 13.300.110 of County Resolution No. 1-0700 provides that absent statute or ordinance to the contrary, the regulations in effect on the date a complete application is submitted and fees are paid will be the standard of review for a project permit application. 23. Within the UGA, the Phase I Development Regulations provide limited "vested rights" for rezone, conditional use permit, variance and special permit applications that were complete prior to January 15, 2002. Such regulations do not reference change of condition applications, in this regard. 24. Washington case law provides that submittal of a conditional use permit application vests the right to use and develop the property in the manner disclosed in the application according to the land use laws and regulations in effect on the date the application was filed. See Weyerhaeuser v. Pierce County, 95 Wn. App. 883, 976 P.2d 1279 (1999), review denied 139 Wn.2d 1001 (1999). The holding in the Weyerhaeuser case regarding vested rights is broad enough to include the current change of conditions application. Accordingly, the current application is subject to review under the County Generalized Comprehensive Plan and the development regulations in place on December 21, 2001, the day the application was complete. 25. The Interstate 90 freeway is located directly south of the adjacent parcel to the south, with its travel lanes located well below the grade of the current site. The County Arterial Road Plan in the Comprehensive Plan designates Montgomery Avenue, located approximately 1,000 feet north of the site, as a Minor Arterial. All other roads in the vicinity are considered Local Access roads, including Woodruff Road, Shannon Avenue and Knox Avenue. 26. The site is designated in the Industrial category of the County Generalized Comprehensive Plan. The subject property also lies inside the Aquifer Sensitive Area, Priority Sewer Service Area and Urban Impact Area designated by the Generalized Comprehensive Plan. 27. Prior to January 15, 2002, the site was located inside the interim urban growth area boundaries designated by the County pursuant to the State Growth Management Act. 28. The Staff Report adequately analyzes the consistency of the project with the Comprehensive Plan, the development standards of the I-2 zone, and the criteria for approving a change of conditions. Such analysis is hereby adopted and incorporated by reference as findings of fact herein. 29. Neighboring property owners or the commenting public agencies did not express any opposition toward the project. 30. The adjoining property to the south has been attractively developed with office/warehouse uses. The office/warehouse use proposed for the site is of lower profile, and the site sits eight (8) feet below Woodruff Road to the west. 31. At the public hearing, the applicant requested that the Examiner not require the extension of the sight-obscuring fence along the west property line of the site. The Examiner rejects such HE Findings, Conclusions and Decision ZE-222B-79 Page 4 request, because the application proceeded to hearing with the understanding that such fencing would be extended. The existing buffering along the west property line, with the addition of the sight-obscuring fence, adequately buffers the neighboring residences to the west from the industrial/warehouse uses developed on the site. 32. The I-2 zone permits development of all uses permitted in the Regional Business (B-3) zone, provided the development standards of the B-3 zone are met. The B-3 zone requires frontage along a public road of the Principal Arterial classification or higher. Since the site is located along Local Access roads, B-3 zone uses not otherwise permitted in the I-2 zone cannot be developed on the site. County Planning conditions of approval for the proposal prohibit the development of B-3 zone uses on the site. 33. Changed conditions in the area since the site was last zoned include the addition of improvements to the site, inclusion of the site in the County's IUGA boundaries, the development of light industrial and commercial uses in the vicinity of the site, the change of conditions approved in File No. ZE-222A-79, the adoption of a the GMA Comprehensive Plan and Phase I Development Regulations, and increased population growth and traffic in the area. 34. The proposal, as conditioned, will not have a significant impact on the environment or adversely impact neighboring properties. 35. The updated conditions of approval for the project recommended by County Engineering, Spokane Regional Health District and County Utilities replace the conditions of approval for such agencies attached to the 1980 rezone of the site. Other conditions of approval of the 1980 rezone are also made applicable. Based on the above findings of fact, the Hearing Examiner enters the following: II. CONCLUSIONS OF LAW 1. The proposed change of conditions, as conditioned, generally conforms to the Comprehensive Plan. 2. The applicant has established that the proposal bears a substantial relationship to, and/or will not be detrimental to, the public health, safety or welfare. 3. Conditions in the area have significantly changed since the site was rezoned to the Restricted Industrial zone in 1980, and since the zoning of the site was reclassified to the I-2 zone on January 1, 1991. 4. The procedural requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met. 5. The proposal, as conditioned, complies with the I-2 zone, the County Zoning Code, and other applicable development regulations. HE Findings, Conclusions and Decision ZE-222B-79 Page 5 1 6. The proposed change of conditions meets the criteria established in Section 14.504.040 of the County Zoning Code for a change of conditions application. 7. Approval of the land use application is appropriate under the criteria established for the approval of land use applications in Section 1 l of the County Hearing Examiner Ordinance, adopted by County Resolution No. 96-0171. III. DECISION Based on the Findings of Fact and Conclusions of Law above, the above application for a change of conditions application is hereby approved, subject to the conditions of the various public agencies specified below. Any changes to pubic agency conditions added or significantly altered by the Examiner are italicized. Failure to comply with the conditions of this approval may result in revocation of this approval by the Hearing Examiner. This approval does not waive the applicant's obligation to comply with all other requirements of other agencies with jurisdiction over land development. SPOKANE COUNTY DIVISION OF PLANNING 1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant", which term shall include the owners, developers and users of the property, and their heirs, assigns and successors. 2. This decision applies to the real property legally described as that portion of the north half of Tract 266 of Opportunity, according to the plat recorded in Volume "K" of Plats, page 20, records of Spokane County Auditor, lying south of Knox Avenue and east of Woodruff Road, excluding the South 54 feet of the north half of said Tract 266. 3. The proposal shall comply with the Light Industrial (1-2), the Aquifer Sensitive Overlay zone, and all other applicable provisions of the Spokane County Zoning Code, as amended. 4. The proposal shall comply with the Spokane County Subdivision Ordinance, as amended. 5. The applicant shall develop the subject property in conformance with the site plan of record dated May 25, 2001 in Planning File No. ZE-222B-79, subject to compliance with conditions of approval and development regulations. Minor variations may be approved administratively by the Director of the Division of Planning/designee pursuant to Section 14.504.040 of the County Zoning Code, as amended, subject to compliance with regulation standards and conditions of approval. 6. Approval is required by the Director of the Division of Current Planning/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. HE Findings, Conclusions and Decision ZE-222B-79 Page 6 7. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 8. A specific landscape plan, planting schedule and provisions for maintenance, acceptable to the Director of the Division of Planning/designee, shall be submitted along with a performance bond or other suitable guarantee prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 9. A six (6)-foot high sight-obscuring fence shall be constructed on the eastern edge of the Type I landscaping strip required along Woodruff Road. 10. Uses identified in the Business Zones Matrix (Zoning Code Chapter 14.623) as permitted within the Regional Business (B-3) zone are not permitted on the subject site, as provided in Section 14.629.080 of the Zoning Code. 11. The Division of Current Planning shall file with the Spokane County Auditor, within the same time frame as allowed for an appeal from the final disposition, including lapsing of appeal period, a Title Notice, which shall generally provide as follows: "Prior to the issuance of any building permit for any building or any use on the property described herein, the applicant shall be responsible for complying with the provisions of the Zoning Code for Spokane County, Section 14.706 (Aquifer Sensitive Area Overlay Zone). The property which is the subject of this notice is more particularly described as follows: [legal description]" 12. All conditions of approval imposed on the site under the 1980 rezone of the site in File No. ZE-222-79 are replaced by the conditions of approval of this decision. 13. Uses permitted in the Regional Business (B-3) zone, as identified in the Business Zones Matrix (Zoning Code Chapter 14.623), are prohibited on the site unless such uses are otherwise permitted in the Light Industrial (I-2) zone, as amended. See Section 14.629.080 of the County Zoning Code. 14. The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, noting that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Current Planning. The Title Notice shall generally provide as follows: "The parcel of property legally described as that portion of the north half of Tract 266 of Opportunity, according to the plat recorded in Volume "K" of Plats, page 20, records of Spokane County Auditor, lying south of Knox Avenue and east of Woodruff Road, excluding the South 54 feet of the north half of said Tract 266, is the subject of the approval of a land use action by the Spokane County Hearing Examiner on May 30, 2002, approving a change of conditions to the 1980 rezone of such property and imposing a variety of special development conditions. File HE Findings, Conclusions and Decision ZE-222B-79 Page 7 4 No. ZE-222B-79, which pertains to such approval, is available for inspection and copying in the Spokane County Division of Planning." SPOKANE COUNTY DIVISION OF ENGINEERING Prior to release of a building permit, grading permit, or use of the property as proposed: 1. The applicant shall dedicate the applicable radius on Knox Avenue and Woodruff Road. 2. Access permits for approaches to the County Road System shall be obtained from the County Engineer. 3. A professional engineer (P.E.), licensed in the state of Washington, shall submit road and storm drainage construction plans and a drainage report that conform to the versions of the Spokane County Standards for Road and Sewer Construction, the Guidelines for Stormwater Management, and all applicable federal, state and local regulations and laws that are in effect at the time of the plan submittal or at the time of the development permit application(s). The final road and storm drainage plans and drainage report shall receive the County Engineer's acceptance prior to release of any grading, building, or right of way permit. 4. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on-site sewage system plan and surface water disposal plan for the entire project or portion thereof if the development is phased. 5. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard engineering practices. Paving or surfacing as approved by the County Engineer will be required for any portion of the project which is to be occupied or traveled by vehicles. 6. To construct the roadway improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be willing to participate in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. This provision is applicable to Woodruff Road. 7. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a county Road project (CRP) to the extent of the required improvement. Spokane County will not participate in the cost of these improvements. This provision is applicable to Woodruff Road. 8. The construction of the roadway improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. The County Engineer has designated a Local Access Roadway Section for the improvement of Knox Avenue that is adjacent to the proposed development. This will require the addition of varying amounts of asphalt to equal 20 feet of asphalt measured from the centerline, along the HE Findings, Conclusions and Decision ZE-222B-79 Page 8 frontage of the development. Curbing and sidewalk must also be constructed. Note: The applicant has constructed road improvements from the intersection of Woodruff Road to the eastern access driveway off Knox Avenue. The applicant shall match these improvements along the Knox Avenue frontage. 10. The County Engineer has designated a Local Access Roadway section for the improvement of Woodruff Road that is adjacent to the proposed development. This will require the addition of varying amounts of asphalt to equal 20 feet of asphalt measured from the centerline, along the frontage of the development. Curbing and sidewalk must also be constructed. 11. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge construction and other applicable County standards and/or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 12. Access to Woodruff Road shall be prohibited until such time as specifically authorized by the Spokane County Engineer. Note: Any access to Woodruff Road will require the applicant to construct full frontage improvements. 13. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane County Resolution No. 1-0298 as amended and are applicable to this proposal. 14. No construction work is to be performed within the existing or proposed right of way until the County Engineer has issued a permit. All work within the public road right of way is subject to inspection and approval by the County Engineer. 15. All required construction within the existing or proposed public right of way is to be completed prior to the release of a building permit or a bond in an amount estimated by the County Engineer to cover the cost of construction or improvements shall be filed with the County Engineer. 16. Applicant shall sign "Spokane County Notice to the Public Number 6" which specifies the following: "The owner(s) or successor(s) in interest agree that in consideration of Mutual Benefits now or to be hereafter derived, do for themselves, their heirs, grantees, assigns and successor(s) in interest hereby request and authorize Spokane County to include the above described property in a Road Improvement District (RID) and to support the formation of a Road Improvement District for improvement of the road(s) described below, by requesting and authorizing Spokane County to place their name(s) on a petition for the formation of a Road Improvement District pursuant to RCW 36.88.050, or by requesting and authorizing Spokane County to cast their ballot in favor of a RID being formed under the resolution method pursuant to RCW 36.88.030, and/or by not filing a protest against the formation of a RID being formed under the alternative resolution method provided for in RCW 36.88.065 and Chapter 35.43 RCW. HE Findings, Conclusions and Decision ZE-222B-79 Page 9 L If an RID is proposed for improvement of the road(s) described below, said owner(s) and successor(s) further agree: (1) that the improvements or construction contemplated within the proposed RID are feasible and (2) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficiently developed; provided, they, their heirs, grantees, assigns and successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of a RID by either the petition or resolution method under Chapter 36.88 RCW and to appeal to the Superior Court the decision of the Board of County Commissioners confirming the final assessment roll; provided further, it is recognized that actual assessments may vary from assessment estimate so long as they do not exceed a figure equal to the increased true and fair value improvement(s) add(s) to the property. It is further acknowledged and agreed that at such time as a RID is created or any County Road Improvement project is authorized by Spokane County, the improvements required shall be at the sole expense of the owner(s) of property within the RID or served by the improvements without any monetary participation by Spokane County." The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. This provision is applicable to Woodruff Road. 17. The applicant is advised that there may exist utilities either underground or overhead affecting the applicant's property, including property to be dedicated or set aside future acquisition. Spokane County will assume no financial obligation for adjustments or relocation regarding these utilities. The applicant should contact the applicable utilities regarding responsibility for adjustment or relocation costs and to make arrangements for any necessary work. 18. The applicant shall grant applicable border easements adjacent to Spokane County Right of Way per Spokane County Standards. SPOKANE COUNTY DIVISION OF UTILITIES 1. A wet (live) sewer connection to the area-wide Public Sewer System shall be constructed. A sewer connection permit is required. Commercial developments shall submit historical and/or estimated water usage prior to the issuance of the connection permit in order to establish sewer fees. 2. The applicant shall submit expressly to Spokane County Division of Utilities, "under separate cover", only those plan sheets showing sewer plans and specifications for the public sewer connections and facilities for review and approval. Commercial developments shall submit historical and/or estimated water usage as part of the sewer plan submittal. 3. Sewer plans acceptable to the Division of Utilities shall be submitted prior to the issuance of the sewer construction permit. HE Findings, Conclusions and Decision ZE-222B-79 Page 10 4. Arrangements for payment of applicable sewer charges must be made prior to issuance of sewer connection permit. Sewer charges may include special connection charges and general facilities charges. Charges may be substantial depending upon the nature of the development. 5. Any water service for this project shall be provided in accordance with the Coordinated Water System plan for Spokane County, as amended. SPOKANE REGIONAL HEALTH DISTRICT 1. The sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 4. Subject to specific application approval and issuance of permits by the Health District, the use of individual on-site sewage disposal systems may be authorized. 5. The use of private wells and water systems is prohibited. 6. The structures with water pressure must be connected to public water and public sewer. SPOKANE COUNTY FIRE DISTRICT NO. 1 1. The appraiser also advises that the adjacent proposed usage would make it almost impossible for a purchaser to obtain a mortgage on this home, rlacinn the present owner in a position of being inversely condemned withoui comp- ensation, and unable to find a buyer. Please do not consider this petition, as opposed to our personal appearance, as a sign of apathy or lesser interest. It is because the timing of the hearing, on a work day, at an indefinite hour, makes it extremely difficult for most of us to attend. There are 40 homes (attachment A) most with a current evaluation of from 60 to 100 thousand dollars in this small but densely populated area. The bulk of these homes were individually built on lots purchased from the original two owners who, when they sub-divided, placed covenants on the deeds as to minimum construction value and usage that were intended to uphold property values. We were first isolated from the adjacent residential area to the south by the freeway and subsequently eroded by gradually encroaching industrial and commercial zoning on the perimeters. This final proposed change would complete the job, placing dire<-! across from the east boundary of the area (an area that would certa i r be zoned R-1 residential anywhere @Ow-w in the valley or city) an industrial operation that would be operating sixteen hours a day, that would be under high-intensity illumination all night long, that would bring noise pollution from the same source, and that would invite heavy truck: traffic directly through the area, since Shannon Avenue is one of only two exits from the proposed faci I i ty. A comparitive appraisal by a professional appraiser (attachment B), made on the home directly across Woodruff Road at 9 821 East Shannon shows a projected appraised decline in value of $35,000.00. This home's bed- room windows would be less than 80 feet from the truck parking area, would be illuminated all night and flooded with diesel noise and exhaust. The appraiser also advises that the adjacent proposed usage would make it almost impossible for a purchaser to obtain a mortgage on this home, placing the present owner in a position of being inversely condemned without comp- ensation, and unable to find a buyer. The additional proportional depre- ciated value of the balance of the area's homes would definitely be in the thousands of dollars. Even the more distant homes would be subject to the unsightly night illumination and heavy truck traffic. Some of us have lived here for over 25 years when the area was truly agricultural. (attachment C) We cannot and do not deny that light-indus- trial and commercial zoning is inevitable adjacent to the railroads to the north. However, we strongly protest when it is allowed to directly adjoin our prior-existing borders with no buffer zoning or without even an attempt to l i m i t its use to an operation with minimum irritant factors. It would not be a good lot for residential use,and small for commercial.So you would have a projected loss of $10,000 on the lot. The house in my opinion has a value today of $75,000.
