FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on November 20, 1979,
(being a continuance of the November 15, 1979 hearing) and the members of the
Committee present being Eldon Thomas, Chairman, Jane Myers, and Ted McCoury
and there being the following persons present who wish to request approval of a
Zone Change; Robert Fogg (T.D.C., Inc.), applicant for a Zone Reclassification,
Agricultural to Restricted Industrial for the purpose of a business park - retail,
wholesale, warehousing.
B. FINDINGS OF FACT
1. That the existing land use in the area is residential, cultivated, and
undeveloped.
2. That the Comprehensive Plan designates this area as appropriate for
agricultural, undeveloped, or use under study.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of Chapter 43.21C RCW (The State Environmental Policy
Act) have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.

8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor dis-
approval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Robert Fogg (TDC, Inc.) for a Zone Reclassification as described in
the application should be approved.
Special conditions or contingencies applied to motion:
1. That the proposal be served water by an existing public water system.
2. That a six foot high sight-obscuring fence be constructed on the northern
and eastern property boundaries on the proposal.

SITE CHARACTERISTICS: Proposal is a relatively flat area and is or
recently was under cultivation.
NEIGHBORHOOD CHARACTER: Residential use has developed to the north with
Single Family being established. To the south is the Industrial Park and Trent
Avenue.

a) COUNTY FIRE MARSHAL
1. The site is located in Fire District #1.
2. Mains and hydrants need to be installed in the above areas. Access
plans for firefighting equipment around the building shall be approved
prior to building permit issuance.
b) COUNTY ENGINEER
1. Access permits and improvements to Trent Road must be approved by
the Washington State Department of Transportation.

2. An appropriate on-site drainage disposal system shall be approved by
the Spokane County Engineer's Office prior to the issuance of building
permits for the project.
c) WATER PURVEYOR
1. Applicant will supply own domestic water supply if not annexed into
Trentwood Irrigation District #3.
d) COUNTY HEALTH DISTRICT
1. No comments received.
e) SEPA
1. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080
RCW be initiated by the applicant within thirty (30) days of final
action of the Responsible Administrative Body and be completed before
any site improvements are made.
2. The request has proven to be environmentally non-significant.
Therefore, a final declaration of non-significance shall be signed by
the Chairman of the Hearing Examiner Committee.
f) DEPARTMENT OF TRANSPORTATION
1. Although accesses have been granted by this department, to this
parcel, this department would request the developer as a condition of
rezoning, present a development plan to the Department of Transpor-
tation in order that the presently approved approaches be as efficient
and safe as possible and the developer be required to revise such
accesses prior to finalization of the development.
g) ZONING
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of any
building permits.

2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Administrator
shall be submitted with a performance bond for the project prior to
release of building permits.
3. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Minor variations when approved by the Zoning Administrator will be
permitted, including, but not limited to the following changes:
Building location, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.
4. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
5. Applicant shall work with the Spokane County Engineer's Office to
develop appropriate drainage plan prior to issuance of building
permits.
h) That the Hearing Examiner Committee after hearing all testimony and a
review of the staff analysis adopts the proposed declaration of non-signifi-
cance and directs the chairman of the committee to sign the final declaration
of non-significance.

This statement is directed to concerned persons regarding the
proposed business park to be constructed by Tupper Realtors
on a 17 acre tract of property located at the northeast corner
of Sullivan and Trent Roads.
lir. Bob Fogg, representing Tupper Realtors, contacted my wife
and I last week and explained the proposed business park. In
outlining the project he said it could possibly consist of
office space, some wholesale, possibly some retail outlets and
the liklihood of light industry (such as small assembly, etc.
as opposed to heavy industry).
The park would be primarily controlled by Tupper Realtors which
indicates to me selective control would be exercised over who
would and c,Tho Uould not be allowed to participate.
MLy wife and I feel that there would be no significant change of
our residential atmosphere nor would it cause our neighborhood
to degenerate into a'suburban ghettd. On the contrary, we feel
it inhances the community. After all, Spokane is progressive
and affords one of the best job markets of any city. This could
pcssibly open additional opportunities.
Ile have no objections to the business park and favor allowing

1. Although accesses have been granted by this department, to this
parcel, this department would request the developer as a
condition of rezoning, present a development plan to the
Department of Transportation in order that the presently
approved approaches be as efficient and safe as possible and the
developer be required to revise such accesses prior to
finalization of the development.

I previously made plans for a business trip out of town, departing
on October 19th, and not returning until October 29th; therefore, it

As previously commented by this office on September 7, 1979, it was
requested your condition of rezoning restricted commercial accesses
to ZW-140-79 to Hayford Road only. The existing channelization for
the Hayford Road signal legally restricts access to right turning
movements only on Sign Route 2.
ZN-113-79 on Sign Route 2 has the access controlled by the City of
Spokane in as much as council action has incorporated all of Sign
Route 2 at this locality into the City of Spokane. This office has
been contacted relative to a major development east of Sign Route 2
and this rezoning should be appressed in conjunction with this pro-
posal.
ZW-179-79 legal access at this location is restricted to right turn-
ing movements only to and from Sign Route 2 due to the painted median.
The major access to the property should be developed oriented to
Fairview Heights Road not Sign Route 2.

SPECIAL PROVISIONS
12-inch culvert pipe of adequate length shall be constructed to proper alignment
and grade in the existing ditch line, approximately 20 feet from the edge of
pavement.
Drainage shall be provided away from the roadway by continuing the existing
shoulder slope of approximately one-half (11) inch to one (1) foot to the right
of way line.
Asphalt material placed on the roadside shall be machine spread and rolled
wherever possible. Careful attention shall be paid to the drainage pattern.
Inlet gratings, valve box covers, etc., shall be adjusted to grade. Sufficient
pregrading shall be done to insure a uniform depth of surfacing with the specified
sloping. Flared connections shall be made to the highway pavement.
Highway traffic shall be protected by flagmen whenever any portion of the traveled
surface is obstructed by equipment working on this project.
It is unlawful to erect a structure or establishment or maintain a business, the
nature of which requires the use by patrons of property adjoining the structure
or establishment, unless the structure or establishment is so located at a dis-
tance from the right of way of a state highway that none of the right of way is
required for the use of the patrons.
All advertising signs shall be placed on private property so that the entire sign
shall be outside the limits of the existing state right of way.
All building restrictions established by the Spokane Planning Commission shall
be complied with.

SPECIAL PROVISIONS
Culvert pipe will not be required under the proposed approach.
Drainage shall be provided away from the roadway by continuing the existing
shoulder slope of approximately one-half (2) inch to one (1) foot to the right
of way line.
Asphaltic material placed on the roadside shall be machine spread and rolled
wherever possible. Careful attention shall be paid to the drainage pattern.
Inlet gratings, valve box covers, etc., shall be adjusted to grade. Sufficient
pregrading shall be done to insure a uniform depth of surfacing with the specified
sloping. Flared connections shall be made to the highway pavement.
Highway traffic shall be protected by flagmen whenever any portion of the traveled
surface is obstructed by equipment working on-this project.
It is unlawful to erect a structure or establishment or maintain a business, the
nature of which requires the use by patrons of property adjoining the structure
or establishment, unless the structure or establishment is so located at a dis-
tance from the right of way of a state highway that none of the right of way is
required for the use of the patrons.
All advertising signs shall be placed on private property so that the entire sign
shall be outside the limits of the existing state right of way.
All building restrictions established by the Spokane Planning Commission shall
be complied with.
