MINUTES OF THE SPOKANE COUNTY PIANN?NG COMMISSION HEARING OF APRIL 21, 1978. WHEREAS, the Spokane County Planning Commission did hold a public meeting on April 21, 1978 to consider the testimony and requests of several applicants, objectors and other interested parties concerning the below referenced zone classifications and other items of business, and WHEREAS, at said hearing opportunity was afforded those favoring and those opposing all items of business, and WHEREAS, Mr. McCoury, Mrs. Byrne, Mrs. Rawlings and t! e Messrs. Kennedy, Main and Quigley. WHEREAS, the Spokane County Planning Commission fully considered the testimony given the environmental review. and all other evidence presented, recommends to the Board of County Commissioners the following: 1 o Five Viile Progress Report: Mr. McCoury announced that Mr. Kennedy couldn't participate In the planning of Five Mile because he hadn't attended all of the meetings to Its consideration, Mr. McCoury stated that it was necessary to have another motion by Mr. Quigley for the same request that had been made at the previous hearing. Mr. Quigley had made the motion at the March 30th meeting, seconded by Mr. Kennedy. Mr. McCoury said that only five Commission members had parti- cipated in the plan. The original motion stated, "That the Planning Staff be directed to prepare a final plan for Five Mile based upon the maps and the goals and policies pretty much as developed as per the Citizens Committee from Five Mile and as per the final vote." Mr. Quigley wished to add the following to his motion, seconded by Mrs. Rawlings: That all of the other materials in the alternate plans should-be submitted along with the plan recommended by the Citizens Committee. (Only Plan "D" for Five Mile should be considered to go through the entire process. The other plans should just be submitted as source material.) Messrs. McCoury, Quigley, Thomas and Mrs. Rawlings voted "Aye". Mrs. Byrne voter "No". Messrs. Kennedy and Main abstained from voting. Motion carried. 2. Plannincr Business: a) Report on Commissioners' Actiens john Sweitzer of the Staff presented a Planning Staff review of all items which had been appealed to the Board of County Commissioners - - 1 - ZE-2-78, Tupper request for a zone change from Agricultural to Local Business. This property is located at the northwest corner of Sullivan and Boardway. The Planning Commission recommended denial; however, the Board of County Commissioners reversed the decision and gave their approval to the zoning request on May 23rd, ZN-150-77, proposed by Harlan Douglass, at the northwest corner of Francis and Washington. This proposal was recommended for approval by the Planning Commission, and the appeal hearing upheld this decision and gave their approval to the zoning request on May 23rd. ZE-192-77, proposal on North Pines from Local Business to Commercial by Mc C Properties. This zone change proposal was recommended for denial by the Planning Commission, and a decision has not as yet been given by the Board of County Commissioners after their appeal hearing. b) Staff Reports. Mr. Sweitzer reported that the Staff requested a.one month continuance on showing Residential Office Zones which had been approved on North Pines for information and evaluation by the Commission. c) Report from Policy Committee. There had not been a recent meeting of the Policy Committee . Mrs. Byrne suggested a discussion be held on the Policy Committee being ad hoc or a temporary committee and the determination made whether it is necessary to have as a permanent committee and also define the responsibilities of the committee. Mr. Kennedy asked that the Policy Committee be continued. He stated that it should be checked whether or not the member of the Commission has the capability of voting on an issue and who determines whether a person has a conflict of interest. He said this should be decided by Commission members. Mr. Thomas moved, Mr. Kennedy seconded that it be proposed that the Policy Committee be a permanent committee but not meet on a regular basis but only at the direction of the Commission. Mr. Emacio, legal counsel, advised that it would be necessary to amend the By-Laws, advertise the amendment proposed, and take action at the next regular hearing of the Commission. Mr. McCoury suggested that this matter be postponed until the first meeting in May for further consideration of the motion. No vote was taken. The Commission concurred with the postponement. -2- d) Other Business. ZW-26-78, Citizen Request of Change Zoning Map. Mr. Terry M. Thompson requested that the Commission place his proposed zone change from Agricultural to Restricted Industrial on the agenda in May for property located in the area of Russell Road intersecting with Highway No. 2. The Site contains approximately 50 acres and it is planned to have an office - industrial park, Mr. Thompson stated that 30 % of the required property owners' signatures had been obtained on the petition which had been circulation. Mr. Sweitzer informaed the Commission that the West Suburban Compre- hensive Plan designates the area on the edge of the subject property as Restricted Industrial zoning. Mr. Quigley moved, Mr. Main seconded, that Mr. Thompson's request be placed on the Commission's next agenda. Messrs. McCoury, Kennedy Quigley, Thomas and Main voted "Aye". Mrs. Rawlings voted "No". Mrs. Byrne abstained from voting. Motion carried. Mrs. Byrne moved, Mr. Kennedy seconded, that a study or referral be made by the appropriate committee or some action be taken regarding some of the requirements to see if they should not be changed - to be studied and re-evaluated to see if they are still filling the purpose that was that was intended for processing applications. Motion carried unani- mously. ZN-161A-72 Mr. Sweitzer reported thatthe legal description was incorrect on the advertised agenda; the Planning Commission approved one piece of property and the Board approved another. Mr. Main moved, Mr. Thomas seconded, that ZN-161A-72 be placed on the next agenda for the Commission to consider. Motion carried unanimously. e) Ordinance Amendments: Vital Records Center as a Conditional Use in the Agricultural Zone. In order that the language be consistent, 4.04.170 (ii) and 4.24.550, should be "Vital Records Center" instead of "Vital Statistics Center" in the proposed amendments, -3- Mr. Quigley moved to approve the proposed amendment allowing a Vital Records Center as a Conditional Use in the Agricultural Zone. Mr. Thomas moved, Mrs, Byrne moved to amend the motion to amend Paragraph 3-B to read a fifty foot (50) front yard setback instead of the 25 feet listed in the standards. Motion carried unanimously. Mrs. Byrne moved, Mr. Quigley seconded, to amend the Zoning Ordinance to allow a Vital Records Center as a Conditional Use Permit in the Agricultural Zone, including the Declaration of Non-Significance for the environmental assessment by the Staff, with the change of fifty (50) feet. Motion carried unanimously. Proposed Deletion of Section 4.06.040 from the Zoning Ordinance Regarding Uses Prohibited - Beauty Parlors in the Two-Family Zone. Mr. Sweitzer stated that the Staff has received three letters requesting deletion of this use as a home occupation. It is necessary to determine whether the beauty parlor is a primary use or a home occupation, Mr. Quigley moved that the proposed amendment be denied. Mrs. Mary Mitchell, East 12819 Semro, spoke in opposition to the proposed amendment. She cited the work done in 1963 through 1965 to obtain the status the way it exists. Mr, and Mrs. Munyan have made the request for the deletion. Mike Senske reported that duplexes are being used for residential pur- poses only and not for commercial uses. He stated that the State of Washington is planning to drop all licensing features for beauty parlors in the near future. Mr. Quigley moved, Mr. Mai n seconded that the proposal. to drop the beauty parlor provision be denied. Mrs. Rawlings moved, Mrs. Byrne seconded, that the motion be amended that the other residential zoned be reviewed for appropriateness of home occupations. Motion carried unanimously as amended, Proposed Conditional Use within Residential Office Zone - Residential Office Accessory Uses Mr. Sweitzer explained that the primary use is office, and the proposed amendment would consider allowing pharmacies, coffee shops, cafeterias, and answering services as an accessory use through the Conditional Use Permit procedure within the Residential Office Zone, It would be anticipated that the accessory use would occupy no more than 10 % of floor area in the Residential Office Zone -4- Mr. Main asked questions regarding the space devoted to this use and also the provision for signing. Mr. Quigley asked that this proposed amendment be considered at a later time and have the Staff prepare alternatives for review by the Commission. Mrs. Byrne suggested that a definition of accessory uses amendment be returned to the Staff for father clarification and placed on a future agenda. Motion carried unanimously. 3. ZE-5-78, TRANSIENT LIVING TO COMMERCIAL: PEARSON, BOYD & LITTLER That the zone reclassification request (File Number ZE-5-78) be approved, and in so approving, adopts the Staff's findings as the Planning Commission's Findings of Fact as well as the conditions stated in the Staff's Findings, and with the added condition that the zone change be developed in substantial conformance with Plot Plan "D" dated April 13, 1978 and that the application is to conform to the requirements of the District Fire Chief, and that a proposed declaration of Non-Significance be issued. (Mrs. Rawlings moved Mr. Thomas seconded. Vote was unanimous.) 4. ZE-1-78, AGRICULTURAL TO RESTRICTED INDUSTRIAL: MILLER & BRAINARD CONST. That the zone reclassification request (File Number ZW-1-78) be continued for one month to allow the developer and Staff to ands wer some co ncerns such as: The Health District requirements; screening of the NW corner of the develop- ment; provision for water storage for fire protection; and also an environmental review should be prepared. (Mr. Thomas moved, seconded by Mr. Quigley. ) Vote was unanimousJ 5. ZE-4-78, AGRICULTURAL TO MULUPLE FAMILY SUBURBAN: MC QUEEN. That the zone reclassification request (File Number ZE-4-78) be approved, and in so approving, adopts the Staff's findings as the Planning Commission's Findings of Fact as well as the conditions stated in the Staff's findings, and that a proposed declaration of Non-Significance be issued. (Mrs. Byrne moved, Mr. Quigley seconded. Vote was unanimous.) 6. ZE-102A-77, AGRICULTURAL TO MULTIPLE FAMILY SUBURBAN: MC QUEEN. That the change in condition of the zone reclassification request (ZE-102A= 77) be approved, and in so approving, adopts the Staff's findings as the Planning Commission's Findings of fact as well as the issuance of a declaration of Non-Significance. (Mr. Thomas moved, Mr. Kennedy seconded. Vote was unanimous.) 7. ZS-37-78, AGRICULTURAL TO AGRICULTURAL SUBURBAN: SPO. CO. PLAN. COMM. That the zone reclassification request be approved, and in so approving, adopts the Staff s Findings as the Planning Commission's findings of Fact as well as the conditions stated in the Staff's Findings, and also that a proposed declaration of Non-Significance be issued. BACKGROUND: On November 18, 1977, the Spokane County Planning Commission recommended approval of ZE-102-77 Agricultural to Multiple Family Suburban for a 34,625 square foot parcel located adjacent and to the south of the site in question. The applicant is now proposing to incorporate the 13,850 square foot site in question with the property to the south, the new parcel totaling 48,475 dquare feet. (Applicants are proposing a twenty-one (21) unit apartment complex.) II. SUMMARY: The applicant's proposal is compatible with the land uses to the north, south and west, but could be incompatible with the single family residential uses to the east; is consistent with recent Planning Commission Zone Reclassifications within the area (east of Valley Mission Park); is consistent with the Regional Comprehensive Plan Map; has or-can provide adequate provisions for circulation, sewage disposal, water and fire protection. III. GENERAL INFORMATION: A. Existing Land Use - Site Vacant to the north vacant property; I-90 Freeway to the south 3 duplexes; south side of Mission - Duplex, single family residence to the southwest apartment units, 44 units total to the east single family residential uses; duplexes to the west senior citizen center; Valley Mission Park B. Residential access n/a Bates Road Residential access n/a Engineer's Review: The Spokane County Engineer's Office has requested that all access from the site be restricted to Bowdish and/or Bates. B. Sewage Disposal This project is located in an area with soils classified by the Soil Conservation Service as suitable for installation of individual on-site sewage disposal systems. The area is, however, located over the Spokane Aquifer. A study is currently under way to determine the degree to which subsurface disposal of sewage treatment effluent may contaminate the Aquifer. There is very little probability that this project in itself will have more than a slight impact on the Aquifer. However, taken in conjunction with the overall urbanization of the area, some other sewage disposal method will most likely be required in the future. From an environmental health viewpoint the project appears feasible. NOTE: The applicant's revised development plan shows a primary sewage treatment facility; septic tank and large drainfield. C. Water Availability through - Modern Electric Water Company. The District has indicated that it does have the ability to serve the site with water. D. Fire Protection The site is lcoated within Fire District No. 1's boundaries. District representatives have indicated that: Fire plains are not available Fire Hydrants are not available E. Staff Environmental Review Concluded that a declaration on Non-Significance be issued. However, evidence and findings presented at the public hearing concerning this matter should also be considered. The slight adverse impacts noted by the Staff included: earth, air, water, flora, noise, light and glare, land-use, population, transportation, public services and utilities. -3A- ZE-4-78 - AGRICULTURAL TO MULTIPLE FAMILY SUBURBAN (Continued) V. CONDITIONS: The Planning Department Staff feels the following conditions would be appro- priate if the proposal is approved. 1. Dedication of the east ten (10) feet of the advertised property for right of way purposes. 2. Improvement of Bowdish Street and Bates Street along the project peri- meter to Spokane County standards. Improvements shall include curbs, sidewalk drainage control and thirty (30) feet of paving. 3. Access permits for the advertised property shall be obtained from the Spokane County Engineer's Office prior to release of building permits for the project. 4. The advertised property shall be developed in substantial conformance with the development plan on file with this application. (Note: The project is the incorporation of ZE-4-78 and ZE-102A-77). 5. Any portion of the project which is to be occupied or traveled by vehicles, shall be maintained in hard surface paving. 6. An on-site-storm drainage system for the project shall be approved by the Spokane County Engineer's Office. 7. A specific landscape plan, planting schedule and provisions for main- tenance, acceptable to the Spokane County Zoning Administrator shall be submitted for the project prior to release of building permits. 8. The applicant shall provide a performance bond to cover the cost of the required landscaping prior to release of building permits. 9. Installation of fire mains and hydrants in accordance with the require- ments of the Spokane Valley Fire Marshal. 10. Sewage disposal shall be approved by the Spokane County Health District. 11.
